We hope Larry Parker gets her $2.1 million

Hit-and-run driver pleads guilty:
The man charged with a hit and run crash that seriously injured an Encinitas mother entered a surprise guilty plea Wednesday in North County, according to the San Diego County District Attorney's office.

Prosecutors said Justin Parker was driving the white truck that hit Ashley Mullins Lane on Encinitas Blvd. on Sept. 22. Witnesses said Parker got out of his truck, spoke to them, but left the scene.

Lane suffered severe injuries and bone fractures that led to multiple strokes and partial paralysis, her parents said. They told 10News she has mobility issues on her left side and is left-handed.

Lane has two young children. A GoFundMe account established for the family raised more than $44,000 of its $50,000 goal.

  1. The defense strategy would probably be to settle on a generous damage award; this would attempt to reflect "remorse" and "acceptable of responsibility" in legal parlance. The defendant would then hope for mercy in the sentencing phase - minimal jail time. A guilty pleas was the only option, as the attempt to conceal the evidence (repairing the truck) would have weighed heavily against him (and still may).

  4. Excuse me, but the leading opinion this thread appears to be missing is the point.

    That this son of Larry Parker ran way to avoid an alcohol test is not avoidable.

    Ashley and her family deserve every penny they can get from this elitist prick who ran way from a crime scene. That he then tried to repair his vehicle in Riverside or wherever, should demand an extra penalty for his attempt to hide his drunken behavior at the wheel.

    Take this cretin for all he is worth. Ashely and her family is deserving of nothing less.

  5. 12:21 PM And the point is? Yes, Parker is behind the proverbial 8 ball for his own criminal evasive actions. But a defense attorney has to make the best effort for his client, even when the odds are stacked against him. Parker needs to demonstrate "remorse"; this is where monetary settlements come into play. He is culpable for such damages as is, but a "willingness" to settle without lengthy court action would indicate an acceptance of responsibility. You need to separate the chess game aspects of the law, versus the emotional anger that you obviously are concentrated on.

    1. Victim’s families usually wait until after the criminal case to file a civil complaint for damages. If the family hasn’t filed the civil complaint yet, there isn’t much chance it will be settled before he is sentenced for this guilty plea for the criminal charge.

      All of this would be known to the attorneys. It’s unlikely his guilty plea was part of some strategy to pay the family to get a reduced sentence.

    2. The guilty plea was the only option, given the damning evidence; and is separate from the monetary compensation issue (other than he is wide open for damages). A settlement offer prior to a formal civil lawsuit would show a willingness to immediately compensate the victim; thus the inference of an acceptance of responsibility. Granted it is a long shot, but where does a defense go in a case like this?

  7. 4:18 PM Larry Parker was one of the first injury lawyers to mass advertise their services on TV in the 1990's. His come on was that "he was mad as hell" (about the clients' injury) and then there was a "testimonial of someone claiming he got $2.1 million in a settlement, thanks to Parker. Then there was the quick disclaimer that this was not a guarantee of what to expect. Parker made millions with this come on.

  9. The blog has changed. Whoever is running it isn't on top of the issues as the owner was earlier. Many of the topics posted are lame, and the intros aren't as well informed. Almost all the comments are more stupid.

    It doesn't seem that anybody would buy a blog that doesn't generate income, so it's doubtful somebody bought it.

    EU is a valued resource for the majority of residents that come here, even when we have to put up with those few who contribute little other than to criticize the moderator, certain select city council members, city manager.
