But the school district decided to auction it off to the highest bidder in 2014 and the city wasn’t even interested in buying it, so of course a developer was going to buy it? Then Save Pacific View launched a campaign to get the city to buy it and save it and thankfully they did!
Thankfully they overpaid by 40%? Geezus. Do you not get that developers even if they purchased it would have to go through a public vote. Misinformed much?

If they didn't vote for the developer's plans, do you think the developer would have just given up? They would have torn it down and there would be apartments there, and if you think CRC is attracting bad elements, what do you think an overcrowded apartment complex would have done to that neighborhood?
No vote needed. State law supersedes local. The school district was auctioning the property with a guaranteed rezoning to residential. The deal would not close until the rezoning was complete.
State law does not supercede, that is only if that parcel had been earmarked by HCD and put on the map by oh I dunno, KRANZ? and forced on us through legal action. You live in a world where the developers write your script. We see you.

Encinitas In Tussle Over Pacific View Elementary's Multimillion-Dollar Site
Pacific View Elementary in Encinitas closed 10 years ago and the school district now uses it for storage. But the property is a few feet away from a dramatic ocean overlook and the land is worth millions. Just how many millions is up for debate.
The city of Encinitas has offered to pay $4.3 million for the land to keep it for public use. But the school board has voted to auction off the property, with a minimum bid set at $9.5 million. They said the money will go to benefit public schools.
Superintendent Tim Baird said the school district wants to work with the city, but has an obligation to their students and families to get the highest bid. Encinitas Mayor Teresa Barth said even if the school district got $9 million, once that money is spent, it’s gone. But the land could remain available for generations if the city buys it for public use.
One major reason for the big discrepancy in land-value estimates are the limitations on how the property can be used. It could not be sold to a developer to build private homes, for example, without a zoning change. And who would grant a zoning change? The city of Encinitas.
But even the city council might not have the power to change the zoning, because Encinitas passed an initiative last year that said any significant zoning change has to go to a vote of the people. That could be a major roadblock for any new development.
Baird said the school district got an offer two years ago of $7 million from an arts group, but unfortunately that group couldn’t raise the cash, so the deal fell through. Since then, he said, property values have gone way up, so he believes $9 million is a reasonable minimum amount to ask.
The school board passed a resolution asking for closed bids on the property and they scheduled an auction to start with the highest bid on March 25.
Wednesday evening the Encinitas City Council will consider what to do next. One option is to raise their offer, but there seems little chance the city would or could meet the school district’s minimum bid. Barth said the city hopes to avoid getting into a legal battle over the issue, but the council will also hear a presentation on whether it would be feasible to use eminent domain to take the land.
UPDATE. The city council voted to direct the city manager to write a letter to Superintendent Baird, expressing the city's disappointment in the school district's decision to hold an auction on the property. They pointed out that there is no request for a rezoning of the property on record at the city. And they invited him to submit a proposal for a purchase of the property by the city.
The council will take up the matter of the price and terms for purchase of the property again at a meeting in February.

The EUSD auction had two sets of terms. Bidders could bid on either or both sets of terms.
Option 1 was an as-is sale. If the highest bid from this option was selected by the board, the sale would close quickly, and EUSD wouldn’t have the time and expense of pursuing a zoning change under state law. Obviously, if they could get a fair price, they’d rather sell it quickly as-is.
Option 2 invited bidders to submit a bid with a guaranteed change in zoning to residential as allowed by state law. The winning bidder would have to put the bid amount in an escrow account, and the deal wouldn’t close until the zoning change took effect. If for any reason the rezoning failed, the bidder would get all of their money back.
FYI, the school property rezoning law existed because a city in Orange County wanted to buy a school property but couldn’t come to an agreement on price. So they voted to rezone the property as open space, making it virtually worthless to a commercial buyer. They did this to screw the school board out of the value of the property. The state legislature reacted by passing a law saying that when a school disposes of surplus property, they are automatically entitled to zoning identical to the adjacent neighborhood.
In other words, the whole purpose of the law was to block any local efforts to use zoning to prevent a school from getting the appropriate value for the property. And the law doesn’t make any exception for prop A.

The less we hear from the developer's whore the better until she is punted off the Council like all her former freakshow members Kranz, Blakespear, KK, Fly Boy, the shitty Shaeffer that moved out of Encinitas after she realized that Box Pointe ruined the City and her neighborhood.

AZ Jenny and BIAspears message to the region were Encinitas is the welcoming place for drug addicts and North County Party Center is still load and clear.
The next goal settting session should be a complete revamp of the City Council goals. I sure hope our local heroes show up, especiall the strong women of Encinitas.

However, this is just a temporary fix, city engineering employee Badr Suleiman said. The permanent solution, estimated at $6.5 million, would involve replacing the old metal drain pipe, which runs the length of the canyon.
City Engineering Department Director Jill Bankston said city employees are looking into obtaining grant funding to help cover that project’s cost. City records indicate Encinitas has spent more than $2 million on sediment removal from area drainage pipes and the Manchester outfall in recent years.
Scott Campbell, a frequent council meeting attendee and the leader of the Encinitas Citizens Review Panel, told the council Wednesday that this was a sign that the city should have done something about the Lake Drive situation long ago.
“We’ve got to get our act together and spend money on the right things,” he said.

Pacific View Elementary in Encinitas closed 10 years ago and the school district now uses it for storage. But the property is a few feet away from a dramatic ocean overlook and the land is worth millions. Just how many millions is up for debate.
The city of Encinitas has offered to pay $4.3 million for the land to keep it for public use. But the school board has voted to auction off the property, with a minimum bid set at $9.5 million. They said the money will go to benefit public schools.
Superintendent Tim Baird said the school district wants to work with the city, but has an obligation to their students and families to get the highest bid. Encinitas Mayor Teresa Barth said even if the school district got $9 million, once that money is spent, it’s gone. But the land could remain available for generations if the city buys it for public use.
One major reason for the big discrepancy in land-value estimates are the limitations on how the property can be used. It could not be sold to a developer to build private homes, for example, without a zoning change. And who would grant a zoning change? The city of Encinitas.
But even the city council might not have the power to change the zoning, because Encinitas passed an initiative last year that said any significant zoning change has to go to a vote of the people. That could be a major roadblock for any new development.
Baird said the school district got an offer two years ago of $7 million from an arts group, but unfortunately that group couldn’t raise the cash, so the deal fell through. Since then, he said, property values have gone way up, so he believes $9 million is a reasonable minimum amount to ask.
The school board passed a resolution asking for closed bids on the property and they scheduled an auction to start with the highest bid on March 25.
Wednesday evening the Encinitas City Council will consider what to do next. One option is to raise their offer, but there seems little chance the city would or could meet the school district’s minimum bid. Barth said the city hopes to avoid getting into a legal battle over the issue, but the council will also hear a presentation on whether it would be feasible to use eminent domain to take the land.
UPDATE. The city council voted to direct the city manager to write a letter to Superintendent Baird, expressing the city's disappointment in the school district's decision to hold an auction on the property. They pointed out that there is no request for a rezoning of the property on record at the city. And they invited him to submit a proposal for a purchase of the property by the city.
The council will take up the matter of the price and terms for purchase of the property again at a meeting in February.

DeleteThe EUSD auction had two sets of terms. Bidders could bid on either or both sets of terms.
Option 1 was an as-is sale. If the highest bid from this option was selected by the board, the sale would close quickly, and EUSD wouldn’t have the time and expense of pursuing a zoning change under state law. Obviously, if they could get a fair price, they’d rather sell it quickly as-is.
Option 2 invited bidders to submit a bid with a guaranteed change in zoning to residential as allowed by state law. The winning bidder would have to put the bid amount in an escrow account, and the deal wouldn’t close until the zoning change took effect. If for any reason the rezoning failed, the bidder would get all of their money back.
FYI, the school property rezoning law existed because a city in Orange County wanted to buy a school property but couldn’t come to an agreement on price. So they voted to rezone the property as open space, making it virtually worthless to a commercial buyer. They did this to screw the school board out of the value of the property. The state legislature reacted by passing a law saying that when a school disposes of surplus property, they are automatically entitled to zoning identical to the adjacent neighborhood.
In other words, the whole purpose of the law was to block any local efforts to use zoning to prevent a school from getting the appropriate value for the property. And the law doesn’t make any exception for prop A.
Imagine if they installed another Goodson Project on that lot...

Mayor Bruce Ehlers and his AZ Jenny provided an update yesterday in implimenting BIAspear's Kranzinitas Workplan.
So dissappointing. We punted the old crappy City Council excluding AZ Joy (who is on her way out), yet
Luke saids he's happy. Wow. Well at least he got out of Gonzo's fourth of July parking snaffoo. He's a pretty simple guy so its not too hard to make him happy.
Developer whore, Joy babbled for over one minute so she wasted everyones time. Please City Council, push her seat further to the left maybe have her sit in the janitor's closet and let her join via internet. The less we hear from the developer's whore the better until she is punted off the Council like all her former freakshow members Kranz, Blakespear, KK, Fly Boy, the shitty Shaeffer that moved out of Encinitas after she realized that Box Pointe ruined the City and her neighborhood.
The staff speaker James did a presentation following AZ Jenny style - rambling words, hard to follow and meaningless.
Ehlers rabbled quite a bit. We have the workplan in writting like Ehlers said. They problem is its still Blakespear shitty BIA agenda. Ehlers think the roads are great. We think they suck like Encinitas Blvd., half of Leucadia Blvd is failing, North Coast Hwy 101, all the neighborhood streets suck, and Vulcan Ave looks like TJ.
Jim said staff did a good job at implimenting BIAspear's /Ehler's workplan. I think staff sold you a bill of good while you were a green councilmember. what a waste of a year. Lots of paperpushing, lots of chatter from Developer's whores and staff.
Some progress on arresting drug attics and actually prosecuting them, no progress on traffic enforcement and increased cops throughout the City, no progress on address the low use super expensive Second Senior Center, little progress at improving beach access and maintaining infrastructure including keeping our beach access open, stop the flooding and lawsuits, create real bikelanes, and paving our roads.
AZ Jenny and BIAspears message to the region were Encinitas is the welcoming place for drug addicts and North County Party Center is still load and clear.
The next goal settting session should be a complete revamp of the City Council goals. I sure hope our local heroes show up, especiall the strong women of Encinitas.
Jim hit the nail on the head, the City didn't really do that much last year. We need to focus on the high priority issues and drop the wasteful report and distraction like the Climate Action Plan joke which is an entire waste and the City is the biggest offender of wasteful practices.
Remember Ehlers and City Council,
Its pretty simple. The Voters want more police enforcement on our streets, more DUI enforcement and get the drunks off the road, more policing the PB style drug huts and bars and put the DUIs in the PoPo right when the leave the drug hut and drunk tank parking lots, and PAVE OUR ROADS.
