Blakespear never sued residents, and there are no unfunded mandates.
You can go to the superior court website and click on the case search tool. Enter the years, and select civil case, north county. Try plaintiff as both City of Encinitas, or Catherine Blakespear. Spoiler alert: you’ll find nothing.
Unfunded mandates are unconstitutional. It’s a required financial burden imposed on a city by federal or state government without providing funding.
In the case of affordable housing, the additional financial burden to the City is only the cost to process and approve projects, code inspections, and maybe some signage or asphalt repair—assuming the city didn’t force the developer to do it as a condition of approval.
The funding source for these minor costs is more than covered by increases in the city share of property taxes. Also increased sales tax revenue from having new residents.

Her original filing states: "The City is ignorant of the true names and capacities of those sued herein as DOES 1 through 100, and therefore sue those Defendants by such fictitious names. The City will amend this Complaint to allege their true names and capacities if and when they are ascertained." Whoops, she sued her residents!

DeleteYou can go to the superior court website and click on the case search tool. Enter the years, and select civil case, north county. Try plaintiff as both City of Encinitas, or Catherine Blakespear. Spoiler alert: you’ll find nothing.
Unfunded mandates are unconstitutional. It’s a required financial burden imposed on a city by federal or state government without providing funding.
In the case of affordable housing, the additional financial burden to the City is only the cost to process and approve projects, code inspections, and maybe some signage or asphalt repair—assuming the city didn’t force the developer to do it as a condition of approval.
The funding source for these minor costs is more than covered by increases in the city share of property taxes. Also increased sales tax revenue from having new residents.

Her original filing states: "The City is ignorant of the true names and capacities of those sued herein as DOES 1 through 100, and therefore sue those Defendants by such fictitious names. The City will amend this Complaint to allege their true names and capacities if and when they are ascertained." Whoops, she sued her residents!
