Council unanimously believes Vina is doing an "excellent job"

...  as per Mayor Barth at tonight's council meeting.

They're also supporting comedy attorney Glenn Sabine and continuing his contract.

  4. I am very disappointed in the Council if they gave a "heads up" to Sabine. I offered all 5 of them information that was negative about Glenn. I suggested they put it out to bid and see what other firms has to offer and at what price. Guess they didn't do this? I'm working so haven't see the meeting. Does anyone know how it went down?

    2. 9:26 - now that's funny! If Lynn Marr, Sheila Cameron, Donna Westbrook and Bobby Virk all were elected to Council in 2014, they would get the biggest wake up call in their lives. They would realize how difficult it is to change the course of city governance. Within 6 months all their supporters would be crying foul and feeling abandoned - not because these 4 changed their principles, or moved to the dark side, but because they would be faced with the realities of governing. You can hate Stocks all you want, but he knew how to pull the levers of governance. You're better off finding someone as knowlegable as Stocks that is more aligned with your world view.

  28. I am also disappointed with this council that many of us worked hard and long hours to get elected. What I realize now is Teresa had it easy before, She knew she could vote with the people and her vote would still be negated by the male majority. Now, she has the power and what is she doing with it? Between she and Vina I call it micromanaging our lives to fit their ideas of what is good for us, whether we like it or not. Shaffer is disliked by SANDAG and I am not sure what the other 3 are doing. I almost wish Jim Bond were back on the Council. he seemed to be somewhat reasonable,even I didn't agree with him. Even Jerome had clout with SANDAG. Something that Shaffer will never have. She seems to not have good playground skills. They are all of our Council members, and they seem to not be doing what we elected them to do.

    5. The Encinitas CC and staff should be looking out for Encinitas residents--#1. Nobody is disputing that business that offer goods services to residents are important, but they shouldn't be allowed to degrade an entire community.

      By their actions, Gus Vina and his staff are #1, and they, with the help of Peder Norby, are extracting value from every corner of our city and selling it to the highest bidder. Those funds go to their pockets and pension funds!

    If some drunk is at .18 and want to do 5 more shots before going home and raise his blood alcohol level to .25, I rather he drive and leave Encinitas at .18 than have more drinks at drive and possibly kill someone driving at .25.

  30. Isn't there a law already on the books that says if a bar staff member or owner deems the person too drunk, they cannot serve him or her anymore alcohol? And it is their responsibility to call a cab if the person drove there? If it is a law, then why doesn't the sheriff enforce it? Isn't that what we pay them to do?

  32. Why is it that all the council members need to glorify themselves? Gaspar references being a CFO and having a cramped hand from taking notes. Shaffer lectures everone with he self importance, Muir talks about sitting at the table or being on the menu..............won't touch one. Kranz talks about doing his research. Gaspar thinks 9 new licenses is not proliferation, hmm? I do agree if a license is in process they should be grandfathered in.

And the "cut off" proposed by Lisa Shaffer for licenses "in process," should be 11 p.m., which I believe they requested, not the arbitrarily "set" by Shaffer, 10 p.m. These restaurants which continue to serve food are not the problem, in my opinion.

      You know the argument with guns? Establishments serving alcohol don't cause problems, human nature does! Dennis Holz is correct about the lack of infrastructure, that is PARKING, causing many issues. When people are parking and being loud in residential neighborhoods, it becomes an issue.

      We should establish a shuttle service that operates at the Kraken or somewhere similar, with parking? Monterey and Seattle both have free bus service, downtown, and that has helped, tremendously, for them.

  40. This was on the ABC website and Encinitas is on the moratorium list. If ABC has stopped issuing alcohol licenses for off-sale for wine and licenses, why are they continuing to issue for on-site sales?

    2011 Moratorium Figures – Section 23817.5 B & P Code

    On January 1, 1998, Section 23817.5 was amended to permanently establish a moratorium on the issuance of off-sale and wine licenses (Type 20) in cities and counties where the ratio of Type 20 licenses exceeds one for each 2,500 inhabitants.
    In the city and county of San Francisco, the ratio has been established as one for each 1,250 inhabitants. The San Francisco computation combines off-sale beer and wine license with off-sale general licenses for the purpose of establishing the ratio.
    Enclosed are the following lists and a map showing the new Type 20 license limitation data:
    o List of Counties with their moratorium status.
    o List of Cities in Counties with partial moratorium status.
    o Summary of Changes to Moratorium Counties/Cities.
    Please note the changes in moratorium counties compared to the 2005 list. There have been changes in some of the cities within the current 11 non-moratorium counties.
    The new moratorium lists are effective as of May 9, 2011 and will be in effect until recalculated in approximately five years, in accordance with Section 23817.9.

  41. The council vote 5 to 0 to "request" the Hospitality Committee to come back in 45 days with recommendations. The council then voted separately 3 (Barth, Shaffer, Muir) to 2 (Kranz, Gaspar) to bring back a modified 45-day moratorium next week, city wide and closing hours at 10 pm. Neither required a 4/5 majority. There will be a 4/5 majority needed to impose the moratorium. Will the 4 votes be there next week? Kranz said he wasn't in favor of the moratorium.

    2. The suggestion for a modified 45-day moratorium to be brought back next Wednesday excluded any alcohol-serving place that closed at or before 10 p.m. The purpose was to grandfather in the lobster place and any other similar place that has its permits in process.

      If the Hospitality Committee comes back in 45 days with a plan, and the council approves the modified 45-day moratorium next Wednesday, the two gears are out of sync by seven days.

      I don't believe it. The booze and wine portion of the meal is always higher than the food. What is the definition of "Food" sales?

      City Council better get their shit together and reverse the years of damage done by Stocks and clan.

      I think everyone agrees downtown Encinitas IS heading in the BAR direction, and almost ALL residents do NOT want Encinitas to turn into Pacific Beach Norte.

      The raving praise for Sad Sack was pathetic. I hope this Council can pull their head out and turn this City around. It is clear they support a pour choice for City Manager. I just think Teresa will not admit it because she was on the selection committee.

      Only hope now is to vote them out and/wait another 1.5 to 2 years until Sad Sac retires and hope the damage is not too great.

      Now I really appreciate all the active Citizens of Encinitas. We need to stay on Council and Staff because its obvious they are willing to pour Encinitas down the drain and give the quality of life to the few bar owners who enjoy huge profits at others expense. I can't believe I am saying this but that even includes the frequent comments from Lynn Braun. At least there are citizens check going on and the citizens have finally finally awaken.

      Since there is no money for any more projects beyond the budget sucking Regional Sports Park, the next major move will be to remove Gaspar from office in the next election. Lets rid Encinitas of all Stocks bad habits. Citizens should also voice their displeasure with Sad Sack. He continually recommends poor choices to City Council. Why didn't the City remain more neutral on Prop. A?

      THANK YOU BIG TIME to all the citizens that spoke to preserve our laid back beach town atmosphere and try and prevent it from becoming PB Norte.

  44. After opposing any moratorium, Gaspar turned around at the end an said she would support a 10pm moratorium for new licenses but in the end voted against taff to come back with new text. Seems to me she is confused!

  54. I am disappointed that they have such low standards. It makes sense that Vina and Sabine are fighting to keep the standards low, because where else will they find such a sweet deal?

    I am talking about council. It is as though there is a race to the bottom to find out how bad Vina and Sabine have to be before they are asked to improve.

    Most companies try to have a process of continuous improvement. In Encinitas, they look for continually lower standards and the protection and increase in the number of unqualified people. Looking at some on staff can remind one of when the mad Emperor Caligula made his horse a senator.

    When will this ever end?
