A woman believed to have been an undocumented immigrant died Thursday following a collision between a crowded smuggling skiff and a U.S. Customs and Border Protection vessel off the North County coastline, authorities reported.
The agents, members of the CBP Office of Air and Marine, spotted the panga early this morning near Encinitas, hailed the occupants and ordered its pilot to yield.
The motorboat continued on, prompting the government agents to fire warning shots, CBP spokeswoman Jackie Wasiluk said. The two vessels then collided, causing the skiff to capsize and sending its 20 occupants into the ocean.

Woman dies off coast of Encinitas after being thrown from immigrant panga
Times of San Diego:
Bring the Encinitas lifeguards along on the next trip.
ReplyDeleteVery sad on a human level.
ReplyDeleteWarning shots? This may be a problem for CBP.
Most use of force policies prohibit taking safety off a firearm unless deadly force is justified. Most law enforcement do not use guns to wound or warn--they use them to stop an imenent deadly threat.
ISIS plans to use Mexican Smugglers to illegally cross our borders to enslave and rape your daughters, behead your husbands and sons and stone to death your homosexual neighbors
DeleteI want secure borders that includes laws for everyone-
you support lawbreakers-
Border security is for all- you don't get to decide that it only applies to this group- and not to that group
there is no border security moron. You are a tool.
DeleteI suppose you think that the war on drugs has value. Haaa
"ISIS plans to use Mexican Smugglers to illegally cross our borders to enslave and rape your daughters, behead your husbands and sons and stone to death your homosexual neighbors"
DeleteThat is horrifically vile and blatant fearmongering, in the worst possible way. You should be deeply ashamed of even thinking those things, let alone posting them publicly, you anonymous coward.
Poignant painting after all.
ReplyDeleteShots fired and collision are no accidents. They were killed.
ReplyDeleteThe media is making it sound as thought the panga rammed the Customs boat. It wasn't regular "Border Patrol." Shots were fired and it seems obvious that the governmental authorities rammed the panga. Very sad, an unnecessary tragedy which could and should have been avoided through better leadership and greater self control by those wielding the big guns and the bigger ship.
DeleteThis painting may become a memorial.
ReplyDeleteI doubt it. Surfing Madonna maybe.
Delete5:31, Yes. And isn't it kind of refreshing no one's complained about a surfing Jew in public art?
DeleteThese comments are beyond ridiculous!
ReplyDeleteWhat part of "crowded smuggling skiff" and "undocumented immigrant" don't you understand!
Why should we condone the illegal events that take place off our coast?
Here is a question for you.
Why did the illegal skiff smugglers fail to follow the directions of our US Customs boat?
What part of the blame will you place on the smuggling skiff operators who prey on undocumented immigrants who want to enter our country illegally?
So, are you suggesting that our choices are: condone illegal events, or condone firing weapons at unarmed immigrants?
DeleteReally? No middle ground? No third option?
Its simple.
DeleteEnforce the laws of our country.
@2:23 You do realize that this was a law enforcement intervention, right?
DeleteSelling single cigarettes to make ends meet and working for less than minimum wage for US agriculturalists are indeed crimes, but are they worthy of the death penalty?
Could this possibly be the downtown barber who has had such a problem with the mural in the past even though it is a block away from you and whatever patrons you have left? Sounds like the same lack of compassion at play, whether it is this same person or not.
ReplyDeleteWe are better than this and this type of thinking towards the less fortunate looking for a better life that we all are so blessed with. WE ARE ALL IMMIGRANTS and you are too, save for the native Indian Peoples who were all but exterminated. Their way of living within nature surely was and that we could all learn a thing or to from.
Todays actions were contemptible and illegal. To fire at them when they had them contained for the most part, was far from necessary. They were not going to get away and escape. They could have stayed with them until it was safe to have them disembark in shallower waters. Whoever does not feel sympathy for the needless loss of life has little heart left.
3:03 you are a moron.
Delete3:03, thank you. 6:47, you are the Crap Master, early riser anonymous bully/coward who gets his rocks off by spouting out prejudice, without an ounce of compassion, a racist bigot.
DeleteJust answer the question and stop evading it.
ReplyDeleteDo we need to follow the laws of our country?
A simple yes or no will do.
I think that the issue is not about following the laws, which I doubt anyone here is arguing.
DeleteI think it is about use of force appropriate for the context. I for one would have liked to see a more peaceful resolution to this issue instead of an escalation. I am sad for everyone involved in this episode including the woman and her family.
Is that a Yes or a No?
DeleteWill you just answer the question posed to you without all that rhetoric?
Actually, 3:55 did a swell job of pointing out why your yes/no question offers a false choice.
DeleteI'm sorry if it hurts your brain to consider shades for grey, but that's not my problem.
I'm betting most folks support non-lethal enforcement. Do you?
Some of the laws of our country have been found to be Unconstitutional,, like Jim Crow laws. Not every question can be answered with a simple yes or no. Those who fired shots and rammed the panga broke the laws of this country and the laws of integrity and conscience.
Delete2:22, What alternative did the Coast Guard have to stop the boat after firing warning shots and the boat captain did not comply? The woman was not shot by us. She was killed by the outlaw evading capture. That's where the blame lies.
DeleteRight, I'll go there: 3:51 would have made a good Nazi.
ReplyDeleteI'm so happy that many are taking about how wrong this was, and how it could have been handled differently. Compassion for others, along with intolerance, was the reason our forefathers came to this country. What some of them did after they came is unforgivable, however, this country ( at least the European ancestry side) was based on the belief that people are living things and have a right to say what they think (within reason); have the right to peacefully assemble; and have the right to live without fear of being gunned down by the police.
ReplyDeleteIn these times the police have a lot more resources for containing a person(s) than ever before. Besides mace and pepper spray, they have tasers, stun guns, tranquilizer guns, and much more. They should try all of these before shooting, unless someone is shooting at them, or has a gun and looks ready to shoot. I didn't read anything about any of these people having guns aimed at the police. Does anyone know if the police felt they were in mortal danger?
I'm 5:46 and as I reread I realized I should have said that our forefathers came here because of so little compassion where they lived and they being treated in intolerantly by others in their own society. I know my whole post is not well written but I hope you all get my point. I don't have time at the moment to redo it.
DeleteWe get it...3:51 does not.

ReplyDelete8:50/6:45 is a whack job. WC, at what point to track an IP and turn the hate speech poster in for monitoring?
ReplyDeleteSorry, make that 6:50. This individual sounds unhinged.

DeleteEU does not cooperate with The Man.
DeleteBut we'll remove ethnic slurs when we see them.
When comments cross over into hate speech, that is against the law, too.
ReplyDeleteWhat constitutes "hate"?
DeleteThis comment has been removed by a blog administrator.
DeleteHate speech, like skateboarding, is not a crime.
Delete5:29, That's why this blog can be a hate speech park.
DeleteThese people were not criminals. Opviously, they were drinking at the Union and were on there way home.
ReplyDelete- Sylvia
That was a real contribution to the discussion, "Sylvia."
DeleteBack to whether WC is going to deal with the whack job. It keeps popping up on this blog and it was old the first time. I'm all for freedom of speech, but talk about a walking oxygen depleter....
The downward fall of Encinitas' lovely character began with the Union. Seen any council members hanging at Biergarden and other of the Union's drunken children? Noticed the recent postings to sell more alcohol on 101? The sideways comment about the Union is not odd at all.
DeleteRegarding immigrants
ReplyDeleteLegal immigrants are placed on waiting lists for years in order to come legally into our country.
Legal immigrants follow our laws for entry into the U.S.
What part of legal do you not want to comprehend!
Breaking the law has its consequences.
Blatantly disregarding the directions of U.S. Customs and Border Protection is not only foolish, but has consequences for those choosing to challenge its authority .
Translation:
DeleteShe got what was coming to her, and our Border Patril should do more of this.
We understand your viewpoint, we just don't agree. Interdiction of unarmed immigrants can be done with humanity, dignity, and safety.
"We"? Got multiple personality disorder?
DeleteNo. There are quite a few posts that don't agree with you, and I didn't write most of them.
Delete9:18 there are quite a few posts that don't agree with you. However unlike you- they want one rule of law that applies to all
DeleteYou on the other hand want 2 sets of rules, one you alone get to apply to those you deem worthy- and another set of rules that apply to everyone else
I'm confused.
DeletePlease point me to the post where I Or anyone else promoted two-tiered justice.
Please name the time of the post, quote the words, and describe the "two sets of rules" you think are proposed by those words, and who they apply to.
Be specific.
10:09
Delete"These people were not criminals"-
yes, they were criminals. Hundreds of thousands of law abiding people who respect our country and our laws are legally going thru the process of visiting, working and living in the USA-
Illegal Immgirants break our laws and are criminals.
ISIS is using Mexican smugglers to infiltrate our borders to murder our country mean and destroy our country.
There are now currently 121 murderers standing trial who killed law abiding american legal residents
So, you are not going to try to defend your statement about "two sets of rules," then? Just moving on?
Delete4:18
Delete"These people were not criminals"
yes- these peopel were, as were the smugglers getting paid to bring the in-
It is you believe in two sets of rules- one for this group, and another for that group- the have a word for that "intolerance" -
No one can be unilaterally declared to be a criminal without a fair hearing in this country. If there is deadly force being used, then a situation exists in which deadly force can be used to protect public health and safety. Customs agents are not to be judge jury and executioners. Even if a crime is being committed, deadly force is not justified. It's easy to label an undocumented worker trying to enter this country as an "illegal," or as a "criminal." But that's all you're doing, is judging others. Your obvious prejudice is born of lack of understanding and fear, 7:57. You have been poisoned by the venom of your own bitterness.
Delete2:31
DeleteWhen ISIS uses Mexican smugglers to attack our country to behead our sons, rape and enslave out daughters custom agents protecting our borders are Judge, Jury and executioners. To do their job they apply the rule of law to all. It is you who disciminates, not them.
They are not at fault for this woman dying- they did their job. The woman and her smugglers broke the law.
It is you who judge, not I. I respect the rule of law for all. I am thankful we have custom agents willing to risk their lives to protect our safety. It is you who is prejudice and fearful, not I.
There is no such thing as an "undocumented worker" there is such a thing as an "illegal worker"
The hundreds of thousands of legal immigrants of all races, genders and creeds are legal workers and as such have documentation. You are the one who lacks understanding, not I.
Once again you tweek your translation to fit your personal agenda.
ReplyDeleteNot everyone believes in breaking the law like you do.
MY god… RAMBLING!
ReplyDeleteMy heart is heavy for the dead one family.
A lot of trolls on this blog sound like tweeters
ReplyDeleteThank the government for their inability/refusal to have a comprehensive immigration policy.
ReplyDeleteWas it a 3 hour tour? Blame the Skeeper!
ReplyDeleteThese people are basically peasants attempting to survive. Do you haters ever once mention the legions of white illegal criminals. Of course not, Fox news never mentions them.
DeleteCabezon
5:05, You're confusing Gilligan's Island with Ren and Stimpy.
Delete5:32 reveals s loss of logic-
DeleteThese comments are about illegal immigrants, the rule of law, those who respect and follow the law, those who do not.
Perhaps 5:32 is the bigot and racist?
the rule of law knows no color. There are thsoe who follow the law- like the hundreds of thousands filling out the paper work and waiting to come here legally- and there are those who care so little for our rule of law, our country and our culture they come here illegally
The one's who are legal wait
The lawbreakers are rewarded with drivers licenses
hmmmm - and someone blames fox news?
Fox news is a tool.
DeleteThe "rule of law," is that deadly force cannot be used against those not threatening with deadly force. Breaking immigration law, or speeding, for example, or shop lifting, so many crimes, do not justify the use of deadly force. That is part of the "rule of law," too. As someone else said, this is not a "black and white," situation.
This tragedy didn't have to happen. I hope you don't have a gun, 7:54. You reveal a lack of compassion and integrity. You reveal yourself to be a bully who is a fearful coward, as bullies always are, hiding behind what you judge, in your bias, to be the "rule of law." I and many others posting here call BS. Get a heart.
2:39
DeleteThe "rule of law" is that it is illegal to cross our borders wthout following the law. You disregard this.
The "Rule of Law" is when a law officer gives you a legal command you follow it. The Illegal Immgirants and their coyote smuggler did not follow it.
It is very black and white. Hundreds of thousands of legal immigrants follow our laws each and every day - that is how "black and white" it is. Not one of them has died.
This tragedy did not need to happen, it did happen because illegal immigrants and their smugglers don't give a crap about our laws, our families, our cities or our culture- they instead do what they want to do- everybody else be dammed.
It is you who lacks compassion and integrity. I respect our laws, you do not. I believe that all are the same under the rule of law, you believe rules don't apply to one group but do apply to another. You have no compassion for the thousands of legal immigrants who are documented workers who do follow our laws.
It is you who is the bully seeking to intimdate us to believe there is such a thing as an "undocumented worker" BS- Legal Immigrants are documented workers becuase they are legal.
It is you who judge others by your bias- while it is I who judge all equally.
I and many others here call BS on you- you are the bully seeking to silence us from the simple truth that there is no such thing as an undocumented worker, "undocumented" = "illegal" yes, it is that black and white.
2:18 said:
Delete"The "Rule of Law" is when a law officer gives you a legal command you follow it. The Illegal Immgirants and their coyote smuggler did not follow it."
Corrections:
1.) Panga boat drivers are usually not professional smugglers. They are typically only tasked with driving the boat for one trip:
"And, for the most part, law enforcement authorities are disposed to regard the pilots of panga boats as 'mules,'ndividuals either coerced or induced to make a one-time run, but not career criminals."
http://www.psmag.com/politics-and-law/panga-boat-mexico-california-marijuana-drug-trafficking-homeland-security-54454
2.) The panga driver probably did disregard a command, but that doesn't automatically justify lethal force or aggressive maneuvers that put human lives at risk. Especially when the driver may fear the retribution of the cartels more than he does US law enforcement.
3.) The woman who paid with her life did not actively disregard orders. She was a passenger, which shares a root word with "passive."
4:07- your response is full of excuses- you apparently do not believe people should follow the law and take responsiblity for their actions. While you give excuses here is what happened:
Delete1." They are typically only tasked with driving the boat for one trip" If you sell coke one time, drink and drive one time, steal something one time then you are breaking the law
2. "that does not automatically justify lethal force" There was no lethal force, Custom agents shot no one
3. "The woman who paid with her life did not actively disregard orders"- She chose to illegally break our law, ignore our rules and actively seek to act against all legal residents- that is "active" as in actively breaking the law
7:54PM Hate to break it to you but there are tens of thousands of women who marry male US citizens to gain entry into our country. Yeah, they "wait" until they can find someone willing to the bend "the rule of law". It's all lies, of course, but as long as you have a good line of BS, you can pull it off. I probably know 3 dozen or so.
ReplyDelete8:36
DeleteHate to break it to you but the "tens of thousands of woman" who marry US citizens are acting legally. You may or may not like it, it may or may not be a "loophole" - it is legal.
OK, got it. It's legal to lie. Nice.
DeleteWho are you to judge someone's intent with marriage 2:04?
DeleteIllegal immigrants coming ashore our breaking the law - there is no interpretation or mind reading necessary
They all hang at the Saloon or Union looking for lonely suckers.
DeleteDirected Energy weapons are showing great promise. They can send a non-lethal pulse of RF energy from miles away on a boat, helicopter or drone to fry the electrical system of a boat and its motors.
ReplyDeleteZap. You have no propulsion.
These are pretty far along in the development cycle. We could start seeing them in action off our coast in the next few years.
Let's hope they deliver on the promise. Safe and effective for our law enforcement crews, and for the passengers of these pangas. If they are really effective, then the pangas will stop trying, which would be the safest outcome of all.

I sure could use a little good news today.
ReplyDeleteThe good news today is all of us that live in Encinitas live in Paradise. Improvements could and should be made, but for me, and I tend to gripe a lot as well, I appreciate the beauty of the place we live. How's that for some good news?
ReplyDeleteWhat a waste of a [in] humane ? being we have her. There is no point engaging him. He will only come back and spew his vitriol endlessly. Talk about a black heart, he is just such an example.
ReplyDeleteThat old saying about not engaging a pig as he will only bring you down to his level, applies to this racist cretin. The rule of law indeed is only black and white to those with no compassion. Ah but for fortune could he be in a similar situation.
This low life has made this thread so ugly, I wish WC would say enough already and move it on out of here. It only takes one to bring this sad story of loss of life to such a bottom feeding level.
it was nice to read some of the caring thoughts of our fellow citizens who expressed feelings for this poor woman who died but once this pos kept chiming him with his of brand ugliness, it spoiled it for the rest of us. Way to go. Thanks for nothing but right wing ignorance and arrogance. They do tend to go hand in hand. It is a bummer to know that such thinking exists here among us.
Amazing how a woman's death can be perverted into all sorts of angles by people with an axe to grind about a variety of topics that have nothing to do with the reality of this person and why they risked their life to enter the country. Shameful....
ReplyDelete3:31 and 8:41
Delete"Black heart" ?? The poster recognizes the families of legal residents who have lost loved ones to the rape and murder by illegals. There are currently 121 illegal immigrants awaiting murder charges across the country. You ignore them, the poster does not.
"racist cretin"? The poster thanks legal immigrants who follow our laws and respect our families. The poster supports the rule of law that knows no skin color, you support two sets of laws based on skin color.
"The rule of law indeed is only black and white to those with no compassion"? The poster has compassion for all based on the rule of law- compassion for the legal immigrants waiting years for visa's, compassion for the legal citizens who have lost loved ones to the violence of illegal immigrants- it is you who lack compassion. The law is indeed black and white- legal immigrants have documentaion, because they are legal.
THere is no such thing as an undocumented worker- only an illegal worker. The poster observes the truth - while you ignore it.
"Ah but for fortune" you know nothing of the poster or their circumstance. You assume the poster is male. Perhas it is you displaying your prejudice and gender bigotry.
"Right wing arrogance" ? Illegal immigrants disrespecting our country, our culture and our rule of law is not a democrat or republican issue- it is you who reveal your ignorance.
Thankfully there are people who see the truth as it is, it is good to see such thinking exists here among us.
3:31. What's shameful is the captain of the little boat evading capture after warning shots failed to phase him. The woman's death is totally on his shoulders. The RF blast mentioned earlier is a great idea - if possible. And its extremely sad someone died. But you can't rewrite protocol from your liberal armchair for illegal aliens evading capture with "If warning shots don't stop them then let them go. If they don't come back, they were never really yours to begin with."
ReplyDeleteThe mural depicting a boatload illegals landing illegally on our shore, under cover of darkness, needs to be removed, now.
ReplyDeleteWho commissioned this offensive mural?
What it is the City's position on public art that glorifies lawlessness?
3:11,
ReplyDeleteI like it a lot. Leave it alone.
7:33
ReplyDeleteMan murdered by illegal is surved by loving wife and 4 daughters- died on fathers day in texas
Man who's son was murdered by illegal testifies before congress on 2/2014
Man who's son was murdered by illegal testifies before TX senate in 4/2015
and the list goes on and on- you support these illegal murderers- while you oppose hundreds of thousands of legal immigrants following the process to visit, work, learn and live in our country
5:32, I don't support illegals invading at all. But the mural doesn't support illegal entry into the US any more than a painting of Jesus on a cross supports his crucifixion. The Moonlight mural is art. Its a statement. And its pretty accurate. Not to mention nicely done.
ReplyDelete
