10/19/16 City Council meeting open thread

The current city council has continued prior councils' practice of not providing written summary minutes of council discussion, but only "action minutes" which state the outcomes. Encinitas Undercover will provide a forum for observers to record what occurs at each council meeting.

Please use the comments to record your observations.

  1. Council is putting the cost of the lights on Leo Mullen on every taxpayer in Encinitas. Encinitas Soccer Express scored big time!

  2. Leo Mullen started out as a day use neighborhood park with limited parking.
In comes Encinitas Soccer Express and takes over as practically the sole user of the soccer field. Council pays $1.2 million from the General Fund and not from the zone H assessment district to pay for the artificial turf. Now Council is paying from the $150,000 from the general fund not from the zone H assessment district to start the process to amendment the specific plan for lights on the field.
Why are city taxpayers footing the bill for the zone H assessment district that is required to maintain Leo Mullen?
Council is buying votes for the election. Council action is rotten. Give taxpayers back our general fund money for street repairs and infrastructure.

  4. Are you one of Encinitas environmental fascists? The environmental fascists believe that if people are allowed to have large amounts of freedom and liberty that the planet will literally be destroyed. That sounds crazy, but that is what they actually believe. Left to our own devices, they are fully convinced that global warming and out of control pollution will transform the earth into an uninhabitable hellhole. Therefore, they believe that it has become necessary to strictly manage human behavior “for the good of the environment”.

With each passing year, the control of the social planners gets even tighter. Today, they have banned certain kinds of light bulbs, they are putting mandatory “smart meters” into our homes, and they have instituted all kinds of ridiculous regulations concerning what you can do with your own land. Tomorrow, they plan to put “black boxes” into our vehicles and move most of us into “stack-and-pack” housing that has communal bathrooms and no elevators. There is a reason why these people are called ecofascists. The “true believers” of the environmental fascism movement actually believe that they are “saving the world” by being control freaks. They truly believe that they know better than the rest of us, and they love to get into positions of political power so that they can impose their will on everyone around them.

    1. The environmental fascists are constantly “pushing the envelope” and doing whatever they can to use the power of the government to impose new rules on all the rest of us. Most of the time, Americans just take it without ever fighting back. For example, a car wash for a high school cheerleading squad was recently shut down because the cheerleaders were “in violation of water discharge laws“…
It’s hard to wave your spirit fingers when the city shuts down the cheerleading squad’s fundraising car wash to protect the environment.
This is what happened to Lincoln High School cheerleaders trying to raise money to attend a national competition in April. The San Jose Mercury reports that local environmental officials warned the high school cheerleaders that their car wash violated the city’s water discharge laws.
“We had a visit from the city of San Jose Environmental Services Department who said that the car washes at Hoover [Middle School] are in violation of water discharge laws, therefore we had to cancel this and all future car washes,” said an email that was sent out to neighborhood email lists on Oct. 18.
Fortunately, there are some Americans that are still willing to stand up and fight back against this emerging ecofascism. A recent Businessweek article profiled one north Idaho couple that is vigorously fighting back against the ridiculous demands of the EPA…
Four years ago the Sacketts were filling in their lot with dirt and rock, preparing to build a simple three-bedroom home in a neighborhood where other houses have stood for years. Then three federal officials showed up and demanded they stop construction. The agency claimed the .63-acre lot was a wetland, protected under the Clean Water Act.
The Sacketts say they were stunned. The owners of an excavation company, they had secured all the necessary local permits. And Chantell Sackett says that before work began, she drove two hours to Coeur d’Alene, Idaho, to consult with an Army Corps of Engineers official. She says the official told her orally, though not in writing, that she didn’t need a federal permit. “We did all the right things,” she says.
The EPA issued an order requiring the Sacketts to put the land back the way it was, removing the piles of fill material and replanting the vegetation they had cleared away. The property was to be fenced off and the Sacketts would be required to submit annual reports about its condition to the EPA. The agency threatened to fine them up to $32,500 a day until they complied.
Sadly, this kind of thing is happening all over the nation. The EPA is completely and totally out of control, and they seem to be obsessed with making life absolute hell for farmers and private landowners.

    2. This truly defines Catherine Blakespear and her mom's 60-something feminist friends:
"They truly believe that they know better than the rest of us, and they love to get into positions of political power so that they can impose their will on everyone around them."

    5. Hey ass hat, you ever tried to sell hot take out food for a living? Do you have any sympathy for these business owners that feed our community? Are you into forcing them to obey your will by removing polystyrene boxes from their businesses? You're just another Coastal elitist using words like stupid because as cited above you always know better than everyone else. It sounds like you're retired and we're paying your pension.

    6. Yes, I'm retired, but you are not paying my pension. I worked in the private sector as an engineer.

    7. 9:50 Hummingbird hatchlings so small each can fit in a teaspoon know not to poop in their nest.

Use an alternative to polystyrene for take-out food and pass the tiny marginal cost onto customers as you already do with the slightly lower-cost polystyrene.

Take-out food buyers can do their part to preserve the only nest we have.

    8. We are lucky to have a huge marine preserve in our backyard. We should make a little extra effort to help keep it as pristine as possible.

    9. Boo hoo. McDonald's got rid of polystyrene over 20 years ago. Go do a beach cleanup, then tell me it's not a problem.

And we all need to start picking up cigarette butts tossed out car windows and throwing back into the car from which they came.

    10. ONLY polystrene will keep you food warm for a 15 minute ride home. NO OTHER material retains heat. You are simply discriminating against those that have a dire need to deliver food to people that cannot cook or pixk it up themselves. Rot in hell you spoiled elitist scoundrels.

      Delete
    11. A dire need? Really?

Sure, you're performing a great charitable service by selling take-out food in indestructible polystyrene containers.

Food not hot enough? Got a microwave?

    13. Gaspars are two of the most unqualified persons for running for office. This is a test of the intelligence of the electorate to see if fluff and propaganda can make these sell-outs palatable to the voters.

sell your customers a reusable insulted bag, with your branding, just like other in town do.

  5. Rather enjoyable hearing Paul Gaspar's medical pretensions exposed so bluntly. Kristen's head was down the entire time the speaker was talking.

A good crowd there, too, and perhaps even likely Gaspar voters. The words "illegal" came up repeatedly, as did the irony of both Gaspars' campaign claims as the "ethics" candidates.

  8. The Yes on T signs are illegal since they don't indicate who is paying for them.

Why is it that they don't want to be identified? Are they using taxpayer's money, or do they know that Encinitas citizens hate developers??

    Vote NO on T!

  9. I've heard that Lisa Shaffer paid for those signs.

  10. According to this video, Yes on T is funded by Foundation for Independent Research & Education Issues Committee.

  14. Roberts is finally striking back at the hypocrite Gaspar. She endorses Trump for President, ran a non-profit that was suspended by the State and declared deliquent, CFO of a company with a history of unpaid taxes and sued for malpractice, elder abuse and negligence. Gaspars are both frauds - unfit for office.

      Elder abuse? Shame on them.

      NO to GASpars.

    2. A confidential settlement could be either something substantial or a big nothingburger.

Pretty meaningless unless someone comes forward with details.

      Delete
    3. Elder abuse is not meaningless. The Gaspars have some explaining to do.

      Delete
  15. Probably few health care practitioners have not been sued; hence the high malpractice insurance rates, passed on to the public. Lawyers are often driving factors, pressuring settlements because it is so expensive to defend a case.

Gaspar, according to KPBS radio, has withdrawn her support of Trump, after the primaries, and after more allegations came out about him (and his treatment of women).

I see the unproven Gaspar allegations, about a case, which never went to trial, as an "October surprise," another low-blow hit piece, as are the allegations Issa supporters are spreading against Applegate. Politics are dirty on both sides of the aisle.

    ReplyDelete
  16. I went on-line to see if there were any court details of the lawsuit against Gaspar Physical Therapy - there was no archival information. A settlement may have stipulated non-disclosure.
Gaspar withdrew her endorsement of Trump under pressure. It wasn't like she suddenly got a revelation that he was completely unqualified for the office. That endorsement shows her mentality about political orientations in general.
Gaspar is no victim of dirty politics. Her campaign has focused on Robert's office debacle and questions his overall integrity. It is a shame candidates can't discuss policy instead of personality flaws, but the electorate apparently bores easily. Gaspar/Roberts race boils down to money - Gaspar's camp is going for broke, as she is a one shot pony. Her political career is over if she loses this one.

  17. So glad to see Dave hitting back on the elder abuse case. Totally agree that all practitioners get sued at one point or another and that it might make sense to settle some of these cases regardless of guilt. You sort of want to give them the benefit of the doubt, right? Well, the foundation for the whole Gaspar campaign (under the laughable slogan "Ethics Matter") is the settlement in the case for Dave. Apparently we have to apply a double standard in Gaspar land: Presumed guilt for Dave (who didn't want to settle) and the benefit of the doubt for Gaspars. No can do, I can't go for that. Can't get behind the tidal wave of Gaspar slime/mud based on this. I call bullshit on them.

    1. Yea, Gaspars reek of hypocrisy. The generic campaign for Kristin is all the handlers could muster, as she is politically clueless. She avoided debates because the handlers didn't want to expose her ignorance of the Supervisorial responsibilities or the pertinent issues of the county. She is a puppet, propped up by the developers, who pull the strings.
