Developer attorney Marco Gonzalez REALLY wants 48-foot-high mixed-use buildings in Encinitas

... rather than the city working with residents to develop an affordable housing plan that fits Encinitas' community character.

Attorney Marco Gonzales [sic] proposed an alternative path, which is for the City to adopt Measure T despite the public vote, and offered to work pro bono to defend the City against an anticipated lawsuit from the opponents of Measure T.

      Agree or don't agree, but you can't disbar an attorney for doing his job. What are you going to do - frame him for a felony? Talk about ad hominem - we don't like Marco so we'll go after his professional credentials......oh WTF - we're in the Trump Universe now so I guess all bets are off.....

    4. I think you have to commit some type of crime to be considered for disbarment. As much as you may not like Marco's position, being a lawyer is his job, and clearly he is going to represent a certain segment of the development community in town.

      That said, it sure seems like a long time since he did work with Surfrider.

    If Blakespear is behind this attempted developer giveaway to fit the now exposed for profit high density housing industry the people need peacefully revolt

  5. If the city council even considers this absurd offer, a recall is in the making. Gonzales needs to get hit with a frivolous counter-lawsuit - hit him in the pocketbook - the only thing he is really concerned about.

    3. So the Sculpin is now a legal expert, amongst his other delusions of grandeur. If Gonzales sues, the city needs to respond; unless it is immediately thrown out by a judge for lack of merit. A lawsuit could be brought against him for any costs involved - that is not uncommon. Maybe you and Shaffer can ride off into the sunset together - you both think you know it all.

  7. He is a little slow but will figure out that he can not win. This is his sorry attempt to save face after he realized he had no case against the city.

    A recall would have to take place within a couple months I think. This needs to be voted on by our elected overlords soon.

    Prop A still requires a vote for any zoning change.

    Nothing will be built while in court.

    How about we agree to waive the special vote costs for developers while we get a proper HEU together? We could even offer an incentive of waived permitting fees if approved and is considered affordable. That would be a better way to waste money than giving it to lawyers.

      This isn't correct. He's making every attempt to resolve the matter short of legal action, even if he knows it won't work. It will save him time when a judge asks if there are settlement options that have not been exhausted.

      Who wants to place bets there's not a major Meyer/BIA pot of gold waiting for him if he somehow pulls off his little plan? Clearly that's his only interest.

    3. Resolve what matter? There is nothing stopping a developer to ask for approval to change zoning. What damages has Marco, his clients, or affordable housing suffered?

      So is he going to sue the city, rep. the city, rep. the developer, and be an environmental attorney? Jack of all, master of none. Tune in next week when Marco applies to be a city planner.

      He has no case but that will not stop the city from giving him a settlement for his measure T lobbying.

      Is he a registered lobbyist? No. Does he fit the legal definition? Probably.

  9. This is not the first time Marco has tried to get the city to take on his services. And, it will probably not be his last. He might do this pro bono, but his motives are for a long term paid gig with Encinitas. How do I know this? Because I heard him say it to a council member. How can the City even consider this? The people voted! That should be the end of the story and the city is now asking citizens to help with the HEU. So why did Marco even bring this up? I haven't watched the Council meeting so I don't know when he said it. Does anyone have the approximate time he said it. Shaffer put it in her newsletter, so I can only assume he said it at lat night's city council meeting. This is not a disbarment case, but if the Council were to go for it, I would say I would like any council member who approved it to be impeached. The people voted. What part of that don't you get Marco?

    1. He gets it fine, he just doesn't care, and that's worse. Blakespear and Shaffer simply cannot get enough of Marco and his ilk. Just watch them fawn all over Keith Harrison. They have no ability to read people.

    2. I saw part of the meeting. Marco came up and spoke during Consent Calender Item 8E, which was pulled, and agendized as: "Authorize Council Member Blakespear to work with Bruce Ehlers, the City Attorney, outside Attorneys, City Staff and HCD to discuss a path forward regarding the Housing Element update for a report back to the City Council."

      It was decided "despite the veiled or not so veiled threats" by Marco to establish a subcommittee with Blakespear and Kranz to hold publicly noticed meetings. Other members of the community besides the No on T group (Ehlers and other activists) will be allowed to attend. The meetings will be noticed as other open subcommittee meetings have been.

  12. As much as Marco deserves all of our recriminations, he is within boundaries that we cannot go after him for.

    Why Encinitas has to be saddled with this cretin, only goes to show how much money he makes locally from certain interests that don't represent the will of his own community. Cut that off and he will go elsewhere.

    Most dogs prefer to crap outside of their own yards, if given the chance. Marco happily leaves his deposits in his own front yard, so to speak.

    His feeble attempt to sway the council went nowhere. The threat of lawsuits is just a threat. The city satisfied the conditions of the closed session wrangling by bringing forth a hosing plan.

    Council has the ultimate responsibility for this failure, because they let Manjeet and his planning robots run the show. Council abdicated their duty through all this waste of time and millions of our dollars trying to sell a plan that was nothing but a giveaway to developers.

    Will the future be any different?

    They now say they will listen to us this time when they could have all along.

    Karen, clean your house. You have been generally ineffective in doing what needs to be done.

    We are rid of the the Murphys' and Pruim, and Manjeet and please, pretty please, send Masih packing.

    Every time he sits there over on the side area for the staffers and looks out on the crowd, the look on his face, should tell you, Karen., that his time here needs to end.

    There are numerous neighborhoods throughout our city that have suffered greatly under his blinders on, one size fits all, viewpoint.

    Masih has continued to defy directions from council to stop and he is allowed to persist.

    If a petition drive is needed, you better believe there are many of our fellow neighbors that would relish the opportunity to sign on and have him fired.

    Karen, if you force us to have to pursue other avenues, it will only reflect upon your leadership qualities. Do the right thing. Now.

  13. Marco made his statement (his offer) about 35 minutes in on the webcast counter. His offer was for Council to just vote to override Prop A, and force a housing element update without another public vote. Then he would defend pro bono (free) the inevitable lawsuit(s), which would result from those citizens who fought so hard to get Prop A to become law.
