Democratic infighting over Assembly seat
When Councilwoman Tasha Boerner Horvath announced a run for Assembly, some local Democrats including Councilman Tony Kranz and former Councilwoman Lisa Shaffer had an unusually harsh reaction, apparently upset that Horvath would buck the party hierarchy and challenge the party's anointed candidate, activist Elizabeth Warren.
Still, she persisted.
Now colleagues and fellow Democrats Joe Mosca and Catherine Blakespear are rising to Horvath's defense.
Warren, though not well-known in Encinitas, is a long-time activist with Moveon.org, the PAC formed in 1998 to give former President Bill Clinton political cover against accusations of sexual harassment, sexual assault, and perjury.

DeleteIn 65 years since passage of the Brown Act, there has not been a single successful prosecution for violation.
If you were to have rock solid evidence of a violation (you don’t), the law calls for you to send a cease and desist letter documenting your evidence. At that point, the City can respond “My bad. Promise not to do it again” and the matter is over legally.
Getting a parking ticket has more consequences.

DeleteI suggest you go to the Fair Political Practices Commission and tell them the Brown Act is being violated, and that your only “evidence” is that the duration of public debate doesn’t meet your personal standards.

Complaints have been made to the FPPC. In most cases all that results is a slap on the hand of the Brown Act offender.
DeleteAt the same time as Prop. A was being written, a "Sunshine Ordinance" was written, but never got any further. An eighty page draft till exists. Among other things, the initiative would have required recording all closed sessions and then making public the recordings after a certain time period.
The Brown Act doesn't require closed sessions on any subject. It only allows closed sessions on certain subject-- personnel discussions or real estate transactions, for example.
Serial discussions are more difficult to police, even with a Sunshine Ordinance. For anyone closely watching Blakespear, Boerner-Horwath, and Mosca, there is prima facie evidence. The coordination is just too obvious.
7:09, just curious: is your anger coming from the lack of Brown Act convictions, or directed at folks observing and believing the three have violated the Act? And finally: have you watched closely and not seen any behavior among them that might suggest pre-discussions among them?

DeleteThe Brown Act is a poorly written and ineffective law. It’s meaningless, unenforceable, and accusing people of violations with real proof is pointless and lazy. Without proof, it’s just stupid.
For people who actually want to make a difference, we should ban any reference to the Brown Act forever.
"We?" Who are "we?" The effectiveness of the law is beside the point. It's there, it's clearly laid out, and not referring to it only means the three will be more emboldened than ever to violate the law.
DeletePretending the three aren't working behind the scenes, contrary to law, is not something I can agree to - but you go for it. Their behavior bothers me and a whole lot of other people - people who once supported Catherine and Tasha. Again, separate from the difficulty of enforcement, there are ethics issues here. And that bothers me.
Legal enforcement aside, does their behavior not bother you, or do you not see what so many are talking about?

This is too easy. Elizabeth Warren is the only candidate that can take out Rocky. Just ignore Tasha and her supporters. I plan to.
ReplyDeleteWe need all the Elizabeth Warrens' we can find these days. Tasha's, not so much. We are stuck with her, unless her ambition leads her somewhere, anywhere else. I wouldn't put that out of consideration either.
Liz is a looney leftist. Not in line with the district. Does not understand basic economics. Tasha is a moderate. I can see myself voting for Rocky over Liz.

DeleteGary was instrumental in getting the city to fix the drainage problem on 101 in Leucadia. He wasn't afraid to speak strongly to the city council for their negligence, which included spending millions to fix the problem, but only making it worse. It was nicknamed the Pasco Fiasco after Pasco Engineering, who designed the solution that failed.
