by Kaila MellosApril 27, 20233049 ENCINITAS — Three years after cyclist Jennings Worley was fatally struck by a large commercial truck while riding his bike along Leucadia Boulevard, the parties in his family’s wrongful death lawsuit have entered settlement negotiations, recent court filings show.
In November 2020, Worley, 62, was cycling westbound in a designated bike lane near the intersection of Leucadia Boulevard and Moonstone Court when the driver of a PODS Enterprises moving truck attempted to make a right turn, colliding with Worley and causing severe injuries that led to his death, according to court documents.
Worley, an avid cyclist, was a leading scientist fighting to cure cystic fibrosis, according to his obituary.
At the intersection of the accident, Shea Homes had recently constructed the Alia community, a 13-unit residential development in Encinitas. As part of the project, Shea Homes converted a private driveway into Moonstone Court, a public access road for residents to access their homes.
According to the lawsuit, the bike lane along Leucadia Boulevard was separated from the road by a solid white line and bollards leading up to the intersection, forcing vehicles turning right onto Moonstone Court to cut across the bikeway.
“(These) dangerous conditions created a trap that a reasonably careful person would not notice or anticipate as being dangerous, since the lack of dashed lines, and presence of bollards/stanchions created a false sense of safety while operating a bicycle in the bikeway while at the same time, depriving automobiles adequate opportunity to merge into the bikeway to turn right onto Moonstone Court,” the complaint alleges.

Former San Diego County Supervisor Nathan Fletcher is again banking on his abandoned state Senate campaign to pay for his steep legal defense bills in a lawsuit accusing him of sexual assault.
Fisher & Phillips LLP, the firm representing Fletcher in the case, billed his campaign $200,000 for “professional services” in the first six months of this year, according to campaign finance disclosures. The bill had not been paid as of June 30.
In April, KPBS found Fletcher’s dormant campaign had paid Fisher & Phillips more than $323,000 to cover his legal bills last year.
The California Fair Political Practices Commission (FPPC), which oversees campaign finance enforcement, has received a complaint against Fletcher for his use of campaign funds for attorneys fees in the case. As the population of the San Diego MSA has increased, we’ve pushed development and affordable housing further and further away. We now have teachers, cops, nurses and plumbers commuting in from Ramona, Julian, and Temecula.
And with those houses, they need stores and strip malls to provide food, gas, and karate schools for the kids.
All that sprawl sucks ass for the environment. It’s building over massive tracts of backcountry open space and trail systems that used to be accessible for day trips from Encinitas. Used to could get up in the morning on a Saturday, drive an hour to a trailhead, and walk for 10 miles without seeing a house, road, building, or power lines. Sprawl has made that all but impossible.
Plus, all those long commuters are burning carbon by the ton, and jamming the roads producing even more carbon, and making getting from A to B a shit show for everyone.
And sprawl has caused all of our insurance rates to skyrocket, as the rural-urban interface firefighters need to defend has grown dramatically.
Do I love having a big apartment building down the street? Not really. But in the big picture, it’s better than the alternative.
In the big picture, putting people’s beds closer to their work makes hella sense. It shortens commutes and takes cars off the road. It reduces traffic because 10,000 people traveling five miles to work generates less traffic than those same 10,000 traveling 100 miles to work.
It also keeps the backcountry experience closer to Encinitas.
Dems view on the environment is big picture and nuanced. Republicans view on the environment is selfish and short sighted. Me me me.
Sure just take areas designated and zoned as Parks and turn them into luxury apartments all in the name of affordable housing, 10%. And we all know how often the friends and family of the developers make up that 10%. We've all seen the newspaper articles, even locally, where certain developer friend get luxury affordable housing as opposed to a low income applicant.
Sure take parks away from our children that are growing and families that need a healthy outlet. Take all the open space you need and make sure to tax it.

ENCINITAS — Three years after cyclist Jennings Worley was fatally struck by a large commercial truck while riding his bike along Leucadia Boulevard, the parties in his family’s wrongful death lawsuit have entered settlement negotiations, recent court filings show.
In November 2020, Worley, 62, was cycling westbound in a designated bike lane near the intersection of Leucadia Boulevard and Moonstone Court when the driver of a PODS Enterprises moving truck attempted to make a right turn, colliding with Worley and causing severe injuries that led to his death, according to court documents.
Worley, an avid cyclist, was a leading scientist fighting to cure cystic fibrosis, according to his obituary.
At the intersection of the accident, Shea Homes had recently constructed the Alia community, a 13-unit residential development in Encinitas. As part of the project, Shea Homes converted a private driveway into Moonstone Court, a public access road for residents to access their homes.
According to the lawsuit, the bike lane along Leucadia Boulevard was separated from the road by a solid white line and bollards leading up to the intersection, forcing vehicles turning right onto Moonstone Court to cut across the bikeway.
“(These) dangerous conditions created a trap that a reasonably careful person would not notice or anticipate as being dangerous, since the lack of dashed lines, and presence of bollards/stanchions created a false sense of safety while operating a bicycle in the bikeway while at the same time, depriving automobiles adequate opportunity to merge into the bikeway to turn right onto Moonstone Court,” the complaint alleges.

Nathan Fletcher is being investigated by the FPPC for using his campaign donations on attorney bills. What a crook!
Former San Diego County Supervisor Nathan Fletcher is again banking on his abandoned state Senate campaign to pay for his steep legal defense bills in a lawsuit accusing him of sexual assault.
Fisher & Phillips LLP, the firm representing Fletcher in the case, billed his campaign $200,000 for “professional services” in the first six months of this year, according to campaign finance disclosures. The bill had not been paid as of June 30.
In April, KPBS found Fletcher’s dormant campaign had paid Fisher & Phillips more than $323,000 to cover his legal bills last year.
The California Fair Political Practices Commission (FPPC), which oversees campaign finance enforcement, has received a complaint against Fletcher for his use of campaign funds for attorneys fees in the case. The state commission is now considering whether to launch an investigation, which could provide legal clarity for similar situations moving forward, according to experts.

As the population of the San Diego MSA has increased, we’ve pushed development and affordable housing further and further away. We now have teachers, cops, nurses and plumbers commuting in from Ramona, Julian, and Temecula.
And with those houses, they need stores and strip malls to provide food, gas, and karate schools for the kids.
All that sprawl sucks ass for the environment. It’s building over massive tracts of backcountry open space and trail systems that used to be accessible for day trips from Encinitas. Used to could get up in the morning on a Saturday, drive an hour to a trailhead, and walk for 10 miles without seeing a house, road, building, or power lines. Sprawl has made that all but impossible.
Plus, all those long commuters are burning carbon by the ton, and jamming the roads producing even more carbon, and making getting from A to B a shit show for everyone.
And sprawl has caused all of our insurance rates to skyrocket, as the rural-urban interface firefighters need to defend has grown dramatically.
Do I love having a big apartment building down the street? Not really. But in the big picture, it’s better than the alternative.
In the big picture, putting people’s beds closer to their work makes hella sense. It shortens commutes and takes cars off the road. It reduces traffic because 10,000 people traveling five miles to work generates less traffic than those same 10,000 traveling 100 miles to work.
It also keeps the backcountry experience closer to Encinitas.
Dems view on the environment is big picture and nuanced. Republicans view on the environment is selfish and short sighted. Me me me.
