Judge smacks down Assistant DA for overcharging Shaffer

North County Pipeline:
Encinitas City Councilman Luke Shaffer scored a significant legal victory after Thursday’s preliminary hearing when his felony assault charge was reduced, and one misdemeanor was dismissed.

Judge Saba Sheibana was not swayed by San Diego County Deputy District Attorney Chandelle Boyce regarding the felony assault and a misdemeanor omission to perform duty. Shaffer, 45, was also charged with misdemeanor hit and run, which Sheibana said was “de minimis.” In the legal context, de minimis refers to matters too minor or trivial to be considered by the law.

    Next, 5th graders were allegedly told to have their buddies choose a color representing their buddies’ gender, and draw their buddies’ outlines in chalk in that color to communicate “gender was determined by an internal feeling.”

    protected speech,

    a legitimate public concern,

I screenshotted and time stamped this, there’s 100% certainty that the comment came from Andrew Matuszeski. You can’t fake a Facebook invite with someone’s name and picture attached along with verifiable details in that profile.

      Any and all comments with that IP address are from Andrew. Based on the language, wording, threaded conversation, etc etc, Andrew is our dark early morning poster. He’s also made many defamatory remarks regarding Encinitas residents over the years.

    UC San Diego says it’s struggling to deal with a large and growing number of freshmen whose math skills are below middle-school level, leaving many unprepared to thrive at an institution famed for its teaching and research in science, medicine and engineering.

    This fall, 665 students — 8.5% of incoming freshmen — were placed in Math 2, a remedial course meant for students who aren’t prepared for a foundational course in precalculus, according to a campus report issued on Nov. 6. Five years ago, 32 students, or 0.5% of freshmen, did the same.

    In one assessment test, some students failed to answer a simple addition question, and some could not round off the number 374,518 to the nearest hundred.

    The report — which offers possible fixes — says many students are struggling even though they completed the math classes they needed to take to qualify for admission to the University of California. Many also were found to have trouble with language and writing.

    The rise in math-challenged students “coincided with the COVID-19 pandemic and its effects on education, the elimination of standardized testing, grade inflation, and the expansion of admissions from under-resourced high schools,” the report says.

    “The combination of these factors has produced an incoming class increasingly unprepared for the quantitative and analytical rigor expected at UC San Diego.”

      And while anonymous forums can be rough, anonymity doesn’t give anyone a license to defame people, make baseless accusations, or damage someone’s reputation and livelihood. There’s a difference between harsh opinions and outright false attacks.       And while people can choose not to read abusive content, that doesn’t magically make the behavior acceptable. If someone is spreading malicious falsehoods, inventing accusations, or repeatedly targeting individuals, that’s not “dialogue”—it’s harassment. In many cases, it’s also illegal.

      Libel, defamation, and coordinated harassment don’t suddenly become lawful because they’re typed on a blog or posted anonymously.

      And the idea that “this never happens to private individuals”? It absolutely can and does. Anonymity can embolden people to cross lines they never would in the real world, and private individuals often get caught in the crossfire simply for having an opinion about local issues.

      Discussing public matters is fair game. Maliciously misrepresenting people, harassing them, or damaging their reputations isn’t protected by some special “blog exception.” Freedom of speech doesn’t mean freedom from responsibility—online or offline.

      Answer: Andrew Matuszeski's anonymous comment came with a Facebook link he shared. That Facebook link said "Andrew Matuszeski sent you and invite". You can't fake that.

      Now that we've established who sent the anonymous comment regarding Luke. We need to look at the IP address attached to that comment. Because now, every single comment that has the same IP address, no matter if its Nord VPN, Star Link, etc will be Andrew Matuszeski's.

      I'm not going to tell you how I know, but there are A LOT of defamatory, illegal comments attached to that particular IP address. Andrew might be using other IP addresses, I don't know, nor do I care, I only care about that 1 particular IP address, because without a question of doubt that IP address is his.

      Finally, Andrew lives in Carbondale, Colorado. Different laws apply for doxxing in Colorado, they're more geared towards public representatives and threatening physical harm, physically harassing. Think physical...       Regarding Amanda, the truth will always set you free.   66. Another fantastic review, go grove-dawg go!

    We went to Haven at Fox Point Farms hoping for farm-to-table... but apparently the table was abandoned somewhere along the way.

    We got seated at 6:45pm, and then we began our journey into invisible guest mode. For nearly 30 minutes, no water, no busboy, no server--just us, slowly evaporating into thin air while the staff had a solid group chat session five feet away. Honestly, I've been ghosted before, but never by an entire restaurant staff.

    Finally, someone appeared--presumably our server, though I'm still not sure because he seemed more surprised to see us than we were to see him. Let's just say the vibe was less "welcome to Haven" and more "why are you here?"

    After 30 minutes of feeling like we crashed a staff meeting, we got up and left. No food, no drinks, no water, no thanks.

    If you're looking for ambiance and the thrilling suspense of wondering if you've been forgotten in a simulation--this place is for you. If you're hungry... maybe not.
