This is an immediate issue which impacts you! It involves the SealFit business located at 849 Second Street in Encinitas. They currently use megaphones for their fitness exercises and drills in an outdoor courtyard, in the streets of downtown Encinitas, and on the beach -- at all hours of the day and evening. They are asking the City for a Major Use Permit. If granted this will add significant disturbance to the peace and harmony of our beautiful downtown neighborhood.Here's SealFit's invite to the city-mandated neighborhood meeting.
Like many ECC members and residents, you have probably already been disturbed in the morning, noon, and even in the evening by SealFit clients doing their training on the streets as well as in their courtyard.
Tonight from 6:00 - 7:00 pm there with be a Citizens' Participation Meeting at SealFit. Their objective is to more freely use their courtyard and streets for training (with the continued use of megaphones). If the City awards them the Major Use Permit they are seeking, they will undoubtedly go into full swing and there will be untold problems as the result.
Please attend this important meeting to voice your opinion or to stand by those who will be expressing their concerns about this already troublesome neighbor.

Noooo one morning my daughter and I were running through the alley and we had to zig zag through a group of "seal fitters" no one even moved to give us room, it was pretty lame.
ReplyDeleteThese people run thru the streets and act like everyone needs to move out of their way. This macho approach to fitness is all the rage and attracts a certain mentality. The trainers should not be allowed to use megaphones to bark out commands and should pay fees for using the beach. Basically, they are kind of annoying.
ReplyDeleteLast time I checked and I did, this was formerly the 'fitness' biz that was upstairs from the New Old Chamber office and was when 2 of the officers that were killed in Benghazi worked when they were 'in town'.

Yup, follow the workout people to their cars and bag pots as the leave and arrive. If Sealfit can't be a good neighbor then neither should you. Go to the Sealfit owners' home and bang pots, it's legal until 10PM.
DeleteCheck out Sougias city planning case # when he received approval to build his garage and offices. Lots taxpayer money went to the chamber to help them move to a small office in his building.

ReplyDeleteThe northeast corner of 2nd and H used to be Vern Painter's Garage. Charlie bought it from Vern, made it Charlie's Foreign Car and renovated the building. Later, Charlie built the current Charlie's Foreign Car on the southeast corner of 2nd and F. There used to be a plumbing supply place there before Charlie bought the property. Between its being a plumbing supply place and its becoming Charlie's Foreign Car, Surf Research made surf wax there.
I don't know if Charlie still owns the corner of 2nd and H. Anybody can find out by entering the address on the property finder on the city's website.
There used to be two wooden cottages on the lots just north of 2nd and H's northeast corner. They disappeared and Encinitas German Auto Service was built there. I think those good folks closed that business and retired. I don't know if they sold the property or retained it and lease it to the fitness people.
What's being called a courtyard above was Encinitas German Auto Service's parking and temporary storage lot.
Charlie owns everything from the alley west to 2nd north of H up to where address 841 stops and 839 starts. That includes the whole fitness complex.

In other news of the too easily aggrieved, someone used power tools to cut down the slides on the Paul's Ecke Central playground equipment. This is the second time in less than a year using the same MO on the same equipment. It happened just a day or two before school started. The playground equipment targeted is near a fence abutting a residential neighborhood.
ReplyDeleteGiven that power tools were used, I'm assuming this was not kid vandalism, but rather some adult A-hole who moved in long after this school and playground were built.
Once again, too many selfish bitter angry people who feel they should have the right to control everyone else.
I hope they catch the neighbor, and bring suit in both criminal and civil court. If anyone has specific information about the crime, speak up and I may personally find a way to connect to offer a reward.

ReplyDeleteI always love it when anonymous posters suggest that they will offer a reward. So let's say I know who did it, which I don't, how would I get my reward 12:50. Maybe you are 007, Bond, that's James Bond! And yes, I realize I posted this anonymously. But, I'm not putting up a reward. I'm going to let the sheriff try to do their job, if they are not too busy giving out tickets to dog owners who let their dogs run wild 5 minutes after the deadline to leash them.

If the source wants to maintain anonymity as well, they could also use a temporary gmail account, or use one of the free email anonomizer web sites.
After communicating, if it turns out the source actually has useful information, we could both associate our temporary email / phone with PayPal accounts to transfer funds.
Anti money laundering laws make it illegal to transact in a way that the financial institution is blind to the identity of the parties. If something illegal was going on, a subpoena from law enforcement could expose our identities. But since there is nothing shady about offering a private reward for vandalism, neither of us would need to know who the other really is.

DeleteThe massive "noise campaign" in Encinitas is not an isolated problem, it is nationwide. Check out Noise Free America for people all over the country complaining about the exact same noise issues we have here. We need better laws. According to SDSD I live in a "blue collar" neighborhood insinuating that I am just going to have to accept the scores of modified mufflers and revving engines passing my home all day and night. ReplyDeleteSealfit is out of control and needs to be put in its place. They have a right to exercise on their property but out on the street? Give the neighbors a break. And a bullhorn?? Could they be more rude and insensitive to their neighbors? Surely code enforcement should have already been all over them.
ReplyDeleteThey have more than earned a substantial fine by these behaviors and they are seeking to expand their permit beyond their property? How is that even possible? and noise ordinances are in place to deal with their bullhorn bs. It may be time to discreetly install some sound meter devices and catch them redhanded.
If they can't operate with some responsibility within their sizable property, they need to find another less sensitive location.
Some businesses seem to get away with so much and not pay a price whatsoever.

9:39am What is meant by That guy? It is the overbearing, rude and irresponsible behavior by Sealfit that cares not how they affect the neighbors that is the problem. If they are indeed acting this way, code enforcement should all over them.
ReplyDeleteBullhorns in that area is inconceivable, yet there they go. Taking their exercises out into the public street is inconceivable, yet there they they go. What will it take for code enforcement to do their job? That Sealfit has behaved this way in that space, may be only the beginning if they are not shown how to get along and respect their neighbors.
