Waves to Ride blog analyzes Prop T's impact on Leucadia

Waves to Ride:
The HEU doesn’t require three-story buildings to line Highway 101 in Leucadia, but if the commercial strip there is upzoned to allow them, you can bet at least some will be built.

Anyone who doubts that should check the six three-story mixed-use monstrosities that march north from the corner of Phoebe Street. They were allowed under the city’s North 101 Corridor Specific Plan before voters passed Proposition A.

After June 2013, Prop A required buildings above two stories or 30 feet to be approved by a vote of the people. Hence, only two stories since. The proposed HEU, affectionately called “At Home in Encinitas” by city staffers and council members, effectively cancels Prop A in designated areas of the city’s five communities.

If approved by voters, the HEU will upzone every parcel fronting on 101 from the Leucadia Creek Apartments at address 1786 to the north corner of Leucadia Boulevard at addresses 902/914 with two exceptions: Sea Bluff and Pacifica condos.

North of Diana Street, the HEU identifies the zoning as both AHE-GC-X30 and AHE-101SP-X30. As far as we can tell, the two codes mean the same thing: At Home Encinitas-General Commercial-Mixed Use 30 Housing Units Per Acre; 101SP = 101 Specific Plan.

North of Diana, the zoning will let property owners build three-story buildings that can be either all residential, or commercial on the first floor and residential on the second and third floors. Although the building heights will be limited to 38 feet, stuff on the roofs can push the heights to 48 feet. Developers of buildings with five or more housing units who invoke the state Density Bonus Law can raise the density from 30 to 41 units per acre.

  2. What could happen and what will happen are 2 entirely different things. Waves to ride is practicing FEAR MONGERING. W2R should be more concerned about the TRIPLE tracking coming to Encinitas and a train every 20 minutes, day and night.

    1. It is not "fear mongering" to expose plans that citizens do not agree with yet have to pay for! Many things that "could" happen have captured at meetings or found buried in staff reports were exposed to the public, and we said NO.

      I do agree that what will happen and what could happen are 2 different things.

      IN EVERY CASE, FINAL PROJECTS ARE ALWAYS WORSE FOR RESIDENTS THAN THEY ARE PRESENTED IN PLANS.

    5. Go watch last Wednesday council meeting. Kranz is speaking at the end of the meeting and mentions TRIPLE tracking and one train every 20 minutes, then Gaspar dismisses the meeting.
      Watch it and weep. You know nothing.

    6. Except that Kranz was speaking of the whole NCTD rail corridor from Oceanside to San Diego. He didn't specifically mention the Encinitas rail corridor for triple tracking. Cardiff is already double tracked and work will soon begin on double tracking across the San Elijo Lagoon. In all the SANDAG meetings triple tracking has never been mentioned for Encinitas. I wonder how much you know. Don't be a fear monger unless you have more specific information.

    7. Fear is a healthy response, sometimes, but we can release the fear by taking constructive action to defeat this phoney baloney ballot measure, with its blatant marketing slogan, @home Encinitas.

      They should have left the term mixed use in the ballot statement, and Glenn Sabine should include it in his so-called "independent analysis" sample ballot statement.

      The City Attorney's analysis is supposed to be based on facts, not speculation, as was his biased statement re Prop A, before.

      Will this be another Prop A measure, come November? Confusing, if so, but those in control appear to be counting on the general public's confusion and fear of judges' taking over our planning dept, our "local decisions." But if Council doesn't honestly represent its constituents' wants and needs, then we, as individuals and neighbors, have no control, anyway. That is something to be concerned about.

      It's logical to fear an increasingly deteriorating quality of life; we are reminded daily of quality of life issues by traffic delays and poorly timed lights, poorly planned roundabouts, one, in Leucadia too near the RR Tracks, and a stop sign, another roundabout, and 10 traffic signals, another, on Santa Fe, installed with an unsafe grade, which can block one's view.

      We have ongoing drought concerns, and worry about needing new tires (motor vehicle and bicycle), sooner, because of the City's long deferred road maintenance. We worry about long term, increasing, debt, unfunded pension liabilities, due to wage and pension inflation for City workers, particularly administrators.

      Many times, it feels as though there is so little we can do. But we can do our best to pay attention, and Vote NO on this disingenuous version of the housing element update, whatever letter it is assigned.

  4. The North Hwy 101 Specific Plan didn't require three-story buildings on Leucadia 101, but when the zoning allowed them, six were built at the corner of Phoebe.

    The Downtown Encinitas Specific Plan didn't require three-story buildings downtown, but when the zoning allowed them, Pacific Station was built.

    Prop A stopped three-story buildings unless approved by a public vote.

    Only a developer or a shill thinks three-story buildings (actually four stories up to 48 feet as Measure T is written) won't be built if the zoning allows them.

    Landowners/developers almost always max their profits. What is allowed to be built will be built. Count on it.

  5. One night when Jerome Stocks was mayor, the council was discussing upzoning to meet the RHNA numbers. Stocks said just because we upzone to allow high density and three stories doesn't mean those buildings will be built. Raucous laughter erupted from the audience.

One thing that JS and others who make the claim that what is allowed doesn't necessarily mean the "by proxy" projects will be built, is that the housing element must be updated every eight years or so, and if there isn't ACTUAL NUMBERS built of affordable housing, it is added to the next housing element update's required numbers by the State.

      This false claim is clearly designed to alleviate justified fear of over-densification of our city. Because we do not want three plus story projects, providing far below the actual affordable housing required, does not mean we do not want any change, anywhere, anytime, bozo.

  6. 12:50- Yes I remember Stocks saying that very same thing. The State has turfed the whole Housing Issue until next term. So, if anyone tries to sue us, that could be the reason to say "wait and see what the State says". Kranz did that the other night. Although I think he thought the State would weigh in during this term. So, for now, we can tell the BIA aka David Meyers to "go to hell" if the City had the cajones.

      You do realize that the train devides this city as nothing before or since. I-5 cuts the city but none of the intersections are closed with I-5. With the addition of double and triple tracking the only city on the coast not troubled is Solana Beach.

      Ok so now I'm not feeling so benevolent. You can change the conversation back to heights of your neighbors house. Btw, the entire length of 101 through Leucadia will be torn down and rebuilt. Every bit of it. It starts with the old Leucadia chiropractic building as they go 3 stories right on up north to Robertos. Of course you can stop all this advancement by purchasing every lot site and keeping it as is. But you won't. But hey, your dogshit brown library doesn't have a name and that's most important. Now you'll have to excuse me I'm going to Leucadia farmers market to ask people to sign a petition to Keep Leucadia Crappy.

    1. Its pretty simple. Catherine and Tony didn't listen to the folks they represent concerning the unwanted railtrail. 1500 Cardiffians cried foul. Catherine and Tony flipflopped on their original rail trail vote. Now 4 months later, Lisa, Tony and Catherine have created a Working Group to allow them flip flop again, only this time they will point to the working group and say,"We didn't decide this, our cronies did!" Allowing Judy to lead this group, someone who didn't even submit an application originally may be the low point of the Shaffer/Barth Citizen Academy/Conspiracy era. Staff says that Shaffer called the Mayor and tried to cram additional cronies on the working group the day after Catherine destroyed the original unbiased choices of the Consultant; which of course, would be illegal because it wasn't done in public. But when did that ever stop Lisa, Tony and Catherine?

      Without question, this is the biggest back-stab politically in the 30 year history of the city and will without question lead to Catherine's come-uppence and Tony Kranz's excommunication.

      Whether or not it was ethical, although I have my doubts about it's truthfulness, Shaffer talking with Gaspar doesn't violate the Brown act as long as the discussion only involved those two.

      "... tried to cram additional cronies on the working group the day after ..." Since the whole council voted on the group's membership, any additional members would also have to be voted on by the whole council. The council directed the commissions to nominate representatives but didn't direct the mayor or city manager to add any.

This agency is called ICE. Thanks to ICE Kate Steinle's killer in San Francisco had been deported.     I guess I missed that intention. I don't see that happening and don't understand why you do. The main reason the first list was tossed, you already know why. ssssssssssssssss

    The fear mongering that you spread by attempting to make people believe the trail will be moved again, is not going to happen. Look to SANDAG and the other involved agencies who have put up with it being moved back to the 101 already.

    It will be staying on the 101. You are spreading division with no evidence that the stakeholder group has any such intention. Can anyone imagine this city once again changing its mind and moving it off of the 101? Not going to happen and you know it. Considering the source and your chosen candidate, we should all not be surprised.

    The stakeholder group does have proponents for the east side alignment but our changing this off of the 101 is not going to happen and you know it.

    People, don't buy into this attempt to create a situation that does not exist. The trail is on the 101 and will be staying there.

    2. Well, what about the rail across the San Elijo lagoon? It's on the 101 Coast Highway. SANDAG said it was too expensive to put a separate bridge spanning the lagoon for the rail trail. Putting it along side the new double track bridge soon to be built is considered too dangerous.

      If the Coastal Commission approves the 101 alignment across the lagoon, why wouldn't it approves the 101 alignment through Cardiff? It's all politics on the part of SANDAG. I tend to agree with 4:00 PM that the rail trail will stay on 101. Even Lisa Shaffer, the bugbear in all of this, seems to have lost the tug-of-war.
