The pre-election surprise was the false allegation from Nichole Burgan. Fortunately, the San Diego Sheriff’s Office proved that Burgan was lying prior to Election Day but that didn’t stop Graham’s Republican opponents from trying to undo his advantage; Maureen “Mo” Muir started a whisper campaign, through surrogates, to try to rescind Graham’s endorsement from the Republican Party. Meanwhile, labor unions trafficked direct mail pieces about Burgan’s false claim and ran Facebook ads to discredit Graham. It looked like the Democratic-Labor Complex had successfully executed a hit job on Graham.
This past summer, The Voice of San Diego published an exposé about the FCC investigation into Ken Moser. In that investigation, Moser named Encinitas Council Member Mark Muir, husband of Graham’s Republican opponent Mo Muir, as the source of the the content for the robocall campaign against Graham. I questioned any and all people associated with the Muir campaign, here on San Diego Rostra, about the veracity of Moser’s accusation. Every single person I questioned denied knowledge or involvement with the libelous robo-call scam except Mark Muir.
Mark Muir danced around the question, first claiming that the robo-call campaign was not libelous. Then, Muir rationalized the campaign before thrice avoiding the question about whether Moser was lying about him being the source of the content. Muir knew better than to deny Moser’s claim because Moser provided the media with the email with the audio file, sent from Mark Muir.
Moser is also the guy who files FPPC lawsuits against political activists in Encinitas and elsewhere. Muir is still the reigning pension champion of Encinitas, pulling in $196,114 per year.
Between March 1st and July 10th, 226 restaurants permanently closed in San Diego County.

ReplyDeleteThe usual suspects should be very, very nervous. Perhaps some other ex-council members will be named? Ex mayors, even? Perhaps a some local unpopular developer? Bet these jerks are on the phone to Moser advising him to clam up as we speak.

The is an old story about Ken Moser and his operation. The Unions, PAC's (who spent around 200K on this specific story), Newspapers and News Stations all jump on Graham's late night encounter (in of itself should question his judgement). News Break - It's not uncommon for candidates from the same party to question their opponents. If all of this came out before the witness recanted her story under tremendous pressure, where's the lie?

Moser's fine is over spoofing another vendor to make it seem like the calls were coming from the other guy.
Did Graham exercise poor judgment? Did the woman lie and rightly go to jail as a result? Yes to both. At this point though the pair are red herrings to the real story: Moser and Muir.
Fingers crossed that Moser spills more names I agree.

The woman who accused him of sexual assault admitted her lie and only got two days in jail and 3 years probation. This reminds me when a woman gets raped and people ask "What were you wearing?" Graham's on to something, and I hope this little cabal is exposed.
ReplyDeleteI read the report. Moser sent out 1 robo call “before” Graham was vindicated and it was under $1,000 (reporting not required). Unions and PAC’s sent out over $100K on the same message. Moser also said that he has done work for Graham in the past. The issue here is that another vendor accused Moser of using his numbers and interfering with his operation. These 2 vendors have been fighting each other for years.

According to VOSD, the robocalls started March 30, a day after the Sheriff cleared Graham.

ReplyDeleteThree years ago, I was also falsely accused of the same vile offense. The woman who accused me pled guilty and went to jail.
But former Encinitas Deputy Mayor, Mark Muir, and San Dieguito School Board President, Mo Muir didn’t care. Mo Muir was running against me for a State Assembly seat and wanted to destroy my reputation, no matter the facts and no matter the consequences.
The Muirs paid for 47,000 robocalls to be sent out to North County voters, labeling me a rapist (after I was exonerated by the Sheriff), and telling the voters not to vote for me. The person they paid to make the robocalls was fined $10M by the FCC. The Muirs, on the other hand, got off scot free.
It also led to my personal and professional lives being completely upended, not to mention a significant financial burden.
As you might imagine, the Muir’s disgusting tactics allowed a leftist to be elected to the 76th Assembly seat, the seat I was running for. This was the first time a non-Republican had ever held that seat.
Beyond how it affected me personally, it also had a distinctly negative effect on our political process. I was told many times that good candidates for office decided not to run because of what happened to me. They would say, “If my opponents are just going to make up the worst possible things about me, with no accountability, why in the world would I run for office?”
My hope is that this article will help do two things. I want to close this chapter in my life. More importantly, it’s critical that people like Mark and Mo Muir are exposed and their destructive actions made public. It shouldn’t matter what your political affiliation is.
These types of scorched earth tactics of personal destruction have no place in our society or in our politics. I feel the same way about the normalizing of people protesting in front of elected official’s homes. It wasn’t too long ago that these things were unheard of.
For the sake of our general civility, our democratic political process, and the future of our country, these reprehensible actions must stop!
