Paul Gaspar fingered as man behind sham charity

Recently, we marveled at the gall of some shadowy new group to take charity money and use it for blatantly transparent political purposes. We can now add self-serving to that charge, and put a face to that seedy group.

From the California Secretary of State's web site:



None other than Paul Gaspar, husband of city council member and Jerome Stocks acolyte Kristin Gaspar.

Really, Paul?  Using a charity to send out campaign propaganda didn't trigger even the tiniest sense of shame?



Incidentally, Kristin Gaspar's 2010 election campaign was heavily funded by out-of-town physical therapists, who presumably had a lot more interest in currying favor with Paul Gaspar as director of the California Physical Therapy Association than they had in wayside horns for Encinitas.

Bonus Thought: If Paul Gaspar plays this fast and loose with IRS rules on 501(c)3 charities, what else might he be pushing the envelope on?  An enterprising IRS auditor might want to find out!

    1. As far as I know, Encinitas Neighbors never filed as a charity or took tax-deductible contributions.

      You do raise some legitimate questions about their activities and whether they completed all the necessary paperwork filings, but I don't have the answers to those questions.

      I would have scrutinized Yost / Encinitas Neighbors more closely if she were a serious candidate. She wasn't.

      If Yost comes around next time with better knowledge of the issues and a more serious campaign, I would expect she would distance herself from rookie stuff like that Encinitas Neighbors e-mail.

      Their Dump Stocks signs and magnets were everywhere. They influenced an election. How was their message less political than We Love Encinitas', 97% say they love Encinitas, campaign?

      If by "non-profit" you mean only that it's like every other campaign and PAC in that it's not a for-profit business, well, there's nothing unusual about that.

      But if by "public benefit corp" you mean she was registered as a charity and using tax-deductible funds like We Love Encinitas, I would be very surprised.

    4. It could not be a PAC. That would be outright illegal. Candidates can not run PACs.

      Yost and Aronin ran it as a charity just like Gaspar. How many of Lisa's supporters gave money to that shady group?

    5. There is a big difference between ordinary not-for-profit organizations and tax-deductible 501(c)3 charities.

      I highly doubt Encinitas Neighbors registered as a 501(c)3.

      In terms of keeping the money trail more cloudy, is there any difference?
      In terms of a candidate being able to skirt the contribution limits and prohibitions on candidates coordinating with PACs, is there any difference?

    7. Encinitas Neighbors (as well as Leucadia and Cardiff Neighbors) are autonomous affiliates of the North Coast Civic Assn. Appropriate registration documents are on file with the San Diego County Clerk.

      The North Coast Civic Association (NCCA - www.coastcivic.com) was formed in 2007 as a California non-profit public benefit corporation. As such, its political activity is severely restricted. NCCA files an annual report with the Secretary of State., as legally required. The group's mission, principles and advocacy are published on its website. The purpose of the group is to educate and inform the public regarding its advocacy of integrity, intelligence, accountability and civility is public affairs. NCCA promotes conflict resolution, collaboration and coalition building as constructive civic. Conflict resolution workshop information is available through the website.

      I'm one of the founders of NCCA and, currently, its president.

      Encinitas Neighbors was formed several years ago in response to the city's persistent approval of non-conforming development projects that intrude on neighborhood and town character. It advocates for neighborhood rights, cohesion, communication and coalition building. Encinitas Neighbors is attempting to bring neighborhoods together for mutual support to protect and preserve neighborhood and town character. Its political activity is limited to advocacy for these purposes. I am one of the founders. Currently, Barb Yost is president.

      Barb Yost decided to enter the race for city council member in August - a week before filing. Prior to her decision, she and other members of the Encinitas Neighbors Steering Committee met with select candidates in the hope one (or more) of them would make neighborhood rights a part of her/his platform. The effort was unsuccessful. Subsequently, she entered the race to assure protection and preservation of town and neighborhood character was a major campaign issue.

      Barb asked me to become her Campaign Manager. I accepted - not only because of her position on neighborhood rights - but also in belief the council would benefit from her integrity, decency and fervent desire to listen to the views of the community on all issues. Barb's a sweet, kind and caring person cares deeply about Encinitas and its towns and neighborhoods. She's a dog-lover and her home-made fudge is quite popular.

      Barb formed a campaign committee in August and filed it in compliance with campaign law. It's reports are public - as are those of all candidates.

      The DUMP STOCKS campaign was a project of Encinitas Neighbors which was clearly noted on the website www.DUMPSTOCKS.com. The campaign purpose was to inform and educate the public about Stock's anti-neighborhood actions and positions. The city ruled the DUMP STOCKS campaign wasn't subject to campaign rules because it wasn't election-specific and was covered by the 1st Amendment Right to Free Speach.

      As public reports will verify, no funds were intermingled between Encinitas Neighbors and the Barb Yost Encinitas campaign committee. All contributions to the DUMP STOCKS campaign were deposited in an Encinitas Neighbors bank account and used only to promote the DUMP STOCKS project. Separately, contributions to Barb's campaign were deposited in her campaign committee's bank account and used exclusively to promote her candidacy.

      I don't really know you, but thank you! for recognizing the danger that drunk-with-little-power Jerome Stocks represented to our fine city, and actually doing something about it! That was HUGE!

      I believe you helped bring down this most divisive mayor that Encinitas has ever had. Barbara, run next time for council, but give people more time to see who you are. If they had, Stocks would have had fewer votes than you, without doubt.

    That's like saying that Muir and Stocks being recorded violating campaign laws is equal to citizens putting campaign signs up early.

  7. Did Paul Gaspar and contributors pay for the Satisfaction Survey that was used in the mailer? We taxpayers are on the hook for the $20,000 survey. We paid nothing for the Dump Stocks campaign. Both campaigns may or may not have been legal. What is very clear is the ethical lapse in the Gaspar camp. Taxpayer money was used to support both Stocks and Muir. Don't forget that Teresa Barth's photo was left off the second mailer praising the council. This showed the bias of the mailer.

  8. Perhaps the way to attack this is to utilize the IRS whistle-blower program. The IRS offers a 30% bounty on tax fraud cases. I have a feeling that this would likely violate the guidelines as a 501(c)(3) charity. Perhaps it would also involve Gaspar's business (which would be the much larger prize for an aspiring IRS auditor).

Very disappointing from Gaspar to be behind this. I will remember that in 2014. Her turn will come. We need a complete flush of this council. We are almost there.

I heard the rumor that the surreptitious fake mailers were organized out of Paul Gaspars offices at Gaspar Physical Therapy, 700 Garden View Ct, Ste. 103, all under the guise of a non-political, equinanimous-sounding, non-profit organization. Very sneaky, Paul and Kristin. It's not nice to fool Mother Nature. Or the citizenry of Encinitas. Tsk, tsk. May come back to bite you.

  12. When Kristin was running for Council I received emails from Gaspar Physical Therapy, where I was once a patient. I could not figure out how he got my email and why he was using it to promote Kristin, which would have been illegal because is a violation of patient confidentiality. I called him and he said he had never done that. Now, I have to wonder.

If you were ignorant to his evilness, then you may be forgiven. If you support him knowing what he is, then you deserve the outcome for supporting the devil of encinitas. It's that simple. Out Gaspar in 2014!

      The Coast News is the watchdog of Encinitas. Without a strong voice for the people, bums like Stocks would be allowed to continue to control the false perceptions of the community and= to fool the masses into thinking that he actually cares about this community.
      What does the Coast News have to gain from reporting the truth? Maybe a few readers who are thankful to have seen the light.
      Boycotting advertisers would affect hard-working people who work at the paper and their families. Not a nice thing to suggest, and very off-topic for this blog. Andreen?

      He behaved just as badly this election season. Building your own shadowy political website, running ads and printing bumper stickers all with a "political organization" behind them is not "watchdog" journalism, its pulling a fast one on the public. That is not ethical.

      I don't like Andreen, Stocks or Gaspar, but Jim did no one any favors either by doing what he did.

      Imagine another four years of the insufferable Jerome Stocks? the most divisive mayor this city has ever known! No. It would have torn this city apart. Jim Kydd did not make his own truth. Au contraire, my friend - he only reported it writ large. He brought to the forefront the truth about the characters who were running our city government, plain and simple. I would have no problem sleeping at night if I was Jim Kydd.

  29. The FPPC suggested that the Dump Stocks' bumper stickers and signs were considered free speech and not campaign signs, per se.

    I feel that Encinitas Neighbors is a small grassroots group, taking in less than $1000, so it didn't have to register as a political group or a non profit. It certainly wasn't taking or giving tax deductions. WCV is right on, I think on that issue. Perhaps some of the printing services and paper was donated, but NOT written off?

    Just imagine, people acting with self integrity and self authority, not under rules that are twisted for more control, regulations and restrictions and policy that benefits the few for their short term profit at the expense of our common space, freedom, and shared dreams.

    The non-profit issue and their cozy relationships of a few of them with Councilmembers and the State of our City should be explored through agenda items, including the Sunshine Ordinance, which should be agendized ASAP, under the new Council.

    The City should not subsidize certain private contractors, private businesses, or non profit associations except through their all applying, yearly, for grants or contract renewal.

    There is a separate, related issue here, about that bogus survey being taken, to begin with. That was a direct subsidy to ALL the incumbents on behalf of our overpaid City Manager Vina. I appreciate his name, because my grandfather was Augustus, aka Gus, but he is paid 20% more, at least, than need be. Hopefully he will try very hard to implement the policies of the new Council, one of which should be more separation of powers, more checks and balances. Not so much greasing of palms.

  30. This bogus survey mentioned above works hand-in-glove with the specious "We Love Encinitas" mailers that were mailed out.

    There needs to be an investigation of some sort regarding the relationship between these two. It epitomizes the back-room dealings of what had been going on behind the backs of the Encinitas citizenry. Two negative influences from our city council have recently been removed, but two of their proteges still remain. This is a strong cause for concern, as both are strongly perceived to have been part and parcel of these back-room dealings. (Ms. Gaspar, especially, we're waiting for you to take some ownership here vis-a-vis the surreptitious "We Love Encinitas" mailers with your husband, or risk being hounded from office for the next two years.) Inquiring minds (who desire open government in Encinitas) want to know where you stand on things.

  31. I understand that credible persons are in contact with the FPPC. The commission is interested in certain activities that have been going on in Encinitas. Ms. Gaspar has been directly connected with the mailers. It remains to be seen whether there are illegality involved, but I wouldn't place any bets on her escaping unscathed.

Really what I'm getting at is that Coast News basically entered the race as its own political action group, which is not professional journalism, I don't care what the Big Cats (Murdoch and now Manchester, and others) have done. Just because they behave that way doesn't make it right, and it annoys me that people seem to buy into it as being okay, and accepted behavior of news people.

    2. Remember $tock$ came in just after Muir vote-wise. Had $tock$ not brought in his buddy as a council member replacement, he'd likely have been reelected to a 4th term! Muir would have been an unknown and couldn't have rode the brief incumbancy advantage. Fortunately there were enough voters to vote in Shaffer and Kranz; Yost would have been preferrable to Fats Muir. Muir will be listening to $tock$ handlers for directives (as does Gaspar).

  40. If Barb Yost hadn't entered this recent race so late and/or had been more prolific Stocks would have come in fifth. I.e., she wasn't that far behind the toxic Stocks - he just had more name recognition after 12 years, and many people who weren't paying attention to what's been happening during his tenure simply went with a name they recognized.

    1. Jerome, that you again? Remember "your" in this case (you made this mistake earlier in the thread) is spelled "you're" in this usage.

      What I was saying was that people, in the aggregate, who voted for Jerome Stocks were likely not paying attention to Encinitas politics and voted by rote. Got to admit, he garnered embarrassingly low numbers for a longtime city council person, never mind current mayor. He became too attached to his little powers and forgot that he worked for the people of Encinitas. Thankfully, like water seeking its own level, enough people became aware of it. The rest = history.

  45. Yes, we DO live a great city, but this current city council has very little to do with that quality of life here, which was here way before any of them were on this council. Dr. Gaspar, you promoted your wife and Encinitas Prince of Negativity and Darkness, Jerry Stocks, and then you tried to cover your trail. Alas.

    Btw, we didn't need you to remind the citizens of Encinitas what a wonderful place this is - especially right before an election! You can see how this smacks of being political. And then you and your wife not 'fessing up? Tsk, tsk, tsk. People will remember you and your wife for this.

  46. Jerome didn't lose because of Anyone but Jerome Stocks. Jerome Stocks, the RINO, is his own worse enemy. His worse decision was to cuddle up next to Mike Andreen. Those two are poison. Gaspars already have been soaked in the poison. Lets see if they live. I see them as being on Life Support. As for Muir...... he can live the fat life forever with $170,000 a year of taxpayers money forever. With our council finally address pension reform, now that the RINO is gone and responsible people are in office?

    1. Exactly! Stocks lost because many individuals and groups GOT THE WORD OUT about him. He lost because his PAC hit pieces and last minute campaign mailers against Tony Kranz DIDN'T WORK! Personally, I will be forever grateful to EVERYONE who made it possible for us to finally vote Stocks OUT OF OFFICE.

      The DUMP STOCKS campaign was very effective. For that I thank Bob Aronin and Barb Yost AND ALL OF US who put bumper stickers on our cars, and signs in our yards. Part of the reason it was so effective is because Encinitas Neighbors, Leucadia Neighbors and Cardiff Neighbors had the wisdom and foresight to start that grassroots movement about a year before the election.

      People became more aware of Stocks' incivility after the way he treated Maggie Houlihan, the debacle over his banning banners in the public right of way for six months, all because the Artists' Colony wanted to and finally was able to display her image on the back of the Arts Alive Banners, in tribute to a recently deceased, beloved community member.

      Also, more and more became aware of Stocks' incivility to Councilmember Teresa Barth, in engineering her being skipped over in rotation for mayor three times in six years. Yes, the code allows for appointment by three; but until Teresa, the tradition was a yearly rotation, giving all duly elected Councilmembers a chance at being mayor. In 20 years, Bond was skipped over twice I believe, and part of that was because he had thought he was going to run for State Assembly, or he did run? Anyway, twice he said he wasn't going to run for Council again, then changed his mind, at the last minute. His own plans were why he was skipped; thank God he finally retired.

      Most of all, Stocks got the reputation of being a bully, of being uncivil to public speakers. His power on SANDAG and NCT seemed to go to his head. I'm very grateful to Jim Kydd and the Coast News, to everyone and anyone who worked to inform their neighbors, the public about the "goings on" at City Hall. It's easy for some anonymous poster to criticize the Coast News, but everything it did was within its rights of freedom of the press. Jim did a service to our community. A newspaper can have a strong editorial opinion. Don't read it if you don't like it!

      What was wrong, to me, was that the publication, Encinitas First, was so strongly subsidized by the City of Encinitas through the Chamber of Commerce, which affected past elections. To me, the danger is when non-profits and private individuals, contractors, or corporations are subsidized by the City and become like a "second wing" of our City, another arm of the government. We do need more separations of powers, more checks and balances.

      The We Love Encinitas non-profit group, which we now know, thanks to Marco Gonzalez and the Coast News, was set up through Paul Gaspar, used the survey which ALL the public speakers practically BEGGED not to be taken so that the results would be published right before the election, as another tool of the incumbency, to support Jerome Stocks, and all of the incumbents, with the exception of Teresa Barth, whose picture was left off, who was NOT quoted as loving Encinitas. Because she was left out, it became partisan. It became political.

      One of the first agenda items under the new Council after they are sworn in on December 11, should be to somehow regulate City subsidies to non-profits. That bogus survey was just another subsidy for them! Within this discussion of curtailing City subsidies to non-profits, unless they apply yearly, for community grants, we should also renegotiate and discontinue the contract for election year surveys, an obvious subsidy for any non-profits or PACs supporting incumbents.

      Again, all private contractors, businesses, individuals and non-profits should have to be vetted YEARLY by applying for a new contract or a new community grant, in the case of non-profits.

Thank you for a sensical, honest (and well written) assessment of the political antics of this soon-to-be former Encinitas City Council, who have brought shame and divisiveness to our Paradise by the Sea. That will be changing now, thankfully. Still, it's difficult to forget that the Gaspars and the well-off Muir (thank you citizens!) were directly implicit in all the misdealings and untruths and negativity and power grabs. It sticks in the craw.

  49. Oh wow ...The city of San Bernardino has cut it's budget by a whopping $26 million, an austerity move. How long until COE is doing the same thing??? Biggest problem in SB...They can't pay for their employees retirements. Hmmmm.....

  51. Mark Muir, excellent navigation and working of the system. I.e., this "system" as it stands now needs some retooling. This is wrong for so many reasons. Encinitas taxpayers' money going for years and years into the future to help these gentlemen live oh so handsomely. No wonder these guys are trying to grow Encinitas into a monstrosity: They're going to depend on these funds for years and years to come. Watch how the votes go, folks. Fortunately Dr. Evil (Stocks) and Minnie Me (Bond, James Bond) are history.

    These guys were willing to throw the Encinitas quality of life under the bus under the guise of being "pro business." Looks like, on the face of it, more of a case of "self-interest" from this vantage point.

  53. Very odd meeting. There was an unagendized presentation of plaques, thank yous, and certificates to Bond and Stocks. Usually this is done when the new members take the oath of office in December. Small audience, only light applause, and a lot of staff. Mayor Stocks asked Jackie Bond (Jim's wife) to lead the Pledge of Allegiance, but Jim led it. I guess he hadn't turned up his hearing aid.

    I understand Patrick Murphy will be retiring in December. Another rat jumping ship.

  54. Please, God, I hope Patrick Murphy WILL retire. That would be a MOST WELCOME development. We need fresh perspective in the Planning Department, as well. It was uncomfortable to watch Patrick Murphy kissing up to Stocks and Bond, representing all of staff at the Council Meeting. It was strange to see it happening, when it was NOT agendized, and certainly should have been done during the regular Council Meeting, not the SDWD Meeting.

    Some suspect that Stocks and Bond could be absent from the meeting on December 11. I hope so, now.

    1. This sounds surreal, but what else could you expect where Patrick Murphy is concerned?

      I think that he got them thank you gifts for not firing his ass over the Updated General Plan and the other string of problems that he has caused this City. There are 7 city planners who are paid over $100,000 per year, and non of the seem to have basic skills and credentials in the field.

      He should take the entire Planning Deparment with him since they are disgrace and a poor reflection on the rest of the City staff of Encinitas. This deparment is so bad, that Gus Vina should lose his job for their consistantly poor and unacceptable performance!

  59. Muir is the poster child for grandiose pension excess. $170,000+/year for retirment!! Outrageous! The new council must put salaries and pension benefits in line with fiscal reality. Fire the Planning Department and have a long look at the city manager - his salary should be cut. Stop the abuses now, before Encinitas is underwater.

  62. Thank you for helping to start this process. No more fleecing of Encinitas by the Gaspars, both of them. That was some shady business, hiding behind those fake non-profit "We Love Encinitas" mailers and ducking cover whilst the controversy swirled about who had spearheaded it. Sneaky and shady. Waiting for one, or either, of the Gaspars to own up. People are forgiving to people who own up to their stuff. Let us see what they do, these Gaspars. All ears are open.

    If Councilperson Gaspar does not address this to the citizens of Encinitas before the end of 2012, then let the "Dump Sneaky Gaspar" campaign begin in earnest. 2014 elections will be here soon enough. Many feel already that this lady is vastly unqualified.

  66. Gaspar used his MORALS PAC to supposedly get Mary Hayashi out of office for the San Diego Republican committe and the Board of Equalization, said money was used for flyers against Mary Hayashi, but none were really sent out, took money and used to promote his wifes political interest.
