Residents rip council and staff deception and stonewalling on Measure T

Wednesday night's Council meeting saw four Oral Communications speakers, all of whom opposed Measure T and some of whom were scathing regarding the city's handling of the issue.

Watch here, beginning about minute 43.  The first and last speakers are particularly informative.

  2. If T passes, Planning Commission and Council will affect what is built. If T fails, a new Measure will be developed. Either way, remember who is being funded by the developers, and property owners who stand to gain. Just look for their big signs.

  4. No more noise. Let's just vote.

    It doesn't matter how you vote. We will be brought into compliance with state law either voluntarily (cheaper and faster) or involuntarily (expensive and painful).

    Some would have us believe that a no vote starts the process over. If so, what happens if the next version of the HEU is voted down? Do we hit the reset button again? And what if that next one gets voted down? Another reset? And the next?

    That sounds great, because it allows us to ignore state law forever with no consequences. Brilliant.

      The city has failed to produce a plan that represents the majority of residents and complies with state law.

      Instead, city staff has produced a plan to benefit developers, relatively few property owners and themselves.

    2. Yes, yes, and yes. This is why so many other cities are going the prop A route. out of compliance is better for everyone except those corrupt ones who lose money when it gets voted down and have to start the bribes all over again to keep the wheels moving. A fool and his money, errrr, a meyer and his wife's money.

      Furthermore, it is clear why staff and council cannot get a plan passed and they have broken laws in their attempt. They are in a position where they now can face civil action from both the citizens and developers. The criminal courts can get it straightened out though, then we can get to,work on a real plan.

    3. I understand 9:26's frustration. If T fails, which I think it will, it will be because the average voter will err on the side of caution to prevent any kind of overbuilding and increased traffic. The measure really reads poorly and will fail on its own! But in the aftermath, I don't have much hope that a better plan will be created. The "smart opposition" (and that's exactly what I mean - those people who have the knowledge and skill to actually craft an alternative plan) does not have the political clout to install like minded decision makers on the council. It's a battle of impotence! Very frustrating.

      As I have pointed out before, the latest compliance report shows that there are 448 housing elements that have been blessed by HCD and adopted by cities and counties. And they all look very similar to Measure T.

      I'm a reasonable person, and willing to change my vote if someone can show me an example or examples of specific HCD approved housing elements that contain aspects that constitute a "real plan" you would back.

      Over and over, no one will take up the challenge, because you either want to believe in some fantasy solution, or you really don't want a solution.

    5. I have read through a handful of adopted plans and disagree with you 10:49. It gooes beyond just the plan, other factors already in place contribute to the plan but domt need to be expressed in the plan. While, admittly a very small number, grannyfalts are counted. In this town they do eveything they can to not count them so the developers get to build more units.

      Also, this current plan will only force us to upzone even more (again, great for the developers) when this current stinker fails to produce affordable housing. So next cycle we can plan on more upzoning because the citizens were hoodwinked into approving a developer givaway.

      Granny flats are now easier, by right, and should be counted. Brown upzoned the entire state to plus one affordable unit. MANY studies have shown just how accessory units Are the best option for supplying affordable housing AND makes housing more affrodabke to purchase. They should be counted toward our allotment and on Jan. 1st thousands of Encinitas single family residents will be effectively upzoned. Rememeber, just like Strong told me, we just need to have the zoning, they domt have to be built. Strong is wrong, but he knows that. They do need to be built or are added to the next round. Strong and the rest of them should be fired or sued personally in civil court for the lies they spread, which have cost this town MILLIONS and will continue too when T fails.

      Furthermore, legal,challenges to the law have yet to shake out. Encinitas would be better served to remain out of compliance. Payoff the most hated guy/family in Encinitas if that is what it takes but Encinitas should make it clear we are willing to bring the fight. Prop A has been copied by a handful of other cities for a reason, its a smart solution to city coruption(free kitchen anyone?).

      Cue the city rebuttal which will have nothing to do with anything but fear mongering....

      You should change your vote to NO for a few reasons. Principle, what kind of pussy gives into lying wannabe bullies. 448 approved plans and none of them resemble our small coastal town with open space, they mean nothing to us. Nothing will change if we are out of compliance, a lot will,change if it passes and there will be no going back. A yes vote is a vote for corruption, special interest, and rewards those who are actively try to screw you. We can demand they at least use a little lube so it does not hurt so much.

      Vote NO on non-State required developer giveaways at the expense of our community character, quality of life, and future voting rights.

  7. There is a great commentary in today's (Oct. 14, 2016) Coast News, by a local attorney saying why voting NO on T will not land us in court, or get us sued. Since I don't have the online version of Coast News, I can't post it. If anyone does, maybe you can post it.

    Sue in the name of affordable housing even though the plan will produce no affordable housing. The evidence is clear that this law has produced a negative number of actual affordable housing. Its just a scare tactic to bully voters into a yes vote. It is not the residents fault the city can not produce a fair plan. If marxo is suing on behalf of the residents then good for him. Pretty sure he will be suing everyone he can just collect fees, just like the fireworks. Nothing more then a hustler with a crappy law degree. Is Briggs a pig too? I have wondered about him before. Marchoe is probably busy creating the front nonprofit right now.

    Lets offer a settlement that includes a provision that requires actual affordable housing be built. No buying out of it. Every offer to settle should not include money, only provisions for actual affordable housing. That should satisfy anyone suing in the name of affordable housing.

    What loses have he or the affordable housing bullies suffered? No city is building anything considered affordable. prop T is even more greedy then most.

    Or just pay the pigboy off, its still better than 4000 LARGE four story buildings. Maybe with him suing all the cities they will actually ban together and change the law or take it to the supreme court.

    Or maybe he donated to a few campaigns and knows he will get a big fat settlement ala taxpayer. He wants in the hustle.

  10. I went back and watched the public speakers during oral communications. They were all excellent. I'm so glad we have involved, concerned citizens willing to speak out.

    What bogus Measure T and the analysis by staff don't take into account is that the City is operating on the false belief that existing affordable housing has already been counted. Any plan that I could support would have to go back and reassess the number of existing accessory units, which should be automatically counted as affordable housing. In fact, with the new State laws recently put in place, and existing Government (California) and Encinitas codes, our city could make a good case that we already have the required number of units for potential affordable housing or "by proxy," without forcing densification and upzoning citywide.

    Also, the City needs to reassess projected population increases. SANDAGs numbers are off for us, and other cities. SANDAG has far too much control over us, and I'm hoping everyone will be voting NO on the bogus tax increase as well.

    1. A pending land use agenda coming up will be the rezoning of parts of the now protected Cleveland National Forest. This dwindling open space is the last stand for native flora and fauna and is used for recreational hiking. Greedy developers want to start to jam housing into the foothills and valleys of this vial land resource and Gaspar will be first to champion that cause. She is dangerous to the future of this county!
      Gaspars need to be trounced at the polls to end their political careers.
