A Village Park 7-11 market will continue to be barred from selling alcohol due to the property’s unusual zoning status, the Encinitas City Council decided last week.
Council members unanimously upheld an April 17 decision by the city’s Planning Commission that declared “off premises” alcohol sales — ones where the purchaser buys alcohol in one place, but consumes elsewhere — are not allowed in what’s known as a “limited local commercial” zone.
The market’s attorney, Bruce Evans, had argued that it ought to be granted permission to sell alcohol because a Rite Aid store in a similar zone — a local commercial zone — was granted this permission in 2006.
“I get that it’s a different zone … but these are very, very similar (zones) in their description,” Evans said.
Mayor Bruce Ehlers, a former city planning commissioner, said the Rite Aid, which was located on Manchester Avenue and has since closed, gained its alcohol sales permission under an old interpretation of city zoning regulations.
“In other words, there’s no path to get alcohol” in either of these two zoning designations now, Ehlers said, later adding, “This isn’t my first time where we’ve had old interpretations (that) were determined not to be in compliance with the (current) law.”
Councilmember Marco San Antonio, who lived as a child near the 7-11 store but now lives in Olivenhain, supported Ehlers’ position, but said he had sympathy for the market’s owners. Their profit margins as franchise owners are so narrow and alcohol sales would certainly help, he said.
“I feel for you guys,” San Antonio said. “7-11 is definitely a tough corporation to work for.”
The store’s situation — a commercial entity surrounded on three sides by homes — and its unusual zoning reflect its history. Located at 1988 Village Park Way, the market is one of two properties in Encinitas with the limited local commercial zoning classification, city associate planner Fran Carr told the council. The market building predates the city’s incorporation in 1986, a city staff report notes.

My whole life there was a tacit agreement between the political parties to intentionally make it easy for immigrants to come here illegally. They each had their reasons. Lefties were bleeding hearts trying to live out the words on the Statue of Liberty. There were also a lot of Republican business owners who needed people to do the dark, dirty and dangerous jobs in restaurants, construction, agriculture, landscaping, etc. Populism and othering made it politically impossible to legalize the agreement, but there was certainly backroom deals that made it happen.

And the people who came were mostly good, and strong risk takers. Imagine leaving your home, your family, friends—to go to a place with $10 in your pocket. Where you don’t speak the language; don’t have a place to stay.
We have a good family friend who was an ER doc in the Navy. He used to pull shifts at Scripps Encinitas. He was as right wing as they come, but he relayed a story that played out over and over in the ER. An immigrant would come in with injuries to the hands from doing the dangerous manual work most of us wouldn’t do. He’d assess the situation then explain that the injury requires surgery, followed by weeks of rest to let the wounds heal. Over and over, nearly every time, the patient would ask: if you amputate the finger(s), can I go back to work tomorrow?
I think about this a lot. These are the kind of people we are demonizing and throwing out. Tough, strong, hardworking people.
And again, people we lured here with winks and nods behind closed doors in the Capitol.
I can accept it if the national consensus is to close the border. I don’t love it, but I can accept it.
What I can’t accept is the brutality and meanness toward good hardworking folks who were lured here and have been making positive contributions for years.
That is just wrong, and we should all fight it.

I know from connections working at Paul Ecke that Mo Muir abused her power on the school board to get Stocks’ kid into the program sidestepping the lottery. The benefit of being fluent in two languages helps with college admissions and beyond. This was a benefit conferred by our immigrant neighbors in Encinitas, and it was not lost on even the most right wing politicians at that time.

A Village Park 7-11 market will continue to be barred from selling alcohol due to the property’s unusual zoning status, the Encinitas City Council decided last week.
Council members unanimously upheld an April 17 decision by the city’s Planning Commission that declared “off premises” alcohol sales — ones where the purchaser buys alcohol in one place, but consumes elsewhere — are not allowed in what’s known as a “limited local commercial” zone.
The market’s attorney, Bruce Evans, had argued that it ought to be granted permission to sell alcohol because a Rite Aid store in a similar zone — a local commercial zone — was granted this permission in 2006.
“I get that it’s a different zone … but these are very, very similar (zones) in their description,” Evans said.
Mayor Bruce Ehlers, a former city planning commissioner, said the Rite Aid, which was located on Manchester Avenue and has since closed, gained its alcohol sales permission under an old interpretation of city zoning regulations.
“In other words, there’s no path to get alcohol” in either of these two zoning designations now, Ehlers said, later adding, “This isn’t my first time where we’ve had old interpretations (that) were determined not to be in compliance with the (current) law.”
Councilmember Marco San Antonio, who lived as a child near the 7-11 store but now lives in Olivenhain, supported Ehlers’ position, but said he had sympathy for the market’s owners. Their profit margins as franchise owners are so narrow and alcohol sales would certainly help, he said.
“I feel for you guys,” San Antonio said. “7-11 is definitely a tough corporation to work for.”
The store’s situation — a commercial entity surrounded on three sides by homes — and its unusual zoning reflect its history. Located at 1988 Village Park Way, the market is one of two properties in Encinitas with the limited local commercial zoning classification, city associate planner Fran Carr told the council. The market building predates the city’s incorporation in 1986, a city staff report notes.
