Half a mayor

In last night's meeting, the Council decided to give Teresa Barth half of the next year as mayor, and Kristin Gaspar the other half.

Apparently, the Council's unanimously approved city attorney Glenn Sabine didn't bother familiarizing himself with the city code on the issue before the meeting.
2.20.020 Presiding Officer

A. On the second Tuesday of each December, the City Council shall choose one of its members as Mayor and one of its members as Deputy Mayor. (Ord. 2010-09)

B. The Mayor and the Deputy Mayor shall serve a term of one year, or until a successor for each position is chosen. Three affirmative votes shall be required to choose or change the Mayor or Deputy Mayor (Ord. 2010-09).
But who cares about law or good public policy? We have council members who get along with each other, and isn't that what really matters?

In other news, the council decided not to have an open council meeting about the city's pollution of Rossini Creek at the Hall Park project. Apparently, getting fined by a regulatory authority for repeated, reckless practices that pollute the lagoon is just like being involved in a lawsuit that requires confidential strategy discussion. So the public will receive only a carefully crafted "informational presentation" on December 18 rather than an open, honest discussion of what happened.

  1. No wonder Sad Sac is running the circus show including the complete waste of time meetings of the "strategic" planning meetings. The only thing strategic about the planning is how each month he gets closer to his big fat retirement check at over $200,000 a year forever as you stupid citizens have zero money for any needed projects throughout town and are left with a regional sports park that will make the City raise fees and taxes to pay for its huge ongoing costs.

    Man this is a Council of do nothing feel good fellows. Let the City finances tank as you pat each other on the back. Sure speak loudly for term limits. Teresa is the veteran on the block, she should have lead the discussion.

    I sure hope we have some good fresh faces for the next Council race. It can not come soon enough.

  2. Not only did no one lead the discussion, Kranz suggested Teresa continue as mayor for the next six months, at which point they'd have the same discussion all over again! Just call him "I'll think about it tomorrow" Scarlett O'Hara Kranz.

    1. Sadly, there's nothing illegal about about ordinary municipal incompetence, cronyism, infrastructure decay, unfunded liabilities, and outrageous pay and pensions.

      The Bell guys had to go way overboard to do something illegal. Stupid, as they could have all been set-for-life at 55 like Gus and friends if they just hadn't gotten quite so greedy.

      People are greedy, and that's the story. Why stop at a million when 10 is better. Look what the lady who got convicted said, something to the effect of "I was overpaid and got a lot of vacation, but what's wrong with that"?

    3. It's nice to see that when a few government employees get greedy, it's because they all are. Catch anybody in private enterprise being greedy or dishonest and it's just a few rogues. The one exception are those damn developers who are always being dishonest and greedy. It's just standard operating procedure here.

  9. They (Gus) has kept Teresa in her old role so that he can continue to slide through rezoning and other issues that he want in place to assure his retirement.

    1. Sorry, but the Gus retirement stuff is old hat. He would get that retirement in Sacto, Stockton, wherever Calpers is in place.

      He doesn't have to do anything special to get that retirement, correct me if I'm wrong. He doesn't have to work to assure he gets that retirement, he'll get it the same way Cotton got it, Kerry Miller got it, whatever.

    2. To me, this is the same horse-poop as we've seen before. They want Gaspar to be mayor during the second half so it can say "mayor" next to her name on the ballot when she runs for mayor.

      Same crap Bonds and Stocks pulled in skipping Maggie, the same reason they wanted Muir to replace Maggie.

      Can Gaspar make a decision? Any decision. Unbelievable. I can't believe she said that up there, trying to force Teresa's hand to declare as a candidate for mayor, and Tony kind of threw gas on that fire.

      I thought Teresa gave a good answer. And then Muir comes in, trying to pretend he just came up with that off the top of his head.

      You could populate Del Mar with all the horseshit statements coming out this night...

  11. I have a hard time believing that any of these posts are from people who actually voted for either Kranz, Shaffer or Barth. These posts, and others on other threads, appear to be carefully crafted to beat into the reader, any reader, that Encinitas would be better off with anyone but..........
    To me, it really looks like a concerted effort by the "old guard" to regain power. Is that what "you folks" want? You want to be shut out again? Y'all are very good at complaining, but have great difficulty in translating that into any real action. Basically, the people you put in shut you out! It takes two to have an argument - so you better fix this quick or risk being on the sidelines - again............

      The old guard will be there in the next election, Kristin will run for mayor, make no mistake.

      If Teresa runs, I'd take her over Kristin, who can't make a decision.

I actually like the entire council (not every decision, but most) and appreciate that fact that they can disagree and still get along - Isn't that what we want in our elected officials.   15. I agree 10:18. At least they seem to get along, which is something we have not had in a while. I would have looked more info on Rossini Creek, and a few other matters. But, let's face it, would we have gotten more form the last Council? I don't think so. So let's see what happens, and let's see who steps up to the plate to run in 2014. Personally, I wouldn't want the job.

Recently observed Kristin Gasper having lunch with David Meyer and Jerome Stocks,I believe last nights events were will scripted.Oh buy the way she cant make tonight's meeting as the is leaving for vacation and Mark Muir must leave at 8:30 tonight to catch a flight.I ask you all were are there priorities.self serving I think.

    1. Vina is a slick manipulator who is not to be trusted. Rutan & Tucker is the only proof needed. How much blame he deserves for Sacramento's and Stockton's woes is hard to know. He was an underling except for about a year as interim city manager in Sacramento. Internal politics there gave the job to somebody else. Why he has our council's confidence is also hard to know, but a good guess is it has to do with financial solvency. Keeping the boat afloat now and into the near future is the name of the game.

    3. Vina wasn't an underling in Sacramento. He was an assistant city manager before he was chosen for the interim position. His duties included overseeing the finance department. Sacramento's $150 million budget debt happened on his watch.

    4. Vina was one of three assistant city managers, and he was subordinate to that city's council. He was an underling. When he was first attacked on this blog, he was held primarily responsible for sinking two cities. Now it's changed to "part of the management team." That new designation is closer to reality. Read the Sacramento press during his years there. Let us know what condemnation you find.

    6. That's it? He's mentioned once in a 28-page document. He had been interim city manager for nine months when the city council amended a contract that began in 1998. Even if there was scandal involved originally or with the amendment, is it Vina's doing? Is that how he plunged Sacramento into debt?

      Seems you'll have to do better than that to lay Sacramento's woes at Vina's feet.

    Both in the Rossini Creek matter & the selection of TWO mayors and TWO deputy mayors, SIMULTANEOUSLY, Council didn't abide by the letter & intent of the law, including Encinitas Municipal Code & now, has engaged in more Brown Act Violations, after an inappropriate closed session when there was no legitimate threat of "exposure to litigation," & no opportunity, at the open meeting, for public input on a major policy shift in the selection of Council's last appointed mayor. For this policy change there were no alternatives listed on the agenda; Council's surprise motions couldn't be discussed or responded to by the public.

    Just a few questions, when has Kristin Gaspar passed on making a decision?

    When and where did you see her having lunch with Stocks and Meyer? If this is a fact you are reporting on, please give your name.

    Lisa's motion to have Teresa be mayor for another year was an unprecedented change in policy. Traditionally, our policy has been an "honorary" rotational system. The majority of the time, the rotation was abided by, with a few notable exceptions. The code was actually changed in 2009 to add the bit about "successor," I believe. Please correct me if you know the exact wording of EMC re election of the presiding officer prior to 2009. I will also submit a CPRA request to find out what the code was previous to 2009.

      I wasn't the one who saw her having lunch with Stocks and Meyer, but I know other people in the past who saw her having lunch with them, and I don't think it's a secret that she falls on that side of the fence sympathy-wise.

      It's her choice to do so, of course, but that would preclude me from ever supporting her.

      Basically, Gaspar passed on being mayor last time, even though she next in the rotation, isn't that correct? And guess what, just in time to be listed in our voting pamphlets as "mayor", although Teresa pointed out that she to could list herself as mayor.

Because it was made after public discussion was closed, and neither it nor the hybrid option of selecting two mayors and two deputy mayors were listed on the agenda, the public had absolutely no opportunity to give input or feedback last night.

    These people are supposed to be public servants, not puppets and string pullers, jockeying for power. Council did not name one member to be the mayor and one member to be deputy mayor. Basically, Teresa volunteered to be her own successor. She named herself.

    Council did not choose who would "go first," so did not select a mayor and a successor, at the same time. Teresa Barth volunteered to go first. Otherwise, since Kristin was leaving town, Tony Kranz would have been our initial presiding officer! Sounds like "Not Ready for Prime-Time Players!"

    Teresa did state she wanted to go first so she could complete the closed session as Mayor. Also, never before have there been two special meetings, one partially closed, one open, whereby the first closed session special meeting recessed, then a separate open special meeting was conducted, then the initial special meeting was continued in closed chambers. Why couldn't Council simply start the initial special meeting earlier?

    When I asked at 5 p.m. and during the open meeting, why it was being done that way, why wasn't I told, then, that Kristin was going out of town, and Council wanted everyone present (but the public), especially for the Rossini Creek discussion?

    People stood up and turned their backs on Stocks and Kristin Gaspar when Teresa was skipped over in rotation. Last night was to be the final appointment for mayor through the honorary rotational system. Lisa Shaffer, fairly new to this City tried to do a "reach around" to circumvent the Brown Act, and Encinitas tradition.

    Lisa defended her initial motion, which upset the apple cart, by stating the public voted for a two year term for mayor, and that the "rotational system no longer exists." Yet she knows that we voted for the shorter term for our ELECTED MAYOR. Mayor by appointment has ALWAYS rotated, and been for a one year term. Never has one council member served two successive terms or 1.5 terms. Lisa and Teresa's arbitrary and unilateral decision that Teresa could repeat herself as mayor is unprecedented an an obvious attempt to displace Kristin Gaspar's turn in the rotation. Tony, Kristin and Teresa were going to nominate Kristin for mayor last year, but she declined because of family obligations, as well as the public's outrage at the "We Love Encinitas" brouhaha. That was enabled because ALL OF COUNCIL, including Teresa, had voted to pay for bogus citizen satisfaction surveys during election years, which were obvious campaign tools for incumbents, despite ALL the public speakers asking Council NOT to so vote, when Jerome Stocks was still mayor.

    This scenario probably was scripted between Lisa and Teresa, because Teresa will almost undoubtedly run for mayor, and Lisa doesn't plan to run against her. Tony did throw a monkey wrench into the works, by not following along.

    Most candidates wait until August or September to announce. That isn't unusual in Encinitas. This isn't a Presidential race. Kristin stated she's unwilling to announce, yet, and so did Teresa. But Teresa did say she would not run again for Council, the implication being she will run for mayor.

    Council and a couple of public speakers patted Teresa on the back for all of her photo op public appearances, and the "civility" of Council. I would rather have more dissent, than unanimous consensus that Gus Vina is doing an excellent job, and unanimous consent that Council supports Glenn Sabine.

      Politics is politics, ladies and gents. The rotation has been jacked with so many times, I can't dissagree that it wasn't truly a rotation. I always said, if you want to have a rotational system, put it in writing and assign #'s. 1-5, with each following the next. If you pass, you go to the end of the line.

      I think it would be foolish to think that politics didn't come into play. All it means is Teresa and Kristin will both have the current mayor designation next to them on the ballot. Kristin made sure to make a statement about declaring/not declaring for mayor.

      It will come down to a vote for mayor between Gaspar and Barth. As for the Brown Act Violations, good luck proving that one. Won't happen.

      Sorry, I don't see any value to Gaspar on the council. There's nothing wrong with having young kids, but that's probably not the time to be on council. She's there to further the David Mayer/Stocks Bonds/developer front agenda.

      I hope she runs for mayor and is defeated, thus clearing her council seat. We have to do better than people like Danny D. and Kristin.

      The documents also list David Meyer, a real estate consultant and land developer in Encinitas as the secretary and chief financial officer of the group. Meyer’s past advocacy includes forming a political action group to oppose policies promoted by the late Councilwoman Maggie Houlihan."

    7. Thanks, 3:36. And yes, 2:49, politics is politics. I believe there are politics in any relationship, because politics is about shifting powers. Politics includes appearance, and photo ops. All politicians engage in publicity seeking, power plays, and positioning in time and place for greater control. That goes with the territory.

      I agree with Dr. Lorri. It's a challenging job. Yes, politics is part of the territory for elected officials. But so is criticism, and watchdogs calling out politicians for their failures, not just obsequious supporters who want more subsidies through the powers that be.

When the Council voted to remove Shelia Cameron as mayor November 1999, they voted Jim Bond to be mayor for the first six months and Chuck DuVivier mayor for the final six months. The only certainty is that the mayor & deputy mayor have to be voted on at least once each year in December.

    Kristin and family will be in lake Tahoe on vacation ,she has taken the kids out of school and will all so miss the meeting of 12/18 .She didn't tell you .Your choice for mayor is going to miss two meetings,what a great example,what high standards she has. LOL---------- you are being duped!

Krsitin said something about "leaving" at the 5 p.m. meeting, before Council went into closed chambers, again with no actual report re Pacific View, although it was listed as being a separate "open" agenda item. I thought Kristin was talking about leaving her home, which apparently has construction defects. More shoddy work by Encinitas inspectors through ESGIL.

      Kristin had informed Council she was going to be taking a Christmas season break. This isn't unusual for anyone at this time of year, in public office, or privately employed.

      Kristin's announced absence, to Council, was why Teresa volunteered to take first rotation as "bi-mayor," to succeed herself.

      Everyone had culpability on Council for those bogus citizen satisfaction surveys. If Teresa's photo had been included in the campaign mailers through We Love Encinitas, there would not have been a big fuss. We all knew, including Teresa, that the surveys, during an election year, would be used to benefit incumbents. Teresa didn't want to be left out.

      Our campaign finance laws need to be reformed. Right now, there can be anonymous donations to so-called non-profits. That is one reason why all non-profit business associations, or ANY non-profits in our city should have to compete through CIP hearings and community grant decisions with all other non profits for subsidies/grants through the City.

    2. Lisa Shaffer also gave the excuse, in her most recent newsletter, that the special council meeting closed session had to be held on Tuesday, instead of Wednesday, as the City was made aware Kristin was leaving and they wanted everyone to be part of the closed session.

      So Council was aware, although the public may not have been, until Teresa brought it up during last night's Council Meeting, in her decision to succeed herself as Mayor.

    2. Sounds like it is time to bring the Princess Narcissus moniker back since she continues to earn it, unabated. Some just can't learn from experience and deserve ridicule. We presently have no representatives representing us, not a one. Sometimes just for a second a hopeful light appears only to extinguished shortly thereafter. We are all in deep doo doo and need a full compliment of new, truly for the people of our beloved community council members to step up next year. Dump them all just like we dumped his lowness last year. This town deserves so much better than this bunch of turncoats. We won't be fooled again hopefully. If the same staff remains what does anyone expect? Clean house and rid ourselves of these bad influences from top to bottom. We have sadly learned the hard way that when the same staff remains nothing changes.     Looked like five pigs playing in the mud, happy to be there splashing all around and not caring how stupid anyone from the outside could see them to be.

    No doubt about it. Gaspar is dying to be elected mayor and Barth feels a civic responsibility to keep that from happening.

    6. 7:20 we are $43 million behind in road repairs, drive Crest, Birmingham, San Elijo, the list goes on and on. At the council meeting for repairs Shaffer and Phony Tony looked shocked there was not enough money for road repairs, of course just a few weeks earlier they ignored residents and approved $400K in money to expand the planning dept budget- and then rasied fees (taxes?) on citizens. It is who they are, they hope don't notice.

      Scuplin- nice of you to chime in, but once again your opnion is unfounded. If the city was not at fault in the Santa Fe incident then then the city would not have been sued- correct? Get your facts straight Scuplin- it seems the city being suded and held responsible for the Sante Fe incident is relevant.

    9. Sunday November 11, 2007 post at the Leucadia Blog has the story on the lawsuit against the city of Encinitas regarding hazardous conditions at Santa Fe. Worth noting the road in my opinion has been left crappy as the hhg density profiteers want to put a transit village across from Scripps- like the transit center at UTC. The city is hoping the developer pays to fix the roads because the city has wasted our money.

      The least you can do is offer an apology, what is shameful is you spouting off like an overheated tea kettle without knowing the facts-

From where i sit gus vina is running the show. at weds council meeting they stacked the oral communications with palace guards to spread propaganda the council is doing a good job. I think that Judy is a nice and peace loving sort of gal, but when she and the other woman who was given the job of HWY 101 coordinator on account of Teresa spoke, it made them all look like they had low standards. How is council working as a group to spread the blame equally, and the Mayor showing up for photo ops deserving of praise in light of all of the other problems that have been ignored?

      The 101 woman is also a nice person, but it does not come off well when people praise the mayor who uses taxpayer's money to recommend a job for the person giving the compliment. I for one think that the position should be done away with--along with the new communications position.

      We should not have taxpayer-funded kiss ups for the council and for Gus Vina to create the perception of popularity when citizens in general do not feel that way.

      I agree, the comms position is absurd, but the L101 job is not a city job. That gigs been around a long time, and those guys have done a lot of good things for Leucadia.

      People have always gotten up and praised leadership as long as I've been going to council. Judy did a lot to help get Tony and Lisa elected, so give her some credit for not running away at the first sign of trouble. Judy and Dadla are awesome people, who care about our community.

      Again, be careful what you with for, we've already got Kristin running for mayor, who will come out of the woodwork from the Stocks side to run for her council seat?

    4. There has been zero coverage of last saturday's community coming together over the Harwood/City Mark development on Fulvia/Hymettus. Although the weather was chilly with sprinkles the warmth of many of our neighbors coming together in opposition was all so heartening. There was never the proposed walk around and every question and answer was filmed. This was a true coming together of our beloved community in opposition to the proposed density bonus that these folks were relying upon. This was a pivotal moment in our town's future and deserves coverage. If this isn't stopped in its present form [10 lots] you can be sure it will pop up next door to all of you at some point. There were attendees from all over our city. They surely recognized this and perhaps the coast news will have some opinion tomorrow but I feel this is so crucial to all of our futures it should demand recognition.
