2/10/16 City Council meeting open thread

The current city council has continued prior councils' practice of not providing written summary minutes of council discussion, but only "action minutes" which state the outcomes. Encinitas Undercover will provide a forum for observers to record what occurs at each council meeting.

  1. All day hearing at the Coastal Commission meeting to oust the Director, Dr. Lester, by some members on the Commission. Where does our Council stand on supporting Dr. Lester or the Coastal Commissioners that want more development? Nothing to say Council?

    Meanwhile streets go in need of repair.
    Sidewalks are missing all over town.
    No safe underpass at the 5 freeway and Enc Blvd.
    The city can't water any landscaping.
    Santa Fe drive is a nightmare, neighbors and SDA are left wondering why the construction isn't completed.

    This city is in shambles. Lead by idiots and morons, it's turd and needs to be flushed.

  8. -On VillaCardiff street there is a 100 yard trench that the city allowed to be filled with sand, that sand is washing away and those residents are left with a 100 yards pot hole.
    -At Oak Crest middle school the city can't/won't finish the retaining wall, leaving hundreds of cones to block the roadway, forcing students to walk in the street.
    -The southside of SantaFe gets NO sidewalks or curbing, the idiot at city hall that come up with that plan should have his/her ass kick.

    Meanwhile construction was hurried and complete at the D street entrance to city hall.
    Where are the council members?? Where is the city manager?? When will these projects be completed??

Sit in at city hall until they fix the HEU language AND clean house in the planning dept. if they dont by the end of the day start collecting recall signatures for ALL 5 do-nothings that evening going door to door, supermarkets, etc. invite very new team in town. Start a go fund me page to hire a private investigator to follow the money. Press charges and demand justice and jail time when the PI finds out just how corrupt staff is. Yeah? Would it work?

      Loads of people voted "no" mistakenly on A thanks to Andreen's last-ditch efforts to spread the lie that a no vote meant "no, I don't want more uncontrolled development." Wonder if he had to give his handlers a discount on that fail.

  10. 9:41- What are your goals. As an old "hippie" we had sit- ins, but at that time it was to get us out of Vietnam. Yes, I am that old. I am personally not sold on the idea that staff is taking bribes, nor do I believe that the City Council is taking bribes either. What is it you want? The HEU is a really difficult piece of work, and has to uphold State of Calif. law, whether we like it or not. Seems like lobbying at the State level would be more effective. Whether one likes all of the Council members, I think they are trying to do the best they can, under very difficult circumstances. I think the same of the Planning Commission. I, too, am frustrated, as are many others. Perhaps we can think of other ways to help get this thing through with the minimal impact on our community? If you read the news today the Calif. Coastal Commission Director was fired Weds. eve. with no evidence presented against him. There were thousands of letters written to keep him, and yet he's gone. That may mean a more pro development Director of the Coastal Commission, or it may not. But, in any event, I think transparency is important, and at the Calif. Coastal Commission meeting the attorney said that the Commissioners could give their reasons for firing Dr. Lester. However, the Commission, Olga Diaz being one of them (she is from Escondido) did not choose that route. They voted 7-5 to fire him, in closed session. Lots of things going on in this State and the idea of affordable housing in any coastal community is difficult at best. Anyway, that's my 2 cents, for what it's worth. Lorri Greene

    2. I believe that goverment begins at the local level and we could be an inspiration to other cities that could then make a change at the state level, collectively.

      Anyone could re-apply but the criteria will be as strick as the law allows as they should be with the pay and benes they get. They can resign before hand andnot worry about a finaicail investigation or can get a nice fat whistle blower check.

      A finacial PI finding nothing would be great but something is not right when a planning dept. employee lies to your face. I want to get to the bottom of the lies. These are not opinions I am talking about, these are blantant lies meant to misrepresent the truth.

      If our elected officials will not do anything about it than they are part of the problem and need to go.

      Are you ranting too with regards to the CC or trying to re-direct the conversation?

      Gov. Brown needs to be recalled too, if he does nothing about the CC take over by his appointees.

      I would love to hear what comes out while under oath and the threat of perjury looming.

      Community housing events with regards to two or three stories. I was told 3 stories here and two stories on back of the lot. Nope, no language currently on where three stories can go. Where will they park I ask? They must build parking. Look it up and boy are there a lot of ways to get around parking. And guess what, every one of those exceptions are there for this specific lot. He helped write it and knew full well he was purposly misleading. Other examples have been well documented at these events. Maybe my standards are too high but purposly misleading someone is a lie in my book, just harder to prove in court, but still a lie.

    7. Thanks 4:00. I am going to check it out, as I have had that happen to me as well. I have no problem naming planner Kerry Kusiak who screwed over 7 of my neighbors so Marion Ross could get a 29'6' height on her home that she never uses. I live right behind hers. Kerry came to all of our homes and determined it would not affect our property values, even though many of us lost significant views. We were then told that there is no "view ordinance' and therefore that argument would not hold water, so to speak.

    8. 6:36 again. We appealed to the City Council and lost there as well. I don't remember all of the people on the Council at the time. I do know Stocks and Bond were on it, but I truly don't remember the others.

  12. The prop A lies and BS feed to me at the community events sure smell rotten. We have seen coruption here in recent history. Did it all stop and begin with Dalanger? The system here is not working with the people, i.e the Impossible granny flat program. Time to get some people in there who dont have a pro-developer agenda. Why is staff so pro development? Are they paid by us to be prodevelopment? Why does my back button now work? Why are these iohone keyboards so small?

      Wake up! Encinitas has had an inclusionary zoning ordinance for a number of years and is in the process of revising it. The council specifically waited until the State Supreme Court issued their ruling in the San Jose case before proceeding.

      In the process of and actually doing are very different things. the city and its amatuer legal team of one failed miserably with the rounding down settlement. No body from either vested side wanted to be under oath. Why would this be a any different. The developer step'n'fetch boy toys (talking to you meyers) have already figured out that our legal chump cares more about billable hours than champion our best interest. They waited for the state courts ruling for selffish reasons, not to stick it to developers who have been sticking it to us. Look at the BIA statement from after the rounding down case, they still think we are falling for thier building housing for the poor bit.

      450k fine for the creek, no one fired
      Private meetings with our mayor, large land owners, and a developer.
      Have we ever won a lawsuit? How much do we pay this guy?

      Your are confusing two issues. The San Jose case was a question of whether a city can impose inclusionary zoning (IZ) through their police power. The State Supreme Court ruled in the affirmative. State law allows cities and counties the option of passing IZ ordinances but doesn't mandate it. That is different from density bonus which is mandated by State law.

      You obviously have no idea of what you're talking about. Do people a favor and stop demonstrating your ignorance and possibly passing that ignorance along to others.

      Would IZ zoning count towards the affordable housing numbers? Thus, less need for density bonuses?

      Say if Encintas required new developments to include 15% at below market rate. Houses and condos/apartments must be on the property, and no paying to get out of it. Would that type of zoning be legal and would that extra 15% satisfy at least some of the state mandated units? Then get a real granny flat program to fill in the rest? Please educate all of us on this, it is so confusing.

      I would imagine the city would have to show a track record with IZ and as the ordinance now stands, a developer is able to pay an in-lieu fee instead of building the unit(s). Whether or not the city has an IZ ordinance, density bonus is an option available to a developer by state statute. Also, courts have ruled that the IZ unit can be counted toward the density bonus affordable unit so one unit can satisfy both requirements.

      Some of you people continue to confuse the Inclusionary Zoning (IZ) ordinance and the Density Bonus (DB) statute. The IZ is allowed by State statute but not mandated. The Encinitas ordinance requires any new subdivision of 10 or more lots to provide and affordable house per 10 lots. So a subdivision of 10 lots must provide one lot for a affordable house. A subdivision of 20 lots must provide two lots for affordable houses. And so on. This isn't optional. What is optional is that currently a developer may pay in-lieu fees instead of the affordable house(s). These IZ ordinances was affirmed by the State Supreme Court as a proper application of a city's police power. Also, the IZ doesn't allow an increase in density like the DB statute.

      The Density Bonus is a State statute and must be implemented by all cities and counties. DB is optional but the choice is up to the developer not the city. The formula is spelled out in the statute. The State Appeals Court has recently ruled that an IZ affordable house can be applied to the DB affordable house requirement.

      Here is the description of the City's IZ ordinance update from the City's website:

      "On May 7, 2014, as part of the Strategic Planning Work Session on Community Planning, the City Council received a presentation from staff and a representative from the consulting firm Keyser Marston & Associates covering the City’s current Inclusionary Housing Ordinance and the different options to develop an in-lieu of fee.

      Direction and funding was given to staff to update the ordinance to address the following: round up fractional units; make the in-lieu fee a City determination (not the applicant); fee based on units similar to that proposed in the project; comp-based calculation formula; address any recent court actions; and, other changes necessary in order to provide more affordable units."

      If IZ can be applied towards DB then they are both a part of the same issue. Like blue and red are both colors. IZ sounds way better than floating zones and IZ would actually make sure affordable houses are built, if at all. As staff is sound fond of saying "we only need the zoning, not to actually build" then IZ sounds like the more responsible path to carrying out the mandated increase in density. If there a reason Encinitas can not go this route while San Jose can?

      Unfortunately, there aren't enough new subdivisions to get anywhere near our RHNA numbers from IZ. The council has discussed lowering the IZ threshold from 10 lots to maybe 5 lots but the IZ ordinance update hasn't resurfaced yet. I don't know for sure but if the city can demonstrate to HCD a certain number of affordable units each year from the IZ it could lower the rezoning requirements but the city is running out of vacant land. The council would also need to remove the in-lieu payment option.

  14. The point is that a city is not powerless to limit the reach of developers. If they want to build here they must do it in the spirit of the law and actually build the affordable units. This forces the developer to dip into thier own profits rather then get rich at the expense of residents. In this town, developers use the law to get around zoning laws, which screws the nearby property owners. It is just another way to screw the middle class. If profit margins are slimer, development will slow down.

  17. There are 4 City Council seats up for election or reelection in November. Let's see who steps up. For those who don't like the way the city is run, this is the best election time you could ever run. It's a Presidential year, so more people are going to go to the polls. The HEU will be on the ballot. Step up to the plate. I would but I'm way too old and don't have the fortitude.

  18. Someone asked, just who in Planning has been lying to residents about what the current HEU will foist upon this community? The answer to that is that every damn staff member in the Planning Dept. who attended the so-called community meetings. There was not one planner that was not overheard misrepresenting what this turd of a plan would do to our ability to have any say over whatever developers want in the future.

    Mike Strong for one and he is by far not alone. He was just doing what he was told by manjeet ? who was just doing what he was told by ? Mike should not be explicitly targeted, as he was doing as he was instructed by ???? Every other planner in attendance was feeding the gullible citizens the exact same story. These community presentations were nothing but a sham.

    I can't imagine every/ or any member, of our Planning Dept. did this on their own. The atmosphere down there must be something special to promote such disingenuousness to what they are hoping is an uninformed public.

    I had hopes that Karen would come in and clean her house, as it is so freaking obvious who needs to be sent packing. Nothing has changed one iota since Karen has been here. Karen is a local and can't help but know what is and has going on. She serves at the pleasure ? of council of course. The lack of any progress on cleaning up the Planning Dept. is very disappointing. We may as well still have Gus here for all the difference she has made so far.

    That needs to change and now. Fire the whole bunch and offer some a chance to come back with some new priorities, such as stranding up for this town who rewards them so handsomely with their undeserved salaries and benefits.

    A forensic audit is long overdue.

    12. I think the poster meant to say Assistant City Manager. Our city attorney, Glen Sabine, is a contracted employee. He works for us and the city of La Mesa. So, since he is not an employee, but a contract employee, I don't think the City could hire someone to assist him. He already has a law firm where he doles out a lot of his work, and bill extra for that.

    13. There is no additional city attorney being hired that I'm aware of. What is happening is to reclassify the currently unfilled position of Deputy City Manager to Assistant City Manager and to fill it. From the Work Plan report last Wednesday:

      "In September 2015, the City of Encinitas hired a new City Manager. After approximately four months in the position, the City Manager reviewed the organizational structure in the City Manager’s Department and determined the need to eliminate the Deputy City Manager position by reclassifying the position to an Assistant City Manager. The classification of Assistant City Manager includes a more extensive span of responsibilities. Some of the expanded duties associated with an Assistant City Manager’s classification include providing supervision, direction and leadership to Department Directors and Department Managers, assisting in the City’s annual budget process, implementing directives and policies from the City Manager, and managing the City’s day to day operational issues associated with the overall functions of the City."

      Glad to see you're continuing to be proudly ignorant. You know nothing of management or how to read, apparently. Private or public organizations of any size have complexity. A public organization like the city has a active council which must be attended to as well as city departments and citizens like you. It's often divided between two people or more if it's a city the size of San Diego.

  20. 1:05- The reason for bringing up the Coastal Commission is that without them, we have a real chance of having buildings above 30 feet. Ross did not ask for over 30' because she knew the CC would not let her. Now under different leadership it is possible that developers will be able to go 30 feet. And since the City is doing its best to get around Prop.A the possibilities become even more real. If you have been to the Village in La Jolla you can see what was built before the CC was established. Or go to Oceanside and you can also see it. So, it is directly related to our city, along with other cities as well.

    1. Has the CCC ordered you to GIVE 8 foot of your property to the state so the public can have access to the beach, even thought there is a 90 cliff down to the beach?? Access even thought there is no safe way to the beach without a stairway which has to be ADA compliant?? All those have been demands of the CCC to homeowners that live on our coastline.. What?? You can't comply?? Then you can't get a permit to remodel your property.... It's called an ILLEGAL taking of property, which is AGAINST The laws of the UNITED STATES OF AMERICA. And the CCC has been struck down again and again but they keep trying.
      How about the commissioner that voted to deny a permit to build a home because he said when he's kayaking along the ocean he doesn't want to see a house...WTF? When asked why someone on shore should be subject to seeing his ugly kayak bobbing on the ocean, he had no reply.

      Fuck the CCC they are nothing but radical left-wing environmental despots that think of thing but screwing private property owners.

  21. 10:36am sounds like the same jerk who showed up at a Surfrider meeting on the beach about seawalls this past year just south of Grandview. Many were respectful and let the presenters have their say before the question and answer period was to open to all.This was not good enough for him though.

    He constantly attempted to interrupt the presenters and couldn't have been more rude even though they told him any and all questions would be welcomed once they finished their presentation. Those who came to learn and not disrupt, waited for the speakers to finish and asked their questions.

    The not so curious thing was that once he could ask whatever questions he wanted, he remained mute. His whole objective in attending was to not allow the presenters to have their say. Myself and others told him to chill out and wait respectfully for the question and answer portion. This long haired guy with promotion stickers all over his jacket clammed up once he could ask questions. He wanted to be on camera showing what an a hole he could be and at that he certainly succeeded. I hope his sponsors were happy with his despicable behavior. The residents who came to learn, not so much.

    I don't know how a sponsor could accept this rude behavior but he got his two seconds of camera time acting like a complete miscreant. If I had taken notice of some of these sponsors, it would be interesting to see how they felt about supporting someone who acted so disrespectfully just to get some on camera time.

    If this person had any point at all to make and yet when he had the chance to ask, he had nothing to say. Unimpressive to say the least. He apparently owns a bluff top home on north Neptune and appreciated the CCC as much as he did Surfrider. Thank the stars he was in the minority that day or the rest of us that wanted to learn something educational would have been deprived of that opportunity if had had his way. It takes all kinds and we sure have them around here.

  22. 5:37- I remember that meeting and that person. You're right. However, the same folks did manage to oust Dr. Lester, who was the head of the CCC and now it is up for grabs. Most regualar folks cannot go to every CCC meeting, as they are up and down the coast. The one that ousted Lester was in Morro Bay. However, developers have no problem getting to them, just like at the City. Planners see developers on a daily basis and they bring them donuts, cookies and other things like that. I doubt if any of them would be stupid enough to take an outright bribe, but they become friends and friends do favors for one another. Just ask Mike Andreen regarding the Rail Trail in Cardiff. He put out an email saying Cardiff was burning and when your neighbor's house is burning, you help fight for them. So, he and his cronies are going to fight the rail trail. The irony to me is I don't want the rail trail, as it is configured either, but I really don't like Andreen. So it all comes around to figuring out how is doing what and to whom. The tangled webs we weave.
