Encinitas' "Footloose" anti-dancing policy gains national attention

City officials in Encinitas, California, have fined Peabody's Bar and Grill $3,000 after catching people dancing to live music performed there. Owner Brie Cardosa says she was surprised. She says she doesn't run a dance club but sometimes the natural reaction to music is to move around.

  5. I've dealt with code enforcement. Unwielding, rude, uncompromising and threatening. Worst experience with a "public" servant ever. They are stooges for bloated revenue collection for concocted "violations".
    Incorporation was a mistake.

  6. Today at the street faire there were a couple teams roving around will amplified bullhorns spouting crap at full volume.

    If these thumpers want to espouse their version of the lord, they should not be allowed to use amplified bull horns. Walk around with their signs is fine. They are welcome to do that ll they want. Using loud amplified bullhorns should be allowed.

    A faire official told me there was nothing they could do and that they had asked the sheriffs and got nowhere.

    Freedom of speech dictates they can walk around with their signs all they want. The use of obnoxiously loud amplified bullhorns should not be protected under free speech.

    City? How about doing something about their use of amplified bull horns at a public event that we have enjoyed for decades without having to be exposed to such rude behavior at our Springtime street faire?

    2. We had the same impression - why were they allowed to use bullhorns? Freedom of speech does not imply it has to be amplified above the normal level of discourse. The Sheriffs were all congregated in one location - why aren't they walking the beat and spreading out?

  7. Fricken Sheriffs don't do any enforcement in Encinitas. Tell the City Manager to get on them about enforcement. The City Manager manages the Sheriffs contract.

    Did you actually speak to any of the law enforcement officers that were there all day long , both days?

    Until our city comes up with a policy banning amplified bullhorns there is nothing anyone can do. That should be our focus, so next time we have a pubic event, these fundamentalists will know that they are welcomed to parade around all they want with their signs.

    Let freedom of speech reign. Using amplified bull horns at our public events needs to be banned from our city now.

    These are the same people who showed up with their bullhorns at Moonlight Beach for the Womens' march and told everyone, moms and dads and their kids, that they were all going to hell. There is some real christian behavior being shown. Not even close.

    We all need to implore the city to put a policy in effect banning bullhorns at all of our public events. Until they do that, there is no recourse for anyone, not the sheriffs, nor the residents.

    Let the city know this needs to be addressed immediately.

    It is not the city manager to blame.

    It is not the sheriffs to blame.

    Until our town has a policy banning these bullhorns at our public events, no one can stop this group from using such tactics.

    Council, do the right thing and set a policy now.

    Aren't the Sheriffs and the City Manager supposed to bring issues that are negatively affecting the City residents to the City Council's attention with sound recommendations on how to address the issue?

    I know its not happening and all we get are excuses, but isn't that what is supposed to happen? Why don't I ever see or hear of traffic enforcement in Encinitas? Its known throughout north county that encinitas is not enforced and speeding and straightpipe use is the result. There are plenty of laws on the books for enforcing speeding and using tampered exhaust systems (straightpipes) that the sheriffs choose to simply ignore and the residents suffer. But the sheriffs love to cruise the beach in their beach machines and get looksies at all the hotties on the beach.

    I think your answers is lame and represents the city staff current perceptions. Lame.

  11. Portable bullhorns should be banned; amplified music at fixed stage sites are exempted from restrictions (within reason). Or have a fright zone on the periphery, where all the fringe can express themselves.

  12. I’ll personally show up with my bullhorn next year and shout over him. Also, the guy selling flower photos is totally creepy. Overheard him tell a very underage girl how pretty she was and if he was younger he would be all about her. Keeps you kids away from that dude.

For people with autism, bi-polar issues, PTSD and those who have been in combat, a loud bullhorn could trigger an personality episode or a seizure and by allowing such antics during a street fare raises a serious conversation about litigation. In addition, any and all vendors who were subjected to this noise pollution should be given a refund.

    1. Also dangerous for startling people with pacemakers. It would really be in the city's best interest to assign 1-2 deputies to enforce any type of noise that disturbs the peace. Many smart phones now have apps with decibel meters. Many of the drivers with speeding/modified mufflers/illegal tint violations are likely breaking other laws too which could lead to bigger arrests for SDSD. 5 years ago I was pulled over by a deputy while leaving Pannikin for taking a pic of his parked patrol car with my cell phone. I was not talking or texting on the phone. I was issued a speeding ticket for 5 mph because "the only safe speed while using a cell phone is zero". This same deputy later made the news for harassing a vet downtown. They are protecting and enabling the criminals and scrutinizing the rest for any little thing.

  15. This anti-dancing policy is nothing but a money scam on the part of the city. At the next council meeting someone bring a boom box, put on some tunes and everyone get up and dance. Lets see the city fine themselves..... City Council=FOOLS!!!

  17. The sheriffs did all they were allowed to do by having these thumpers lower the volume somewhat.

    Without a city ban on using amplified bullhorns at our public events, there is no recourse.

    The direction we should all insist upon from here on, is to have the council lay down the law and prohibit the use of bullhorns at all of our public events.

    That will not infringe upon free speech, which is everyones right, no matter how despicable a message is to most reasonable people.

    These fundamentalists did the same at the Women's March at Moonlight Beach. That should have been enough for the council to lay down the law. Maybe now they will. We should all make it clear to council that two times is two times too much. Enough is enough.

  18. We're finally ready to go to the planning commission with the dancing matter this Thursday. The permit process has been long and complicated. If we get permission from the City we will go through the ABC permit process next. We appreciate your support. The meeting starts at 6pm, City Hall. Hope you can make it.
