Right to Vote fearmongering debunked

At the Leucadia Blog:
There is already an existing, city-wide height maximum of 30 feet or two stories in the general plan! All the initiative does is reaffirm this and require a public vote to change this provision.

Does Al understand that the Municipal Code is subordinate to the General Plan and the Municipal Code can (and DOES) set building heights that are lower, such as the 22-foot and 26-foot limits in certain areas and under certain zoning. So what is the problem?

  2. VOTE YES. And get off the council's back for letting the people have the right to vote on the matter. I don't blame them for not wanting their 5 butts in the wind should anyone sue them for passing the initiative. I think at least the ones that signed the initiative will be happy if/when it passes, and basically have to look impartial by writing a ("soft") rebuttal to it. My take on it anyway.

  3. Yikes! It looks like our novice city council wasted $41,000 on the Rutan and Tucker Impact Report. Not mentioned in the blog posting is that Section 7.10 only allows NON-RESIDENTIAL 3-stories in specific plans areas. It's right there in the General Plan. Where does that leave Pacific Station and Moonlight lofts even if the initiative fails? Legal non-conforming? Seems City Manager Gus Vina and staff have bungled this.

  4. Fred, they are not even trying to play both sides anymore. They have not let people have the right to vote. Wait, won't they get sued if they did that? Are they lying about wanting to give us the right to vote or are they lying that they object because we the city will get sued?

    They have fought against the right to vote with more lies than even Jerome had the guts to generate. They all signed the ballot argument that was disgusting to anyone who knows anything about planning law. That is your signature Tony, Lisa, and Teresa! You own those lies now.

    The council even wanted nice guys like you think they might be sued if this passes. Gaspar asked Mr. Harmon how many times Escondido got sued, because she had swallowed the Barth-Vina kool-aid. Mr. Harmon passed a right to vote initiative in Escondido when things started going south in Escondido. Escondido has not been sued. Escondido has both approved and turned down upzoning initiatives, so it is not a no growth measure and we will not get sued.

    With Stocks you knew where you stood and he didn't play you. More than ever, we need the right to vote.

    We also need term-limits.

  5. Staff did not sign the opposition. The council did. The council could have allowed the RTV people time to rebut Rutan but they decided not to. They could have at least let them have the same deference they gave Marco, but they did not want the truth out. Barth's true colors are not the colors of open government.

  8. I also think Teresa has pulled her weight through the tough years, after this year, its time for her to step up and become the first elected Mayor. Only if she can dumb Sacramento Guss. He and his bid debt program are bad for this town.

    But we all know he sold the strategic planning crap, because it buys him one more year to get closer to retirement. He could care less about encinitas and its future. If he did, let him drop his PERS to 2% per year. If he does that, I would believe he actually gives a shit about Encinitas. Same goes for Mark Muir. Mark should give back to Encinitas, every penny he gets from pension over a 2% per year level. Same as Jerome, the Diablo, Stocks. Guss is a Stocks Man. Remember- He let Stocks put his signs out a day in advance and had his code enforcement officers leave the signs up. Scum

I don't understand how Gonazlez, who is constantly threatening to sue the City, and who City staff has claimed will sue them if they don't support Desert Rose, is suddenly shoulder to shoulder with them. When did Scott Vurbeff stop lying and sending in false paperwork--or no paperwork at all to State Agencies? When did Roy Sapau, Massie Maher and other suddenly become experts that the Council trusted? This is crazy, but the answer is that Guss wants the money.

    Gus has 30+ years in the public sector, 9 years with the State of California, 10 years with the City of Stockton, 12 years with the City of Sacramento, and now recently appointed City Manager with the City of Encinitas.

    All the Agencies he has worked for are Bankrupt or near bankrupt. He was in charge of Finance. Great Financial wizard. I guess he trying cuba commy style. One thing for certain, he doesn't no shit about finance and doesn't no shit about running a City.

    Dump Gus before we end up like the rest his been involved in, bankrupt, while Guss sits back and smokes his Cubans.
