4/9/14 Council Meeting open thread

The current city council has continued prior councils' practice of not providing written summary minutes of council discussion, but only "action minutes" which state the outcomes.  Encinitas Undercover will provide a forum for observers to record what occurs at each council meeting.

    1. The City only approved the TransNet spending plan, including monies already spent for workshops and preliminary planning, and further planning.

      It was unclear to several people that the staff report with respect to TransNet tax funding was referring to $100K, not $1K. Why not write it out, in full, with the extra three zeros to avoid confusion?

      The truth is that TransNet tax funding cannot go to beautification projects, although it could go toward sidewalk and curb improvements, the railtrail corridor, etc. I felt the way the agenda report was worded as the Leucadia Highway 101 Beautification project is misleading for that reason, as well. If you recall, the "beautification" aspect of the Leucadia Blvd. roundabout project, which was to include sidewalks and landscaping, to delivered in Phase 2 never came to fruition, just as Phase 2 of the Downtown 101 Streetscape project never was initiated or completed.

      Apparently the money for Phase 2 of the Leucadia Blvd roundabout project was diverted to the Leucadia 101 Streetscape Project. But it should be made clear to the public that TransNet tax funding will primarily go to hardscapes, not restoring the canopy, planting flowers and succulents in the medians, not artwork along the highway, etc.

  5. Agree with 7:10. Forget about widening I-5. Put the money into doubling and trenching/tunneling the RR tracks through coastal North County.

    1. Lowering the tracks would increase safety for pedestirans, increase property values, improve business and aesthetically be a lot better. But it wouldn't do anything to relieve traffic congestion.

    2. It would relieve traffic congestion at the City's four grade crossings. That congestion will get a lot worse as the number of trains per day doubles to about 120.

      I would say do both, and sadly, to increase efficiency, double tracking for the whole county. Too bad they didn't put the train down the middle of the freeway when they had the chance, instead of the slowdown through Sorrento valley.

  15. Sorry WC to bring up an unrelated matter but yesterday afternoon while at the Leucadia post office I witnessed a mom and two young kids were stopped and TICKETED for crossing over the tracks. No warning, just the high buck ticket to try to find a way to pay for that and pay their living expenses. I stopped and asked her if she spoke english and no she didn't. I expressed my sympathy for the heartless treatment by this enforcement officer. He must have surely known this citation would cause extreme hardship for that family. A little consideration and compassion could have been much more effective than penalizing this family with an added expense. How about a fund raiser for this hard working family. I don't know how they could be identified but they deserve better treatment than this easy mark for this officer to collect revenue from. Have a heart please dear police officer. You can dismiss this infraction if you have any heart in your soul. Sorry WC to bring this up and if there is a more appropriate place for this feel free to move it there. Thanks WC for all you provide for this so special community that we or sot of us are trying to preserve. chaching

  19. Next time Gaspar is out of town, just be absent. It is not necessary to spend the dollars to do teleconference so she can feel important. Actually, it was nice not to have to look at her tonight, but the irritating voice is hard to listen to. She had nothing of significance to offer tonight, so the phone call could have been skipped and saved a few dollars. I also agree with the comment made about Barth patting the staff on the head for doing a good job. Correct, that is what they get paid to do and paid well I might add. Please, Teresa, your dress is outdated. I hope we don't have to look at that for another 8 months. Muir must be out investing in new vests or sweaters?? The speaker about the recent death of an Encinitas resident by a DUI was the most significant point of the whole meeting. We really should have a DAO to help regulate the bar situation. It has not gotten any better.

  21. Julie for mayor!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!A shoe in to be sure if she chose to do so and is so needed. I am sure your family needs you too and that priority stands above any other considerations for public office. Two weeks ago as you walked away from the microphone I had the same thought. Way to go Mayor Julie in my own wishful mindset. Thanks for your passion to give back to our community with your time and effort.

    4. Julie Graboi did a good job, as usual, in her oral communications. I could not attend, but was grateful she did, and that she spoke.

      Russell and watched the entire Council Meeting, tonight, from home, on Cox 19. I noticed that Mayor Barth cut off Julie Graboi, without allowing her complete her final, closing sentence, when she was nearly done with her three minutes of oral communications, immediately after the buzzer sounded. As I personally explained to Teresa Barth on March 19, this makes our outgoing mayor appear to be rude, and uncaring.

      Why don't you start off small and go ask the City if you and your "friend" if you can find someone, would like to go plant and water a tree along Hwy101 or something. Lets see you do something good for Encinitas and lets see if you can revise your speaking style so can gain some ounce of respect and credibility from someone. You have every right, just as any one else that lives in this city, to voice their opinions and/or concerns regarding our elected officials, their decisions, and anything related to the city since we are the taxpayers and are footing the bill for the decisions they make. You have done a great job and spent countless hours researching issues. You are effective when you stand before council, so don't let the remarks get to you. Those people wish they had as much guts and integrity as you. Keep up the good work.

    13. Naw. no hard feelings against those who now dislike the idea of roundabouts coming to town. I fully understand people's reluctance to accept them. Fear of their installation is usually to be expected according to the USDT. It's a major infrastructural change and a lot of people in Leucadia including myself are very leery of change unless we're convinced its for the better. I obviously am. Pretty hard to go wrong with more trees, better sidewalks, slower speeds, contiguous hometown street lamps and landscaping. So roundabouts get the focus by some as a reason to thwart the entire Streetscape. (Not sayin' you, either). Why? "Because Leucadia isn't worth it" one man announced at a meeting. And one woman who seeks to pit residents against N 101 business owners tries to sell her neighbors with "The selfish business owners are only concerned with themselves doing better with Streetscape". She also claims they will usher in unwanted density more than intersections would (never mind that Prop A passed and we're nearly built out here on the hwy). But to each his or her own. I asked her not long ago at a meeting if she preferred making a left onto 101 from a side street at "15 mph with one lane of traffic to navigate - or if she'd rather 35 mph traffic with three lanes to navigate" But instead of an answer she snapped "Don't pull that stuff you pull on (12:58)". Whatever.

      The USDT says on their website that after they're installed and their benefits are seen, most people who were against roundabouts like them.

    15. What you seem intent upon failing to understand, Fred, is that we are not talking about "most people," here, or most roundabouts. I respect adjacent residents, such as a couple of public speakers who came forward last night during oral communications at the Council Meeting, saying that they want a roundabout at Santa Fe and Crest. As I've said, that could be a good fit, there. That is different than development interests along 101, through Leucadia pushing for them, here, just as they pushed to blight Leucadia, before, or pushed to defeat Prop A.

      This is the difference. Those were adjacent residents, not primarily a few people who are on the board of directors of Leucadia 101 Mainstreet Association, which backed, because of their development interests, defeating Prop A, just as all of Council did.

      Those people backing the roundabouts on 101 through Leucadia think that they, personally, will benefit, because people will slow down and come into their businesses more, they will get additional back-in diagonal parking, and for those who have ownership interests, their properties will be worth more, because roundabouts can be claimed as traffic calming so that future development could get mitigated negative environmental impact declarations. Thus, a complete environmental impact report could be deemed unnecessary. All this at taxpayers' expense, through Transnet Taxes we pay, and no resultant increase in property taxes through a special property tax assessment district, as Solana Beach has.

      In other words, targeted benefits, paid for by the public at large. So what is being pushed on us, is that there would be universal benefits, from which we would all benefit.

      There is no argument that all of us want the universal benefits of preserving and enhancing the canopy, planting and maintaining the medians, more public art, more and improved sidewalks, and a railtrail corridor, which bicyclists could use, all the way to La Costa, not only from Chesterfield to G Street, as now planned. We all want a beautiful Greenscape, not a hardscape of road obstructions, that would have the opposite effect that you are hoping for, Fred. People would begin to AVOID Highway 101, especially during peak holiday periods, to avoid becoming ensnarled in bottlenecks, back-ups, and gridlock.

      We agree that more parking is important. There would be a NET LOSS in parking were the four one-lane roundabouts to be installed because much of the parking currently in the dirt, west of the tracks would be eliminated. Bicyclists would also have to go through the one-lane roundabouts with cars.

      Some roundabouts work well. Roundabouts work best when traffic is not already backing up, such as during peak periods. Traffic on 101, through Leucadia already backs up during peak periods. We don't need roundabouts to add to that problem. Traffic is backing up right now, because I-5 is.

      Roundabouts are NOT recommended by the U.S. Department of Transportation when cross street traffic is significantly less than the main thoroughfare. We would have NO CROSS STREETS for the narrow diameter, one-lane roundabouts with less safety features, here, because the are planned for 3-way T intersections. They are not needed for pedestrian safety, as there are no RR crossings and no crosswalks where they are planned, and will not be any, in the foreseeable future.

      In fact, according to the Transit Strategic Planning Presentations, Transnet Tax money will primarily be going to the railtrail corridor and mitigation for I-5. If there is extra money, through TransNet, I hope it could go to road maintenance, and, possibly to installing a roundabout at Santa Fe and Crest, if that is what adjacent residents and local commuters think would help with traffic calming, there.

    16. Residents adjacent to 101, from A St. to La Costa, signed petitions, over a thousand of us. Over 60% of those answering the survey distributed at City Hall in October of 2008 said we did not want the City to go forward with a plan for five roundabouts and lane elimination on Historic State Highway 101. Surveys by Mike Andreen, through the Chamber of Commerce, verified that an overwhelming majority of residents and a majority of merchants adjacent to 101, also did not want the City to go forward with the plan.

      L101MA has exercised a great deal of insider influence and lobbying, subsidized by the City, pushing a project under the name of beautification. We all want beautification, Fred. What are you afraid of, the truth? Are you afraid to use logic and common sense?

      Roundabouts may be a good fit, elsewhere, they are not on Highway 101, through Leucadia. Locals don't want more cut through traffic, slower emergency response times, more back-ups, and gridlock on the highway. That doesn't mean anyone is fearful of any change.

      A Sports Park may be great, but our City has paid many, many times the cost of Pacific View to purchase the land, and now construct the beginning phase of the sports park. A City our size is taking on a huge amount of debt. That is what people are concerned about, with the Sports Park, now, the debt service, maintenance costs, and the issues related to toxic soil, and the recent run-off, that was never tested for toxicity.

    17. Leucadia Neighbors also did a survey, which demonstrates that most adjacent residents and most merchants do not want roundabouts on 101, through Leucadia. Some people have indicated they could support a two lane roundabout at Highway 101 and La Costa, but there's no guarantee a traffic signal would not be later installed there, as has been the case at many roundabout, nationwide.

      "The sky is falling" scenario of "people avoiding 101 because of backups" is not because of your concern for the businesses here. Its to frighten anyone you can into thinking traffic on 101 will become a snail's pace with roundabouts. You believe it will, I believe the roundabouts will aid circulation. Stops are what create gridlock. Streetscape removes over 20 mandatory stops making travel time for those using 101 and related side streets quicker, easier and safer.

      I agree some would avoid 101. Like commuters who should be using Interstate 5 who use 101 instead as a fast track to Sorrento Valley. The same cut through folks that likewise create little revenue for Encinitas. They'll avoid 101 because of the illusion it will take them longer to go through 5 roundabouts than to travel 101 the way it exists now. Not so. By removing the stops at La Costa and Marcheta it will make going from La Costa Ave to Encinitas Blvd a shorter trip time wise. That's what removing stops does. There will always be periodic back-ups, but those are always exacerbated by the stops at La Costa and Marcheta. Congestion will be relieved a lot when better circulation elements are introduced. When our roundabouts remove over 20 stops, do you have any idea how much time that will save drivers collectively on a daily basis? Let's see, 9000 cars a day not having to stop for 1 minute each.....play with those numbers a few minutes and get back to me.

      I must have been closed the days those surveys came by our shop.
      Is it just me, or is it a wee bit ironic that you comfortably rely on local survey conclusions conducted by a former board member of the Encinitas Chamber who is strongly pro-development and fought tooth and nail against Prop A? A man down on Streetscape but high on 5 story buildings. Which brings us to the other paradox. Namely, the fear you're trying to instill that roundabouts are a developer's tool that will create "mitigated negative environmental impact declarations" permitting over development near them. Why wouldn't your survey guy like roundabouts then? I would imagine for the same reason so many developers don't. They want Streetscape's funding for other areas of the city because N 101 is virtually built out and lots are owned by the stubborn who don't want to leave. Nothing wrong with liking greener grass on the other side of the hill, I'm just sayin'. And btw, no one ever showed me WHERE roundabouts EVER caused over-development through a "mitigated negative environmental impact declaration". Do tell.

    22. No, Fred, I'm not attempting to frighten anyone, only to use common sense and logic. People avoided 101 during construction of Phase ! of Downtown's Streetscape. People avoided 101, through Solana Beach, during construction of that streetscape. Roundabouts were not used in either of those locations. But during construction, the businesses suffered, mightily. Some did not make it through the process.

      If one-lane roundabouts were to be installed through the "business district" of Leucadia, businesses would suffer not only during construction, but afterwards, because the roundabouts would be obstructions on the road, narrowing what had been a four lane configuration with two lanes northbound and two lanes southbound down to one lane in each direction. Traffic already backs up, now, during peak periods. It would be a nightmare, if this became a permanent condition. People, including merchants, can figure this out for themselves.

      Motorists don't need to stop at roundabouts, when traffic isn't heavy. When it is heavy, just like at a yield sign, people DO HAVE TO STOP. That, too, is only common sense. When traffic is heavy, during peak periods, four roundabouts, nearly in a row, would create more back-up. People could not just plow into the intersection without stopping. And there is no guarantee that a traffic signal would not have to be installed at the La Costa roundabout, as has been the case for many other roundabouts across the U.S., in Mexico, and in Europe.

      There is also no guarantee the stop sign would be removed at Marcheta, just as the stop sign was to be removed at Hygeia and Leucadia Blvd., but never was. In fact, because people do cross the tracks near Marcheta, taking out that stop sign would not be a good idea. I know people can get a ticket for crossing the tracks there, but I see it happening all the time. After awhile, the public should gain a prescriptive right of way to do so, in my opinion.

My reasoning was to show that surveys from both sides of the "political spectrum," the Chamber of Commerce, and Leucadia Neighbors, demonstrated that not only a hefty majority of the public are not in favor of roundabouts AT THIS LOCATION, through Leucadia, on 101, but also a majority of merchants. Maybe you were out of your shop that day. Russ rode his bike up to Just Peachy the other day, and was going to stop by to say hi to you, and you weren't there; your shop was closed.

      But importantly, the contractor hired by the City, Peltz and Associates, showed by its one valid survey, taken in October of 2008 that over 60% of those taking the survey at the most widely attended workshop, at City Hall, did not want the City to go forward with the roundabouts and lane elimination as planned. A subsequent survey, the next year, because different questions were asked. The only choice was between five roundabouts and lane elimination on 101, or more traffic signals. The questions were biased and the answers were "stacked," as someone who said she would be in favor of only ONE two lane roundabout at La Costa, was counted as YES for Plan 4A, with five roundabouts, four of them one-lane roundabouts; anyone answering that the possibility of any roundabouts could be explored further was counted as a yes. That last survey was rigged, and everyone participating knew it.

    24. Yes, Marchta street's stop signs will come down. Yes Streetscape will not be without growing pains during construction. But no, it won't be a gridlock nightmare when over 20 stops are removed, but a circulation element long needed. And roundabouts that requie lights are mega roundabouts not like ours.

In keeping with a fiscally conservative approach and with a goal to help balance our City's books, we hope that, before it's too late, the City Manager and Mayor will consider hiring two half time Code Enforcement Officers, rather than another FTE. When the City Manager gave his brief report, tonight, he did not address the questions I had last week sent to all of Council and to Planning Director Jeff Murphy about the March 26 staff report agenda item, and Deputy Mayor Mark Muir's specific motion, which was to hire a half time CEO, now, not wait until May, which half-time CEO would be devoted, exclusively, to pro-active enforcement of regulations related to alcohol serving establishments.

    Citizens and some Council Members have been disappointed when it turns out that the City Manager has gone ahead and initiated contracts, such as the one through Peak Democracy, or the contract with Rutan and Tucker, when these discussions are only brought to council after the fact of the contract. I heard, tonight, from Gus Vina, in his report at the end of the meeting, that the City has already solicited for a new FTE, when that was not our understanding of Council's direction.

    Moreover, the City Manager said nothing about the motion maker, Deputy Mayor Mark Muir's caveat that funding for a half time CEO for proactive code enforcement related to alcohol serving establishments must come from savings from other departments within the City. In order not to again appear to be overstepping his authority, Gus Vina could have more correctly also shared where the savings are to come from, in his solicitation of another (we feel unwanted and unnecessary) full time employee. Considerably less expense to the City, including in pension benefits could be gained through hiring two half time employees, rather than one full time employee.

Check out the pay information WC listed a few weeks ago. A lot of the FF earn in the 80's, until the OT kicks in, then they all earn into the $130k range....

      Roundabouts may work wonderfully in other locations. They usually don't work, in heavy traffic, and in those locations, nationwide, where there is heavy traffic through roundabouts, because of all the problems with failures to yield, stop lights have been installed in those same roundabouts.

      The final survey at the Community Center, and continued at City Hall, in Sept. 2009, was invalid. One reason was because there was only a choice between traffic signals and five roundabouts, four of them one-lane roundabouts and lane elimination, down to one lane northbound and one lane southbound. There was no option, for the 2009 survey through Peltz and Associates, as there had been in October of 2008, at the most widely attended Peltz and Associates (roundabout lobbyists) workshop, held at City Hall, to say NONE OF THE ABOVE, we do not want the City to go forward with a plan for roundabouts and lane elimination for motorists on 101, through Leucadia.

      The alternative for traffic signals was "thrown in" because Jerome Stocks said come back with another alternative and then do another survey. He did not say eliminate the alternative of no roundabouts, without having to instead choose traffic signals!

      People wanting only ONE two-lane roundabout at La Costa, were counted as yes on Plan 4A with 5 roundabouts and a lane "diet" in both directions. Traffic would have been slowed to 15 MPH through one roundabout after another, in the BEST of scenarios. In the worst, there would be bottlenecking and gridlock, as motorists entering from the west, in particular, would be required to stop when cars are entering the roundabout from the north or south part of the one lane roundabouts' 3-way T intersections.

      Simply stated you comments were proven to be lies. Same as Sheila. We get it Lynn, you don't like roundabouts.

      Many of us love them. Your rants will not change that fact. The speeding problem on Hwy101 still exists. Roundabouts will help address that issue. Speed limits have little affect on driving speed. Like stop signs people ignore them.

  25. City of Gothenburg Sweden says they will reduce city staff worker hours to. 6 hour day. City workers in Enc respond by saying they will not work these long hours.. Enc fire fighters say they will put in a 6 hour day but only if they are paid overtime.

My guess is you are not even in the ballpark with her commitment to this community. Sounds like crappy marvy again spouting inanities as usual. You are what you are and you seem to revel in it. I heard a saying recently that so applies to you if I can get it right. There is no point is getting in the muck with pigs as you will soon realize that they love it in there. That is close but the meaning is clear enough. Lynn is a treasure and is well known for her unflagging and boundless energy in holding our electeds' responsible for their actions and inactions. The more you rail against her the lower you descend into irrelevancy and wouldn't that be such a shame for you. Not!

The actual waste of taxpayers dollars are the wasted hours that employees who we pay spend by putting out misinformation that others need to research and resubmit. We then have to paying them to correct their own misinformation Lynn is one of a few people who bring up these mistakes and ask for them to do their jobs.

  38. I have been critical of some who work at the city, but how can any of them be their best with Gus Vina in charge? How are they supposed to act, when he publically lies about issues like the Rutan and Tucker contract just to name 1 instance. According to retired city employee Rhonda Graves, he meets with them and threatens their jobs. How is their performance gauged? Are they threatened if they don't lie as well as he does? That place sound like a very bad place to work since Gus has taken over.
