The big promise revolves around a covenant on the property that would prohibit using the density bonus. It doesn't appear that the city attorney has provided the Council with any opinion on the legality of such a covenant and how it would be against public policy.
Instead of these closed doors meetings, the city should offer outright to buy the property on a yearly lease. The school district gets a steady stream of income and the city gets park.

As expected, $tock$ and Bond voted to rezone Pacific View School; while Barth and Houlihan rejected the proposal. Gaspar recused herself, claiming she has had no prior involvement and therefore is unable to render an opinion. Sabine did his routine double talk and long, exasperating expositions that just further muddled the issue. He was trying to infer that the council had no choice but to approve the rezone proposal, as it was predecided by State law. When the issue faltered, $tock$ was visibly irritated and predicted that a judge would force a rezone under worse conditions than those presently proposed (higher density). Neither $tock$ nor Bond heard any of the public sentiment to preserve this public cultural heritage, but were frustrated that they couldn't move it forward. Houlihan brought up the Ecke proposal to rezone his property - it is a scam to get it away from agricultural zoning, then a public vote is no longer required for him to develop it. It is his second attempt to break his promise to the community and develop the land that he said he'd keep in agriculture in perpetuity. He lied to the public the other night and said it was for "refinacing" purposes. Apparently Ecke III cannot speak any other "truth" other than that which fits his purpose - and that purpose is $$. Watch for $tock$, Bond and Gaspar to approve their Master's wishes.
