9/28/16 City Council meeting open thread

The current city council has continued prior councils' practice of not providing written summary minutes of council discussion, but only "action minutes" which state the outcomes. Encinitas Undercover will provide a forum for observers to record what occurs at each council meeting.

      The City was arguing that they had discression to round down in DB calculations. AB 2501 says they do not, and it also states that this was always the law, so the city can't try to grandfather rounding down.

    1. We didn't spend it until the City awards the contract to construct it. There is still time not to make this colossal waste of money to build a cop fort in the surf zone of the beach. We need cops giving straight-pipe violators tickets and speeding tickets, not staring at bikinis all day.

      It will never be a high priority for law enforcement, because they have higher priorities.

      The people who buy and operate straight pipes are simply inconsiderate jerks. But there is no time or place throughout history without inconsiderate jerks. Best to move on with your life and not let something you can't ever control ruin your day.

    Many communities have and will continue to address excessive and illegal noise pollution. Hence, the existing laws.

    Noise pollution has grave impacts on health (mental and physical), environment (nature), property values, and financial success for businesses, and quality of life in communities. Because of the importance of the issue, many community have adopted quiet zones, and enforce existing laws.
    If you don’t address the idiots, the idiot population bad behavior grows dramatically. Which has happened in Encinitas.

    I know the prior poster doesn’t agree, but I know many in the community who do care about noise pollution issues that could and should be addressed.

    --Enforce existing California Vehicle Code laws.

WC, the proprietor of this blog needs to decide if that is what is desired. Maybe go all the way to alt-right. Free speech is one thing. Hate speech is another. The person(s) making those comments have the right to publish. The question is whether WC wants it published here. WC has exercised editorial judgement before so it's not like this is anything new. Maybe WC agrees with these comments and wants to associate Encinitas with it. Who knows but the lack of action is telling.

That would explain why so many anti-semetic posts are being left up and others are being deleted. In the past when something was deleted by EU, it would say "this comment deleted by EU", or something like that. Now, the only way we know if something has been deleted is by other people posting it. Something seems different about Encinitas Undercover. Does anyone else think the same?

      There are literally hundreds to choose from, so certainly you can point to ONE without the "developer friendly fine print."

      I think encinitasforward does a very good job of presenting an objective analysis. (no, I don't work on the site; no, I don't work for the city. Yawn.)

      I'm inclined to vote against people who are not telling the truth, like the measure undermines Prop A. It doesn't. In fact, Measure T is a direct manifestation of Prop A. Prop A calls for a vote on any upzoning, and we are going to vote. The council super-majority language in the draft has been removed, so this talking point about undermining Prop A is 100% false.

      I have read other HCD and have seen things such as low interest loans for updating granny flats. ( which just became eaisier through state law, despite Encinitas road blocks.). They also include other owner-occupied options. Yes, SOME developer friendly stuff but nothing like Encinitas. Unless, of course, the city is also run by developers. Encinitas will not be, you are at the point of dimishing returns. Studies have shown that investing in Republican politicians does not pay off.

      This all or nothing stance by you city folk is silly. A mixture of both owner occupied and developer hand outs would pass.

      Personally, I feel like it is picking between PB(every yard is an apt.) or Huntington Beach with stack and pack. A toned mixture of both with respect to lot lines, height, and set backs is all I want. The corrupt process will never allow that. May as well try to kick the can down the road for as long as possible until something breaks. Rather the city be broke than let corruption win and have to deal with three story BS.

    2. The Sheriffs need to walk a downtown beat on weekends. Putting them on the beach is pure fluff, as the lifeguards are the first responders. The Sheriff claimed under staffing issues, but can spare personnel on the sand? When was the last crime out break on the shores? The Moonlight Beach Taj Mahal is a testament to misguided spending priorities and over-staffing.

  44. 10:09, if you believe that the language in Measure T that eliminates future resident votes "to stay compliant" doesn't circumvent Prop A, then I have a bridge to sell you.

    By inserting the 4/5 supermajority clause, gone now only because residents complained, the City showed its hand early on: get rid of the voter. Pretend you listen at "workshops" and "outreach," then get rid of the voter.

    Should Measure T pass, Prop A will have applied to this vote only; if Measure T passes, voters will have kissed their future votes goodbye. They'll watch helplessly as the City squeezes all other upzonings into "to stay compliant" decisions.

    There's a reason language stating the City will meet annually with developers to identify the next round of "infill opportunities" remains in the 230 pages of policy changes. Those developers will be the real and only stakeholders left as far as the City will be concerned.

      First you admit that the supermajority council uozoning is "gone now." As in, it's not included in the final version.

      Then you go on to claim that if the measure passes in its current form, the council will be able to avoid future voting on upzoning.

      Question: how will council be able to pull that off if the offending language is "gone now?"

    2. There is more than one place the language was inserted, but I suspect you know that. For the City to think residents would believe the 4/5 was all that covered how/if we vote shows the usual attitude toward residents.

      We have been (sadly) trained by the City to know we need to read the fine print.

      You sound angry and not a little desperate. I'm hearing that tone a lot lately from certain Council and staff members :)

    4. I didn't post anything above. I did attend the first workshops on the HEU. I had discovered the Prop. A killer clause and pointed it out to Mike Strong. At first he denied it, but when I gave him the page number, he said the city would take it out. I then asked him why it was there in the first place. He had no answer.

      It was many, many months before it was taken out and only after public outcry, including on this blog. However, other things were left in, such as how height is measured. Under Prop. A it is from the natural grade or finished grade, whichever is lower, up to the eave of the roof. Under Measure T it will be measured from the midpoint of the finished grade up to the midpoint of the sloped roof. Doesn't sound like much, but it give an advantage to the developer which has nothing to do with state law. The result will be higher pads and more blocked views.

      Measure T DOES eliminate future votes to comply with future HEUs. It still allows a public vote on non-housing element upzoning. But how many of those will there be? With a RHNA number of 1093 Measure T upzones to 1987 units at minimum zoning (R-20) and 2979 units at maximum zoning (R-30). We will be approving or rejecting R-30, not R-20. Add in Density Bonus at 35%, approval will upzone for over 4000 units. The city calculates added traffic for condos or apartments at 6 daily car trips. This comes out to 24,000 more car trip per day or 8,760,000 per year, if all units are built. This is not trivial. I'm voting NO. We can get a better plan -- strip out all the language not required by the state, bring the upzoning down to what is only necessary, preserve future HEU voter approvals, and make transparent all details now buried in 230 pages. Also get rid of the silly AT HOME IN ENCINITAS zoning designations.

    5. This measure is so corrupted, it is the Red Herring of the year. It is an outright gift to the developers - and all the current city council members support it. I will probably vote for 2 only, as there aren't three choices for city council.

    On the Nov 8 election there are 2 seats opening on the Encinitas Union School District board. EUSD runs 9 elementary schools with about 5,000 children. This is important even if you do not have children in the district. The current board and superintendent have spent millions on non-academic and extra-curricular projects while ignoring the core curriculum and parents’ objections.
    Current Board member Patricia Sinay says she is running for re-election and that is false. She was never elected and was appointed by the current failed board to finish a term of a vacated seat. She votes yes 100% of the time as instructed.
    Rimga Viskanta is also running and she is currently Vice Chair of the Citizen Oversight Committee for Proposition P Bond fund. She was appointed to that post by this same Board to oversee the Board regarding spending of Prop P funds. When she actually attends a meeting which isn’t very often, she rubber stamps any spending proposed with no oversight whatsoever. We can assume she will continue that trend on the school board.
    Leslie Schneider and Ann Katherine Pingaree are both running for EUSD board seats and they are two well qualified and involved parents of students in the district who are committed to making sure your tax dollars are not wasted. They stand for fiscal responsibility and transparency. They will listen to us and put these children’s needs first for a change. Please Vote.
