North Coast Current on Blakespear bike obstacles

North Coast Current:
Encinitas officials have defended a new protected bikeway along Coast Highway 101 between Cardiff and Solana Beach that may seem inviting for less-experienced cyclists but has actually been the site of multiple accidents, even striking some of the area’s most veteran riders.

Len Bourgeois, a local cyclist who has been riding for decades, said he suffered a double fracture to his collarbone after hitting one of the new bikeway’s wheel stops in Cardiff, immediately flipping his wheel around and forcing him to the ground.

Bourgeois has yet to report the incident to the San Diego County Sheriff’s Department, but he would not be the first.

    1. That's what the mayor wants you to believe. She responded to one injured party that the accidents were due to a "learning curve." Some nerve there. That email was first posted on Nextdoor and now in the cycling Facebook thread below.

The 15 accidents have real names behind them. Go to the Facebook page "Please Restore Safe Cycling in Encinitas" for full discussions: https://www.facebook.com/groups/556935515245051/

  8. Take the road out. Open up the lagoon to tidal flow. That will save all the bitching by cyclists and the lot.

  9. The cyclists have every right to use the road and complain. Its very dangerous. People need to learn the laws of the road.

I want to see blakespear go right with her hubby and kin in the sharrow lane. How safe does that feel with trucks flying by at 60 mph?

Like most things in Encinitas with this crappy Mayor, things change when lawwuites hit.

Watch even though we are going to payouut millions due to negligence on the Coast highway and Roberta and others needlessly getting mowed down, the City still does not provide for bicycle lanes going south. Could they be more dumb and dangerous as a City Council?

“ Section 16005 of the California Vehicle Code makes the information on SR-1 accident reports confidential and subject to disclosure only to those with a “proper interest” in the information, and includes a list of the types of categories of persons that are considered to have the necessary ‘proper interest.’”

“. . . may be given to any person having a proper interest therein, including:

      (1) The driver or drivers involved, or the employer, parent, or legal guardian thereof.
      (2) The authorized representative of any person involved in the accident.
      (3) Any person injured in the accident.
      (4) The owners of vehicles or property damaged in the accident.
      (5) Any law enforcement agency.
      (6) Any court of competent jurisdiction.”

Which one are you? If any of these describes you, you can get the accident report.

    https://patch.com/california/encinitas/man-convicted-in-deadly-leucadia-hit-run-bicycle-case

Saddest part is after all this blood spilling on the road, the City Council keeps the road in a very deadly condition. They know better and the trial attorneys working on the cases know better as well.

The simple needed bicycle lane in the south bound direction from La Costa to Encinitas Blvd. will be made after one or two more mow downs. There is no good reason why it has not been done today. Are they waiting for a kid to be killed in the sharrow lane? Judging from the bicyclists I see on that road including ice cream eating clueless tourists on fun rental ebikes and the sharrow's that tell them its safe to ride in that lane, that day I fear is not as far off as I'd like it to be.

Sad but likely true. I gets me sick to know this is known and nothing is being done. This shows the City's leaders are clueless or plain stupid.

The millions in payouts could have paid for the needed bike lanes plus the long awaited streetscape, but now we get to pay double with all that unnecessary pain, suffering, and carnage. Sigh.

    2. 9:52 - i responded to the crash and screaming after swarzman was run-over at jason and the 101. It took 15 minutes for the sheriff to arrive and another 10 for an ambulance. Flight for life arrived 50 minutes.
The 101 in leacadia was a 4 lane road then. Very dark.
Criminally inadequate/ emergency services, ruined swarzmans chances of survival .

    3. 10PM Stupid,

The accident report is confidential by law unless you are in one of the six categories listed above (which is a verbatim quote from the law).

SR-1 isn’t a reference to the roadway, as it would be stupid for the state to have different reporting requirements for different roads. SR-1 is the standard reporting form for traffic accidents.

You are stupid. Please refrain from voting or reproducing. Refrain means don’t do it. Reproducing means having sex. Voting means—oh dear god, I give up.

    4. An accident report is not required to be released if no citation is issued. The implication, of course, is that the driver of the truck in the Roberta Walker crash didn't violate the law. The city could ask for the report to be released.

Mayor Blakespear was planning to appoint Roberta Walker to fill the vacancy created when Tasha Boerner Horvath was elected to the State Assembly. For political reasons the mayor wanted to make this a cause célèbre to advance her agenda. As a lawyer she should have known better than to say the city was at fault for not having a bike lane. It doesn't appear that the lack of a bike lane was the cause of the accident.

Now the mayor has created a situation on south Cardiff Highway 101 which makes the city liable for any serious injury caused by the reconfiguration of the highway. And the taxpayer will cover the settlement.

    5. 8:16,

      Stop making shit up.

It has nothing to do with a citation being issued.

      Google CVC 16005.

      ALL accident reports are confidential.

The law describes basic information from the accident reports than can be released to anyone who asks: “ (1) The names and addresses of persons involved in the accident.
      (2) The registration numbers and descriptions of vehicles involved in the accident.
      (3) The date, time, and location of the accident.
      (4) Any suspension action taken by the department.
      (5) The names and addresses of insurers.”

That’s a direct quote from the law. We already know this information from the press reports.

Any further information and the accident reports themselves are confidential and may only be given to (again quoting from the law):

“ (1) The driver or drivers involved, or the employer, parent, or legal guardian thereof.
      (2) The authorized representative of any person involved in the accident.
      (3) Any person injured in the accident.
      (4) The owners of vehicles or property damaged in the accident.
      (5) Any law enforcement agency.
      (6) Any court of competent jurisdiction.”

If you are not in one of those categories, the law says you can go pound sand and have your tough shit card punched.

Read the law for yourself here, and stop making shit up:

    2. And just because other create a hazard does not mean they are not llable. Wait for the payout. The hammer will drop and things will change in Encinitas, solana beach and other Cities. It will only take one or two mow downs in Solana Beach to get that change started.

  15. “You start out in 1954 by saying, ‘Nigger, nigger, nigger.’ By 1968 you can’t say ‘nigger’—that hurts you, backfires. So you say stuff like, uh, forced busing, states’ rights, and all that stuff, and you’re getting so abstract. Now, you’re talking about cutting taxes, and all these things you’re talking about are totally economic things and a byproduct of them is, blacks get hurt worse than whites.… ‘We want to cut this,’ is much more abstract than even the busing thing, uh, and a hell of a lot more abstract than ‘Nigger, nigger.’”

  20. Whats your favorite part about Blakespear?

Mine is the way she invites all the homeless and drug addicts to Encinitas for free beach living at the expense of us residents.

Thanks Mayor! We do not mind all the increased violence, theft, and poop left all over our town. you are doing a swell job!

    1. Oh, hi Jeff.

      Couple questions.

One of your objections to the homeless lot was that it wasn’t humane and that they should have rooms with beds. How is your work going on that additional project and when will you be applying for permits to open?

One of your other complaints about the parking lot was that only a small percentage of the budget gets handed out directly to the homeless in cash. What percentage of your budget will be direct cash handouts?

Also, you complain that the parking lot attracts homeless to Encinitas, even though it’s not even full. How will your much more luxurious room with a nice warm bed and soft pillow not attract even more?

Final question: aren’t you actually full of shit, and in fact doing nothing to create additional services to help the less fortunate here in Encinitas?

      We’ll wait for answers.

    2. Oh hi, city shill 8:39.

      Two questions for you:

You are good with the city working in secret for months on end and ultimately getting caught violating the Brown Act. Even the city attorney admitted to this. So you are good with that?

The mayor was overheard on the council meeting break arranging for portapotty deliveries to the parking lot before she took the vote to approve/deny the lot. You are good with her pretending to listen to concerned residents but already working behind the scenes on what was apparently a done deal?

Yes or no to the above - we'll wait.

That road has been the same for over 20 years. Nothing has changed. Drivers haven’t changed. Cars haven’t changed. Cyclists haven’t changed.

So the answer to your question is, the city will probably pay in lawsuits over the next five years the same amount they have paid over the last five, ten, or twenty years.

      Now a question for you.

How much has the city paid out to cyclists in lawsuits over the past five years?
