Taxpayer-funded Leucadia 101 promotes Kellie Hinze re-election campaign


We have long noted the unseemly relationship between Encinitas’ private merchant associations and the city council politicians who vote to give them public funds.

They’re at it again. Leucadia 101, which still, as far as we know, receives public funds at the discretion of the city council, promoted the campaign of one of its benefactors at a charity event.

    It is a sham that our city pays any of them anything. They deserve to be deprived of any of our tax dollars going to these organizations.

    Sure, there are a few members that are not in the real estate/developer business but the majority are and we are paying them?

  14. First, there’s an accusation. An accusation means nothing until it’s proved, and there’s a process for that.

    After an accusation is made, someone needs to make a formal complaint to the Fair Political Practices Commission (FPPC). Then the FPPC does an investigation. Then there are findings. Then the accused has a right to dispute and challenge those findings. If the findings are upheld, the FPPC may impose a penalty.

    At this point, Hinze has been accused by random anonymous blog posters who probably aren’t lawyers—nothing more. I’m not sure what the accusation even is, as Hinze doesn’t control what L101 puts in its own website.

    Meanwhile., Hinze’s opponent had an accusation made against her to. But in her case it was followed by a formal complaint, and an FPPC investigation which resulted in an admission by Turney that she violated election law 13 times, and must pay a fine.

    So one candidate for D2 has an unfounded anonymous allegation. The other has a 13 count civil judgement against her.

    So if election law violations are your key issue, only one candidate has been proven to have done anything wrong.

L101 is happy they have their insider and like any special interest promotes, using tax payer money in this case. Its an inside job in a city full of back door special interest deals. Special interest/lobby ground don't get to use tax payer money to subvert democracy. L101 should give back the money or Kellie should recuse herself from all things L101.       First, Anti-SLAPP suits are not expensive. In fact, they are FREE. The whole purpose of an anti-SLAPP law is to deter frivolous lawsuits by making well healed litigious plaintiffs pay all legal fees of the defendant.

      Second, anti-SLAPP suits are not relevant in this case, because the only legal adversary in Susan Turney's case was the FPPC. She wasn't being sued by anyone other than the FPPC. If you are suggesting that either she could have brought anti-SLAPP action against the FPPC, or against a third party who filed an FPPC complaint--then you are a bigger moron than I previously imagined.

      Third, if you are relying on Susan Turney as an objective and impartial source for your news and information on her own FPPC case--during a time when she's running for office--then the depths of your stupidity are heretofore unknown to science and nature.

    Because of our support of Prop A, I and others became a target of those opposed to Prop A.

    My guilty pleas were over minor clerical errors and the FPPC settled with me for a nominal amount - $38 per infraction. Asking the FPPC to impose minimal fines for minor offenses prevented Ken Moser and Harry Eiler, who made the complaint, from filing a civil lawsuit against me that could have led to huge legal expenses.

    Since Ken Moser lives in San Diego, he had to use an Encinitas resident, Harry Eiler, to file against an Encinitas resident. Moser makes a practice of filing these frivolous clerical-error lawsuits against political opponents. He and Eiler have a history of harassment in Encinitas in particular, having filed 96 complaints in one year alone against former Encinitas Mayor Maggie Houlihan - anything to hassle the opposition. Because of Moser’s complaints, the FPPC has remarked that there were odd things going on in Encinitas elections.

    Moser himself is now facing a $10M fine from the FCC for repeating a fake assault claim against a candidate:

      4.) At best, Turney mismanaged the the organization she was entrusted to manage. Mismanagement isn’t exactly a strong resume bullet for elected office.

      5.) Turney’s mismanagement wasn’t using her own money. She had a responsibility to the people who donated to manage and report in line with all applicable laws. By her own admission, she violated the law 13 times.
