Taxpayer funds buying political support for No on A?

While the City Council is determined to defeat Prop A, the Right to Vote Initiative, should they ask that the city business associations take a position on Prop A?

Encinitas has four city business associations and three of them currently receive taxpayer funded support in the total amount of $70,000 from the City Council. The Chamber of Commerce hasn’t received city support money for the last 3 or 4 years. At one time the Chamber had received up to $90,000 a year. According to the Chamber representative, the Chamber has a debt that should be paid off by October.

At the March 27, 2013 Council meeting the associations, which are the Downtown Encinitas Merchants Association (DEMA), Leucadia101, Cardiff 101, and the Encinitas Chamber of Commerce presented a report on their accomplishments. It was agenda item #4.

It was at the end of the presentation that Councilman Mark Muir, the retired fire chief, asked a question of the representatives that was completely unrelated to the agenda item.

Approximately 1:31:47 into the video of the meeting, Councilman Muir asks the representatives – Have you taken a position on a vote on the initiative coming up is the first question and second if you haven’t are you going to?

Each association representative goes to the microphone and answers Councilman Muir’s question that it will be discussed at the board meeting.

The Downtown Encinitas Merchants Association (DEMA) receives $20,000. Cardiff101 receives $20,000. Leucadia101 receives $30,000. On the May 22 Council meeting was a funding request for the Council to give $20,000 to the Chamber of Commerce. This vote was delayed.

With the exception of the Cardiff101 association, the other three boards, DEMA, Leucadia101, and the Chamber of Commerce voted to support the City Council’s No on A position.
The city's incestuous relationship with the associations does raise eyebrows and creates the opportunity for, and the appearance of, corruption. City funds should not go to private business groups in the first place.

And Councilman Muir's crass, stupid questioning of the associations about their positions on Prop A during the discussion of their receiving city funds adds a lot of weight to the appearance of corruption.

  1. Muir is no rocket scientist. Remember he was a protege of Stocks and was caught with him posting campaign signs illegally - indicitive of his ethics in general. He also recently voted to hire more firemen to the already overstaffed department, when the previous discussions were to allocate human resources more efficiently. Muir was only voted in on his "fireman" image; the majority of the public don't realize he is pro-growth, pro-fat pensions. With guys like this on the council, Encinitas faces a dire future.

  2. Please, lets keep this discussion to the facts. I'm kinda tired of the games, conspiracy, misinformation, or flat out lies. People and groups should stated their position when they represent others - particularly when it impacts their members. I have no problem with that, in this case, I just don't agree with them!

    The reason I don't come out publicly is because people like you or them will try to vilify me. No wonder no one wants to run for office. Once they do, they are again vilified for their beliefs. It's interesting that those who are the most critical of government, never want to run and subject themselves to people like themselves - go figure!

    We now have a really good council - I just don't agree with them on this particular item.

The city debt service for this year increased by 600K, Sherriff costs are up 8%, fireman 3%, the city's debt ratings as measured by credit agency's is getting worse not better, we have unfunded pensions of $39M, Calpers payments will increase by $2M in a few years, the city needed to raid 15 capital accounts of money to start the hall park, they city is selling pavers for the hall park, at the council meeting 2 weeks ago the council discussed raising fees on youth sports and parks-

      What is the new good council's action to the increased debt and reduced services? Hire a PR specialist for 135K annually.

    3. Why is Dody Cerawford and DEMA willing to stand behind the council that told the untruth on the ballot rebuttal that no upzoning happened without a vote of the people?

      Dody and DEMA must know this is untrue as they benefited by the council upzoning the 101 awith a vote of the people.

      DEMA is about making money for merchants. DEMA should not get taxpayer money. The business community exists to serve residents with products and services at prices people want. Residents do not exist to serve business. The days of the company store are over.

I believe one organization's stated position on Prop A was they supported the council. That's interesting. I'll try to pull that up if I have some time.

    6. Many Chambers of Commerce do not receive direct city subsidies. They should rely, primarily, on money from their own sponsored events, and membership fees. Peder Norby facilitated an arrangement whereby Leucadia 101 Mainstreet Association gets a portion of rent from vendors who sell at Sunday Farmers' Markets at Paul Ecke Central School? Why does L101MA get this subsidy in addition to $30,000, more than any of the other local mainstreet organization?

      And the Chamber of Commerce was subsidized MORE than $90,000, in the past, while it's "newspaper" published by Mike Andreen, was boosting Jerome Stocks and disgraced Dan Dalager. The Chamber received $94,000 just to MOVE from its previous location in the old Smart and Final shopping center, near Cottonwood Creek, where the volunteers ASKED to remain at public Council Meetings. They preferred the prior location because there was more parking than the new, subsidized location on Second Street, and because visitors/tourists were more easily able to find the Chamber when exiting the Freeway at Encinitas Blvd.

      WCV is correct, from the perspective of most of us who are following the shenanigans at City Hall. Why was the State of the City Address never repeated at City Hall? It was only offered as part of a "commercial event" for the three "rebranded" mainstreet associations and the Chamber of Commerce. Tickets were $20 each. There is a fine line between that Council Meeting being appropriate, or illegal, because all of Council was present.

      There is an appearance of corruption when the Main Street organizations are literally lobbying for redevelopment, but do not report any lobbying activities on their tax returns, as seems to be the case.

      We support our local businesses. We don't support a gentrified, generic, nationwide mainstreet associations that are another opportunity for public officials and private organizations to engage in conferences, and behind the scenes "schmoozing" to lobby for development that is not what the majority of the general public wants.

      Most of us would like to limit our town to two stories, and 30 ft., with certain limited exceptions; hence, we're voting YES! Our wishes weren't honored by the Specific Plans for North 101 and Downtown, passed without a vote of the people, naturally.

      I've suggested this before. The council would be better off identifying programs and projects they want to fund and then opening up the opportunity to people based on the merit of their proposals rather than how well received they are by individual council members.

      Council members reportedly threatened to take city business away from the Coast News over political differences. Do you really believe all the council members are so pure that they wouldn't let political issues influence how much they give to private groups?

      This is both a financial issue and a clean government issue.

The council's response to news two weeks ago that the city has more debt by 600K, unfunded pensions, and rising costs was to discuss raising fees on youth sports AND they approved hiring a PR specialist for 135K annually to spin their story- this is good work? They could have paid down debt, they could have taken the 135K and used it to reduce fees on residents and the council did neither- they are playing fast and loose with our money.

      Quality of life-? The council sided with developers over residents on Prop A and voted to increase density in Olvienhain prompting residents to suit them.

      Pensions?- they should immediately stop hiring any city staff that would obligate residents to pay a pension- instead they have hired 4 new people this year all making around $150K- about $800K that could have been saved has been spent-

      These are facts to show the council is doing a horrible job in moving quickly to set the city on a better course financially.

    2. Previous councils have seriously neglected roads maintenance. Kranz helped to uncover that. I've offered to the council and the city manager to update the roads report to see how far behind we are now and help in their strategic planning. None of the council offered to fight to get a new report created or released to the public. One council member told me that staff just sets an amount and they fund at that level. Staff decides and that's how they have always done it (even though it didn't work).

      Pensions? Glossed over. No action planned other than kicking the can down the road and adding some hope that Sacramento fixes the numbers problem for us.

      Upzoning? The Mayor isn't supporting a plan that will ensure the voters will have the last say on deals made between the city and the upzoners.

    Lets put a stop to the Encinitas Street Fair, the holiday parade, car shows, farmers markets, fashion shows, environmental days, art festivals, music festivals, historic walks, octoberfest, charity support, school support and all the other disgusting events that these corrupt, paid off criminals are trying to stuff down out throats.

    1. 10:13- You confuse civic community events with business supported enterprise. The city putting on a street fair benefits residents, as does an art day, or a music festival. This is taxpayer money going to benefit taxpayers-

      Giving $20,000 to $50,000 to DEMA uses taxpayer money to benefit a few business owners, many from out of town. Even PEdr Norby who gets $135K to promote DEMA lives in Carlsbad. This use of taxpayer money does not benefit residents but benefits merchants.

      Your argument has no legs. Business should exist to serve residents. IF a business does not do that it fails and a new one moves in. Residents do not exist to serve business......

If I disagree with you ,I am wrong and you are rite.How convinent for your position what happened to debate,discussion.I don't care what they are telling you this prop A will ,if it passes go to the coastal commission .It will be there 2 or 3 years.During that time all current laws and code will still be in effect.The rush by developers to get their projects in the pipeline will be deafening .Our city will be ruined THANKS WC KEVIN AND BRUCE

    2. 1:14 - if you're assertions are true, that Prop A will be held up at the Coastal Commission a few things-

      1. If A passes it is my understanding that it becomes law immediately, meaning there would be a tolling until a supposed Coastal Commission review as you suggest would be done. This would mean no rush

      2. If what you say is true and there is a mad rush then only those property along the 101 would apply because they are the only ones the council has upzoned- yet- El Camino, Olivenhain, Encinitas Blvd are still zoned commercial and under local control.

      That is why I fear Gus Vina and the council along with Pedr Norby will move to upzone these properties this summer if Prop A is defeated by using the excuse of HCD and Sandag.

    4. It is not fair for me to take other people's credit. Why do you think I get any credit for Prop A? I was not involved in drafting or implementation of the signature drive. In fact, part of the R2V team thought I might be a "mole".

      If people disagree, figure out why and reconcile the differences. Is it because of different values or because of different understanding of the situation. In the case of Prop A, a lot of dust has been kicked up.

      Clear away this dust. If Prop A passes and Barth's proclamations are correct that the Coastal Commission will get involved, what's the problem? Is the problem that people will go out and build? What is wrong with that? We should expect that what is zoned will be built. No? Explain that. The moment land is rezoned is when the decision is made to change our city.

      I can only conclude that you think previous councils poorly zoned our city. Is this true? Do you regret not having had a vote on the zoning that will result in infrastructure that will appear in the future?

    1. Unsupported allegations?? A few facts, Mayor Barth told kpbs she is oOK with high density, that it is what regional trends are, that seniors and young people want it. Barth also voted to renew Pear Norby's contract with Jerome Stocks......the result was Norby recommending 5 story buildings. Shaffer wrote in an email she wants encinitas to provide affordable housing, this means the council gives new rights to a few while taking quality of life from others.....like desert rose. Then there is Gasapr and Muir who always seem to vote with Barth. Next consider Barth and Shaffer suggesting to limit speaking time of residents city hall and lastly all. Voted for a PR person right after discussing raising fees onresidents and youth sports. These are all facts.

  13. I trusted the Planning Commission to abide by the Specific Plan when it states a three story building cannot go next to a one story building. I won't do that again.
    And now the unanimous decision is revealed by the city's ERAC committee who have recommended 5 story buildings throughout Encinitas. Add to that a Mayor who now believes young people and seniors want more density in Encinitas. Add to that the latest tally of over #35,000 given to the No on A folks to fight Prop A by special interest groups inside and outside of California and you begin to see who's behind a big make-over planned for all 5 communities in Encinitas. No thanks. Vote YES on Prop A.

    The KPBS video with Barth bragging about Pacific Station and the implied virtues of Smart Growth is what did it for me.
    Time to tame the traffic mess in Encinitas: Biking, walking, and the occasional shuttle won't solve our traffic woes. It will have a minute effect.
    Imagine the traffic when Encinitas has 100,000 residents.

    Please read Sara Wan's detailed explanation in the Coast News as to why Prop A will not need to come before the Coastal Commission. As a 30 year member, 2 time chairperson of the Coastal Comm. she has more expertise in what comes before the commission than most of us, including our city staff, our city attorney and our council.

    First, Humboldt County voters remove one–former District Four Supervisor Bonnie Neely.
    Now her successor, Sara Wan, loses her political appointment for double-crossing a former aide to John Burton–who just so happened to be the man who appointed her to the commission these last 16 years." Not so sure, after all the articles I have read about Sara Wan that she is the best person the Yes on A people could have used.

      Did you know the 101 plan was approved without a vote of the people? Did you know residents along the 101 now fear for their safety, and have reported stabbings, fights and finding used condoms in their driveway?- This is what residents told the council at city hall last August in a packed standing room only hearing about density increases and loss of community character- the council's response has been to do nothing.

      I did not know if you were aware of these facts? The Encinitas council rebuttal on A claims no upzoning has happened without a vote of the people. This untruth is being promoted by Mayor Barth who wants us to believe she stands for trust. If Barth stands for trust why is she spreading misinformation?

  26. All one has to do is Google Sara Wan and read a lot of stories about her. All I am saying is when I read these stories, I was less impressed with her than I had hoped to be. W.c. wants us to put out all the facts. But, there are so many articles on this woman, it is hard to do. So, for those who want to blindly trust one woman that was outsted from the Coastal Commission, please be my guest. For those who are truly attempting to learn what is best for Encinitas, you might want to read the articles. She is from Malibu, actually, but the Coastal Commission, as we all know covers the entire coast.

    1. Exactly. It's of a piece, anyway: underfunded pension and project costs paid for through higher construction and property fees from large-scale projects that allow increased density and height.

      Throw in the Mayor's "fact" that folks want to live packed together, both young and old, because that's some so-called trend and you've got a pretty neat little package.

    1. That's a tall order!. Good luck convincing the residents of Encinitas that "smart" growth is good for them. See what happens when MIG and staff tried to push 1,300 packed mixed-use crap along El Camino Real. The residents around there did not take it too kindly. High-density mixed-used housing is a nice concept from a Sacramento point of view. I'll pass. I like my R-8 neighborhood. I wish that I could be in a R-1 or R-3!

  32. It still seems so strange to me that Lisa, who ran as Maggie's "heir apparent" is turning a blind eye to what Maggie's husband, Ian, says Maggie would have wanted. In his robo-call he said Maggie would have definitely said to vote Yes on Prop. A. Lisa could have said she wanted it, and still be outnumbered by the rest of the Council. Makes me wonder how "politically" smart she is. She may have a Ph.D., but she has not scored a lot of points with the people that elected her, or at least she hasn't for me. Others may feel differently. At least Teresa didn't sign the petition. Lisa and Tony did. Kristin and Mark didn't sign it either. So I wonder, at the June 12th Council meeting, is the Council going to put, on the November election ballot, a clause that says they can overrule a decision? Check out the City Council's agenda for next week. It is enlightening or scary, depends on how one looks at it.

    1. She hasn't scored points. Can't the Council just cancel whatever they discuss on June 12th once the June 18th election has come and gone? No, they wouldn't try to sway votes to the No side, would they? Just because the Council has untruths in their ballot arguments, there's no reason to believe they're trying to manipulate the election.

      And the Chamber of Commerce will get their own $20,000 taxpayer funded support money from the Council. Plus, the other business associations might find a little something extra in their Christmas stockings.

  33. And the hits just keep a comin don't they? Almost doesn't matter who is on the Council anymore. They seem to be all a bunch of politicians. Are there no politicians left that actually say what they mean before and after election? Seems like there isn't. I kind of miss people that spoke out, even if I disagreed. They were silenced during the Leucadia Blog fiasco some time ago. Or that is what I remember. KC vs Dr. Lorri. At least both of them put their names on things and said what they thought. Now at least Dr. Lorri seems to be silent. I kind of miss her, even though I was one of the ones who gave her a hard time. Looks like she has joined up with the powers that be now that she is Chair of the Parks and Recreation Commission. Too bad.

    2. Or perhaps it was the constant harassment that made her quit posting. Since I do know her, I also know she has requested a ton of info. on Sabine just in the last few days. She is still doing what she can, but there are many ways to obtain information without trashing people. And sadly, many of you did that, and now you are saying she drank the Kool Aid, whatever that means. Some people work hard undercover, as W.c. him or herself knows. Others do nothing, but call other people names.

    Read carefully bottom of page 2 and page 3. Planning Director Jeff Murphy admits that the city agrees with Sara Wan!

    Are there any facts not proven to be false left in the Rutan and Tucker report? The city should ask for its $50,000 back. And Sacramento Gus should be fired for hiring them,
