Measure T: Know before you vote!

We've heard the city council's arguments that Measure T is the best plan they could come up with and we'll get sued more if we vote no.

It behooves us to be informed voters and hear both sides of the argument before voting.

And there's more- the city admits that the 48-foot height limit is a completely unnecessary giveaway to developers:
The City admits Measure T would work within our 30' height limit.

“Even without an amendment to the height limit, however, local developers have confirmed that R-25 sites could develop at densities of 19-24 units per acre under Proposition A limits."

  1. So...let me get this straight: the city knows it could upzone under Prop A height limitations and the density could be lower than R30.

    So...can anyone explain to me why the city is going to such extremes and calling it a "state mandate"?

    4. The Terrible “Measure T”

      Dear Encinitas Resident,
      By now you will have received oversized cardboard shingles in the mail from pro-development groups urging you to vote yes on Measure T. But, if you really want to preserve your peaceful neighborhood, community character, and quality of life you must reject Measure T. It is bad for the City. It is bad for you. And it does not provide affordable housing.

      All five Council members have aligned themselves with the building industry and want to disenfranchise you from having a voice in the future of your beach community. They have become useful lackeys by selling your rights out to greedy developers. They even overturned their own ordinances to settle frivolous lawsuits brought on by the building industry and land barons.

      They tell you that Measure T, as written, is required by State law. What they do not tell you is that Measure T goes way beyond State requirements.

      They scare you into believing that your State bureaucracy will impose their will onto this City if Measure T is voted down, that the State may sue. Rest assured, the State does not have the power to overturn the will of the people. It would violate your democratic rights guaranteed by the US Constitution.
      They tell you that “Measure T doesn’t add any housing.” They must take you for dummies. Developers already stand in line to quadruple their profits by taking advantage of property rezoned for high-density four-story structures with drastically reduced setbacks and parking areas.

      They tell you that only “13 small areas” were selected to allow for more housing. Folks, this is only the beginning. If approved, Measure T changes the General Plan and Municipal Codes IRREVERSIBLY to allow higher densities of taller structures throughout the city. Resist urbanization of your unique beach town and the nefarious attempt to destroy your quality of life through increased traffic, pollution, noise, and crime.

      They tell you that Measure T “ensures local residents continue to have control over new development.” But history has demonstrated that development driven local governments don’t give a hoot about residents.

      They sell out to special interest groups every time. In Encinitas they exploited the need for a Housing Element Update to destroy your right to vote on future zoning changes and on other changes to your General Plan. If you question these statements please read the entire 231 pages (originally over 800 pages) of the Housing Element Update before you vote.

      Measure T is a “Terrible” plan. Demand a better plan that does not trash your General Plan. Demand one that will actually create affordable housing. Vote NO on T.

      Just one more itty-bitty detail "staff" snuck in while council members were asleep at the wheel. Those "expert staff" to which the entire Council says it must defer....

    8. One of the things that density bonus allows is to "waive" some requirements of the city code. So it's likely that the seaside market site could be "waived" to 3 stories and residents would be unable to do anything about it.

      New density bonus law also allows waivers to commercial structures. Read it. You'll flip out. State law is trending in the wrong direction.

Tony K was sent on a $9000 vacation to Israel by Leichtag's Seidle and Farley so that Leichtag could 'steal' agricultural land from the citizens of Encinitad and let Leichtag built ocean view Jewish-only office space. Tony K lives with his in-laws in Leucadia and has never bought a home in his life, nor has he ever made a living but instewlad has always relied on his wifevs income...in other words Tony K is a major freeloader snd terribly vulnerable to taking brides/'free' trips/gifts/favors. Tony K is gullible, incompetent, an athiest and sadly very unintelligent.

      I'm not sure you understand compounding. Interest compounding applies to the receiver of interest payments (lender), not the payer (borrower).

      I saved up over 25 years of conservative saving to be able to afford a down payment on a place to by in Encinitas. I was finally able to in 1995 and glad I did.

      Really. Poor people in need really need prime real estate living?

  15. 12:29- Actually there is Section 8 housing in Encinitas. It is in Leucadia at the apartments on Vulcan.

      The site shows 152 affordable units. There are probably many others that aren't part of the city program.

    2. The in-lieu fees paid by developers under the inclusionary ordinance are used to subsidize rents for qualifying low income applicants. They don't pay the whole rent; just the difference between the market rate and the affordable threshold.

      In some cases the lump sum can help a lot more families afford housing than building one unit. It needs to be priced right, and for many years the fee was way too low.

  16. The in lieu fees are a complete scam, unless they equal the value of those million dollar homes that they are replacing. This policy is a total giveaway to developers and should end now.

    Our city has every right to demand that developers live up to the permits that they are granted with their projects.

    The lack of will to do so, reflects on how much they have been compromised.
