“The Ray” Leucadia hipster hotel battle

NBC 7:
Gilmer and his local partners plan to renovate the dilapidated building into a boutique hotel destination with a rooftop pool, bar and restaurant area.

The potential noise from that rooftop area is now a main argument in a lawsuit filed by Encinitas community nonprofit Coastal Defender NC, led by Dr. Richard McPherson, against the City of Encinitas.

Attorney Felix M. Tinkov represents the group who says their “acoustic expert’s noise analysis” determined nearby residents would be inundated with late-night noise, a violation of municipal code standards.

  1. Perhaps they can instead partner with Accretive Investments to build a 277 unit 69 ft high development...

    1. See you in court Accretive Investments. You can sit next to your co-defendants, the City of Encinitas.

  2. What happens when the hipster thing fades like hippies did?

Not enough parking. The nearby neighborhoods and businesses will be impacted.

In the drawings, the building looks weird and out of place.

  3. They have all approved permits and can start building any time they want.

    2. Yes. Unless a court orders a suspension of the permit (which has not happened), the hotel owners are good to go. News reports state that they plan to break ground in the Spring.

    3. Right, and Streetscape was gonna be finished about seven or eight years ago. That hotel doesn't require groundbreaking. They want to renovate what's already there.

  5. This abomination needs to be razed to the ground.

Substandard, such as illegal, such as not meeting our codes, parking, under the existing relic, should demand a demand to tear this pos down to the ground and mandate that underground parking be created that meets our codes.

Do that with the current technology to recirculate and filter the exhaust from vehicles would go a long way for local approval.

Just as much of import is the raised party/pool area that needs be mitigated with the residents concerns in mind.

If these same investors can purchase the property next door and provide underground parking for the planned two story business office, they surely can do the same with the Portofino.

These same investors have recently purchased the building next to the Leucadia PO. Who knows what they will try to get away with location. No, that is not a question.

Two story at a minimum will go in there unless I am off. Anybody want to take a bet that it will remain a single story? I will take that bet any day.

  8. Can someone, anyone who has been a property owner with children and a life since 2007 tell us that Gilmer has been a positive force for the area? Ya, he's made himself lots of money but does the man have a character that can be tested and trusted? The downturn will ruin him. I've got a great cache of guns for an inurance policy when it comes with no debt...not sure which is more powerful...well...my biceps maybe LOL. Come at me bro LOL~!

    2. Oh come on, Kellie knows him from her l101 days and promises "he's a good guy!!!" What could go wrong with the entire city trusting her instincts??

    3. Gilmer is a good guy. He does a higher-quality remodel and has helped others who wanted to improve their home to sell.

    4. I agree. He’s a good guy, being attacked by self-righteous assholes who think they should control what others can do with their private property.

    5. He wants to turn Encinitas into Huntington Beach.

    6. "He's a good guy" isn't Municipal Code and it does not ensure the neighborhood's health and safety are protected. It's an absurd way to govern.

Most residents have had more than enough of what results when council members give their friends a pass. Cue tomorrow night's Leichtag item at council. Already put at the very end of the agenda to get folks to leave and minimize participation.

  9. Swell and his partners bought the property next door to the Portofino to build a two story office building with, wait for it, underground parking. Shocking. Not.

They should do the same with the relic of the Portofino. Eric says that would cost too much money. Curious.

He and his partners just bought the building next to the Leucadia post office where rental office spaces tried to make a go.

Funds seem to be no problem for this group.

Do the right thing and tear down the remains of the Portofino and put in underground parking with all the current technology for ventilation and filtering the exhaust fumes from the cars.

In its current state with code violating sized parking spots and no filtering of exhaust fumes for the rooms above, this should be obvious.

Swell and friends step up and do what you know should be done. I will not be holding my breath for that to happen.

A raised pool and bar area? You are making friends all over the neighborhood. I surely jest.

  10. The only way that hotel will work without negatively impacting the surrounding residential and commercial neighborhood is to scrape the lot and start over, including underground parking. If the developer doesn't do that, they'll have forever headaches.

    1. Show us that requirement in the muni code.

    2. Really dumb comment, 2:49. Nobody said it's a requirement. But it's a fact. Inadequate parking is why the hotel has failed since it was built.

    4. Neither. Just sick of hearing hearing people move the goalposts, like whining about anything over a one-story.

    5. ah, but this is not "over a one-story" and you know it. It's three in violation of Prop A, but don't let that get between you and telling your "move the goalposts" story.

    6. I don’t know the definition of a mezzanine level in the code, whether this proposal confirms to it, and neither do you.

Let the court sort it out. I’m willing to accept the ruling of the court, are you, or will you just expand the conspiracy theory to include a judge of the permits are affirmed?

      Delete
    7. It's no secret that in general courts side with cities, but that's not a conspiracy theory. But what choice does one have but to accept the ruling of the court?

You know for someone who wants to "stop the bleeding" from lawsuits, Blakespear's "professional staff" sure does land her in a lot of hot water. Just check out the closed-session agendas.

You need to wake up and stop trying to think, I'll do that for you. And for heavens sakes, stop using the old Communist thought process of "it's the fault of the wealthy or the wealthy ruins everything".
Here is something to help you think. The keyboard you used to slather the leftist garbage was made by a company that has made people wealthy. That means by buying the keyboard you are using, you, contributed to their wealth. Oh' and by the way, your keyboard is made from oil. That means you made an oil company wealthy. You did it.

  14. 2:21:

Housing and Urban Development Secretary Ben Carson said Monday that Rep. Maxine Waters (D-CA) lacked “basic manners” in penning a letter to President Donald Trump last month saying his “shamelessness knows no bounds.”

Waters’ October 28 letter demanded answers from the Trump administration about its plan to push homeless Californians out of homeless encampments, Politico reported.

The Washington Post reported in September that the administration has pushed for a crackdown on homeless encampments in California, with aides discussing the possibility of moving them to government-run facilities.

“Shamelessness,” Carson wrote in a reply letter obtained by Politico, “is a career politician of 30 years laying blame. Shamelessness is allowing more than 55,000 Americans to live on the very streets they represent,” referencing Waters’ district in southern Los Angeles County.

Carson added that he wrote multiple letters to Waters’ office with the intent of meeting to discuss the homelessness crisis in her district but claimed she had refused to meet him.

“Basic manners elude you and it seems that instead of producing results, you’re more interested in producing cheap headlines at the President’s expense — like a true career politician,” Carson continued.

In response to Carson’s letter, Waters told the Hill that Carson is incompetent and “a complete failure at HUD.”

“All of this demonstrates his lack of competence as HUD secretary and the cruelty of this Administration. Instead of whining about his inability to get on my schedule, he should take some time to focus on the over half a million people experiencing homelessness in this country,” Waters said.

You're so full of schitt if IO saw you inperson I would punch you in the face.

    And then do it again.
