Prescience kills

In this weekend's Coast News, Doug Fiske writes:
The first thing most people say when they read the headline or hear those words is, “It would be too expensive.”

Of course trenching the tracks would be expensive, but if we don’t trench we’ll still have the problems, and they’ll get much bigger when the tracks are doubled. Here are the problems:

Crossing Hazards. When people cross the tracks at the grade crossings from Chesterfield Avenue to Leucadia Boulevard or at grade between them, getting from one side to the other can be dangerous. Even being near the tracks is a hazard.

Google search for news articles about train collisions in Encinitas in only 13 of the years since 1990 reveals eight calamities, resulting in 10 deaths and eight injuries. Periodic collisions causing deaths and injuries have occurred since the tracks were laid in the 1880s.
Sadly, Fiske was proven right just a day later. NBC:
A pedestrian was struck and killed by a northbound Amtrak train Saturday morning in Encinitas, according to the San Diego County Sheriff’s Department. The fatal collision happened just before 7 a.m. on the train tracks in the 1200 block of North Coast Highway 101. Deputies say Amtrak train #763 struck a man on the tracks, and the man died at the scene.
1200 North Coast Highway is near the Leucadia Post Office. UPDATE: The victim has been identified as 23-year-old Jon Curtis Lynch, a suicide.

  1. The area mentioned is a half block north of the post office almost exactly where the last cyclist was killed before bike lanes and slower speed limits were introduced. Most of the time these train fatalities are suicides. Sometimes accidents. Always horrific. I don't believe the overall frequency of them here has increased much since 1990. I don't believe you can keep someone hell bent on killing theirself from doing so. But I do agree burying the tracks would not only reduce train fatalities but could add numerous other benefits to the community. Peering into a crystal ball however even non-psychics can see the next problematic chapter after burying the tracks. One side would want a 2 mile linear park on top and the other would want to satisfy California's gluttonous affordable homes appetite. "It's always sumpin'".

    4. There was a death by train at the trenched La Costa crossing several years ago. A young woman; the authorities said suicide but the family suspects foul play.

    6. It was unsafe for that bicyclist to be riding at 1 A.M. in the morning, Fred. A hit and run driver, probably drunk, but no one will ever know, as he waited until he sobered up to turn himself in, drifted over to lane two. That would have happened whether or not there was only one lane for motorists. That one accident was repeated over and over, many times by bicyclists who don't reside or vote in Encinitas, at the 1/30 Council Meeting. Many bicyclist speakers that night were NOT giving their city of residence, were not talking about where the accidents they were referring to happened. They were rallied to come to the meeting to drown out objecting local residents by L101MA. By the way, where is all the info that was on your former webpage, Fred? Now all we can access is your Facebook page. Where are the archives? L101MA is subsidized by the City, that is, we taxpayers and consumers, through OUR Farmers' Market. You should be more transparent, and report your lobbying activities on your tax returns.

      That was a freak accident on 101, just as the accidents on the train tracks with pedestrians are few and far between, and are usually foul play or suicide. Trenching the tracks wouldn't stop suicides, either, but could sure help with people wanting to more easily access the beach from east of the tracks, and could also help with bicycle and pedestrian trails, as well. The transnet tax money that is proposed to pay for roundabouts and underpasses should go toward trenching the tracks.

      Slowing people down to 35 MPH is adequate. We don't need to slow people down to 15MPH through four unwanted, unnecessary one-lane, three-way intersection roundabouts with no cross streets. Enforce the reduced speed limits we have, don't play "Nanny" and slow people to a dead stop, during peak periods, through chokepoints and bottlenecks, diverting commuters onto residential/residential/beach access/egress streets, and slowing already subpar emergency response time along the Coast, in Leucadia.

      Why put a planned total of eight roundabouts through Leucadia, planning Phase Two of the Leucadia Blvd. roundabouts, which was to include more landscaping and sidewalks, and only one roundabout in the rest of Encinitas? Bogus!

    7. Riding a bike on 101 prior to designated bike lanes was unsafe at every time of day, Lynn. But you'd like the bike paths painted out before a bike path might or might not ever happen on the railroad right of way. Fine. Not me and not any cyclists who are now stoked to finally have bike lanes on 101.

      Really Lynn? When someone removes their "favorite movies" from their Blogspot profile they are hiding how they lobby the government? What were these important claims you say I removed from online? I'll put "The Seven Year Itch" and "Big Fish" back on if you'd like me to be more transparent. No idea what you mean about me lobbying legilators though. Unless it was the $100 I spent this year toward a postcard for Yes on A (which humorously did not sway council in the least, but was aimed at every voter).

      And it's fine that you're in denial that traffic circulation improvements cause congestion while stop lights and signs do not. But reality does not back up that stubborn notion. Signals, kill, injure, pollute, waste time and energy. Good luck finding people in favor of those accolades.

    8. You can't get Transnet taxes for "beautification," Fredo. Sorry I misunderstood the logistics of your accident, which you didn't go into so much detail about, before. Enough said, your accident was at the El Portal intersection, not closer to where you live. That intersection, mysteriously, is to be where the first unwanted roundabout, unneeded according to the City's own 7/18/12 collision statistics, is to be forced on us.

      El Portal & 101 is where TWO lanes, both northbound and southbound, where City staff recommended NO lane elimination, will merge for a narrow, one-lane roundaout, eliminating a lane north AND south, creating a bottleneck, by definition.

      Even with the "hourglass analogy, Fred," during peak periods, there's already back-up, both directions, surrounding the stop light at Leucadia Blvd & 101, exacerbated by the RR crossing and two nearby pre-existing roundabouts. And summer peak periods have never been monitored, yet, Fredo.

      And Fred, I'm not referring to your personal Facebook page. I'm talking about your accountability AS A DIRECTOR for the Leucadia 101 Mainstreet Association.

      L101MA's former webpage has DISAPPEARED, rather mysteriously, perhaps a madly grinning skeleton, for Halloween . . .

      In your roll as a director for L101MA, Fred, your Board has deleted the archives because your entire former webpage is now unavailable. That is not transparency, although you are highly subsidized directly through the City, and indirectly, through a contract facilitated by Peder Norby to split the Farmer's Market Rents with the Paul Ecke School PTA.

      The students, through the PTA, should get ALL the money from vendors selling goods at the school. Because Morgan Mallory was allegedly the brain trust that came up with the concept of having the artwalk or a farmer's market at PE Central School, doesn't mean L101MA gets to undeservedly reap the rewards, funding your unreported N101SS lobbying efforts. The Farmers Markets are great, wherever they are held. So are artwalks. Most of the credit goes to the artists and the small entrepreneurs, vendors of produce, and at the artwalk, arts and crafts. The credit goes to the chefs and the servers, for the Taste of Leucadia . . .

      It's great to have healthy business associations that help to organize mutually beneficial events, between business folks and residents or tourists.. But I feel it's wrong for you to take your income revenues, your "profits" and plow them into unreported lobbying for the streetscape. Did L101MA pay for any Board Members to fly out to New Orleans, this year, to play at the Mainstreet U.S.A convention?

      It's also inappropriate for these newly branded mainstreet associations to band together as a promoter, marketing firm.

      Self interested influential insiders, have successfully climbed into bed with some members of staff and council.

      They are constantly pushing their generic "ideal of Autopia, attempting to close a significant portion of Highway 101 off from most all traffic. Bicycles are involved in more accidents in intersections with roundabouts, nationwide, than at the same intersections before their installations. One lane roundabouts are not safer for bicyclists. Pedestrians, unless the train is trenched, are primarily going to be on Neptune, or on the West side of 101, as during the Artwalk. We need additional parking, and lots should be purchased for parking. We already have an "informal understanding" with NCTD re the RR right of way, because cars have not been ticketed parking in the dirt on either side of the tracks, except near bus zones.

      You would tie the road into knots for local commuters, needing access/egress to our recreational/residential streets. The statistical reports from Peltz and Associates are flawed.

      Originally the Board of Directors of L101MA all signed a petition for a stop sign and u-turn lane at Grandview. On 2/23/08, Grandview was the only roundabout "enthusiastically" supported by the focus groups that got together at City Hall after the Workshop 1B walkabout.

      Not revealed was how many people were present at the end of the meeting for the focus groups, that reconvened at City Hall, on a Saturday, or how many people were required, within each group, to constitute ANY level of "support and discussion."

      It seems that, just as with the new Fire Stations, when Christy Guerin told the Fire Dept. to "shoot for the moon," so was Peltz & Associates encouraged to "shoot for the moon." Roundabouts were also suggested at A Street and Marcheta and 101! Every intersection, practically, was "supported and discussed," the lowest level of "support."

      After Workshop 1B, A Street and Marcheta, on 101, had to be eliminated for roundabout installation, because of grading challenges. But El Portal was left in the works, because it doesn't have the same grading and draining challenges, as Marchetta & A St., and Grandview also has!

      The most "enthusiastically supported" roundabout, the ONLY enthusiastically supported roundabout, was the one at Grandview and 101, which HAS drainage and grading challenges, and would require more taking of private property. The place where the Board of Directors of L101MA, beginning with Charles Marvin, had petitioned for a stop sign, at Grandview & 101, is instead the location that a roundabout is LEAST likely to be installed!

      Contrarily, YOU are the person wanting to WIDEN 101 inviting more traffic and YOU are the one ushering in more stops for hwy 101 that are the real entities that clog traffic and have caused cut through traffic in the past. Go figure. Add to that, YOU are the one who would paint out 101's bike lanes prior to a pie in the sky bike rail trail would be installed. Got an estimated date for that one? No.

    11. Fredo, I'm NOT wanting to WIDEN 101, just to restore it to two lanes in each direction. You are inconsiderate to want to NARROW Historic State Highway 101.

      A lane for motorists NEVER should have been eliminated without the City's first completing design review, getting a Coastal Development Permit, and amendments to our Local Coastal Program and our Specific and General Plans, as required by Encinitas policy, as directed by the Coastal Commission on 1/23/13 and recommended by City staff on 1/30/13.

      The January 30 Council Meeting was when Council and locals were "stampeded" by a bevy of bicycle club speakers, many not residing in Encinitas, many failing to state their City of origin. The bicyclists, through more unreported lobbying activities, were rallied on January 29 and January 30 to ride to City Hall in Encinitas, to overrule the opposition, not with facts and not with consideration of policy and law, but with hysterical renditions of accidents happening in other locations, or repeating a single bicycle accident, a tragic hit and run in April of 2011, over and over, without divulging that they were ALL referring to the SAME single occurrence on North 101. There was NO report of bicycle counts justifying closure of a lane for northbound motorists.

      The City's three year collision report that was part of staff's agenda report for the 7/18/12 CC Meeting does NOT justify closing a lane to "slow traffic down," as Engineer Greg Shields incorrectly asserted was the reason for lane closure on 7/18/12, almost as an "aside."

  8. This is not a question of normal supply and demand.

    When a developer gets a near 40% density bonus for a project, claiming that affordable units will be built to justify the density increase, then buys his/her way out of having to supply those affordable units and leaves the community with stack n'pack, that is not based on buyer wants.

    That is based purely on the developers' exploitation of a developer-influenced loophole in the state law to maximize profits on a project.

    1. Agree, The developers are maximizing house size on parcels using the density bonus, for the most part. People can be conditioned to accept certain things, like smelling the beer bottles from La Especial and paying almost 900k for the privilege.

    2. The City and the developers are in a partnership to ruin the city through sustainability. Though the word has environmental overtones, the real thing they are talking about is sustainable building projects that "pencil out" for themselves and sustainable pensions for city workers.

    3. A developer can't buy their way out of the Density Bonus requirements. You're thinking of the Inclusionary Housing program which does allow developers to make a payment in lieu of building the units. The Density Bonus formula is spelled out in the State statute. Also, Density Bonus doesn't effect house size but it does allow the developer to build that big house on a smaller lot.

    4. The thing that most of us hate about Denisty Bonus is that its use in this town usually results in FEWER low income properties than MORE. It is misleading that they do all of this damage in the name of public good when it is in the public bad--especially for the low income people who they are claiming to serve.

Property owners along the highway, and on Vulcan, who got the advantage of being adjacent to a park, instead of a train, would have to pay an extra property tax assessment, as in Solana Beach.

    Ed Deane, City Engineer, highly exaggerates the cost of undergrounding the train, from El Portal, where the first roundabout and the next underspass are to be installed, also where "Fredo Waldkell" unfortunately, got into an accident when someone ran the stop sign at Marcheta, as he was pulling out onto 101, in his van.

    Highway 101 should be restored to four lanes, two in each direction, with dedicated bicycle lanes along the RR right of way. Most adjacent residents and local commuters, who use the highway, including local bicyclists, don't need or want roundabouts on Historic State Highway 101, with or without the tracks being trenched. Were they to be trenched, there could be more room for some u-turn lanes, would that help you out, Fredo?

    How do you think we are getting the funding for the $20 MILLION+ 5 roundabout project, Fredo? Lisa Shaffer reported at last week's Council Meeting that without a certified housing element, which we are nowhere near having, we will not be getting funding for anymore underpasses from TransNet taxes! Likely there will be no money for more unwanted, unapproved by the Coastal Commission, roundabouts, either.

    But either way, we taxpayers pay for it, and we're having something forced on us by a Nanny City, telling us what's best for us. Why don't L101MA and EPA report their lobbying activities, as required on their IRS non-profit tax forms, Fredo? When I started putting in CPRA public info requests to the City, who forwarded them to Peder Norby, he rather suddenly decided to resign from his run for State Assembly, then, shortly thereafter, decided to end his employment as a contractor with the City of Encinitas. Strange timing. He was the biggest lobbyist of them all.

      I don't know Fredo, but if you're referring to me, I did not pull out onto 101 in my van. One more time. I was driving south on N. Hwy 101 from my house to get some chow. A car ran the stop sign coming from the west at El Portal (not Marcheta St.) and T-boned my van. Accidents at roundabouts are not T-bones and at the slower speed cause less damge when they do occur.

    4. Not going to happen, the NCTD is not going to give an inch on their ROW. When they underground the train, I would imagine it would be from Carlsbad to at least downtown, if not the whole length of Encinitas. It will take a massive infusion of Federal Money to make it happen, the same as happened in Solana Beach.

Can't speak for Norby, but I think he saw the writing on the wall in this town, and besides, he got another position in C-bad, it's not like he just quit and vanished.       The grade separation cost approximately $18 million, with funds gathered from the following sources: $5.8 million through Proposition 116, a 1990 state initiative to fund rail projects; $6.7 million from the Federal Transit Administration; $2.5 million from Amtrak; $1.4 million from the City of Solana Beach; $1.1 million from the state’s Capital Improvement Program; and $500,000 from Burlington Northern Santa Fe Railroad (formed when the ATSF merged with the Burlington Northern Railroad). The rail right-of-way was sunken 28 feet below street level for more than a mile-and-a-half through town.

    7. 3:42, Yes, I remember SB's train descent not costing more than $20 million. I was on the inaugural run for the Coaster, so was pretty up to speed on all those costs then. But that was two decades ago and as time goes on, costs have increased greatly. And certainly not proportional to costs of permits, material and labor I'm sure. How that's justified I'll never know. But what do you expect when Rick Engineering for example wanted to put a mile long drainage pipe in the ground for 50 million dollars only a few years ago?

    8. Agree, If it was $20 million ballpark for SB, look for it to be $60 million or more. Material costs have gone way up, due to fuel costs, but yes, it seems like the prices for jobs like this are still very high. Bottom line, don't look for undergrounding anytime soon. Maybe if we had a decent council the last 20 years laying the groundwork, but as we know, that didn't happen.

    10. Eliminating lanes for motorists has always been encompassed as part of the "N101 Streetscape" plans. Proponents feel that this will eliminate cut through traffic from the freeway. They don't seem to understand that locals MUST use Coast Highway for access/egress, and that we are concerned about cut through traffic on our recreational/residential, beach access/egress streets, diverting from an increasingly CLOGGED Highway 101, through Leucadia.

      We bicycle, too. Bicycling is great, but our City MUST go through the proper protocol when reconfiguring a major roadway, main arterial, primary circulation element from a four lane highway, down to two lanes, one in each direction, through four one-lane, three way intersection roundabouts, reducing the speed limit from an already lowered 35 MPH to 15 MPH. The City of Encinitas and the Board of Directors of L101MA are not above Coastal Act Law.

      Those opposing four one lane roundabouts are not obstructionists. The four one lane roundabouts would OBSTRUCT Historic State Highway 101.

      I am sad for anyone who is killed, on the tracks, or anywhere else, whether suicide, foul play or accident. Routing bicyclists and cars through one-lane roundabouts would be MORE dangerous for bicyclists, than the same intersections are, WITHOUT roundabouts.

      Roundabouts on Highway 101 would NOT help with walkability, in our scenario in Leucadia, because pedestrians going north/south are primarily walking on the West side of the Highway, or on Neptune. They aren't crossing the tracks at El Portal, because the tracks have been built up so high, and there's also a drainage ditch, now, in front of Paul Ecke School, on the east side of the tracks, in the RR right of way.

      Like Peltz and Associates, you are twisting the facts. I was down at City Hall and saw the petition put forward by L101MA Board of Directors in 2007 for a stop sign at Grandview and 101. I didn't suggest a stop sign, there; you did, before.

      I am not wanting to paint out the Sharrows. Whenever I use logic, and back up my posts with facts, you and your L101MA Board buddies twist the truth, don't address the direct issues, and disregard valid suggestions. A bike railtrail corridor is NOT pie in the sky. Such bicycle lanes have been successfully installed in many other cities, with or without train tracks being trenched, such as in San Clemente. We COULD get funding to do that. Your vision of four-one-lane roundabouts is what's pie in the sky.

      YOU, Fredo, are not being true to your "funky" origins. Why don't YOU answer the questions about unreported lobbying activities? You are a Director on the Board of L101MA, after all.

      Instead it appears so easy for YOU or your Marvy Charles cohort to distract, disassemble, disregard, deviate, and to label everyone with YOUR crappy moniker, that's a figment of your own fecal, fetid, imaginations.

      I have never ever in over 30 plus years actually seeing Lynn ride her bike or be seen walking on Neptune or hanging out at any of our beaches or parks. The only place I have ever seen Lynn is at city related events.

      I rode my bike every day up Neptune to Grandview and back down to Sylvia, then back home, for at least two years. I walk on Neptune nearly every day. Many people saw me riding, without my knowing who they were, or their knowing who I am, because it didn't matter to us! For years, I walked the beaches, daily. I am not afraid to post under my name. Loser Leucadian, you are a loser, because otherwise you would not make accusations without giving your name. As it stands, you are just another anonymous meat puppet, making unverified false accusations and insinuations.

      Fred has a responsibility, as do all the Directors of the Board of L101MA to make sure that his organization, for which he is part of the administration, reports lobbying activities accurately, on their publicly disclosable non-profit tax returns.

      Fred is capable of defending himself, although I didn't attack him, rather, I responded to his post about me, in which he wrongly claimed I have wanted to widen lanes, etc. I stand behind all my statements about Peltz and Associates disseminating distorted data. Marvy Charles was the one on 1/30 "making stuff up," and he knows it.

    24. Yes roundabouts dots were lined up in two rows, very neatly. All other categories had random dots. I saw two board members step away, and saw two rows of seven dots lined up, precisely. Perhaps they didn't put all their dots, but how many Board Members were in attendance at every workshop? They are all very biased in favor of lane elimination and five roundabouts through Leucadia. There were a total of 14 dots for yes roundabouts, but 11 for NO ROUNDABOUTS. The no roundabouts were randomly placed, not lined up.

      Think what you want, but at Part B of Workshop 1, only the roundabout at Grandview was "enthusiastically supported." That is not a made up fact, but is part of Peltz and Associates 1/5/10 report, which is part of the City's 1/13/10 Agenda Report, available online.

    27. Anon, 10:00, thanks for your honesty in admitting you placed all your dots on support for roundabouts. The protocol was for each individual participating to place ONE of our seven dots on one each of the seven categories that we supported on 2/21/08.

      Unfortunately, as for the MIG workshops re the General Plan Update, there were no real controls. No one was enforcing the one dot per category favored rule. No one was checking to see if people got more than seven dots to place, either.

      That is one reason why the results of the Peltz workshops are not statistically significant. There were no effective controls, and data was not scientifically analyzed both quantitatively and qualitatively.

      It did appear that all eleven dots placed on NO ROUNDABOUTS, another category, were placed by individuals, not by one person placing all seven of his dots, the way those NO ROUNDABOUT dots were randomly arranged. As you know, I strongly oppose roundabouts, but I only put one dot on NO ROUNDABOUTS.

  11. Attorney Glen Sabine is on the Council Agenda this Weds. It is item 8. I encourage all who have had difficulties with our contracted City Attorney to speak, or at least attend. Hopefully, I will be given 2 time donations, so I can speak my piece. This has never been agendized so I encourage all to come to this meeting.

    1. It's not that easy to "secure TransNet tax funding, Fred. Not having a certified element will make it harder to get a grant, and a grant should be required. TransNet funding is not to be used for "beautification." Maybe that's why the "beautification" part of the Leucadia Blvd. streetscape was "eliminated," the additional sidewalks and landscaping that were to be part of the now deleted Phase II?

      Similarly, Phase II of the Downtown Encinitas 101 Streestcape was deleted. Instead lobbyist consultants are paid to find ways to justify something locals, both residents and commuters, don't want or need, four one lane, narrow, with less safety features, roundabouts at three-way intersections, with NO cross streets, fairly near a RR Crossing and two pre-existing roundabouts, which are already leading to subpar emergency response times along the Leucadia Coast.

      The U.S. Dept. of Transportation's recommendations and the Coastal Commissions directions are ignored in Council's foolhardy insistence that "you're not the boss of me!"

      We'll see.

    2. And the underpasses, like the roundabouts, are to be funded through these TransNet taxes. If the underpasses would be affected by our lack of having a housing element, then so the roundabouts should also be.

      Another way the underpasses are tied to the roundabouts is that one of the justifications for the first roundabout being installed at El Portal is that is where the next underpass is to go. This is near Stonesteps, with no parking, and near Paul Ecke Central School, but south of where some claim the dividing line is for Leucadia, "as the crow flies" from Union. So the Leucadia Farmers Market isn't in Leucadia according to a few boundary fanatics.

      Underpasses and roundabouts, beginning with the ones unwisely planned at El Portal and 101 & adjacent RR tracks, ARE tied together by their location, and by their both relying on unreliable TransNet funding.

      Citizens are unlikely to vote for a General Plan Update that includes a denser housing element, just as we voted in Prop A, to protect us from Council and staff's previous glorification of specific plans that exceeded the prudent limitations of our current General Plan, established by our founders.

I'm all for more sidewalks, more flowers and trees, which are watered, art nodules, etc. I'm speaking of lobbying efforts for five roundabouts, four of them one-lane, three-way intersection roundabouts placed where they aren't recommended by the U.S. Dept. of Transportation, at intersections with NO cross streets.

    No, lobbying is not wrong by a non-profit, unless it is unreported, as L101MA's has been. I too want a "nicer, safer community." Four one-lane roundabouts would increase, not decrease health and safety concerns.

    You seem incapable of answering questions or engaging in conversation without resorting to name calling through your easily observable defecation obsession.
