Oddly, just three months after unanimously supporting City Attorney Glenn Sabine, the council is again reviewing his contract. Did public opinion and common sense finally get through to this council, or did Sabine already screw something else up in the interim?
To review, here are Glenn Sabine's greatest hits over the past few years.
1) Wasted thousands of dollars on expensive outside attorneys for Teresa Barth's ridiculous harassment claim.Come on down to council tonight. Could be interesting.
2) Wasted almost $100,000 in frivolous fight against public access to public records. See also (1) (2) (3)
3) So clueless about the First Amendment that he allowed the council to try to censor political speech.
4) We need secrecy in government so bloggers can't criticize us.

All you have to do is watch his complete lack of preparation for the recent ERGA meeting to see that he is not fit for office. Some say he played dumb on purpose...either way...not fit to serve Encinitas.

I will be speaking for about 9 minutes tonight on a few of the reasons I think the Council should look for another Attorney. Come on down. I could use some support, as it is not easy to stand up there, with Glenn on the dias, and attempt to make a case for why we should at least but there contract out for bid. Anyone who thinks it is, try it:)

It is what the citizens want to make it, 11:03. Sabine has never been on the Agenda before since he became our contract attorney in 1999. This is our one chance to share why the position should at least have an RFP (request for proposal) put out when his contract is close to expiring.
DeleteI might add, that Sabine's contract can be terminated at any time. That is part of his contract. It is unlikely that the Council will terminate it tonight, but it could be done.

DeleteActually I think it went exactly where I thought it would go. I was impressed that Lisa Shaffer but a motion on the table to at least look at other attorneys and firms. No one seconded her motion, including Barth, who I have to say I thought copped out. I deliberately left out the issue of us having to pay $17,000 to another firm to get an answer for Teresa when Stocks and Dalger harassed her. Sabine should have known the answer but didn't tell her. But, the good news is it is the first time I have ever seen Glenn Sabine get riled up t what a citizen said. And, for me that was worth it. Instead of calling me Dr. Greene, he deliberately called me Mrs. Greene. So, if we all keep pushing, I think we have a reasonable chance of getting rid of him. I expected more from Tony, and was very disappointed in him. I knew that Mark and Kristin would say about what they did. And, I appreciate Mark Muir asking Sabine some tough questions. All, in all, I feel that it was better than expected. Don't know how I came off on television, but I did the best I could in 9 minutes. Hopefully, those who watched were not too disappointed in my presentation. Unless, of course, you think Sabine is worth the money.

Watching last nights council it seems they want a new city attorney and are moving in that direction. Good step as the citizens have wanted this for some time.
ReplyDeleteDid we watch the same meeting? Barth and Kranz both deserve a raspberry for not seconding Shaffer's motion to solicit a RFP for a new city attorney and look at changes in the contract. Shaffer deserves a rose for this. Obviously a council majority is supporting Sabine.
DeleteKranz blamed the council for previous bad decisions in closed sessions, not the city attorney. What's Sabine there for??? Not to give bad advice.
Barth claimed the importance of continuity. Continuity of bad decisions? Continuity of hiring outside legal help?f It's a ridiculous claim.
There was vague talk of a performance plan, but no subcommittee appointed and no direction to staff. Sabine will be sticking around for a while.
The real bombshell was the announcement by Lisa Rudloff, head of Parks & Rec, that the Hall property park will open in Fall 2014 instead of the previously announced April 2014. This caught Barth by surprise, who asked if the schedule had been changed. Another ridiculous moment when Rudloff answered that the park was on schedule, but the date has changed. She sputtered an answer of late August or early September it was an evening of doublespeak.
The best part was to see Sabine get extremely irritated at Dr. Lorri Greene's very effective outline of his incompetence and at Muir direct questions. It was a moment to savor after years of silence and daydreaming by Sabine at innumerable meetings.
Knuckleheads. The construction will be done in time: the planting of the trees, fields etc...will take the summer to take root: like anyone on this blog wants the park to open in the first place. Next, Morgan's lights!

DeleteShe didn't want unnecessary taxpayer dollars spent, and her confidentiality broken re her harassment "case" discussed, but why not? That was another incident of wasted money and political posturing by our past Mayor Stocks.
Mayor Barth began by stating that it was only to be a discussion of comparative contracts, something to that effect, but the agenda item was "Analysis of Legal Services." The Mayor, unfortunately, was enabled by the subcommittee of the Deputy Mayor and Councilwoman Gaspar; they all wanted, along with the City Attorney of course, for the evaluation process to be done strictly in closed session, with the City Attorney and City Manager present for their own self-evaluations.
I spoke to another attorney about this. There is no reason that the public could not be part of an open evaluation, including an online survey of legal services as initially planned. Confidential personnel records can be separate from public documents or comments, although they are both related to evaluations.
There could have been both a closed session evaluation, and an open session opportunity for public input on July 11, when the secret Council Meeting evaluation was done.
Notice this item was scheduled on the night of the World Series? Charles Marvin gave his roundabout and L101MA "commercial" during oral communications, then quickly left to go watch the game. Once again he was adept at "kissing up to Council."
Without providing any evidence, Marvin stated the $20 MILLION+ N101 Streetscape that he expects without any special property tax assessment to adjacent property owners, will be "paid for in a handful of years?" How? By more taxes paid? There is not ROOM on the west side of North Highway 101 for enough businesses and homes to increase city revenues by that amount!
Plus the businesses that are there now rely on the parking that NCTD allows, in the dirt, in the RR Right of Way. That RR right of way parking may be technically illegal, but people are not being ticketed, unless they park in a bus zone. MUCH more parking would be lost through the 5 roundabout plan, than gained. We WANT the "art nodules," and the landscaping, etc.
We do want and need more parking. We appreciate the 101 saplings that were added, and the flowers that some merchants planted. But 4 one-lane, 3-way intersection roundabouts with NO cross streets are going to increase our challenges, NOT solve our problems of lack of parking. The speed limit has already been reduced! These are all facts.
Marvin is a retired attorney. He could have stayed to participate in the "analysis of legal services." But once he kissed up to Council and delivered his "commercial," he was out of there. I'm sure he wouldn't want to jeopardize any of his inside connections. No Board Members of L101MA would want to jeopardize their status as sponsors/subsidiaries of the City. They want those City checks to keep on coming! Focused "benefits," with the taxpayers, fee payers taking on the liability, including the health and safety costs of more residential/recreational, school zone streets' cut through traffic, and lowering already subpar emergency response times.
Current council decided to allow poor past performance and unwisely spent money all fall on past Councils, but the fact is, a good attorney would have stated in the Cummins' case, unequivocally, "release the `draft,' it's the law!" Sabine is not forceful enough in giving Council direction, because he is paid to be a "yes-man," not an honest, objective legal counsel.
So you're saying unequivocally that she promised you personally? Just saying, I know it came out that that was a potential "want" or "get". Promise is another thing.Just sayin. There's a ton of heresay and conjecture on here due to the anonymity. And, uh, FYI, not that many people watch the Series anymore. The NFL took over as the number one sports around 30 years ago. I hardly think that was the reason they had the meeting on that date. It's not like it was Super Bowl Sunday. Man, you sure have it in for L101 and Charlie Marvin.

Delete1. The evidence is clear, Lynn. Downtown Encinitas for only 5 blocks increased tax revenues from $800,000 per year, to over $2,000,000 per year after their Streetscape. Pacific Station (which replaced two large old buildings and the Lofts that replaced the Artist's Colony certainly helped with that sales tax increase, butt every other merchant there has seen a tremendous increase in sales as a result. Our buisness groups used to work very hard at our "Clean and Green" events trying to spruce up our business districts, It was a good college try, planting flowers we couldn't maintain and unable to do little else about infrastructure improvements but we just didn't have the right stuff to make it a lot better by ourselves. . Then the city started taking us seriously and get creative (WITHOUT Redevelopment or Biz Assessment Districts) channeling TransNet funds and such to us to get everything done right. And it was done well. Anyone who argues that making downtown beautiful is the cause of drinking problems there isn't seeing clearly.
2. Downtown redid 5 blocks. We're redoing 2 miles. Do the math.
3. And if you want to talk "not enough room", we have a LOT more vacant lots available on N. 101 than did the 5 blocks of downtown, including a large Leucadia hotel at the north end that was approved which will create immense TOT funds returning to the city.
That's provenly HOW the city gets their investment back.

DeleteI love Leucadia. Downtown Encinitas has businesses on BOTH sides of Coast Highway. You are comparing apples to oranges. Some of the current vacant lots could and should be bought for public parking, paid parking, if necessary to finance the purchase of the lots.
DeleteWe support, my husband and I and all my friends and neighbors, a railtrail corridor with dedicated bicycle lanes. We support protecting and enhancing the canopy.
We support restoring Historic Highway 101 to its original four lanes, although the lanes could be more narrow, to allow for more of a shoulder. We support the City helping with funds to plant and maintain the medians, as well as providing "art nodules."
We support the currently reduced speed limit's being enforced, not reduced further, down to only 15 MPH though four one-lane, three-way intersection roundabouts.
If you keep insisting this has been so well "vetted," why don't you support Council's putting it on the General Election ballot for a public vote? We bought a Keep Leucadia Funky license plate holder from Fred's shop.
We do business with Just Peachy and several other Leucadia businesses. We can improve the sidewalks, the bike-ability and walkability without adding roundabouts. We support a streetscape, like in Downtown Encinitas, or in Solana Beach, that doesn't include roundabouts. No where else in California adjacent to RR tracks has anyone been able to show me multiple narrow diameter one lane roundabouts, with no cross streets. Nowhere else on Coast Highway 101 are there roundabouts!
You can say people are ugly or want Leucadia to stay ugly. But most people appreciate Leucadia, and love our community character. We do want to improve it, but one-lane roundabouts and large numbers of bicyclists ALSO don't mix. Nationwide, there are more accidents at intersections with roundabouts involving bicyclists, than before the roundabouts were installed. Citywide, we've had more collisions at intersections with roundabouts after their installation than before.
It's of no consequence to me that some don't "believe" my facts. That is called self-interested denial. Your financial interests are conflicting with common sense. That didn't happen in Del Mar and the City of Cotati, when the public was allowed to vote. People can decide for themselves if multiple one-lane roundabouts on Historic State Highway 101 make sense.
Repeating a lie doesn't make it true. The ROUNDABOUTS on Hwy 101 were NOT "thoroughly vetted." The so-called N101 Corrisdor Streetscape project, which extends from A St. to La Costa on 101 (so not all within the N101 Corridor) does NOT have final approval by Council. Diane Langager, Senior Planner, admitted that the environmental review process is NOT complete, and that more public hearings would be held, with more opportunities for Council to listen to public input from all sources, not just subsidiary/sponsor L101MA. All the business associations should stop getting direct subsidies from the City, just as Encinitas Chamber of Commerce did. If ANY non-profits want city subsidies, they should have to compete with ALL THE OTHER NON-PROFITS for Community Grants.
We also support more AT GRADE RR crossings.
Agree with 9:58. I have been known to give Dr. Lori a hard time on this blog and elsewhere. I can now see she does care, does her homework, and can speak both articulately and accurate. It was priceless watching Sabine get angry. That story will become a legend in this community and will not be forgotten.I think she should run for Council.

All of us that have complained about Sabine, including me, should have been there last night, if only for moral support for Dr. Lori. Watch it on streaming. She seemed a bit nervous, but hell, who wouldn't be. I think she would make an excellent City Council member. Barth is up next year, and rumor has it she won't run. Even if she does, she isn't much better than Stocks. I feel someone should ask her. I don't personally know her, so if anyone does, why don't you ask. Also Lisa redeemed herself last night, as she was the only one with the balls to ask for Sabines contract to be bid out.

DeleteOne thing I noticed last night as I watched was Dr. L had the courtesy to ask Sabine how to pronouce his lat name. And she did her best to pronouce it right. However, when he spoke about her he called her Mrs. Green, instead of Dr. Green. He knows she is a Dr. and I have heard him call her Dr. before. It was a deliberate slap in her face, and I thought it was petty. He proved his own case about intimidating citizens.

Why is the council, except Shaffer, so against just exploring what other options exist? At a high level that is very concerning if that is the approach they use to deal with issues. That is not an approach to find better ways than what is being done today, and that applies to many topics the council has to address.

Good news for you 11:57- I have no intention of running for City Council. I appreciate all the support many of you have given me, not only on this blog, but in emails. I will continue my quest to get rid of Sabine, however, as I think he has coast all of the taxpayers way too much money. He also did not tell the complete truth last night about the appeal of the tattoo parlor, which I was actually asked to do by many Cardiffians. The real truth was that the proposal was for tattoos only. It did not originally include body piercings. And, if anyone cares to go back and read the actual Council direction, the tattoo parlor could not change hands. It has done that many times since then, but we have all left that alone. Glenn lied about several things last night, but what is done is done. As for 12:24's post, you are correct and I appreciate you sharing what you know about me. I don't expect anyone to call me Dr. The reason it was interesting last night, is the fact that I did attempt to get Sabine's name correct, and in the past he has called me Dr. The correct term these days is Ms. not Mrs. if you are referring to a woman. Using Mrs. was a direct hit to me, and he and I both knew it.

Delete11:57-You must be jerome or someone of his ilk. Dr. Lori marched with Martin Luther King, and was actually there when RFK was assigned. She has been an activist all of her life. She comes from a very low socioeconomic background and worked for her degrees, and did not take a dime from the government for student loans. A spoiled child is the last thing she is. I do know her, and she never expects anyone to call her Dr., not even her patients. As she spoke last night, notice how far back in time she referenced, using her own appeal years ago as a reference. She has been active in the City for longer than most of us have been here. She is 66 years old, and her energy still amazes me. She works full time as a psychologist, does volunteer work, is Chair of the Parks and Rec. Commission, something she loves and will possibly lose because of last night's performance, and you are calling her a diva. Did you speak last night? Have you ever spoken? If not, shut the fuck up, as you don't have a clue as to what you are talking about.

ReplyDeleteI will be filing some Freedom of Information requests with some other City's, that use contract attorneys, and ask questions such as 1) how many lawsuits have been been filed against your city 2) did your contract attorney fight or settle them 3) if he or she fought them, did he or she win? If not, why not? etc. After I have done this, I can still go before the Council at Oral Communications, which is at the beginning of each City Council meeting, and a member of the public can talk about anything they want to regarding the City. So, even if it is not agedized again, I can still pop in my 3 minutes during oral communications. Glenn Sabine did not tell the truth about the way the tattoo appeal went down, and that concerns me, as a citizen, and it should concern everyone on this blog. When an attorney will stray from the truth, in a public forum, such as last night, deceive the Council with his version of the "story" and they believe it, if they did, it says a lot. When Sabine called and threatened me with litigation over this issue, I was with a colleague, so I put the call on speaker. She heard it all. I will not ask her to come forth at this time, but perhaps at a future date. The Council will hear how they were deceived by Glenn. As the song goes, "know when to hold them, know when to fold them, and know when to walk away." If I were Sabine, I would start thinking about walking away, before he loses his license to practice at all. I have enough on him that I think that could happen. Just not sure how to play the cards quite yet. But there is more, I promise you that. When we Irish get riled, we fight. And, whether you like me or not, I am going to fight to see this man is removed from our City, or at least I will die trying. BTW, the Staff report, was also incorrect. In one year we spent 1 million dollars on Glenn and company. The staff had a price tag of $600,000. And, I have records of that.
ReplyDeleteSabine had his little cutesyisms - FLOW.... More like FLOP or SLOP. This corrupt clown has to go - the sooner, the better.. is Kranz going to the Detour hair palour to get a grey streak to emulate his Mentor? Maybe he can use Miley Cyrus's foam finger next time he makes a point.

DeleteThe City Manager and the City Attorney are playing Barth and the council for fools. Gus tells people that the council will be gone and he and his staff will still be there long after they are voted out.
Council are enthusiastically flinging their bodies in front of a train to save Gus and Glenn for what??
Loved the FLOW acronym. That was priceless. Actually I think I will watch this again, as it has all the makings of a great comedy. Picture it. We have the little old lady, seeking to rid the City of a power mad,unscrupulous lawyer, who uses closed sessions for his agenda. Then add a City Council , who are clueless and not quite the brightest kids on the block. Add a City Manager, who also loves people to walk like soldiers and march to his tune. And a staff, who would rather fudge the numbers, rather than be berated by the power mad City Manager. What else am I missing?
ReplyDeleteDon't forget the mayor, who relishes bestowing awards and engaging in adorable photo ops while shrinking from doing the one thing she was elected for and promised to do: serve the city and actually lead.

DeleteWe have to add the folksy San Dieguito High School council member who loves to party and drink. He finds out after he is elected that there are a lot of perks with going along with the Mayor, and the power mad attorney, including a Rolex watch and new suits. He now gets to mingle among the upper-crust of the CIty has forgotten his roots to the people who voted him in.
DeleteAll is going well for the folksy council member until one day he again loses his temper and knocks the little old lady down for trying to remove the power mad attorney just when he was getting in with the right people. What happens next?
DeleteThe little old lad gets up and gives him a verbal tongue lashing, as they were both raised Catholic and you are not supposed to hit little old ladies. A voice of reason comes in (who could it be?) and begins a coup that leads to even more comedic activities by both the City Council, Manager, and Staff.
DeleteIn a bizarre twist that sets the town back on its heels, deposed ex-mayor Stocks emerges as the voice of reason -- for just a few moments, it looks as though he has a shot at staging a comeback --until -until - anyone, anyone? What happens next?
DeleteUntil it is discovered that Stocks is really no different than before. So, out he goes, and Bond comes back, as the savior he thinks he is. The 007 crowd are thrilled, as they now have a Mayor that is named James Bond. However, the citizens of Cardfiff soon realize that they would rather have a 92024 zip code than have Bond the Mayor, so out he goes as well. Enter the true savior, no one would have expected when the little old lady first stepped up against the bad attorney. Enter, stage left-none other than the City's best watchdog, Donna Westbrook. She has all the stuff on everyone, including the evil corrupt City Attorney. She decides to recruit people that truly care about the community. She is both persuasive, and tells it like it is. However, she also knows she is not the most outgoing person, so instead of hiring a P.R. person, she persuades the little old lady to go out and about and share what Donna has dug up about all of the people that need to go. Does the little old lady agree, or does she decline? To be continued by the next blogger.
DeleteThe little old lady decides to do it. SHe will expose Glenn for the true child that he his. She knows he hates social media, so the first thing she does is enlighten the Council, during Oral Communications, what really happened on the tattoo parlor incident. She makes sure his childish behavior goes viral, as well as exposing his marrying the Former Director of Finance, and having his lovechild with her. She also lets him and the Council know that we citizens pay his salary, as well as Council and Staff's. However, she is unsure as to go about removing the Council. She needs help. So, with all of the information Donna, and others have provided her, and is known to be fact, she goes to the one person who can expose this-YES TURKO. She normally would not stoop this low, but she sees no other way. Before she does it, she tells the Council, again during oral communications, what she is going to do. She tells them there were no boy scouts at the tattoo meeting that night. She tells them that both Bill Weedman and Glen Sabine called her, and she tells them that they were on speakerphone when they called and she has a witness that heard both of them speak. This really sets Sabine off into an even more childish rant calling the little old lady all sorts of names. Perfect-now the little old lady, seeing how upset and disheveled he is, quietly asks the Sheriff to remove him and states he needs a 5150 hold placed on him, as he is obviously a danger to himself or to others. The sheriff complies, as he is also sick of Sabine. The Council is stunned. They decide, each on their own, as they don't dare do it in a closed meeting, that they had better start listening to the citizens of Encinitas. When the next election rolls around Barth decides not to run. Gaspar runs and wins, but has changed her ways. The following election cycle, Kranz loses, Muir remains and Shaffer, who has by now learned the ropes, stays on to become on of the finest Council members the City has had in a long time. Meanwhile Donna is the City Watchdog, a new attorney is hired, Vina is fired, along with the new Parks and Rec. Director for not bringing in the Park on time, and staff starts pulling their weight when a new City Manager enters, treating them with respect, courtesy and kindness.
