11/12/14 City Council meeting open thread

The current city council has continued prior councils' practice of not providing written summary minutes of council discussion, but only "action minutes" which state the outcomes. Encinitas Undercover will provide a forum for observers to record what occurs at each council meeting.

Items of interest on the agenda:

- Closed session performance review of His Excellence Gus Vina and city attorney Glenn Sabine.  Closed session by choice, not a requirement.  Would the fawning praise be too cringeworthy for public consumption?

- Street standards

  2. There is no need for probation. When they wake up and realize Vina has been and is one of the worse leaders for our City (Um- look at the financial problems of Stockton and Sacramento! from Vina serving as Director of Finance!), they should can him immediately and bring in an interim City Manager until they recruit an adequate replacement.

    This loser Sacramento failure will be retiring at full pay over $220,000 per year for doing a shitty job for several Cities over the bleak years of his government disservice. Shameful and a crime again taxpayer.

    1. Vina's contract with the city requires 6 months notice of termination. Unless the council gave it to him in the July performance review, he will be around until July 2015 if the council decides to sack him in January.

      We don't know. Again the mayor reported out that the council only had a discussion in the closed session performance review yesterday. A decision will come in January. The mayor explained that the reason for this premature review was to give Barth an opportunity to weigh in on Vina's performance before she leaves office in December. The council was almost 25 minutes late in starting the regular council meeting. That was quite an opportunity Barth was given. Almost 1½ hours for Barth to try to defend Vina. She and Gaspar are the only ones from the old council that selected him in 2011.

    4. Audet's claim that the city does not care for veterans because of a tiny tear in a flag was a new low. The park host who is a veteran usually takes care of the flags but was out of town at the time.

      Audet is a sensationalist that likes to use the Tammany Hall style of politics to misrepresent facts to achieve his own skewed agenda.

  5. The City Council spent nearly an hour and a half on a performance review of Vina and Sabine. That sure doesn't sound as if the council was singing the praises of the city manager and city attorney. Stay tuned for the vote in January.

  6. Since Sabine, and his firm Morrison and Sabine, have cost the City 10 million in 7 years, it's hard to believe that he is still around. And yes, I did email the whole Council about this. In fact I have done it several times. Seems like they like him for reasons I cannot begin to understand.

  7. Can anybody venture to guess, specifically please, why the public has seen what needs to be done about vina and sabine for years and yet the council refuses to comes out of their blindness syndrome long enough to find some perspective that seems to only be visible to the public?

    It is not just the public but some of staff knows too but fear for their jobs if don't they abide by the powers that be.

    Hopefully that long meeting in closed session means it wasn't an easy go. That Teresa got to have her say when she has chosen to be his biggest supporter to the detriment of this city, stinks. Her opinion of his performance has zero validity.

    Small blessings that the council will not rule on this until January. A glimpse of hope that council will finally be rid of Teresa and the new/old make up will have a chance to distinguish themselves by firing vina and sabine, at long last. Glimpse is all we have for now but this coming council could show they are representing the public by letting these two go onto to their own greener pastures.

    1. 12:50 - what I believe you're missing is a seat at the table. In a nutshell, Vina has done everything this council wants him to do. I'm sure they know how the public feels about him, but he doesn't work for the public. He works for the council. The council works for the public. Clearly, under the terms of the goals and objectives given to him by the council, he has done nothing wrong. Teresa had to be given the opportunity to evaluate Vina not for her sake but for his. Objectively, if you had a review scheduled and one fifth of your input would not be there, wouldn't you want to find a way to get it into the record? That's only fair. Sure, the new council could just fire them both, but what effect would that have on future candidates? It would be chilling. If you knew your predecessor was fired because of a shift in the political winds, would you accept the job? If you did, you would negotiate a steep severance payment to protect yourself, wouldn't you?

      If I were on the council I certainly would not instruct Vina in the manner that this council has chosen, and I would have completely jumped ugly on him on the PV Bond taxability issue - he should have seen that coming. But that's not enough to fire him - just lose his bonus.

      The fact that Vina was blindsided by the taxable bond issue for Pacific View, along with his choice for Financial Director Tim Nash and financial adviser Jay Lembach, is more than enough to fire him. Add in the debacle of the illegal discharges into Rossini Creek and fabricated deceit in the Rutan and Tucker report for Prop. A. There is plentiful justification to push him out.

      The salary of the city manager and the prospect of working in Encinitas are more than enough to attract new applicants. There won't be a shortage of applications.

      I would quickly discount the one fifth input of Barth. She believe Vina walks on water. He doesn't, so what's the value of her opinion? I'm convinced the scheduled closed session yesterday (2 months before it was due) was an attempt to get a satisfactory rating for Vina. He didn't get it, so there wasn't a majority to give him a gold star.

      Vina steered the Council to continue with the two Trophy projects that suck all the small remaining money from the City without ever addressing the real long term costs for moving forward.

      I have never seen a complete forecast of what the Regional Sports Park will cost the City 1) to build and 2) to operate and maintain in perpetuity. Same for PV.

      Vina is supposed to come from a Financial background which should be well versed in looking at long term costs and accounting trends. But wait- How well did he do in advising his Cities when he was in that role. How is Stockton and Sacramento doing financial.

      Vina is a fool and Barth a bigger fool for supporting this napoleon loser. Thank God Barth is out, and I look forward to the day when the remaining Council wake up and fire Vina.

      Encinitas deserves a real City Manager, Not an anchor that is sinking our future.

    5. We should get an experienced manager from the private sector who understands mistakes have consequences. Someone like Jamie Dimon perhaps.

      "After agreeing to pay $23 billion in penalties and settlements in 2013, JPMorgan Chase (JPM) Chief Executive Jamie Dimon was rewarded today by the board he chairs, receiving a 74 percent pay raise to $20 million."

      The amount above doesn't include the $6.2B loss from the London Whale fiasco. Hey the private sector can be brutal.

      It seems that you are impervious to rational thinking, so I'm afraid I cannot help you further.

      I would encourage you to read the original Dialog between Salviati and Simplico. You can Google it. All joking aside it shows how we can be misled by what we believe to be intuitive and obvious. Simplico argued in favor of the Ptolemaic model of the solar system using intuitive rationale (if the Earth were moving, we would feel it.). Galileo used the Dialog to demonstrate the limits of our subjective intuition. Pilots are told to trust the instruments, not their senses--it's the same thing. Trust the data.

    12. 4:14, Good and careful point that we can become misled by what we feel to be intuitive or obvious. The truth is, we wouldn't feel the earth if it were either moving or standing still would we?
      1. We wouldn't feel movement at a zillion miles an hour because of earth's inertia (as we don't in our cars steadily going 100mph).
      2. We wouldn't feel movement at zero miles an hour because of earth's stillness (as we don't in our cars as we're parked at Wal-Mart.)

Even though most of us don't completely understand and cannot explain relativity, we trust the consensus of experts that Einstein was right. So why don't we do the same for climate change? Answer: politics. We don't like the implications and consequences of admitting climate change (economic, environmental, regulation), so some slice of the population has decided that the conclusion must take precedence over the data. If we don't like the conclusion, the data must be wrong.

      The irony is that relativity is mind-bendingly absurd from the perspective of our subjective experience. A purely rational person would much more easily accept the science of climate change compared to relativity.

      E=mc² forces us to believe that your mass and size change relative to your speed. As you accelerate, you get bigger and heavier. The concept of simultaneity only exists at a particular speed. If two people clap their hands simultaneously, and they are viewed from the perspective of someone traveling past at near the speed of light, their claps will not be observed as simultaneous--one will happen before the other.

      Relativity is crazy. It's insane. It makes no sense. But it's true, and some really smart folks have proved it.

      We trust them, only because there are no political angles to relativity.

      Yesterday 50 states in America were freezing, many set record low temps - you ignore this truth as it does not fit with the political agenda

  11. One of the many reasons to get rid of Sabine is he NEVER bills for a paralegal. Most law firms have paralegals and they cost less. In all of my documentation on Sabine, not one charge shows a paralegal. It's attorney's fees all the way. It is supposed to work Sculpin says but from what I can deduce, Sabine has a pretty good handle on what he can bill and get away with, without council asking for anything. So, technically Sculpin is right, but in reality it hasn't worked that way.

  16. In our City Standards for Dept. Heads, all of them are supposed to have Masters Degrees in their specific area. A CPRA request shows that they do not. However, again Council doesn't seem to care. I'm not quite sure what the council cares about these days.

    It's a piece of paper, easy to obtain from a third-tier university.

    Still, it's instructive that department heads and the city council are so contemptuous of the public that they don't even bother fulfilling that minimal standard.

      I guess you don't do recruitment evaluations or you wouldn't say that. Yes, some people get degrees from weak schools but that's obvious from their resume/application. Some are accomplished professionals that feel they need to add something by going through a National University/University of Phoenix type program. Most others are trying to boost their credentials through those programs. In the former case you evaluate them based on their work experience. In the latter case, while the degree may get their application past the initial cut, you pretty must ignore those degrees.

      By the way, do you not put much stock in master's degrees because you have one and see little benefit in your accomplishment? After all, Encinitas appears to have a large share of Phd's living here. Does that include them?

    2. EU - I assume your opinion relates only to the current discussion....gawd I hope so! I put great stock in a Masters degrees. In my field(s), Cornell, Wharton, UC, Stanford, MIT, NYU, even little 'ole SDSU are very nice to have. The problem is that these masters degrees do not end up in Encinitas City government. They're at Wall St., or large public companies, or innovative start-ups........therein lies the problem........but I guess that's OK, because our climate will ensure that we can always attract the best and the brightest!!!

  19. 10:08 There are a huge number of people who further their education by getting a Master's Degree and a Ph.D Degree. It is hard work, more money, dedication, and the willingness to spend the time and money to earn that degree from a reputable college. It is more than just a "piece of paper".

    If you don't put much stock in those degrees, that is your opinion only. People are hired and paid based upon their education and experience. I think it is commendable and respect those that have earned those degrees.

    I don't take much stock in the easy degrees that you can get online. My five year old son could probably get one.

I'd like to thank the City of Encinitas for putting the light up sign in the middle of N 101 announcing (24/7) that the Encinitas Housing Plan Workshop date is coming up for whomever would like to give their input. I grow weary of hearing "They didn't let the residents know!" so obviously newpapers and large vinyl banners are not enough. What a perfect opportunity for complainers to share their effective alternative to the DOT method of voting. Can't wait to hear their plan. If it doesn't cost a lot of money it will surely cost a lot of time.

I have never met Dr. Lori, but even if I disagreed with everything she said, I could still stand to look at her. She doesn't look grotesque, at least on television. Most of us post anonymous these days so not sure why you think any of the posts are about her. Perhaps you need a few sessions with a shrink? Or are you too well put together to do that.   34. I think what it said is we have no good candidates that can fight big money, unless they have some themselves. Lerch came in at the last minute, didn't know anything about the workings of City Hall and came in 2nd. Julie, who knew a lot, but had less money came in third. Lerch loaned himself $20,000. Julie didn't. So, may I suggest we find someone for 2016 that either has some money they feel that they would like to spend, and win a council seat. It seems if you have obey you really don't have to do all the meet and greets, go to every event imaginable, etc. to win. So, the question is, who has enough money to loan themselves 25K, wait until the last few weeks, put out a lot of colored brochures, and do what Lerch did? And, of course, it cannot be one of Vina's 28 so that leaves us with finding someone who cares enough to want to literally fight City Hall from within. Hard to find-perhaps, but certainly no impossible in this town. There are a lot of people who have money. There are a lot of people who care. We have to find them and convince them to run. We have 2 years. Let's get moving.

    1. 8:42- you are counting your chickens before they hatch. The city can't/won't water the plants in the medians in Leucadia, yet plant and grow 7 acres of grass at the sport fields.
      The city can't / won't maintain the sign for the Roadside park yet spends $10 M on a school that will be bulldozed to the ground.
      I've been waiting for 20 years for Leucadia's best to come.... I stopped holding my breath long ago, may I suggest you do the same, breath.

The oleanders, which had survived for years, as they are drought resistant, fell to the Sharp Shooter insects that carry a bacterium, which is killing oleanders all over the state, and in other states, as well. It's sad. Don't blame dead oleanders on those who don't support further ensnarling traffic with unwanted three way intersection one lane roundabouts, narrowing what had been our four lane highway, major arterial down to one lane northbound and one lane southbound. We want a greenscape/artscape not a cementscape.
