Last week's Coast News brings news of a lawsuit by the Treggon Owens family over breach of contract by the city on the Moonlight Snack Shack concessions that the family had run since 2009. Apparently this local family operation didn't fit with the city's plans for a bigger, busier Moonlight Beach.
The Owens family was profiled in January's 92024 Magazine, a new, free, glossy publication that features local content and advertisements.
As usual, no attempt at fact finding here: Mr. Owens neglects to state to the press that he threw in with the guys from the Bull Taco gang and sat back and waited to be appointed by the City to continue: but he/they made a critical mistake in the vetting process: he did a 'No-Show' on his personal interview with the decision-makers from City Staff.
ReplyDeleteHe gets an 'F' for 'Fail' in the process: and it was only 'after' his/they're 'No-Show' that he started considering suing the City because he was without humility and thought the contract was 'naturally' his.
Not so 'home-grown', for a 'hero, eh?

I don't know anything about this case, but I have a question. If they had a written contract that did not spell out that he had to do an interview or that the contract could be ended by the City, wouldn't the written agreement hold up?

8:25 you sound like you are making excuses. Did the family have the concession with the city or not? Did the city breach and violate that contract? It seems to me that this is another example of failed leadership for Sacramento Gus Vina who got a vote of no confidence from the city of Sacramento when he was effectively booted out of office.
ReplyDeleteIt is also a poor reflection on Barth and Shaffer who again blindly follow the losing recommendation of "No vote of confidence Vina'
Then there is city attorney Sabine who most likely is getting paid and is again offering bad advice- remember, Sabine cost taxpayers about $1M with bad advice on the Hall Park and close to another 100K on bad advice on the buried road report.
It seems to me you receive the F for denying the legal fact that a contract is a contract and an agreement is an agreement.
Time will tell which of us is correct. Thanks WC for keeping these issues in the public light.

DeleteAny factual comments you can offer the group for discussion? Sabine did cost taxpayers over $1M by suggesting fighting the Hall Park EIR, he also cost taxpayers about $100K by wrongly advising the council to try and keep secret the road report - the city lost both lawsuits.
So, did the city have a contract with the family? Did the city breach the contract? Who will pay for this?

ReplyDeleteSure, ask anyone on the DEMA board where Treggon is the President. They all know. If some of you posters actually took part in democracy rather than commenting on the 'hearsay' that WC feeds on... but then, you would actually 'know' what your talking about.

ReplyDeleteGood question! Remember that he signed a contract with Rutan and Tucker a month before it came to council, and then they did a fake vote to support the decision that had been made for them 3 weeks before the fact. It was only later that it was made public that Gus had already hired them.
DeleteI think that Rutan and Tucker charged us close to $50,000. All he has done is to lead council to divide the city for his own PERSONL gain. Add that to more taxpayers funds that went down the toilet.
And he did that because Mayor Barth thought it more important to take her new council mates to a weekend away at tax payer's expense to the League of Cities party, instead of agendaizing Prop A as part of the Initiaitve process. The clock was ticking and 'Travelin' Teresa' had her priorities wrong: again.

Owens must have been very sure of himself not to follow up more closely on his contract. Perhaps the ouster of Stocks and Norby mean he's not got the guaranteed inside track he once enjoyed? Pure speculation, but something is off here.

DeleteIf his contract had terms that named a specific completion date, one would think that the city would honor its agreement. However, this is the City of Encinitas!
Vina received an excellent rating from the Mayor!!!
