5/28/14 City Council meeting open thread

The current city council has continued prior councils' practice of not providing written summary minutes of council discussion, but only "action minutes" which state the outcomes. Encinitas Undercover will provide a forum for observers to record what occurs at each council meeting.

Please use the comments to record your observations.

Tonight should be quite a circus. Generating the most heat will be the majority's ill-advised Mean Girls stunt, where they welsh on their end of last December's power-sharing bargain and strip Kristin Gaspar of her turn as mayor. Our spider sense tells us they may back down in the face of public criticism, but they've been stubborn and wrong plenty of times before.

But of more substance this evening will be Bob Bonde's presentation on ambulance services, as well as more budget discussion.

      As to your grammar? Is the reason that your postings are always a space or two off because you have carpal tunnel syndrome from operating the bean gun at Taco Bell? Either way, when you cannot spell or punctuate correctly, or adequately most folks who read your posts likely assume you are playing banjo in the Ozarks of Leucadia?

    1. When Barth spoke, she said she did not cut speakers off, including Council Members.

      Not true. She was not as bad tonight, but at past council meetings, she would start saying thank you, keep repeating thank you the second the three minute signal went off.

      She also tried to cut off Muir and Gaspar re the Pacific View discussion, and was able to do so after the city attorney advised the discussion by council could only be cut off with a council vote, if a council member asked, by motion for a vote.

      Summary minutes: Shaffer starts walking it back. Kranz still defiant, drags out Gaspar quote from December. Parade of public speakers, both Gaspar supporters and a few former Shaffer/Kranz supporters, lecture council on ethics and integrity. Gaspar gives speech on importance of civility and keeping promises. Council agrees to take no action, meaning stick with Gaspar becoming mayor June 11. Barth gives speech about knowing how it feels to be passed over and she wouldn't do that to someone else.

  26. I was there and although I voted for Kranz, and not Gaspar, I saw more common sense in Gaspar tonight than I dec Tony. Teresa droned on and on about how much civility she has added to the Council and ow she knew what kristin felt, as she too has been passed over in the rotation. Tony looked like he was about to throw a temper tantrum and Lisa just sat there and pouted. Some speakers who did not vote for Gaspar stated that a deal was a deal and Tony and Lisa should not have even put this on the agenda. I kind of wonder why they thought it was a good idea to begin with? In the end they all voted on hearing the speakers and then made no action. Which was the best outcome that could have come out of this, from a political as well as citizen point of view. No one spoke supporting the Lisa/Tony agenda. House was filled to overflow and then some. Bob Bonde's presentation was great. He bantered a bit with Muir, but it was respectful on both parts. When Teresa asked Vina if he had the staff information council had asked for he said no. When she asked when he would have it, he said he didn't know. I think, even she was frustrated with that response. It was pretty much confirmed tonight that Barth will not run again. She would be wise not to. Tony may never get elected again after this performance. We'll see. Julie Graboi was there, although she didn't speak. She is running for Council and personally I think she would be a welcome relief. She is not being groomed by any of the council members, and I find that refreshing.

      To me last night sounds like a confirmation that we need five new councilmembers. I think we really need to break the chains of the Stocks/Bonds crew and the Barth/Maggie crew.

      Let's get some new people in there, like Julie Graboi. We're spinning our wheels with crap like the Gaspar thing. We're spending time on someone who's an embarrassment every time they open their mouth.

      Every Gaspar utterance makes me cringe, but Lisa and Tony's reaction also made me cringe. I'd like to see our focus get a lot narrower, specifically, let's start looking at the city's budget numbers....

  28. Donna Westbrook had to leave early, but during oral communications she asked why the financial plans were not available in the agenda report, or by public information request of all three main street associations that are subsidized by the city.

    Her question isn't being addressed, so far. The Economic Development portion of the budget is like one long commercial.

    When William Morrison spoke about Leucadia 101 Mainstreet, he kept repeating that the number one priority and all of the organization's goals were in anticipation of the Leucadia 101 Streetscape.

    He compared Leucadia to Downtown Encinitas, but failed to talk about obvious differences between Phase 1 of Encinitas 101's Phase 1 streetscape and Leucadia 101's. DEMA has many more businesses west of 101. DEMA's streetscape plans, both the completed Phase 1 and the anticipated Phase 2, don't include roundabouts on the highway.

    L101 Mainstreet never shared how many businesses in Leucadia, including off of Vulcan, are members of the mainstreet association. Morrison never shared why L101 mainstreet gets $30K per year, when Enc101 and Cardiff101 get only $20K, and Encinitas Chamber of Commerce gets no direct subsidy from the city.

    Morrison never shared that Leucadia 101's economic development is restricted by the RR tracks, so that businesses on 101 are only on the west side of the highway.

    Morrison was asked by Tony Kranz, which wasn't addressed in his presentation. DeWald, for Enc101 did bring up DEMA's work on a comprehensive parking study.

    Now Gus Vina is asking for an additional subsidy for the Chamber of Commerce of $20K and also increasing funding for the facade grant program that goes directly to businesses, by $40K.

    Morrison is sitting in the audience, in view of the camera, just shaking his head, yes.

  29. Morrison is misinforming Council that the Leucadia 101 streetscape has been ongoing since 2005. That's not true, either, at least as it is now planned. The workshops began in 2008.

    Morrison says they need more money than the other business associations to get the Leucadia 101 Streetscape done. In 2007 all of the members of the board of directors of the Leucadia 101 had submitted a petition for a stop sign at Grand View and 101. There was no talk of roundabouts as part of the Leucadia 101 streetscape until 2008, when Peltz and Associates were hired.

  31. Kranz moved to extend the meeting until 11. Motion passed, unanimously. The vast majority of the public left after the mayor transition council member initiated items. Muir had asked that those agenda items be moved up to after the consent calendar, to before the budget items.

    Council was glad all those people weren't there to see Barth, Shaffer and Kranz vote to make the so-called intent motions official. I think that's what happened, this new process is confusing.

    One of the previous speakers, could have been Donna Westbrook, said that even Wikipedia doesn't define or have any information re "intent motions," which is something that Gus Vina seems to have cooked up.

    Most of the people in the audience are now leaving. They were all affiliated with either the 101 business associations or the chamber of commerce. Oh, suddenly Barth interrupts Vina to say we have three public speakers. They had to wait until after 10:08 to be heard.

      Gaspar told the public an appointed sitting mayor would have an advantage running for elected mayor - and that Gaspar opposed that.

      But then, when it benefits Gaspar- she supports it.

  33. What a sad thing when you bring your mother and son to speak for you. Will Gaspar let her son play mayor also? She is weaker than I thought. The next 6 months will be more of the same even if she is mayor. Gaspar and Muir will remain voices not heard. 3-2 led by Barth, Kranz and Shaffer. I hope she remembers to wear her tiara to the meetings.

    1. Most of those in the audience at city hall, and probably most of the public at home, enjoyed the family aspect of the public speakers. They were straightforward about who they are. I admired Gaspar's mom's directness, and her 7 or 8 year-old sons courage and brevity.

    Asking for financials of publicly funded organizations is fair. And Economic Development is indeed commercial. Sorry it was so long for you. Yes, Leucadia Streetscape was, is and will continue to be a high priority with L-101 and the majority of residents who cared to learn about it and show up for workshops. That number one priority encompasses much. Most people here like trees, sidewalks, streetlamps, slower speeds, bike lanes for our business district and the advent of better circulation with roundabouts for everyone as well. Sorry to those who don't. The desires of locals to better Leucadia started long before the first Streetscape workshop. And sure there are many differences between downtown Encinitas and Leucadia. No one ever said their weren't. They're pretty obvious. But a business district on one side of a street does not diminish its value. Ask Solana Beach if their business district is restricted by the RR. Leucadia has over 200 businesses on the west side of N 101 and several on N Vulcan. L-101 represents all of them for free on our Leucadia Merchant Guide. Sorry if that disturbs you. Currently the Encinitas Chamber may not get a direct subsidy from the city. Not so in the past. I think 6 to 8 years ago they got 90K for just moving their office. A comprehensive parking study? Sounds like another pricey consultant fee. Let's just hire some planners with brains (although Prop A stands to help a lot). For example, 8 three bedroom condos and 12 businesses in one location that has only 14 parking spaces was not sane. Especially when half or more of such places go bankrupt. The facade grant program is great. The city will match up to $2000 a merchant pays for improvements to their brick and mortar presence. A nice incentive with a smart ulterior motive: more sales! But if you want any questions answered about L-101, please join us at our annual membership meeting coming up soon. Thanks.

    I don't remember doing that. But I did help conduct surveys for both Leucadia Merchants Association and the city in the mid 90's. Back then, EVERYBODY on a corner on 101 wanted a stop sign. In part for better visibility for their business and in part for slowing cars down and a safer crossing. And true, back then NO ONE mentioned, suggested or considered roundabouts! We simply didn't know how beneficial they were and what a great alternative to stops they are. Since then of course the speed limit was lowered some. But back then a stop sign at Grandview may have been in order, as that is the last place people on Neptune funnel back onto the hwy, and a lot handier to make lefts at than with 3 lanes of 40 mph non-stop traffic to contend with. Now we realize that the more stops you put in, the more you have to stop. What a revelation!

    1. Any organization that receives at least $20K is required to provide financials to the City monthly. In addition, they must also provide an annual accountant's review of their records. E101 has always done this. Dody

    2. Donna Westbrook said those financials should be available as part of the Agenda report, and should be available through public information requests to the City. When the public asks for those financials, Dody, we have been told to go get them from the 101 business associations.

      Since you posted, Dody, and thanks for sharing your name, can you find out who was on the State of the City Committee this year? This was also requested through a public records request, and we were told to check with the Chamber of Commerce, who never returned our calls. Mayor Barth said she didn't know. It was stated that Gus Vina was on that committee last year and this year, so it was suggested that the mayor could ask the City Manager for that information. The City Manager, as usual, did not follow through, with an answer.

Although most people here like trees, sidewalks, streetlamps, slower speeds at 35 MPH, sharrows for our business district, on 101, in Leucadia, as with the rest of 101, south of Leucadia in our city, most people here don't want roundabouts and most didn't and don't want a lane or lanes eliminated for motorists.

      No one said that a business district on one side of a street diminishes its value. But the restriction to one side of the street reduces its size and its potential to reap rewards in terms of revenues to the City for economic development, or re-development.

      Because the City got so much more sales tax revenue for Phase 1 of Phase I for Downtown, does not equate to Leucadia 101 having the potential for an equal increase, because many less businesses are, or could be located adjacent to 101, here. Sorry if that disturbs you.

      Morrison did say that L101's territory extends from La Costa all the way to Encinitas Blvd, in terms of the businesses that are being counted, not just to A St., which is also south of Leucadia's border.

      The majority of residents who cared to learn about it and show up for the workshop in October of 2008, over 60%, did support the L101 Streetscape in terms of keeping Leucadia Funky, protecting and preserving the canopy, improving walkability, but did not support roundabouts, which would narrow the highway, including bicycle lanes, into one lane southbound and one lane northbound, from what were, before, four lanes on a major arterial.

      The subsequent survey, taken at the final workshop in 2009, and after two open houses that year, which had cartoon drawings, not engineered plans (as the open house on June 5 will have, but only for 30% of the entire project), is statistically insignificant and therefore invalid.

      Unlike the October 2008 survey, where well over 60% of those present voted against Plan 4 with five roundabouts and lane elimination, and voted no to Council going forward with that version of the Leucadia 101 Streetscape Plan, the subsequent 2009 survey, at the Community Center, did NOT allow anyone to vote no.

      The 2009 survey was invalid because participants in the final workshop could only vote for Plan 4a (supposedly with less trees destroyed, but still with the same amount of roundabouts and the same lanes being eliminated) or more traffic signals on 101 through Leucadia. For those of us who wrote in that neither was acceptable, and that neither back in angled parking nor front-in angled parking is acceptable, our questionnaires were counted as "no answer."

      Anyone writing in that the City could consider one two-lane roundabout at La Costa, was counted as voting yes on Plan 4a, with 4 one lane roundabouts, which would force all vehicles, including bicycles down to one lane northbound and one lane southbound through narrow diameter roundabouts with less safety features, and no bicycle lane in the railroad right of way.

Just for clarify, so none of the $13 million dollars the council just voted 3/2 to borrow is going to the Leucadia Streetscape, but most is going toward overpaying for an old school site that hasn't even been identified by the public for a particular function? No wonder Morrison is depressed, An already approved plan that sits dormant that could help increase economic development, just left by the wayside while the council maxes out the city's credit to concentrate on an arts center landlocked in a residential neighborhood? That is depressing!

    1. The majority of residents, commuters and business owners, most of whom are not members of Leucadia 101 Mainstreet Association are glad. The City has wasted a great deal of money on engineered plans for something that thousands of people have signed petitions against.

      TransNet taxes are being used up by the railtrail corridor and mitigation for the I-5 expansion. TransNet taxes can't go for beautification. But beautification is the part of the Leucadia 101 Streetscape that most residents and businesses, as well as local commuters, support.

    1. 3:27 did participate in the workshops for the L101 Streetscape, which workshops were put on by roundabout lobbyists Peltz and Associates.

      What is objectionable to most people participating in the workshops and the thousands who signed petitions, are the four one-lane roundabouts, not the plans for beautification or improved sidewalks, lighting, preserving the canopy, etc. Please check out the Agenda Report for 2010-01-13 City Item 07 North Coast Highwy 101 Streetscape presentation, to verify:

      The survey done for Workshop #3 was facilitated at City Hall, when the most members of the public were in attendance, on November 13, 2008. That survey included two questions: Do you support the new alternative presented tonight? Do you support this project moving ahead to City Council (see Page 92 of the PDF) file. Less than 40% of those participating in the survey supported the new alternative or supported Council's moving forward with the project. Nevertheless, Council, under Stocks, Bond and Dalager's majority, went forward with the project, having Peltz and Associates create what staff described as cartoon drawings, staging two more open houses, and a fourth and final workshop at the Community Center on October 10, 2009. The survey then provided, and also provided to select people at City Hall for the week following the Saturday meeting (Monday was Columbus Day) was invalid, because those of us participating were only given two options, roundabouts, or traffic signals. (Page 114) If we wrote in, neither, our vote wasn't counted. The same was true for angled parking; we were only given the options of front-in or back in angled parking on October 10, 2009.

      On November 13, 2008, the workshop summary shows, on Page 94, asks participants to "List other priorities you feel are important."

      There were 163 Survey Respondents. 29 listed under “other priorities": expanding traffic study to include adjacent streets (Vulcan/Ponto/Leucadia Blvd/Neptune) All streets west of Highway 101.

      The second highest number, 24 respondents, listed “Keep 2 Lanes Northbound and Southbound (4 lanes Total)

      Next, came 11 participants specifically listing “Eliminate/Reduce Cut through traffic. 7 participants listed 35 MPH Design Speed. 4 more specifically stated 25 MPH is “Too slow.”

      On Page, 96, sixteen participants listed “No roundabouts-roundabouts do not help traffic.”

      9 people listed as a priority decreasing the Number of Roundabouts

      2 people listed “large roundabouts (two lanes)."

      9 participants listed No back-in Angle Parking. Separately listed (these categories could have been combined; the priorities were made to appear artificially low by the way these priorities were divided up) was “No Back-in angled parking/Use head in angled parking, with 4 listing that as a priority, and No Angled Parking (Head-in or back in) and another category, No Back-in Parking/Use Parallel Only, No Street Parking/provide parking structure, and finally Provide Parking on Northbound side, which is the best idea, but which parking on the east side of the highway would be eliminated by Plan 4a.
