Encinitas in San Diego Reader

[...] We are still waiting for a Sunshine Ordinance to be passed here in Encinitas. Our City Attorney is equally lax at following open government law specified in the CPRA and the Brown Act. Encinitas was successfully sued for CPRA violations by Kevin Cummins, in 2010-2011, when City Attorney Glenn Sabine (also City Attorney for La Mesa) wrongly withheld a road report, improperly claiming it was exempt as a “draft document.” Sabine’s office attempted to appeal the court’s ruling, with council’s approval, but the appeal was so frivolous that the Court of Appeal denied review!

Mayor Teresa Barth, and councilmembers Tony Kranz and Lisa Shaffer promised in their 2010 and 2012 campaigns that, were a new majority to be elected, they would enact a local sunshine ordinance ASAP. That has yet to happen.

Instead, our council has actually regressed on open meeting law, disallowing nonagenda item public comments at all so-called Special Meeting Strategic Planning sessions. The Brown Act defines regularly calendared meetings as those that receive at least 72 hours notice. Encinitas Strategic Planning Meetings are now being held, routinely, on the first Wednesday of the month, with more than 72 hours notice.

But because city practice has been to hold council meetings on the second, third and fourth Wednesdays of the month, Mayor Barth and City Manager Gus Vina, are using this contrivance of “special meetings” to discourage public participation and to disallow the normal practice of three minutes per speaker on all agenda items.

These are all unilateral policy changes and decisions being made by outgoing Mayor Barth, City Manager Gus Vina, who was given a vote of no confidence by Sacramento City Council, before being recruited, with the help of Barth, to Encinitas, as of July of 2011, and long overdue for replacement contracted city attorney, Glenn Sabine, our City Attorney since 2000. Sabine is far too set in his secretive ways, which include encouraging, despite public objections, inappropriate serial prebriefing of council members re upcoming agenda items.

    3. The title to my home says I live in Leucadia. My property tax bills say I live in Leucadia. Leucadia 101 Mainstreet headquarters is south of me, and south of Leucadia Glass, on 101. The sidewalk in front of Yoga Bliss, south of me, is stamped Leucadia 101.

  6. Some of you take a disliking to Lynn because she has focused on what the problems are at city hall. She is not afraid to name names. She is not afraid to bring up issues that are in fact in violation of the Brown Act. She is concerned with our lack of ability to participate in the public arena because of rule changes by Grandma Barth and her co-conspirator Gusalina Vina and Smirky Smile Sabine. I wish I had the guts to stand up there in front of this council and staff and tell them exactly what I think of them. Their ears would burn.

    1. Grandma Barth?? You do reach a bit to try to come up with catchy names to slur people with.

      The trouble is while Lynn does represent some Leucadia residents and a few non Leucadian Encinitas residents, she doesn't represent all of us or even, I would hazard to say, the majority of us. I doubt a good majority of Leucadians even see this blog.

      And while Lynn is sometimes right, if only partially, she is often wrong but once she takes a position she doesn't appear to ever reexamine it. We have all been in similar situations at times but Lynn has developed a career at it. After awhile it just wears on you and you want her to stop.

      I'm sure she has good intentions but unfortunately many people just tune her out these days. There is such a thing as too much.

    6. One was removed a month early with three council members playing politically musical chairs. Another council member was running for Assembly and his campaign literature would look ever so much better if his title were "Mayor of Encinitas" instead of councilmember or former mayor. A "special meeting" began and Voila; the Mayor of Encinitas was running for Assemblyman.

      Sheila was a strong willed mayor and that rubbed some the wrong way. She accomplished much, but it was a pretty tough road with 3 council members and one reporter not liking her.
      One evening she wasn't feeling well and I escorted her to her office for some medicine during a break at a regular council meeting. One woman jumped in front of her in the hallway and began bitching about something. Sheila raised her palm in the air and said "Not now, please." and we continued to her office. A few days later, the lady wrote a letter to the editor calling Sheila rude and claiming she had "flipperd her off"! Hey, I was right there for the whole momentary episode. That didn't happen. But crap from people like that, or the clown folk of yesteryear will do all they can to make someone look wacked. But oh God, forget it when a reporter goes after you.

    These briefings constitute improper serial meetings, but Sabine incorrectly claims, as long as there's no concurrence, it's all good. Unfortunately for the public, many decisions are made before Council's public discussion, though a series of wink-wink, nudge-nudge briefing meetings with individual council members, when there is tacit agreement.

    Barth has become far too close to Vina to remain objective. Sabine never has been objective. He now feeds Council what Vina wants to dish out.

Will you ever grow a pair and be a real man? Real men treat women and their fellow man with how they would want to be treated, you know the golden rule and all that.     1. What I have said is Encinitas is equally lax in that a Sunshine ordinance was promised, as promoted by Barth, Kranz and Shaffer. Promises were made, and positions were taken re the right to vote on upzoning petition and initiative by those three, that were broken.

      I have said, and I repeat, all of Council had terrible judgment to give Gus Vina an excellent evaluation. The subcommittee of Shaffer and Gaspar had said there could be a public process. Jace Schwarm then gave an unverified hearsay opinion from Liebert, Cassidy and Whitmore, the same law firm that gave the opinion that then Council Member Teresa Barth's harassment claims were not applicable because she wasn't an employee, and because her complaints were more about lack of civility by other council members, rather than reaching the level of harassment.

      Although I put in public information requests, and I provided contrary case law, through Terry Francke of Calaware, the public was never able to engage in an online survey to encourage our input re evaluations of the City Manager and the City Attorney.

      I don't feel it's productive to point the finger of blame. But we can point out injustices, and errors, broken promises, so that all of Council, and staff can finally learn from their repeated and repeating mistakes.

  16. I appreciate Deputy Mayor Mark Muir's agenda item set for this coming Wednesday, May 14, the night of the full moon.

    It would be prudent for Council to establish a city employee hiring freeze, in light of the excessive $10 Million purchase price for Pacific View. Because Pacific View is such an expensive purchase, and because the City is adding to debt, which is increasing, yearly, with unfunded pension liabilities, because the backlog of deferred road maintenance is increasing, the City should enact a hiring freeze as Muir has proposed.

    I would ask, additionally, that City employees making over $100,000 per year, would take a 20% decrease in their compensation, down to $100,000, so that if an employee were making less than $125,000, he or she wouldn't see a full 20% pay cut. Council should also consider increasing City employees' compensation to their own pension benefits, which pensions are far in excess of what the vast majority of private sector employees receive upon retirement.

    At the Community focused Strategic Planning Special City Council Meeting this past Wednesday, May 7, there was much discussion of "sustainable growth." Our city cannot sustain growing debt without cutting back on operating expenses.

    We do support the purchase of Pacific View. and believe most citizens concur. But we don't want to bankrupt our city, or to force unwanted densification on the citizens who reside here, so that the City can rake in more development fees, property taxes and sales taxes. Expansion at any cost is not sustainable, with respect to taxpayer dollars, or our infrastructure, including traffic, road repair, and water resources.

    We sincerely hope that with the pressure of the upcoming election, and with strong negotiations by Council, the Board of Trustees can agree to the proposed terms of purchase. It's rare for someone or some entity to agree to zero percent interest, but this is comparable to a loan made between family members. We are all neighbors in this community, like family. What is being proposed is public land, which was donated to Encinitas School District, 60 years before EUSD was formed, being transferred between one public agency and another, to benefit locals without incurring unnecessary additional debt service fees, which debt service would go to a bank, a for-profit institution, NOT to the general public.

    EUSD should not try to gouge the taxpayers, now, but should be reasonable, agreeing to carry the $10 Million loan for an ongoing revenue stream, cooperatively and compassionately offering reasonable terms of purchase. Council and City Manager Gus Vina should ask, and insist, that Superintendent Tim Baird and EUSD do the right thing: carry the loan for 30 years at zero percent interest, to benefit the children, and the taxpayers, by helping to mitigate the excessively high $10 Million purchase price agreed upon for Pacific View.

Anyway, although it wasn't your idea to spend $10 million, you pushed them to find a way to buy it. So you have culpability in this. To try to come out of this smelling like a rose just won't fly. Whatever tradeoffs the council has to make to afford PV is partly your responsibility and the rest of the citizens of Encinitas can thank you for it.

    4. I don't fault Lynn or anyone else for wanting to keep Pacific View in the public domain for a community art, learning and cultural center.

      When you are talking about culpability, you are speaking of assigning blame. Most members of our community feel the City could have negotiated a much better deal. Lynn and Andrew Audet and many others were pressuring Council, to get the best deal possible.

      Teresa Barth and Tony Kranz have responsibility for failing to insist upon a better deal. Lisa Shaffer is also culpable, because she voted to purchase at $10 Million, when Council had many other choices, including threatening to invoke the Naylor Act and Eminent Domain, and following through on the threats.

      Barth and Kranz, on their subcommittee, meeting secretly with EUSD's subcommittee, weren't willing to bicker and barter. They weren't spending money out of their own pockets.

      Of course the council shares the lion share of responsibility but those that beat the drums to find a way to acquire PV also share responsibility. While they did make recommendations on how to acquire it, whether they were realistic or not, I saw few comments about not going overboard. Actually, the comments I saw were saying spending $4.3M for PV was too much. Mostly they were saying we really, really want it so find a way. Maybe now you can make suggestions to the council of what to do without so the city can afford the $10M purchase.

    Why don't you ask your pal Muir to take a cut on his enormous pension while we're playing election year politics?

    Your idea of getting employees to take a pay cut is a pipe dream. You know who most of the employees making that money is with OT? Hint, firefighters, lifeguards and public safety.

    I don't think Muir and his pals are going to go for that move. And note, private companies don't offer pensions, it's called a 401k.

    And we've already had the unwanted densification, to anyone who is late to the party see the development on Hermes, behind La Especial Norte and up off Leucadia Blvd. (Coming Soon).

    Here's what it's going to take: Council people with the guts to battle against the density bonus, city hall cronyism and the just plain malaise city hall seems to be under. Everything else is just talk....

But I do agree that we should keep it civil, not just for Lynn but for the council and staff as well other commenters here. It works both ways. You don't need to call her "Gradma Barth" or whatever to register your disagreement. Stick to the particulars. Leave the personal out of it.
