9/10/14 City Council meeting open thread

The current city council has continued prior councils' practice of not providing written summary minutes of council discussion, but only "action minutes" which state the outcomes. Encinitas Undercover will provide a forum for observers to record what occurs at each council meeting.

  5. Catherine must've read the blog today and piggybacked on the water waste issue. If she was so concerned with the sprinklers using too much water at the park, she could've call the water district herself. In fact, if anyone sees any water being wasted, Email your concerns to: drought@sdwd.org. One would think the city council might take the time to announce this information at tonight's meeting.

  6. Interesting Gaspar refused to look at the speaker who outed her on the secret Mike Andreen informational meeting for selected landowners. Her handlers must be huddled about now figuring out how to spin that puppy.

    2. Watch the first speaker at oral comms. Draw your own conclusions. You won't be able to see Council faces, so "details" won't matter that much to those who weren't there...unless you're interested in the fact that Barth began making smirky faces fairly early on in the presentation.

  8. Once again, the princess and muir voted no on OUR bag ban. wtheck. Please buy a clue and join us. Thanks to the majority for upholding our city's leadership on this symbolic effort.

    As was stated, millions are being waged to defeat this on the state level so it makes it all the more important for us here to do what we can and why not Mark and Kristen? Who is influencing your reluctance to join this effort? Surely it is not just about being disagreeable to the majority.

    How many votes do you think you garnered tonight with this stance on something that couldn't be simpler? There were issues that went unaddressed by the public speakers and were not on the agenda but they will show up at the candidates forum, so breathe easy while you can until then. You know who you are and we do too.

    That mikey bit was a classic and who would be surprised by anything he has his hands in. He never fails to lower the bar for decency and integrity. Anyone who associates themselves with this character should know better and it will be to your demise if you do.

That money could have gone to fix roads, parks and safe schools- Gaspar and Muir said yes to responsible spending- Barth Kranz and Shaffer now want to raise our taxes.   11. Why should it come as a surprise that Muir and Gaspar voted against the plastic bag ban? They are consistent and not flip-floppers like Kranz and Shaffer have been on so many items. Oh, that's right, Tony and Lisa never proposed a sales tax raise, I forgot. At least Tony knows what reconsider means, unlike Lisa Shaffer. He reconsiders all the time (see Prop A, Desert Rose, Sales Tax Hike, etc.).

    1. Asst. City Manager Richard Phillips said something about 60 businesses being effected by the State's ban, which has already passed the State Assembly and Senate, and is likely to be signed. According to Phillips, 150 businesses would be affected by the City's ban. He said the only difference is that the City's ban also affects liquor stores??? How could there be 90 liquor stores? Someone on Council, was it Shaffer? Or it could have been Barth? said that the bag ban by the State would only affect "big box stores." That's not what Richard Phillips reported.

      Kranz, Shaffer and Barth seemed to be drawing conclusions without any evidence from Phillips, who gave the staff report. A question that was implied, but remained unanswered, if, as someone claimed, there is a massive effort to qualify a referendum for the ballot, which could delay the new State ban, and that referendum succeeded, would it eliminate all municipal bag bans?

      It was stated only Solana Beach in San Diego County has a city bag ban. If the State law is signed by Governor Brown, as expected, will it supersede our local ordinances, or can our local ordinances be more restrictive? Didn't Glenn Sabine before give his opinion that the state bag ban would override our local ordinance?

      State Law would affect 60 businesses, the local ordinance would affect 300.

      I believe the state law only applies to businesses that sell alcohol, which would obviously include all grocery stores and most drug stores. I think the local ordinance would expand the scope to include other types of retail establishments (hardware? clothing? fast food? thrift stores? hobby? bike shops? etc.)

  17. Re the discussion on the Cannabis Initiative that will be on the ballot. If Council couldn't use City resources to advocate for or against an initiative, how could they use City time and taxpayers' dollars to advocate against Prop A, writing ballot arguments against it?

    And once again, it sounds, from the public speakers, as though City Attorney Glenn Sabine's so-called "impartial analysis" of the ballot initiative is anything but impartial. Council enables Sabine's disservice by allowing him to call his false conclusions, pushing the City's agenda, "impartial facts."

    Council voted unanimously to oppose allowing Cannabis cooperative dispensaries in Encinitas. They wanted to do so by resolution, but just put it in the minutes, after Sabine told them they could only "educate, not advocate." Again, what about their advocating against Prop A?

    The Brown Act only states that the public cannot be required to provide their address or any personal information, in order to attend public meetings. But there is no requirement, at all, that public speakers cannot be required, as has been traditional, to state their names, and city of residence. Most of the speakers against the Cannabis Initiative lived outside of Encinitas.

    Alex Fidel did a good job, and so did an attorney who spoke in favor of Council letting the voters decide, remaining neutral.

    1. Odd that there was no mention of Prop. A. The council and city attorney discussion sounded like they had never been through an initiative before and actively opposed it. Everything indicated that they were being very careful not to violate the law. This probably indicates that they realize that they did on advocating against Prop. A.

      Why didn't the council, since the opposition was unanimous, write the ballot arguments against the marijuana initiative? Or did City Manager Gus Vina play a role in preventing this because he had supported marijuana dispensaries in Sacramento as an income generator for the city?

    CFO are sheer puffery - maybe secretarial at best. Does nothing for 4 years, except what her lobbyist handlers tell her. The husband knows catering to the developers and big monied interests will pay off, so they don't even disguise their allegiances. Now the BS campaign starts, with the assumption that the majority of the voters are clueless and will respond to the Pavlovian images of a fiscal conservative and Mom and apple pie. Sad thing is - it'll probably work! But what is at stake is community character and public indebtedness for years to come - she needs to go.

    People with cancer and chronic pain should have access to any compound or substance that their Doctor thinks might provide relief. That's what the state initiative was about.

    Fortunately, they already have access. Even people seeking a recreational high can get access with a flimsy excuse. Storefronts are simply unnecessary and undesirable.

    Let's liken this to the battle over F-Street. People have a right to freak however they want in the privacy of their own homes, and they can get whatever illicit tools or toys they want online or in neighboring communities. If you want that stuff, you already know where to get it. There's no need to setup a storefront here.

A financial raise of considerable size. We call that a 'soft landing'. Because Bruce Ehler's is nothing but a 'beard' for Pam Slater Price.

      2 months ago, Pam was backing Catherine and Tony for City Council: when they both showed autonomy and backbone, she fired them both: ask'em. "NO MORE WIRE HANGERS!"

      Then PAM replaced them with Sheila and Julie.

      Reporters: ask Tony and the entire council to share the e-mail from Pam Slater/Hershell at the Council break the evening the week before the council voted to consciously violate state law over Density Bonus. Tony thought they shouldn't be hasty and asked for the subject to go back to the Planning Commission. Minutes later, the brash former Supervisor/Hubby sent a flaming e-mail to Tony and the council telling him and them that she/he were "through' with Tony.

      Desperate to find another proxy, they reached out to Sheila.

      And here we all are, dancing to a tune played by a 'retired' politician bent on controlling politics in Encinitas even though she lives in Del Mar.

      Check it out Reporters: believe it, none of the city council members deleted that e-mail. It was too much hubris and very sloppy.

      So, there might be 27 'enemies', but No. 1 is Pam Slater Price.

      Ask her and Hershell Tuesday night at Ada Harris. PAM SLATER PRICE; NO KIDS, NO JOB. So, if you add them to the 10, then 2 out of 10 have full time jobs. See a pattern?

    8. Andreen actually turned the city council and the chamber in for cooking the books: the grand jury exonerated Andreen and fined the City $90,000 for giving money to business groups without their being responsible to account for how it was spent.

      Andreen loves it when low lifes ask that question. How about the hundreds of thousands of dollars spent by Pam Slater Price used to finance little groups of idolators: taxpayer money from the unincorporated areas of the county.

      Better yet, ask Bruce how he lost his positions: both private and public. Foisting Sheila back on the city is without question the height of venality.

Director, Lisa Rudloff, Marlena Medford (communications person, who doesn't seem to be communicating much), and Kranz, who was one of the originators of Prop. A and has now completely abandoned it.

    2. At least partly true. The organizational meeting to undertake some initiatives was at Kranz's house. Three were discussed. Prop.A was the only one to move forward. Kranz rode the momentum of Prop.A to get elected to council.

Prop A would have won by tens of points more had you not had folks confused by Ga$par's claims to the very end that you couldn't remodel your kitchen or put in a patio without a citywide vote and Andreen's desperate attempts to tell everyone who crossed his path that a "No" vote meant "no to developers." Add the council being against it and willing to lie to "kill this thing," as Kranz put it, and you have a very tentative voting populace. The fact that it won against big money, lies by opponents, and lies by our government was amazing no matter how thin the margin.

    Scads of voters were horrified days after the election to find they'd meant to vote "yes," but got confused....

    But you knew that.

    Pam and Herschell are forever respected here and that must drive you and his lowness crazier than you already are. Any candidate that hitches their wagon to you in any way will pay a dear price come election time.

  40. Prop A: 51.85% of those who voted voted for it. My mom told me before I went to kindergarten that 1.85 > 1. She was right.

    Opponents spent $100K on a misinformation campaign. Vina wasted $50K of taxpayer money paid to Rutan & Tucker for a kill Prop A report. The City Council members came out against it. The Main Street association violated its charter, came out against Prop A and paid for misleading ads to oppose Prop A.

    Yet, it passed! If those circumstances don't tell you which side of the issue the great majority of Encinitans are on, you're delusional.

Dody of course had her own reasons for going hard against A.

    6. Last I checked L101MA was listed, with the IRS, as a 501(c)(3). I believe DEMA, now E101MA has been listed as a 501 (c)(6).

      Since all of the 101 Mainstreet Associations are heavily subsidized by the City, none of them should be lobbying for initiatives; their doing so has the appearance of a conflict of interests, whether their campaigning and lobbying is legal, or not.

  43. Scoreboard: Andreen brought the charges against the Chamber and the City: result, Andreen got what he wanted, exonerated in the public (Tucker too) and the city got fined nearly $100K.

    You might want to ask Pam Slater Price, Sheila and Julie before you continue down this road: all the evidence of wrong doing is still close at hand.

    And Sheila and Houlihan's fingerprints are confirmed as being all over this case.

    So, have at it, but unless you are trying to bring Sheila down, you might want to direct your self-hate elsewhere.

  47. The General Plan Update was proceeding well with a very fair, diversified group with leaders and stakeholders representing the ENTIRE community, good facilitator and city staff support.
    After two years, a draft was presented. A DRAFT.
    For reasons that were not clear, Stocks&Gaspar&Friends labeled "the draft", "an ugly baby", disbanded GPAC, formed their own hand picked group, ERAC, and trashed all the information, time, energy and thought out the window.
    NEVER was El Camino Real slated to have all the zoning potential changes.
    NEVER was there a UPZONING PLAN FOR EL CAMINO REAL, as Garpar claims. Never was there a plan to take away personal ownership of cars and other BS Andreen claims.
    This planned hijack of the General Plan was planned and calculated to benefit Stock&Friends and not the general public.
    A vote for Gaspar is a vote for Stocks&Friends, Andreen, Meyers and developers. Your choice.
