Is Joe Mosca out of touch with voters on marijuana cultivation?

    2. Joe Mosca is a decent and caring individual who takes the time to meet with anyone in the city who has an issue. I have seen him several times come around after talking to people. Joe is an asset to Encinitas. I wish he was Mayor. He is honest and can't be bought .

    Leucadia, Old Encinitas and the northern part of Cardiff could extend to the borders of Olivenhain.

    Olivenhain, as the fourth district , could run north to south to the San Elijo lagoon and head west to the southern part of Cardiff.

    If that configuration were adopted, and a certain current Planning Commissioner were to run for council, as many are hoping that he will do, Joe would be out of here. One and done Joe.

      Joe is only here to serve the interest of the developers that financed his campaign. Why else would our developer owned council hand pick an outsider over a few good local options? Lets play your game of lame endorsements...

      Joe's has been run out of one town for only serving the interest of his donors. He was appointed to the Encinitas city council under shady circumstances. He continues to take stands that defy the majority and enrich his donors. A vote for a joe is a vote for corruption and represents everything wrong with government.

    3. The important distinction is using versus growing. What Mosca said at a town hall meeting is that MJ businesses operate with cash only. Because these businesses are known to have so much cash, they are a huge target for theft and violence, which is not something we want to bring to Encinitas.   4. This whole cultivation thing is just such a non-issue. Far more interesting is the allegedly illegal nature of the pension increases. To think that a) a whole army of attorneys could have missed this, and b) a missed "check the box" requirement could create a legal train wreck is absolutely mind-blowing! Yup - better than a sensi bong hit!

    As for Joe, just don't vote for him - simple enough.

Pretends he knows what citizens want, when he actually knows very little except for some hang ons, like Tasha. Yes, she is running for Assembly 10 months after winning a city council seat. How's that for putting herself before the people. Hope she loses to Elizabeth Warren,who is also running for Assembly. Then we vote out Tasha. How can she campaign for a whole district with all of the things going on in Encinitas?

    2. The Carlsbad Hiltons are fine, but I would rather have family stay closer, and contribute to local TOT.

      The Cardiff by the Sea Lodge rooms are like a frilly doll house—all six of them.

      We have used the Best Western, but professionals like to stay with a chain they use for business travel, as they get extra perks and discounts. There are three mains: Marriott, Hilton, and Starwood.

      Carlsbad has them. Solana Beach has them. Del Mar, Vista, Oceanside, Carmel Valley, La Jolla, San Marcos. All have them.

      Encinitas is the lodging desert. Name a place with room service in Encinitas. It’s a luxury, until you have jet lagged kids.

    4. Joe lied to everybody. He told preservationists that he was for preservation, and he told developers that he was for development. There is a long list of Mosca lies and betrayals. One of the worst things he did was manipulate sensitive people into thinking he was being persecuted for his lifestyle. Nobody here gives a damn about that, but he hit that spin loudly and for a long time, and some less politically aware people bought it. The consequences are more distrust in the political process, and the confusion that results when someone intentionally misleads others. Joe actually has a knack for dividing a community.

    10. 8:13, the worst was about a development plan that would have changed downtown into Orange County kitsch. It was called the Downtown Specific Plan and we stopped it with a new law (Measure V) that said the city had to let residents vote on large scale development projects. Joe had promised that he was in favor of a public vote, got elected, and once in office wanted to forget about the vote, let the plans proceed and evaluate later. You can see it all for yourself if you want to invest a little time and energy in following the Sierra Madre city council meetings tapes.

    The Leichtag - Jewish Federation connection
    Several commenters have made an issue of Tony Kranz having accepted a free $5000 trip to Israel from the Jewish Federation of San Diego, then having voted to allow the Leichtag Foundation to use its agriculturally-zoned land for non-agricultural general office use. The rule change likely saved Leichtag tens of thousands of dollars per year in commercial office space rental.

    Without some connection between Leichtag and the Jewish Federation, this would be a non-story. One Jewish non-profit doesn't necessarily have anything to do with another.

    However, it appears that Leichtag and the JF are quite interconnected. The Jewish Federation operates out of the offices of the Jewish Community Foundation San Diego at 4950 Murphy Canyon Road. Essentially, the JF is the networking umbrella organization, while the JCF is the charitable fund.

    The Leichtag Foundation is one of the primary funds listed as a part of the JCF.



    The JCF has two staff members listed as working with Leichtag, one of whom is an executive there.





    Obviously, laws regarding the improper financial influence of public officials are meaningless if gifts can be given to politicians from nominally separate, but clearly related organizations, before a politician votes to give substantial financial benefits to a group.

    We'd say Kranz should have disclosed and recused at the time of the Leichtag vote.

  18. If I remember correctly we didn't vote for Joe. He was appointed over some very impressive longer term citizens. Also, keeping it current, our Mayor has now endorsed Tasha for Assembly. Tasha has been on the job 10 months and I guess we are not good enough for her ego. She and Joe say one thing and do another. Can't understand why the Mayor doesn't see that, unless there is more in play. Lorena Gonzalez also endorsed Tasha. Go figure. Lorena is the sister of Marco Gonzalez who we all know and love. He has yet to meet a lawsuit against the citizens that he didn't want. Strange times.

    1. Are you sure it’s zoned agricultural? If I’m not mistaken, the only land in Encinitas zoned Ag is the Ecke land now owned by Leichtag that created a new zoning category in exchange for the rights to develop Encinitas Ranch. D&E were not a part of that deal.

      Even if it was zoned Ag, the owners can claim regulatory taking (unconstitutional) if their property becomes useless due to economic changes in the flower growing market.

      If the property was zoned for buggy whip or vacuum tube manufacturing. The 5th and 14th Amendments don’t allow static zoning in a dynamic economic market from basically screwing a property owner.

    9. There are only five properties with agricultural zoning in Encinitas, all in the Encinitas Ranch Specific Plan. All other properties that still have agricultural businesses are grandfathered in and have residential zoning.

      To change from agricultural to residential or commercial zoning requires a public vote for approval under Prop. A. There is no way around this in Encinitas.

      Any agricultural property under the Williamson Act must give notice of non-renewal that starts a nine-year period. A cancellation can be done supported by the local jurisdiction, but a penalty payment is involved. It can be substantial. This is what happened to the Ecke property when the Encinitas Ranch housing and shopping center were developed.

      There is NO subsidy involved in growing marijuana given by the city of Encinitas or the state of California. It is now legal in the state of California. The city will decide if growing marijuana is allowed or not. The city attorney explained at one of the subcommittee meetings that if the city doesn't say YES or NO in a certain time period, the decision defaults to the state, which would allow for an outsider to come in. Many speakers had complained that the city shouldn't even be considering the question.

      Avocado growing is a red herring. For the man on Quail Gardens Drive who spoke at one meeting, it's either a hobby or a tax write off. Probably the latter.

  28. Mark Muir is a stand up guy and has been an asset to Encinitas for all of his adult life. Just to clear things up and for the record: Mark Muir refuses his rightful pension on City Council. He draws a well deserved pension for his service as Fire Chief. That is a very stressful and important job for our community. Also for the record he has and will always vote NO on anything related to marijuana in any way shape or form. Mark Muir is a great city council member and we are lucky to have him. City Council is a selfless job and not too many people are willing to take it on. BTW especially if you live in Cardiff or District 3 you better be fighting for dear life to keep him on city council. If the other person wins ( did I say Catherine's minion ? ) Cardiff is done for and so is the entire city. If Catherine's pawn wins Im moving from Encinitas, seriously and that breaks my heart. On another note: Joe Mosca is a decent human being and is willing to listen to anyone and takes the time to do so. I have seen several instances when after talking to citizens he comes around. Dont be so quick to judge. Joe is new and in my opinion an asset to Encinitas. Give Joe a chance and if you have an issue he is willing to discuss it with you. Just the fact that he makes himself so available and is willing to consider all sides makes him a great council member. I wish I could say the same about Catherine and Tasha but I can't. They are working for the state and vested interests, perhaps their own interests NOT the best interests of the citizens of Encinitas. Thats my 2 cents worth. Take it or leave it but I think its truth.
