Make Olivenhain Carlsbad Again!

Since the topic of Community Character seems to be on everyone's mind at the moment, I wanted to share the document that the Desert Rose developers hired out and that Marco presented at Planning Commission on community character. This has a map that shows they used Carlsbad standards to squeeze more units onto an Encinitas property. Page 9 shows the map they used to make their claim of community character instead of using the General Plan.

While Desert Rose is adjacent to La Costa (Carlsbad) suburbia as the map shows, the suburbs are neither visible nor accessable by road from the rural neighborhood.

  1. Two sides of the property are a Carlsbad open space that was set up as an environmental preserve. The west side of the property borders on two Olivenhain properties that are 1.46 and 1.7 acres respectively. However, they used the high-density Carlsbad units which were not contiguous with the property to justify their density and to define community character. THe document that this map is from is entitled, "Community Character Study Desert Rose, November 2018." This was the basis of Marco's presentation to the Planning Commission to discuss design review.

  3. And Gonzalez wonders why he is so despised. There is clever, which is how he sees himself, and then there is conniving. Just a few fitting words from the Merriam-Webster thesaurus for "conniving:"

  4. I hate to say it but the desert rose whine is pathetic. I would take those homes next to mine any day. Wait until you see the shit coming. Three story russian looking stack and pack boxes. No need for aesthetics its by right and nice looking architecture cuts into developer profits for god sakes.

    1. The point is that Desert Rose and Fulvia were the test cases. A lot of developers stopped and watched to see what would happen before going forward on other projects. It is obvious that other projects that are coming in now are worse, but the methods of misrepresenting and having staff hide documents and material facts are the same. Residents from the Desert Rose and Fulvia projects care about the entire city since some were involved in writing and promoting Prop A. No matter what the underlying zoning rules are, developers figure out ways to break them to make their projects "pencil out" at the expense of neighbors.

  5. It's ALL about greed, nothing more. These clowns ruining Encinitas changed the zoning in Olivenhain from horse property to ghetto apartment property, and they don't care.
    And to think, the head clown blakespear wants a State seat?

  7. Rolling blackouts, water demands exceeding supply, congested traffic and the Encinitas City Councils girlfriend, randy "the rat" goodson, wants to build a seven story ghetto apartment next to peoples homes in Olivenhain. You JERKS, see you in court.

  8. Facts, people, they matter.

    The community character study noted above had nothing to do with the density of the project or squeezing more units onto the property as alleged.

    By the time this study was done in 2018, the tentative map was already approved. This phase dealt only with design review and architecture of the proposed homes. It had nothing at all to do with the land use approvals. However, it is true that I presented evidence during the hearings years earlier showing that the Desert Rose density was not inconsistent with that of the Carlsbad developments to the north. At that time, there was no requirement to provide these Community Character studies, so it was up to the Council, and eventually the courts, to assess the issue on evidence in the record.

    And just FTR, both then and now, calling any of these projects "ghetto" is pretty derogatory, not to mention totally separated from reality.

    1. I don't know anything about rose this or that. I know Olivenhain and the proposed seven story ghetto apartment re-zone from horse property by leftists in the Encinitas City cluster ----. And rat boy randy goodson who is behind said ghetto apartments.
      For the rats in the City of Encinitas to ruin such a wonderful place to live with rich history is a crime. But keep in mind...THEY DON'T CARE !!!!! Rats will even eat their young. Vote them out and put that zoning BACK to where is was.

    Diverting attention the council and court doesn't explain why you would do that. The Carlsbad developments weren't even on ground level with Desert Rose - right? They were up on a hill and you still tried to make the case that they should be considered on an Encinitas property?

    Your win at ANY cost approach works for your bottom line, but you have destroyed your reputation with residents. Worst part? You sleep just fine.

  11. Marco is back at his usual lies. The developers consistently and unfailingly claimed that they had the right to build as they were using community character standards in place starting in 2010. Residents quoted the standards for setbacks during meetings and pointed out that they were using Carlsbad zoning standards in an Olivenhain parcel. Tony and Joe sent their architect Bart Smith up to say that it was their “definition of country life,” and our “definition of country life” was different. They also said that the plan had to be built. After hearing our objections from the first meeting, they disappeared for two years then came back with MORE density and with Marco.
    Marco is trying to muddy the water by claiming:

    1. He was brought on to deal with the environmental aspects and the streambed agreement, yet under Marco’s guidance Roy Sapau shut down the project for two years for wetland violations.

    2. His comments to Voice of San Diego claiming that Density Bonus objectors were racist did not apply to Olivenhain neighbors but were meant for Solana Beach residents instead.

    3. Marco was not aware that his developer clients Jose Colina and Tony Cassolato had financial and legal problems, yet during council meetings he complained that such great guys were being mistreated by Olivenhain neighbors. However, the project was shut down for another two years after the case was overturned in the Court of Appeals when the actual owner of the property found out that they had not paid contractors and were almost $100,000 behind on property taxes. The owner had to go around and write checks to those who were unpaid for years. There was a rumor that Tony and Joe were trying to let the taxes go unpaid in order to buy it out from under the actual owner. Was Marco advising them as he so often offers recommendation to our City Council?

    4. The presentation that he made and referenced entitled “Community Character Study Desert Rose,” during a 2018 Planning Commission meeting identifying an Olivenhain property with Carlsbad zoning was decided as an exemption in court. Marco’s story was that this property should be viewed as part of the Carlsbad “regional approach” and not using the definition of community character codified in our Encinitas General Plan. However, his most recent claim is that this definition only happened after the court case and was not their position from the beginning. Therefore, it is not Marco’s fault that he made these claims at the Planning Commission.

  12. Besides being a liar and displaying questionable environmental expertise and seemingly, no awareness that community character is defined in the General Plan-- Marco can't even read a map! Marco, the development to the north are 1/2 acre lots in the Carlsbad Ranch development. The lots to the north are BIGGER than the units that you pushed through. The units that are like the ones your clients built are on the west side of the map a few blocks east of OPE! Otherwise, why would they have included them in the presentation. The lies go on and on and on with this guy!

  13. Remember the word "facts" when you see them coming out of Gonzalez. Watch for his pseudonym, "Encinitas Facts." You'll see it in online comments and on Facebook. Oh, the irony.

  14. Marco at 4:29 give us another word for "ghetto" and we'll use it. Surely you're well acquainted with the rabbit warren configuration of the "affordable" units. Bed 6' from the stove, have to go through the closet to get from one room to another, etc.

    What do you call that kind of living, Marco??
