4/2/14 Special Council Meeting open thread

The current city council has continued prior councils' practice of not providing written summary minutes of council discussion, but only "action minutes" which state the outcomes.  Encinitas Undercover will provide a forum for observers to record what occurs at each council meeting.

Please use the comments to record your observations.

Tonight's thread may be quiet, as the meeting may not be televised, and the public won't be allowed to speak until late in the night. But we'll continue these open threads for regular council meetings as well.

  1. I guess that what makes it "special" is that there are no Oral Communications, and participants have to sit through 3 hours of staff presentations and council comments before they can say anything. If he could, Vina would make every meeting a special meeting.

  2. Well I'll be watching the futbol match, so I won't be commenting until later, if at all. Rest assured nothing will be accomplished nor will they tell us how they plan to pay for roads, salaries, pensions, the Hall property nor PV.
    All in all a giant waste of time.

  3. And they call this transparency. The minutes should be written in a way that can be deciphered by any one who did not attend a meeting as to what took place. The way they are written now is very vague and it's a big guessing game as to who said what or did what. They are designed that way for a reason and it is not to benefit the interests of the taxpayers.

    1. While they can't brodcast live from the Community Center it is filmed, recorded and archived for later viewing on the city website for anyone to watch. I've been told they are working on a solution to brodcast live at the Community Center in the future.

      Pretty lame that you have the need to read a hard copy. I would not want to read all of that babble. I mean, do you really want to read Gaspars lame comments or how about Lynn speaking on every possible subject? No thanks.This is not some grand conspiracy to hoodwink the public. It is a workshop for the SP and was moved there to allow more people to participate in the process. Unfortunately not that many that live here care or pay attention to what's going on. So how is the city not being transparent or are you just pissed because you can't make snarky comments?

    3. 7:38 FYI No, I don't read the minutes of the council meetings, nor will I ever. I mentioned the way the minutes were written because many, many people have complained in the past about what actually took place at a meeting. In other words, the minutes did not reflect a detailed description. No need to call me lame and snarky or infer that I am pissed about something. I have a right to voice my opinion and if you don't like my opinion no one is forcing you to read it. Must be something in YOU that you are not happy with. As a clinician, that would be my first diagnosis. Try to have a happy evening.

    4. I attended every Strategic Planning meeting. Enough is enough! I bailed on this one. More staff than audience at the last one. Too much bloviating by the council. Public comments, the best part, have been pushed later and later in the meetings. Staff just reads the PowerPoint. The whole exercise seems to be designed to discourage public participation. I can't take it anymore.

  7. I doubt if very many people went to the meetings other than paid staff and any "contractors" making presentations, and Council, Vina, and his cabinet, of course. There was no live broadcast. I'm not going to sit through it. The public's input was so limited, anyway. According to the agenda, there were to be no public comments for non agenda items. The Agenda was disingenuously set up with only ONE agenda item, although there were numerous presenters. Public comments would only be allowed between 9 and 9:30, period, after the break and one more presenter. I BOYCOTTED this bogus "workshop."

    You are probably someone from the City judging us all as "idiots," 9:30. Get over yourself. That's not to say that Crappy Pappy and a few others don't have noticeable personality disorders with which they enjoy soiling this blog. They WANT to make it irrelevant, and to drive people away, just as happened on Leucadia Blog.

  9. Actually there were 2 people that attended last night's meeting. One was the former city employee that gave Vina a good tongue lashing in oral communications a few weeks ago. Don't know who the other person was. I wasn't there, but I was told this by someone who was. Secondly- I love you Lynn, but I have to tell you, and everyone else, there are only 15 personality disorders, and "arrested anal development" isn't one of them.:)

    Psychologists have put forth theories that people can get "stuck" or arrested in their development in either the oral, anal or genital stages of their psycho-sexual identity. I don't know all the correct "pathologies," but I can recognize anal fixation when I see it, repeated, play out here.

    The poster to whom I will now refer to as Crappy Pappy, has a history, beginning on Leucadia Blog, with JP's post about the KLCC, of using the word crap to associate with anyone who disagrees with him and his anonymous associates, with wanting to "keep Leucadia crappy."

    They went so far as to start an imaginary crap club, and to identify who were the members, by their appointment. So members of their delusional club, cannot decide whether or not they want to be members. Anti-Funkites are responsible for that.

    This is all a feeble and unsuccessful, attempt to twist one of the overriding goals of the neighbors and admirers of Leucadia's charm and community character. Instead of Keep Leucadia Funky, Crappy Pappy started the KLC Club. Only difference, he gets to decide what and who constitute crap; the neighbors have no say.

    The neighbors do want to save and preserve the canopy. A friend recently wrote and shared her concerns with me, again, about "Saving the big, old guy on 101 and Leucadia Blvd., and all the other big ones in the median along the N101." The roundabouts, as planned, would eliminate at least 21 more old growth trees.

    This was also shared with me by a friend: "in my opinion round abouts are an insane mistake that will turn 101 into a deadly amusement park.. . . [a few people are] selfish and self-absorbed [in their] goal to keep the 1-lane
    on 101, build the fake-abouts, and sacrifce the safety of an entire community west of 101, just to slow traffic, so people can see their shop[s]!"

    My point is, many old timers in this neighborhood, between Stonesteps and Grandview, see that Leucadia does have some flaws. Since change is inevitable, we'd like to see positive changes.

    Keep Leucadia Funky means we are doing what we can to preserve our neighborhoods' charm and funkiness, while also encouraging artists and small independent business owners. I would like the road at Stonesteps, near the beach access, to be fixed, for instance.

    1. The City needs to focus on deferred maintenance of roads, not the Mossy Property Public Works Yard headquarters for public works and SDWD. The City also needs to focus on cutting operating expenses, not hiring any more full time employees, cutting the pay of those making over $100,000 down to $100,000, up to a 20% pay reduction, for those making $125,000 per year or more.

      The City needs to focus on being a good negotiator and insisting to Superintendent Baird and the EUSD Board of Trustees, that it should carry the entire loan of $10 Million over 30 years. This can become a reality, of the City can learn how to be tough negotiators.

      Baird has practiced Malfeasance by leading various media sources, including Channel 10 News, that the $10 Million WOULD GO directly into EUSD's General Fund. Baird and Superintendents DeVore and King practiced Malfeasance when they colluded with past City Managers and City Council Members, including Phil Cotton and Teresa Barth to either intentionally or negligently not include the terms of the leases that were signed between EUSD and the City in any agenda reports or public hearings.

      The terms of the leases between the City of Encinitas and EUSD deprived the citizens of our right to be offered purchase of 30% of a former school site for public open space, at 25% of its fair market value, for donated land. These leases recited secret private development agreements, that should have been made public, but weren't, that the City would rezone parts of Ocean Knoll, Quail Gardens and would rezone Pacific View, if EUSD would lease PV to the City for only $1 per year.

      Crappy Pappy wants nothing to do with our Pacific View heritage, because he imagines money going to that will detract from his precious roundabouts. Those roundabouts are like an amusement park nightmare, Pappy. But relax, and release; your dream, a nightmare to us, is never going to be realized, in your lifetime, or mine . . . not here. We can't afford it on any level.

    6. I usually don't like to use Wiki, but I found its explanation better than the legal dictionary's:

      "First, malfeasance in office requires an affirmative act or omission. Second, the act must have been done in an official capacity—under the color of office. Finally, that that act somehow interferes with the performance of official duties—though some debate remains about "whose official" duties.

      In addition, jurisdictions differ greatly over whether intent or knowledge is necessary. As noted above, many courts will find malfeasance in office where there is "ignorance, inattention, or malice", which implies no intent or knowledge is required.

      The similarly named malfeasance (or misfeasance) in public office is a tort. In the House of Lords judgment on the BCCI Malfeasance Case it was held that this had 3 essential elements:[4]

      The defendant must be a public officer
      The defendant must have been exercising his power as a public officer
      The defendant is either exercising targeted malice or exceeding his powers"

      What consistently happens, locally, is that the DA, Bonnie Dumanis, who I hope will finally be voted out of office, after her own misconduct, gets to use her discretion, which has amounted to selective enforcement against public officers, when deciding when to prosecute or not to prosecute.

      From reading more about the legal definitions, it would be challenging to prove intent, particularly against Baird, as the secret development agreements were signed by DeVore and King, that were not made available at public hearings.

      It would also be challenging to prove intent against Baird in his saying the money from a sale of the property would go directly into the EUSD's General Fund. He could claim he was misinformed about the law by School District attorneys. But EUSD did not do its homework with respect to the Naylor Act, or the Government Code, which requires that any money going into any school district's general fund, must be certified through the State Allocation Board, as not being needed for capital expenditures for facilities improvements and technology.

      Perhaps I should use the word misconduct, or misfeasance, instead of malfeasance, since it would be so challenging to prove intent. I was using the word malfeasance more in the common sense, as I am not an attorney, and have never claimed to be one!

    1. Yes, I knew it was Freud, and that some psychologists, now, no longer give credence to his theories. Anyway, I think his cocaine usage may be irrelevant? Sherlock Holmes did opium, right? I'm not asking for my theory to be officially recognized, however.

      My personal observations are that many people have various types of arrested development, and it's probably a combination of several "phases," not always related to sex. And yes, sometimes a cigar is just a cigar, but I guess not with Moncia Lewinsky . . .

Marvy Charles has earned the moniker through his despicable behavior toward those business owners who didn't support the Leucadia 101 roundabouts and of course Marvy tells all anyone would need to know the true identity of this 101 Leucadia heavy. I prefer Marvy to pappy crappy but that is just me and I don't consider it a positive appellation in any way for such a bully that should be made public for his past actions toward our Leucadia business owners who think the roundabouts are the dumbest thing we could do to our 101. Because this won't be allowed to be voted upon does not give it credibility through harassing our fine citizens who can see this is a disaster in the making. If Leucadia 101 is so sure this is the will of the community lets just see where the support truly lies. And I don't mean with those who see a profit down the line like the realtors and their ilk who have had enough sway over our body politic for far too long. And no one wants to keep it crappy Marvy.     3. 9:52 is Crappy Pappy. Now he likes to mix in the word "hate" with his aforementioned fecal fixation, since the word "hater" was used on him so often.

      I have been told by two business owners, firsthand, how Charles Marvin attempted to bully them to take down the petitions against roundabouts they had in their stores. I know of two others, secondhand, one through an eyewitness, as it was his niece's business, and he was in the back room, and told Marvin to get out, when it happened.

      I have personally seen Charles Marvin say at the Sept. 11, 2013 Council Meeting that those who didn't want the four one-lane roundabout "streetscape" plan want to keep Leucadia crappy. But when he was still in his chair, and seated next to the new Leucadia 101 Mainstreet manager, Carris Rhodes, he was whispering to her, rolling his eyes, making hand gestures, and doing various antics, which seemed purposefully designed to distract from the public speakers. This can be seen on the webcast footage, including, but not limited to when I was speaking.

      Many times we have seen Charles Marvin's car at City Hall. In the past, he has routinely been allowed "beyond the glass doors," where others, such as myself, have never been. He has had insider influence, there is no doubt about that.

      When L101MA first started being subsidized, directly, by the City, Marvin asked for only $7K to $8K, but I believe it was $7,000. How did that increase to $30,000 per year, more than Encinitas or Cardiff 101?

      When did the former Cardiff Chamber of Commerce start being subsidized. In the beginning, it was only DEMA and the Chamber of Commerce. I thought L101MA should get something, although Dalager voted no, against Marvin's proposal. At the time, I said, as a public speaker, he's asking for very little, compared to the Chamber of Commerce; why don't you give the Leucadia 101 business group the subsidy? And Council, with Dalager voting no, did so.

    5. Yes, the merchants did a good job last night. Taste of Leucadia was a success. Shoreline Rootz, the reggae band, was excellent.

      I never said I don't support the merchants of the Leucadia 101 business association. I don't think the "rebranding" of DEMA and Cardiff Chamber of Commerce are advantageous, because we have five distinct communities.

      I have never supported having four one-lane roundabouts on 101, through Leucadia, beginning at El Portal. That is ludicrous to me. When surveys were done, in 2008-09, most of the business owners didn't want them, either. Most of the people attending the most widely attended workshop at City Hall, in October of 2008, when the questions were less "stacked" and biased, did not want ANY roundabouts, and did not want Council to go forward with the plan, over 60% of those filing out the survey. The survey taken a year later was statistically insignificant because different questions were asked. If someone said he or she supported exploring the possibility of any roundabouts, such as ONE two-lane roundabout at La Costa and 101, that was incorrectly quantified, and counted as a YES on Plan 4A, which included the four one-way roundabouts. There was no option, in that final survey for "none of the above." The only option, besides 4A, was stop lights instead of roundabouts.

      I do support the merchants. I no longer support automatic city subzidation of ANY of the 101 Mainstreet Associations. All non-profits, including business groups, should have to compete within the Community Grant Program.

      I don't hate anyone, here, including Crappy Pappy. Hate is a form of attachment. Hate is a mask that fear wears. Crappy Pappy knows he has tried to divide the community: those that are on his side, a few on the L101MA Board of Directors, and those who don't. He is the one who has been hateful, saying those that want to keep Leucadia Funky hate flowers, love weeds, want to keep it crappy. It isn't crappy, and we know it. We want changes to be beneficial to the majority, and in keeping with community character, which doesn't include one-lane roundabouts on Historic State Highway 101.

      Anyone who knows me, or has read what I've shared, knows I'm not a hater. People know what you've done, and what you're trying to do, CP.

Is he the old guy who often speaks misleadingly at council meetings, was a one-man goon squad who threatened and intimidated Leucadia merchants who didn't support Streetscape, and built a monster house on the bluff between Moonlight and Stone Steps? Those sure aren't contributions, so maybe that guy is a different Charlie.

  16. Since the video was finally "uploaded," from the April 2 Strategic Planning Council Meeting, it appears there was NO one visible in the audience, except staff, or presenters to Council. The meeting could and should have been held at City Hall; then there might have been more public speakers. As it is, the cameras never showed the audience, that I could see, those cameras set up at the Community Center. The only need to hold Strategic Planning Meetings there is if a large public audience is expected.

    There was a single, solitary speaker, after ALL the presentations, and all of Council's "preliminary questions." He was a volunteer patrol with the Sheriff's Department, urging people not to get rid of their land lines, because those are much easier to track for 911 calls. Good idea, but I felt sorry he had to sit through so much bureaucratic posturing, to be able to share his three minutes' worth. He didn't get to speak until 3 hours and over 19 minutes into the video, so including break, not until after 9:30! This was also after Mayor Barth admitted "maybe some of the public will watch this when it is available, online on the City's website, tomorrow."

    What a waste of time and resources to call this a public workshop and hold it at the Community Center!

      Mr Marvins efforts on behalf of his community are to be praised.

      Leucadia 101 MainStreets, as all MainStreets, compets for all grants on equal terms using the same forms.
      the Streetscape survey you talk about was not a city survey and organized outside entities, using a deceitful petition to justify the meeting.
      Roundabout are safer for cars, bikes and pedestrians and are more efficient.
      Gus is not the devil.
      L101 formed the mutually advantageous partnership with the Paul Ecke PTA, to the benefit of our community.
      L101 MainStreet board members and community members are caring individuals who offer their time and energy to make a better future for our community.

  18. Yesterday the planning commission approved the demolition of the 16 room motel in downtown Encinitas. It will be replaced by a mixed-use 4 residential condos, on top of a small commercial 1st floor. The four large trees will be cut down and replace with 36 inch planter trees. It will be underground parking. The developer does infill projects in San Diego.
    The planning commissioners didn't bat an eye when they all approved the project.
    Now four mature trees will be destroyed. The 16 room motel that served visitors will be destroyed. The TOT will be gone. One commissioner really liked the box ugly design of the new condo project.
    The total planning commission could be eliminated tomorrow because all they do is rubber stamp anything that comes before them.
