$32 million settlement in bluff collapse deaths

Fox 5:
A settlement has been reached in the case of a tragic bluff collapse at a North County beach in 2019 that resulted in three women losing their lives.

According a news release from Bibianne Fell, the attorney for the plaintiffs, on Tuesday, the state of California, city of Encinitas and condominium owners and management have agreed to a settlement of more than $32 million with the women’s families.

  2. If the city can be held liable for this, then the city has a fiduciary duty to protect you from all risk.

    They can close the beaches at high tide. They can keep you out of the water lest you drown. They can close trails if there are predators or loose rocks. They can erect physical barriers at overlooks. They can remove stairs to prevent falls.

    If government can be held liable, then logically, they have the authority to take preventive measures.

    This is a bad outcome. And those of you celebrating it aren’t thinking through where it leads.

    8. I think what makes this so harsh is Lorri goes in to get her final results today (Weds.) to find out what physical problems have kept her sick for so long. She has been ill for 3 to 4 months and has gone to many doctors. She talked about it on her own page, not EV. So Julie picks this day to put her PSA on EV. Personally, I think it's a cheap shot. Wonder if Lorri will remove it. Even if she doesn't, she finds out who she is going to exclude from the next group she has in mind, minus MAGAs. She has already said that if whatever she has is treatable she has a new group in mind after the first of the year. I'm guessing it will be a private group and some of the jerks on EV won't even know it happened. I suspect it will be a moderate group, and not the right wing that's happening now. But at least Julie has made sure she won't fit in the new group. I may not agree with Lorri a lot of the time, but I still think it sucks that Julie did this. I would never vote for her if she ran again.

    1. Reasonable people can disagree on that. And the needs of high-speed athlete cyclists aren’t always the same as the needs of low-speed transportation cyclists. I would argue that most of the controversy is being stoked by people who are neither, and just selfishly want to return to a time when everything was about the car, and ALL types of cyclists were unsafe.

      Irrespective of that, we should agree that this bluff collapse settlement is bad for personal freedom and will encourage government to be more aggressive in “protecting” us from our own personal choices.

    3. Good bike lane design should protect those who are professional riders as well as the first time user of these lanes. The part that upsets me is that Blakespear and others continue to identify this record of injury as a safety triumph when there were no accidents prior to the installation of the furniture. The other point is that our city hires staff to chase grant funds regardless of whether they are needed. Grant funds always result in diminishing returns for the taxpayer, but they provide jobs for staff and big political points for politicians like Blakespear to claim that she has achieved something!

    The city has known about multiple mitigation actions it could’ve taken since the grand jury handed Jerome stocks a laundry list of fix its. In his usual dismissive manner he said no thank you. Anyone following this lawsuit will have seen the press conference where the Davis family attorney ran through something like 14 items that the city was electing not to address. That carries through to Kranz today who has responsibility just as much as Jerome did back in the day. .

There have been 33 crashes, and the death of the 4 C's father, due to the city's deadly cycle trap. The death of Dr. Worley and Stephanie, again caused by the city's negligent infrastructure. If a person of brown or black color gets killed in the city's negligent deathly infrastructure, the pay outs will be over 100 Million, because of their minority status.

      Beyond that red herring, is overall good governance. That includes budgeting, prioritizing needs over wants, cleaning up the seediness downtown, getting the homeless problem under control, diligently curtail crime, not creating more stupid projects that cause confusion, accidents and are ugly. Maybe even fix or undo some of the stupid projects so many people, except the lying lawyer, hate, like the cycle traps. And so importantly prepare the infrastructure for the excessive overdevelopment approved by his predecessors.

      There is so much that Ehlers can do and do better than Kranz. And if K is passed I’d much prefer to see it managed by Ehlers at the helm than Kranz, who never saw a budget he didn’t overrun.

  22. I wanted to post this here before the gloves come back on and I get trashed once again. There is good news for all of you who participate in this blog, or read it. Julie Thunder and Co. decided that Encinitas Votes is already dead, even though I had announced it would be paused after the elections were certified. So, if you want to see what the "mean girls" as Marco calls many of us, are up to, you had better switch channels to the new FB group, as I am not going to spend any more time on Encinitas Votes. Now that should be cause for celebration for many of you. And YES, some of you are right. I spent 9 years of my life that could have been used doing other things than searching out Encinitas News from the 10 papers I subscribe to. For me, the good news is I can cancel the subscriptions, say what I want on this blog or somewhere else, (except of course Encinitas Now:) and actually have a life. So, for all the folks that dislike or hate me, this is your lucky day. And, to top it off, the new group even has some of the same people that are on EV, and some that are not, like Garvin and Marco. I would say it's a win-win for everyone.

      Some people on EV disagreed with my comments, and they knew Lorri was easily manipulated, and started lobbying her to delete me.

      I inquired if I had broken any rules.

      Both Lorri and Glen separately told me I was good, and had never broken any EV group rules. This was right before Lorri blocked me.

If the dissenter fights back, they're banned. If the bullying doesn't get rid of them or shut them up imaginary rule violations are created, they're banned.
