Walker was not "mowed down." She was riding in the sharrow lane in the dark before sunrise, a truck overtook her from behind and hit her. The driver was not charged.
There are sharrow lanes through downtown Encinitas, across the Cardiff flats and southbound through Solana Beach.
If Leucadia 101 Streetscape is built, there will be two southbound traffic lanes from Phoebe to Leucadia Blvd., which means the right lane will be a sharrow.
Walker was between Phoebe and West Glaucus when she was struck in the sharrow lane that will still be a sharrow lane if Streetscape is built.
Seems like its being kept pretty hush hush. The latest info I could find was a coast news article from April 1st of last year. It stated that damage claims were filed which is a required first step before a suit can be filed. The city had 46 days to either accept liability or reject the claims. Would be interested to know if anyone knows if the cities response is available to the public. The claim is putting all responsibility on the city saying “There existed a dangerous condition of public property, including but not limited to the following: the pavement markings that were present were confusing and distracting to both drivers and bicyclists; the signage that was present was confusing and distracting to both drivers and bicyclists; there was an absence of proper pavement markings and signage; and there was no separate bicycle lane creating a dangerous condition on public property.” The article also states “Walker, an avid cyclist and advocate of city bicycle and pedestrian improvement projects, was hit about 6 a.m. Dec. 8. Not to sound insensitive to Robertas injuries...I’m sorry this happened. However I do feel it is important that everything is looked at in this case as it could open a Pandora’s box for future lawsuits against the city as more and more cyclists are attracted to the area. Firstly I have a hard time believing that Roberta an avid cyclist and advocate of bicycle and pedestrian improvement projects was confused about any road markings or signage along coast highway. From what I’ve read she regularly rode this stretch of coast highway. It is possible that the driver of the truck was confused. I’m sure the sheriffs collected a detailed statement from him that could help clarify a lot in this case. I don’t believe any such statement has been made publicly available as of yet. I was on the scene within a couple of minutes of the accident as it happened directly in front of my house. I stood within a few feet of the driver of the truck for close to 30 minutes and he did not appear to be intoxicated. I would assume he would have been arrested if so (don’t believe he was) and he most likely was given some sort of sobriety test at the scene. Assuming he was not intoxicated I assume it would be considered an accident with the investigation shifting towards who was actually at fault. The driver, Roberta or the city. Or combination of 2 or all 3. A few days after the incident I saw sheriff’s deputies conducting an investigation at the scene so I walked over and offered to be interviewed and provide pictures I had on my phone. The first question I was asked was whether or not I saw a light on her helmet. Or reflectors on the bike. I told the officer I did not see any. It’s possible that some reflectors could have been detached from the bike during the impact but cant say for certain. She still had her helmet on and I did not notice any light on it. If a thorough investigation was conducted that info should be in the report and entered as evidence in any emerging trial. The accident occurred just before sunrise. If it is revealed that Roberta’s bicycle was not equipped with the required equipment for riding at night then I’m not sure the city could be held responsible. I did read a report a while back stating the she did have a light on her helmet and reflectors but I can’t find that report now. I did find it odd that this was reported as have not been able to find any accident report available online. I guess we will see if and when it goes to trial.

ReplyDeleteCycling is pretty easy, and it's done more safely if you don't ride with try hards, stubborn MAMIL cyclists, and choose the safer routes.
The normalization of bad driving is never going to be addressed appropriately in my lifetime, so the answer is take up mountain biking instead.
