Four Encinitas residents who applied for very-low-income homes have filed a federal lawsuit this morning against the City of Encinitas, developer Woodbridge Pacific Group and several “shell” companies alleging a coordinated effort to abuse the city’s affordable home program.We're going to love the discovery process!
The complaint alleges the city approved the sales of two affordable homes — 1317 Portola Road and 1412 Mackinnon Avenue — to pre-determined, non-qualified investors instead of qualified, very-low-income applicants in violation of federal and state anti-discrimination fair housing laws.

HUD calculates the figures and revises them every spring. HUD provides them to the states' housing depts. In CA, that's HCD.
It's not about deserving, it's about the feds and the states encouraging diversity, opportunity and generational accumulation of wealth, and discouraging exclusivity by income level.
And then it's not supposed to be about figuring out how to line investors' pockets. Gonzalez' clients believe otherwise - on his advice?

Here's what I posted elsewhere: I'm not involved in any way with the suit at this time. Not hired to defend anyone, no evidence to provide regarding the sale of the property at issue. I guess I could provide information about the original entitlement, but that's about it. I will say, however, that (big surprise) I don't think this suit has legs on its primary claim that this particular transaction was in any way discriminatory. The 55 year rental requirement complies with state law, and the complaint fails to state how this is insufficient to beat discrimination allegations. There is no right to purchase subsidized housing, and the selection of long term rent versus sale does not have a discriminatory effect. However, if the plaintiffs are able to prove that the City has systematically failed to track affordable housing and enforce compliance with rental or sales requirements, that could result in some form of remedy. If I were to guess, however, the current complaint will be found insufficient for failure to state a claim in a preliminary motion (12.b.6) and the plaintiffs will have to amend to bring in substantially more detail.
