9/13/21 City Council meeting open thread

On tonight's agenda: the 6-story Olivenhain monstrosity created by Blakespear's Measure U.


Expect Mosca and probably Kranz to vote no to try to save their seats assuming they know the fix is in on the other three votes.

    Do they think Encinitas is a dictatorship or monarchy where the dear and wonderful leaders can refuse public input?

  5. This council is putting the fire chief up to say there are no standards for public safety. The mayor has proven that they are on the hook for safety as proven by her payment of $11,000,000 for the Walker case. Marco says that while Walker advocated for the sharrow that she was hurt on because she was, "confused," the standard for liability is 1%. Think of what the city would be in store for if they pass this and something happens.

    She is the filthy rat who approved all the up-zone locations like this one that will destroy the surrounding neighborhoods.

  12. Blakespear jumped to second Kranz's motion to delay until Nov 2 for a reason. The other three figured out the reason and voted with B and K. What they did is a CYA.

    On Nov 10, all five will vote to go with the staff recommendation to deny the project. Then Goodson will sue. In the lawsuit, the city will say the council was uncertain about two points: Goodson owning RSF Road to the center line and the evacuation situation, and before voting to deny the project they wanted to be clear on those points. That will strengthen the city's defense.

    A court or a settlement will go against Goodson because many of his points are absurd and his legal justifications are wrong, as the ERRD people pointed out.

    Then Goodson will submit a revised and bulletproof plan. ERRD and residents will still object, but by that time the Nov '22 election will have passed, and the council members will support Goodson.

    It's surprising more attention was not paid to McCain Lane as the only access in and out of the project. It's barely wider than two cars and can't possibly accommodate the traffic to and from Goodson's monstrosity.

    2. Exactly as you say. The court will look at the reason for denial of the appeal. This is why Goodson wanted to take the denial yesterday. It would have been a weaker denial. In the end he will get 90% of he wants and the neighborhood will be screwed.

  13. 11:29 don't forget there are two votes on the table. Several speakers addressed this. By approving staff's recommendation the council approves the second vote on that "orphan" parcel as Goodson and staff like to call it. The removal of that parcel would let Goodson off the hook from a multitude of environmental oversights and freeing him up to build even more units.

  14. 1:05 has it right and access is fine for this small amount of traffic. Its all a game, the Mayor knows the applicant well, and in the end the neighborhood get screwed. You better think of something really big otherwise its going to happen.

In her ambitional wake, Encinitas will be over-developed, traffic-clogged and will have permanently lost the ambiance of a small town community. Some call this inevitable progress; I call it profiteering rationalization.

    But the overriding problem is the timing. Two other council members and I have elections coming up. What do you think the chances are of any of us winning if we vote to approve a project — that’s your project, Randy — that’s a blatant, opportunistic manipulation of state laws and local ordinances and, consequently, is on very shaky legal grounds?

    Plus, the optics aren’t good. The massive building doesn’t fit its location physically or conceptually as part of the community. On top of that, while claiming to benefit low income people, you’ve shoehorned those tiny units into the worst locations in the building. And, Randy, even I have to say that your claim of doing Olivenhain and Encinitas a favor by plopping your colossus on the corner of Rancho Santa Fe Road and Encinitas Boulevard is transparently silly and offensive. I support and continue to torture residents with things like the Cycle Trap, Leucadia Streetscape and that huge, oddly named imposition on the north Leucadia bluffs. I’ve betrayed residents in virtually every way possible — even worse than Barth, Shaffer, Kranz and Mosca. People compare Stocks favorably with me for cripe’s sake!

    So all this is to say that for you to expect me to vote for your overwhelming apartment house now is a bridge way too far. I must ask you to back off. I must ask you to delay. The primary for my state Senate election is in June 2022. The general election is that November. If I win the Senate seat, I’ll still have local influence that, combined with my newfound state power, will let me get your project greenlighted. I’ll be able to say I regret its unprecedented height and mass and the evacuation dangers it poses, but that it does help fulfill our housing mandate, including those tiny affordable units. After you make some sleight-of-hand adjustments, I can say it complies with state laws and local ordinances. I can say my hands are tied, I must abide by the law. I can take advantage of the fact that voters have short memories.

    Randy, the council never uses common sense to guide its decisions, so it’s ironic I’m asking you to use yours now. Be patient, you’ll get what you want. I’ll be at your groundbreaking with a gold shovel.
