The City Council ultimately decided against both proposals: the first included bike lane improvements and mid-block pedestrian crossings in north Leucadia, and the second a multi-use path along the east side of Coast Highway 101. The council voted to send the first proposal to the Traffic and Public Safety Commission and voted against moving forward with the second one outright.
Both items were on the consent calendar, which signals they were supposed to be approved with little debate and a simple vote. But Mayor Catherine Blakespear and a member of the public requested the council discuss the items.

Mayor Blakespear is having a hard time getting the council to support her on city policy. Her colleagues are starting to question her logic and rationale. Her leadership is starting to crumble.

Cardiff is a mess; downtown is losing stores ( I saw 2 going out of business signs today); Leucadia never seems to get anything they want, or that is functional; and New Encinitas traffic keeps getting worse. Not sure how Olivenhain is faring (sorry about the spelling).
ReplyDeleteWe're doing OK - the good is that Lone Jack was just resurfaced and re-striped, the bad is people can now drive faster. The trails are well maintained but the bicycle/horse interactions are getting more explosive. There's a fair amount of new construction and remodel activity, but it makes the whole neighborhood a little more noisy. Best part is we haven't had a shooting in quite some time (at least not human)!

As for why the road improvements were done - the storm drains were failing and had to be replaced, not to mention the sinkhole. The resurface was just a byproduct of that.

Nothing could be further from the truth. Under her lack of leadership, City Hall now went from a D to an F for functionally.
Needed projects are further delayed because of the poor lack planning and her spastic daily changes in direction. Everything I hear at City Hall is she is a total spaz and delays the progress of high priority projects. Very few at city hall or in so California respect Karen.
Same ofd thing that happened under her lack of leadership in San Juan Capistrano.
I hold City Council responsible for placing a competent city manager at the helm of our City. Right now the city manager and hence the City Council are getting a big fat F.

ReplyDeleteThe City is so inept when it comes to managing development and other areas that are crucial to the quality of life here. For example, The City relies on third party contractors that are often allied or employed by the developers to ensure the quality of work. The result is often shoddy, non-conforming to drawing work - look at any project by Rincon. The City is unable to monitor or ensure that what is being built is what was proposed and approved. The City's does not oversee these projects. They contract that work out as they clearly lack talent /non-corrupt personnel.
So does the Mayor, and Council members, give the authority to the City Manager to hire out third party consultants? Is it "cheaper" to go with a consultant instead of full-time employees? So if the City hires these consultants, and they are bad and/or not super-competent, who is to blame?

This is a city problem so from the mayor down one would think that there would be city interest - but there isn't.

DeleteInspectors are called out to validate construction corformance with codes and the approved permit multiple times during any build project. For our swimming pool, there were 3-4 inspections that had to be signed off.
If a contractor builds “whatever they want,” the permit could be revoked, they contractor could be forced to bear the cost of tearing down and rebuilding any out of spec work, or they could lose their state contractors license, which would put them out of business. Basically, it would be really really stupid business practice for a contractor to willfully deviate from the approved plans.
Further, the inspectors are also licensed by the state, and could lose their license for approving construction that deviates from the permitted plans.
If you have real evidence that a specific project has been built out of spec, you should take your evidence to the city, and to the CSLB.
Forgive me for being skeptical, but what you are insinuating would cause people to lose everything they have worked for. Given the high stakes, I’m inclined to believe it’s much more likely that you are mistaken, and/or are unqualified to assess whether a project conforms to permitted plans.
A neighbor built prior to getting permits - they had the money and what they did was approved after its implementation. Obviously there are sequential "variances" that do occur.

Delete12:50pm I beg to differ. If a code enforcement request is reported by a resident, they are required to respond every time, and they do. I do not work for the city, but know this to be true.
ReplyDeleteIf there is no report or request for code enforcement review, the city is not out there looking into every backyard for new illegal structures. Some views are quite hidden from the publics view from the street.
If a structure is not larger than 10' square, a permit is not required. This limit may have changed, since it has been a few years since I last checked.
There could be instances where structures were built without a permit, but when, and if these were found out, a serious fine would be levied at the least, and the homeowner would be under the city's focus for years to come.
Any of the embedded developers that have influence with our Planning Dept. senior planners, and there are many, would know better than to try to pull such a thing. It is not worth it.
Some homeowners do get away with non-permitted structures when they are out of sight, out of mind. The risk is even greater if this somehow becomes known to the tax man. That kind of fine would be serious and the state tax men don't mess around.
The hoops the city makes everyone jump through do suck sometimes, but the state is much worse if they find out that some taxes were being avoided. Ouch.
I believe you're referring to the county assessors office. They're the ones tasked with valuing property for real estate tax purposes and they would be very concerned about new non-permitted structures since the building permit is what triggers the interest. The state doesn't get involved with that. If I'm incorrect please let me know. That said, not all building permits result in a reassessment - if your replacing something that's already there it doesn't trigger a reassessment.

DeleteThe question is how does code enforcement respond when they go out. There's the well known case of Councilman Dan Dalagar and his illegal garage conversion on the corner of Third and F street. Code enforcement found nothing, even those there was good evidence that both USPS and UPS were delivering mail and packages to three addresses instead of the legal two.
And there was the uproar by downtown residents who filed numerous code violations with the city over late-night bar violations, drunkenness. and noise. This led to the formation of the Encinitas Hospitality Association, and eventually to the Deemed Approved Ordinance to do what the city employees couldn't do. There's been a long history of selective code enforcement in this city.
