City pays $11 million to bicyclist hit in hazardous "sharrow" lane

Coast News:
The City of Encinitas has agreed to pay $11 million to settle a claim with Roberta Walker, the former executive director of Cardiff 101 Main Street who filed a lawsuit against the city after she was struck by a pickup truck while cycling in Leucadia, according to the plaintiffs’ attorney Ed Susolik.

Just before sunrise on December 8, 2018, Walker, a longtime cycling advocate, was riding her bicycle in a “sharrow” lane on North Coast Highway 101 when she was hit from behind by a truck headed southbound near Phoebe Street intersection in front of the Leucadia Post Office.

Susolik, attorney at Santa Ana-based law firm Callahan & Blaine, claimed the sharrow, or shared bicycle lane, constituted a dangerous condition of public property, causing the accident, according to a written statement provided to The Coast News.

Despite wearing her helmet, Walker was critically injured and briefly unconscious when the impact of the collision threw her a significant distance, as first reported by The Coast News.
Gotta think there will be more lawsuits over the fatality at the Blakespear Bollards on Leucadia Boulevard and the dozens of crashes in the Blakespear Cycle Trap.

  6. I told all you fools that existing hazard would cost the city more to keep it in its existing hazardous condition, than it will be to address the hazard. I knew it would be between $10 to 20 million.

    Next we have Stephanie who was hit the year before walker. Lets say another $10 million. Than we have the fatality on Leucadia Blvd with faulty bollard placement lets say another $10 million, Than what about all the future deaths along the N.C Highway 101?

    After all that, we still have the same hazardous conditions existing today. Everyone knows you do not put sharrows on a highway designed for highway speeds. See- It would be cheaper to fix the known hazard and put in the needed bicycle lane.

    The taxpayers are f'd until the City addresses that existing hazard. Who's kid will be next?

    Is this good City Leadership ? And why do we have the $11 million dollar Pacific View with huge long term capital, maintenance and operations costs?

    Oh yeah, ignore all the above and lets hire two more staff to invite even more homeless to encinitas and then we can report on how we are addressing all there impact on criminal behavior, and negative impacts to residents, businesses, and everyones quality of life. Is this good leadership?

    Oh and don't worry there are plenty more claims to pay on the same stretch of hazardous roadway, the City has no plans to install the needed bikelanes any time soon. Not only that they added sharrows to another super fast section of highway down in Cardiff. Is that crazy or what?

    Please thank your city leaders for giving all your tax dollars to the attorneys. Its a good living for attorneys, ER workers and undertakers in Encinitas.

    My prediction, the City will have to raise sales tax in Encinitas another 1% at minimum to keep up with all the lawsuits from future claims on the created hazardous conditions.

      Even more important is all these horrific accidents along the Hw101 would have and the future accidents could be avoided by addressing the known hazard. The attorneys for the plaintiff in the $11 million cyclist riding before dawn, who was hit by an out-of-towner unfamiliar with "sharrow" lanes, say that there is no language that says the Sheriff can't release the accident report on this case. So far, Sheriff won't share it. The city paid no money so far on this case, but city insurance agreed and paid. It will cost more in insurance in future. A much bigger issue is the rich city of Encinitas hiring more employees, is that it is not fully funding their pensions, and the deficit, to date and in years to come, will make this cyclist settlement insignificant.(see city of San Diego deficit) One way of looking at employees, is like most private firms do: calculate and pay pension costs, and if you can't afford that, you don't hire extra employees.

    Roberta's tragic accident was not at the corner of Phoebe in front of the post office. The photos show it happened about halfway between Phoebe and West Glaucus, south of the exit driveway at the south end of the post office, etc. parking lot.

    The Leucadia Blvd/Moonstone Court Blakespear-bollard-caused accident was more tragic because an extremely valuable man died.

    Whilst I wish Ms Walker well, so much here makes no sense. It wasn’t as if the city had REMOVED a bike lane and replaced it with Sharrows as they have done on the 101 in Cardiff, so where was the negligence?

    Compare this with the multiple crashes, surgeries and now a death their ill-advised (by experts) installation of bollards and wheels stops DID cause and where they absolutely have negligence.

    It looks as though the city WANTED to make this payment, possibly as it was to a friend and it wasn’t their personal money, or maybe in an attempt to justify their obsession with the genuinely dangerous (evidently) bollards?

  20. As our bicyclists are run down and die on our streets, our kids die from Isolation and the roads die from neglect, our City Council focuses on inviting all the homeless and government housing to Encintas.

    Not only that, but instead of fixing our pot holed filled roads and making them safer, we are doubling the population and crowds in Encinitas and spending $11 million on Pacific View, and another $11 million on their liability pay out on Walker. Wait until Stephanie's family drop their suit and the scientist who was run over on Leucadia Blvd due to improper bollards installation, and lets not even start counting about all the suits coming from the Cardiff blood bath fiasco.

    Well at least BIAspear will start building a 5 story affordable section 8 housing with Art Center at Pacific View. That way the City can offer the land for free and really cut the price of the units to an affordable level. But you or I can not buy one. You have to qualify by knowing BIAspear of meeting her criteria.

  22. Wow, it's been a full year since the WHO declared a pandemic. For me, it's been a wild ride. I contract with the CDC, and spent part of 2020 in Atlanta, but then ended up in Berlin working with BioNTech on the mRNA vaccine technology. It's basically been 14 hour days in a lab, only to come home and crash for the night, and then back to the lab. I am so glad to be back in San Diego, and see the covid numbers dropping. Hopefully it isn't a head fake, and I don't think it will be if enough people are vaccinated before next winter. Anyway, the point of my comment is, after so many hours spent in a lab in Berlin, I wasn't able to follow local elections. Can someone tell me how Kristin Gaspar did?

If you want a view of reality - take a look at the oil patch and how employees injured at their job site are compensated.     1. It's tragic, truly tragic the emotional strain of ad hoc, politically weaponized Covid health policy impacting teens. They were let down by an educational system unprepared for emergency contingencies but all too prepared to externalize blame.

      Teachers are entitled, as are any free individuals, to prioritized their and their family's health under the early crazy circumstances. But our local teachers have relinquished at least one thing--any pretense about their jobs representing some answer to a higher calling. Teachers are almost always treated with a reverence stemming from certain specious assumptions about personal sacrifice--"nobly" enduring low pay, long hours, difficult work conditions, personal financial outlays for supplies for their students, etc.--much like those ascribed to the military and first responders. But the military and first responders stepped up during the pandemic to do a tough job during tough times. Even the uncelebrated cashiers at our local Vons were on the job, face-to-face daily with hundreds of paranoid shoppers, because they needed a paycheck, food had to be available to society, and they were essential to a functioning society.

      Teachers were likewise necessary and essential for a functioning society, but they enjoyed a big-union derived immunity from actually sacrificing anything. Our district went more into vacation mode rather than crisis mode, but it sure did pay lip service but accomplished little action toward fulfilling its critical functions. Concern was firmly directed at protecting teachers rather than exploring and finding the willingness to resort to extreme solutions to protect our children.

      Much was revealed about the true interests of our educational system--many want to wring hands and rationalize for the teachers, but too many others have woken up to the craven reality. Like too many other institutional and occupational sacred cows in our society, perhaps this experience will help us stop elevating things at too great a social cost.

If the city pays someone $11 MUSD for assuming that a "shared" lane, in the dark, guarantees protection just wait for the avalanche of claims coming from being forced into traffic through the roundabouts.     2. Sir- please consider giving up your keys. I ride through the roundabouts about 4 times a day on Leucadia and I love them. they are safe for all and efficient too. I hate waiting at red lights at traffic signals. Ask a fire fighter paramedic, are there more fatalities at the City's traffic signals and roundabouts.

      Plus if you do not feel comfortable riding through them in the vehicle lane, you can access the ped/bike crossing shared pathway and continue on your way. See its fun!!
