Residents sue over Olivenhain development

Grassroots group Encinitas Residents for Responsible Development has filed its third lawsuit in two years against the city of Encinitas over a controversial proposed development.

The most recent one, filed on Jan. 28 in San Diego County Superior Court, contests a decision that the city made to allow the consolidation of four lots into one at the site of a proposed project by developer R. Randy Goodson.

  1. The council could have chosen not to allow Goodson to split these lots. Obviously, Blakespear wanted to do a favor for "Randy," as she called him in meetings to ensure that our city will continue to be sued by him too and that developer contributions keep flowing her direction.

    1. Goodson didn't split the lots; he consolidated them. That's the point of the latest suit.

      Three big cheers for ERRD. They have put countless hours and mucho dollars into fighting the disastrous Goodson project.

      Those lots should have never been consolidated and the City of Encinitas is responsible for that screw up.
      In fact, it needs to be reversed.

    I hope you and all your BIAspear voter in the last election love a high density crowded Encinitas with tons of homeless tweekers causing harm, because that what you knew you were voting for.

    -currently converting all my 7 rental properties to 4 units per lot with VRBO. Thanks BIA! I am moving to my new home out of Encinitas and can not wait until its finished.

I'm didn't move too far though just down the street into RSF were our property rights are protected from the state law and all the stupid sit Encinitas is doing to overdevelop per BIAsear's plan. I so funny, you couldn't believe how many of my neighbors here in RSF are developers? Who would have guessed?

      I hope you and your new friends like my new VRBO party rentals. They all have big outdoor desks with awesome sound system and dance floors. I am getting an great response from vacationers. I guess there is a big demand to rave at the beach. With my now 27 units (27 times 12 months at $4000 per month), I am clearing over $1.3 million per year which is not a bad supplement to our monthly income.

      All at the expense of my former Encinitas neighbors. Thanks Mali and thanks BIAspear. You are right - Everybody should be able to live in Encintas. At least rave in Encinitas. Right?!! - Boom Boom shica, Boom, Boom, Shica Boom Boom. Party On!!!

  4. 9:02 the lot split referred to was requested by Goodson and happily approved by the council. It involved the elimination of a small piece of land that allowed the remaining main parcel's slope calculation to flatten out magically within just the amount necessary for Goodson to avoid a host of environmental regulations that would otherwise apply for a steeper lot. Many believe that that little trick has Sa-pow's name all over it?

    So with the denial came a big gift, wrapped in a bow, from the council to "Randy."

    1. The newspaper article says the latest lawsuit is about lot consolidation, not lot split. The elimination of the little steep section is a separate issue.

    2. It is not part of the lawsuit, no. But it was a disgusting display of the council in front of everyone clearing a major environmental hurdle for "Randy."

      No one should be unclear that between approving that split and downplaying the fire danger, this council did huge favors for the developer while appearing to put up the hand to him. Don't let them for a minute tell you otherwise. The ERRD folks are well aware.

  5. The council, in its' response to HCD's letter telling them they had no right to deny Randy's project, made it quite clear they fully intend to put a density project on that site. Olivenhain - IT AIN'T OVER!

    1. Like Randy said at 2:07, it's not over. He seems to have moles at HCD who he works with. I am sick of the staff, council and others working against citizens.

    2. The HCD "moles" are quite friendly with Encinitas "staff," who conduct all HCD meetings by phone with no minutes kept. Ask Roy and see what records he produces. NONE and we're supposed to take his word for what the state says. Working hard for the developer and HCD and against the rest of us.

Over 800 units are being built within a mile proximity to I5 and feeding onto Encinitas Blvd. The traffic there is already gridlock and with this outrageous density increase, will become near impassable. There should be a strict limit on development before the infrastructure hits critical overload. Encinitas Blvd. will become nearly impassable for hours on end, and that's not even mentioning the critical water shortage. Blakespear is as corrupt as they come and the rest of the City council are incompetent also.

    1. This comment at 3:21 is just crazy. Things back up on Encinitas Blvd for a bit in the morning when people go to work, for a short time when the kids get out of school, and a bit in the evenings after work, though not that bad. "Hours on end" sound a lot like the sky is falling, which it isn't. Change your commute time or ride a bike, snowflake.

Anyone that has traveled this route knows the intense congestion it already experiences and adding over 800 additional units to the immediate area will put it in a new category of overload. SANDAG only needs $168,000,000,000 to build their plan. Now please vote yes on the next Transnet bus tax and pay your "fare" share- get it?

  10. The City denies the project but ERRD still finds a reason to sue. Did anyone read their complaint? Their attorney doesn't seem to understand a lot of basic land use stuff. What a joke of an organization.

    2. ERRD is a group of people that care about where they live. Who the hell wants a huge complex in an already crowded intersection. Maybe they aren't legal experts, but I'm guessing they have the funds to pay people that are. Calling it a joke is an overstatement and I wish them all the luck.

  11. 1:29pm. YOU LIE at and are a liar. The traffic on Encinitas Blvd is always an F except maybe late at night when I don't go out.

    Every time it is jammed during the daytime, and I avoid rush hours. That I have to avoid rush hours in town while staying off the 5 sucks.

    There is no avoiding rush hours on Encinitas Blvd. during the daytime.

  12. Goodson knows that this city and its' legal representation is weak and he'll litigate until they settle with a 10 MUSD+ city give-away. Much like the bike rider in Leucadia who drove her bike into a truck, in the dark, with no light and was given $10 MUSD - city administrators are open to giving away tax-payer money to make themselves feel good.
    This city is a treasure trove of give-aways. The coming Goodson give-away is just a little bit more convoluted but will be worth the wait for Goodson...

    Mayor Blakespear Denies Psychologist’s Claim That She’s Brain Dead

    A spat between two Cardiff residents has flooded social media.

    After close study of Encinitas Mayor Catherine Blakespear in person at City Council meetings and earlier at city meetings via the Web, psychologist Dr. Lorri Greene has declared Blakespear brain dead.

    Not surprisingly, Blakespear, who is a District 38 state Senate candidate, denied Greene’s declaration.

    “I’m anything but brain dead,” said Blakespear. “I’m an active woman committed to improving people’s lives in Encinitas and, if all goes well in my campaign, in state Senate District 38. I suspect Dr. Greene has misread my use of the word ‘committed.’”

    “Nothing of the kind,” said Greene. “As a professional who holds a Ph.D. in psychology, I am qualified to assess a person’s mental state. I also know how to use the word ‘committed.’ It is my deeply held professional opinion that Mayor Blakespear should be committed to an institution where her condition can be treated with counseling and appropriate medications. With proper care, her brain can be brought back to life.”

    “My brain is alive and well,” said Blakespear. “I do stuff all the time. I’m the chairwoman of SANDAG, I’m the mayor of Encinitas, I’m a state Senate candidate, I’m a lawyer, I’m a wife and mother. No person who’s brain dead could do all those things.”

    “Perhaps my professional conclusions are too abstract,” said Greene. “Mayor Blakespear has habitually shown megalomanic, narcissistic, sociopathic and hypocritical behavior that is the manifestation of morbidity in the cerebellum, cerebrum and brainstem. Therefore, I used the popular term ‘brain dead.’”

    “If I were not a public figure,” said Blakespear, “I would sue Dr. Greene for libel and slander.”

    “More evidence,” said Greene.
