A group of residents continues to seek legal remedies against Mayor Catherine Blakespear over her alleged censorship of critics on social media, recently filing a new notice of intent to move forward with litigation unless previous settlement terms are satisfied.
San Diego civil trial attorney Carla DiMare filed an amended notice on July 14 with the city of Encinitas on behalf of Robert Nichols, former chairman of the Surfing Madonna Oceans Project, and approximately 28 other “citizens’ rights advocates.”
DiMare, who replaces Carlsbad-based attorney Michael Curran, claims her client’s constitutional rights were violated when Blakespear restricted access to her official mayoral Facebook page and blocked certain users for expressing dissenting opinions.

ReplyDeleteYep. It was laughable to read a thread on EV the other day about roundabouts in Leucadia and Streetscape. Little Bobby Nichols ranting over and over about it and then saying he's going for a run...he's in Oregon! Not even here in person to look at and judge the area they just improved. That roundabout is useful and helpful. That area has not been maintained or updated in 80 years! It is expensive, but it desperately needs the update and will make it more easy to navigate for cars, bikes, and pedestrians.

Mark brother has Managed Mark's money and he's done a really good job. Mark is my best friend, he lived with us for several years, we fed him, took care of him and my wife and I have done nothing but love that man. We were no longer qualified to take care of Mark, when he started having potty issues. He's currently in a memory care facility down the street from us and we visit him once a week and take him to the beach or out for lunch. Mark Patterson is one of the kindest people on earth and everyone knows it. Unfortunately, Bob is nowhere close to that in character. Yet because people love Mark and have a soft spot for the Surfing Madonna, those good feelings get associated with Bob. Eventually, for many people, that patina of kindness wore off when they had to deal with him at events, which they detailed in their staff report recommending the city no longer work with him.

DeleteI don't think it very nice of you to call my wife's company pathetic, what she's created is actually pretty amazing. Many overweight people, persons with disabilities, people with dogs, companies, people that want to set a goal and meet a challenge sign up for her events. As a matter of fact I think her company had around 15,000 participants from across the country over the last two year, and this years she tracking to do the same numbers. Not bad and with about 10% of the workload compared to operating the Encinitas Half Marathon and Surfing Madonna Beach Run (which we loved and created by the way).
So, I don't think it's pathetic at all. My wife stepped up to the plate, told me the city wasn't going to beat us, and built a beautiful virtual running and biking challenge company. We track people's results, there's a leader board, people from around the world communicate with each other about how their 100-2022 miles challenge is coming along. People send us photos from around the world of their weight loss, goals accomplished, cancer survival stories during their challenge. It's beautiful.
I'm very proud of my wife and what she accomplished, and it's a pretty damn good living.

So theres a change Turney was not seeing certain comments and felt she was blocked. Lorri Greene posted more than once on EV that she felt Blakespear and Krantz were blocking people because under each post was the choice to "view all comments" or see "most recent". This confused Lorri and some of the others may have been confused as well.

DeleteNOTE that facebook PAGE, the type of page Blakespear is using, is not the same as a facebook PROFILE, a personal facebook page, or a group. Per the PAGE admin settings, Blakespear could not block anyone who did not already interact with the page. It's impossible, you can't hack that or create a work around.

That’s why she’s acting as Cindy’s right hand man in hopes of getting Cindy elected, then have Cindy repay the favor by appointing Susan to council since Susan has tried more than once to get elected on her own. But she’s never even come close. Adding to the problematic duo is their joint lackluster, deceitful viciousness with ill motives + one other person of the same= 2 problematic people. We don’t need double trouble added to the CC cess pool we already have.

ReplyDelete1. SMOP was already suffering under Bob prior to COVID and losing their city contract. The Tribune called him out with an article detailing how he and his wife, the only 2 employees of the SMOP non-profit were collecting bloated, ever increasing salaries in spite of decreasing revenue.
2. The city was forced to cut ties with SMOP due to a lengthy and well documented history of harassment by Bob. They even tried swapping people around to make it work but Bob still managed to sabotage the whole thing. His perpetual lack of self-awareness is a marvel to behold.
3. Bob and his wife no showed the city council meeting where he was invited to tell "his side of the story". Like a lot of scammers, he threatened to sue the city but after making a lot of noise, he did nothing. A smart decision as he would have lost and knows a lawsuit would only bring out the more damaging details that the city was kind enough not to publicize.
4. Bob focused on Blakespear as the reason his life was spiraling out of control and focused on revenge. In addition to making literally thousands of Facebook posts attacking Blakespear, he filed a bunch of complaints against her with the FPPC. Hint: They were all dismissed as meritless.
5. Bob broke rule #1 of 501(c)(3) and used SMOP accounts to attack Blakespear on Facebook. Yes, he illegally used his non-profit in an attempt to influence an election, a federal offense. How much Blakespear was helped by his behavior is unclear but word is that his behavior and those like him have inadvertently convinced a lot of people to vote in the opposite direction they intended. Hint: Blakespear won the election anyway.
6. Bob and his wife received multiple hefty PPP payments for a company that wasn't actually impacted by COVID. It was Bobs harassment that cost them their only contract prior to COVID. With only 2 employees they received the highest per person payments I've ever seen. While many businesses were getting a few hundred dollars per employee, Bob and his wife took nearly $70,000 in tax dollars for the 2 of them. Hint: This is commonly referred to as fraud.
7. Bob entered a written quid pro quo agreement with candidates Alex Riley, Susan Turney and Julie Thunder to restore his SMOP contract with the city. This would have revived the fat salaries that he and his wife were draining from their non-profit. Word on the street is that the state was informed and was poised to go after them had they won and delivered on their agreement. Hint: They all lost so couldn't deliver.
8. Bob continued shopping around the SMOP to other cities but all turn him down. His reputation preceded him and the only way the non-profit could survive was with him no longer involved with it. He and his wife cut and ran.
9. Nichols and his wife fled to Oregon where he continued his assaults on Blakespear. The latest effort was this gray area first amendment argument. He rallied a number of online mental defectives trying to sink Blakespear in the primary by promoting Joe Kerr. Using a bunch of fake accounts he continues to harass Blakespear and her supporters. Hint: Kerr lost badly in the primary.
10. Bob made a buncha claims about he and his wife voting in our election in an attempt to sway voters. Apparently this prompted some actual residents to file voter fraud claims against them as they are actually residents of Oregon. Hint: Allegedly being a "part" owner of a home doesn't make you a resident.

Third, our Bylaws stated that Officer’s could be Directors and vice versa, this is common for smaller organizations. Furthermore we had several employees, I wasn’t the only one.
Fourth, the IRS determined that our salaries were fair and just by comparing them to other 501c3 who’s President had a similar job role. As matter of fact I was entitled to a higher salary many times.
Lastly, I poured a lot of money into this organization from 2011-2014 to get us off the ground.

Delete4. My life was never “spiraling out of control”, what a ridiculous statement to make, completely false. My life’s been great and I wouldn’t change it for anything. I have a wonderful wife who I love dearly, a dog “Ocean” who we take swimming everyday, friends, live is good and I’m thankful for it.
I’ve always been proud of the work SMOP did in the community. We gave thousands in scholarships over the years to high school kids, who have kids, donated to local charities, purchased floating beach wheel chairs for local beaches, mobility mats for persons with disabilities, started an award winning national recognized special needs surf camp that was free for families working with over 1,400 families to date, donated about $15,000 a year to the Ecke YMCA special needs aquatic programming, donated $70,000 to Pacific View, donated $40,000 to the kids skate park in Solana Beach, donated tens of thousand in scholarship, purchased marine mammal rescue equipment for the Life Guards, etc etc. In all, we donated over $600,000 to ocean, beach and park related projects in Encinitas since 2013, not bad, and all from art on a wall. I’ll always be proud of the work we did and I have no regrets. My life is certainly not “spiraling out of control”.
5. This statement is blatantly false as well, I never broke any 501c3 rules, or used SMOP to influence an election, absolutely ridiculous. If that was the case, SMOP would have had its 501c3 status removed a long time ago. Two years later and SMOP is doing just fine. 501c3’s are allowed to post true statements regarding themselves even when it becomes political, simply because it involves the said 501c3. Statements of fact are and will always be perfectly legal. I like how the author, probably Marco, uses the phrase “word is that”.
6. Again this is a false statement is completely false. My wife and I never received any PPP payments of $70,000 in tax dollars, this is 100% false. Look at our organizations 990 tax returns, we resigned in January 2021. If the moderator will allow me to post a photo of our 990’s I’ll show you this statement is not true.
Mike Redman and Cathy Carey took over our positions for SMOP in 2021 and began applying for PPP grants. Not my wife and I.
Mike and Cathy received PPP payments of roughly $70,000 and were entitled to them, most organizations across the country did this, simply because organization had a hard time generating revenue during COVID, just like most businesses did. SMOP would have been fiscally irresponsible to not take advantage of what the government was offering.
7. Again, another very false statement. This one had me laughing out loud. I like how the author uses the phrase “word on the street” again, like they have some privy knowledge that no one else has.
If I had made an illegal deal with the candidates, such as this, do you think the candidates would have told everyone about it, thereby jeopardizing themselves. Ridiculous! Those events were exhausting to operate and run, the amount of work throughout the year was excruciating. Something I will never do again. Permitting, insurance, dealing with sponsors, residents, participants, timing company, medal and shirt manufactures, marketing, traffic planning, Sheriff and Fire Dept contracts, life guards, numerous city and planning meetings, medical, aid stations, etc etc. So to say that I colluded with the candidates to bring our events back is 100% ridiculous and false. I resigned from Surfing Madonna in January of 2021, so how would bringing the events back do anything for me? My wife and I now have a very successful business, where we make significantly more than what we did at Surfing Madonna with 10% of the word load.

Delete8. Another false statement. Both the City of Solana Beach, City of Oceanside asked if we wanted to bring our events to them, including our free surf camps. They reached out to us. I told them we would consider it. After determining that Solana Beach couldn’t handle a Half Marathon with their short 101 distance, and their beach being too short for a 10K, we turned them down. With regard to Oceanside, the traffic planning would have cost us nearly $50,000 on top of our already $370,000 race budget, there were too many what ifs and the risk was not worth the reward. Also the Surfing Madonna Beach Run in Oceanside wouldn’t have worked on the sand as the beach begins to get very narrow towards the south end a logistic nightmare and large gamble with participants. Logistically this would have been a nightmare and a potential liability. So, we turned Oceanside down as well. However I am very grateful for both cities support and their understanding of the way we were bring treated by Encinitas City Council, unfortunately it just wouldn’t have worked.
9. Another false statement… My wife and I bought a house in Oregon in August of 2018, well before our problems with Blakespear and Kranz began. Every years since 2012 we would drive up to Oregon and camp along the coastline. We’ve always loved Oregon’s rugged beauty.
We never fled to Oregon, why would we have to flee anywhere. Again the author of this post loses all credibility here. He makes it sound like we are Bonny and Clyde, fleeing from the authorities. In 2018 we were lucky enough to find our dream home. Yes we currently live in Oregon and we love it. But we also have a property in Encinitas, a city which I moved to in 1999. So, we still have an interest in Encinitas and we do care about who gets elected and who is representing us. I will always love Encinitas more than any place in the world. We periodically visit our families property, one of which I have a 50% ownership in, every couple of months. So yes, I have a qualified interest in Encinitas and want to see that it’s well taken care of and not in the hands of Marco Gonzalez, attorney for the developers, Catherine Blakespear and Tony Kranz. These people are destroying this beautiful town with their concrete jungle, streetscape, deals with developers, etc.

This is an untrue statement….SMOP was doing just fine financially, my wife and I created the largest beach in the world starting in 2013 and the 2nd largest half marathon in San Diego in 2016. In 2017 the Surfing Madonna Beach Run was recognized as the largest beach run in the world according to the Guinness Book of World Records. Both events brought in an approximate combined $680,000-$750,000 a year and roughly 15,000 people from across the country to Encinitas each year. Those participants spent well over 1 million dollars on hotel rooms, restaurants, novelty stores, etc according to an economic impact report by an independent party.
Revenue was not decreasing as you say, in 2019 we had our best year yet. Unfortunately COVID hit in 2020 and we could not hold our events, the Boston Marathon, the New York Marathon, every event across California and the country was cancelled. My salary at its peak in 2019 was roughly $120,000, my wife salary was roughly $100,000, it took a long time and a lot of years with no salary to get there. We did nothing illegal and our salaries were looked at by an independent 501c3 auditing group and determined to be “Very Reasonable”. Our salaries went for review in front of our Board of Directors periodically, nothing illegal and our Bylaws stated that we could receive salaries, like most 501c3 do. This was a full time job, and it wasn’t just the races that we put on. We did aquatics programming at the YMCA, free special needs surf camps every summer, and a whole list of programs, it was a full time job.
2. This statement is completely false. The City and SMOP always had a great relationship. SMOP received awards and accoladed from the City of Encinitas every year up through 2019. Mayor Catherine Blakespear and her family attended our events each year and spoke at them. In 2019 I was presented with award by Mayor Blakespear for all the good work we had done in the community. If I was having so many problems with city then why were they giving me awards up through 2019 and attending all of our events? So the statement you are making is completely false. If the moderator on this site allows, I will gladly provide a picture of the award Blakespear gave me in 2019 and appreciation from the Parks Dept.
3. SMOP had nearly 40 people lined up to speak at the council meeting. Including local businesses, hotels owners, restaurant owners, local schools board members, Ecke YMCA board members, local charities and residents all ready to present.
We didn’t show up for the meeting, because Blakespear and Kranz decided it would be wise to put us last up on a very busy agenda. We would have been speaking after midnight. I wasn’t about to ask local community members and representatives to wait until midnight to speak. The fix was in. We knew that council was going to vote against us no matter what when we saw where we were on the agenda. This is how this council operates. Just look at what they did to Bruce Ehlers. They gave him 2 minutes to defend himself. All of the speakers defended Bruce Ehlers and council didn’t care, they fired him.
We figured if you don’t want us then what’s the point of fighting?

According to the Surfing Madonna Oceans Project most recent federal tax filing, nearly one-third of the charity’s proceeds in 2018 were paid to board Chairman Robert Nichols and his wife, Megan McCarthy, who serves as the board secretary.
The tax-exempt organization reported income of $676,986 in 2018 , a decline of more than $77,000 from what it collected in 2017.
Meanwhile, Nichols’ salary climbed by more than $27,000, to a total of $112,249, a 31 percent raise. McCarthy, a friend and coworker who married Nichols in 2017, in 2018 received a 34 percent pay raise for a salary of $97,700.
Combined, the husband-and-wife nonprofit leaders took home 31 percent of the charity’s revenue for the year.
Nichols said the pay increases were deserved because of the work it takes to run the organization and to host the two main fundraisers: the Surfing Madonna Beach Run each fall and a half marathon every spring. He also said he had no role in setting his or his wife’s salary.
He said 2018 was the only year in which executive compensation exceeded 30 percent of annual revenue.
Nichols also cited several other local charities run by husband-and-wife teams who receive salaries from the organizations they manage and said his and his wife’s salaries are on the “bottom end” of what those event directors are paid.
“The IRS says salaries should be fair and reasonable,” Nichols said in a telephone interview. “For anybody that brings in the amount of money that we have, that is absolutely reasonable. We let our board decide whether our salary should go up or down.”
He followed up with an email saying, “Our entire board voted, with the exception of Megan and myself, voted unanimously to provide a fair and reasonable salary for the job we do. There’s no question that we earn every penny of our organization. We have built an organization from $0 to over $400,000 in the bank and have donated over $500,000 and all of this since 2013. That’s a lot of work and we’ve done a 5 star job for this organization.”
While the executive pay was increasing by nearly one-third last year, the amount of money the Surfing Madonna Oceans Project distributed to charities and agencies declined significantly. In 2017, the charity awarded $128,819 to community groups; its grants last year totaled $94,892, a 26 percent dip.
According to its 2018 tax filing, the Surfing Madonna Oceans Project donated $39,325 to the alliance, where Nichols was also a board member.
“From the tax forms provided, it is evident that this organization has self-disclosed that they do not require conflict of interest statements, and they do not have an IRS-supported process for determining executive compensation,” said Laura Deitrick, director of the Nonprofit Institute at the University of San Diego.
According to its bylaws, the Surfing Madonna Oceans Project board shall include between one and 10 members, each serving one-year terms that can be renewed indefinitely. Six years of tax filings show significant board turnover.
Nichols and McCarthy were the sole board members reported in 2015. They reported salaries then of $29,000 and $27,500, respectively.

Third, our Bylaws stated that Officer’s could be Directors and vice versa, this is common for smaller organizations. Furthermore we had several employees, I wasn’t the only one.
Fourth, the IRS determined that our salaries were fair and just by comparing them to other 501c3 who’s President had a similar job role. As matter of fact I was entitled to a higher salary many times.
Lastly, I poured a lot of money into this organization from 2011-2014 to get us off the ground.
I’m going to list my salary from 2011 - 2020. I will back this up with a link to our 990’s tax returns via Guide Star, who gave us a Gold Rating. You may have to create a login with Guide Star if you want to verify these, but that will only take minute or two.

Unfortunately some people think that all the employees combined salaries equal my salary. I've provided links to our 990 tax returns from 2011-2020. The board votes for my salary each year, not me. As you can see, they are very reasonable and the IRS determined the same. ^^^

This is an untrue statement….SMOP was doing just fine financially, my wife and I created the largest beach in the world starting in 2013 and the 2nd largest half marathon in San Diego in 2016. In 2017 the Surfing Madonna Beach Run was recognized as the largest beach run in the world according to the Guinness Book of World Records. Both events brought in an approximate combined $680,000-$750,000 a year and roughly 15,000 people from across the country to Encinitas each year. Those participants spent well over 1 million dollars on hotel rooms, restaurants, novelty stores, etc according to an economic impact report by an independent party.
Revenue was not decreasing as you say, in 2019 we had our best year yet. Unfortunately COVID hit in 2020 and we could not hold our events, the Boston Marathon, the New York Marathon, every event across California and the country was cancelled. My salary at its peak in 2019 was roughly $120,000, my wife salary was roughly $100,000, it took a long time and a lot of years with no salary to get there. We did nothing illegal and our salaries were looked at by an independent 501c3 auditing group and determined to be “Very Reasonable”. Our salaries went for review in front of our Board of Directors periodically, nothing illegal and our Bylaws stated that we could receive salaries, like most 501c3 do. This was a full time job, and it wasn’t just the races that we put on. We did aquatics programming at the YMCA, free special needs surf camps every summer, and a whole list of programs, it was a full time job.
2. This statement is completely false. The City and SMOP always had a great relationship. SMOP received awards and accoladed from the City of Encinitas every year up through 2019. Mayor Catherine Blakespear and her family attended our events each year and spoke at them. In 2019 I was presented with award by Mayor Blakespear for all the good work we had done in the community. If I was having so many problems with city then why were they giving me awards up through 2019 and attending all of our events? So the statement you are making is completely false. If the moderator on this site allows, I will gladly provide a picture of the award Blakespear gave me in 2019 and appreciation from the Parks Dept.
3. SMOP had nearly 40 people lined up to speak at the council meeting. Including local businesses, hotels owners, restaurant owners, local schools board members, Ecke YMCA board members, local charities and residents all ready to present.
We didn’t show up for the meeting, because Blakespear and Kranz decided it would be wise to put us last up on a very busy agenda. We would have been speaking after midnight. I wasn’t about to ask local community members and representatives to wait until midnight to speak. The fix was in. We knew that council was going to vote against us no matter what when we saw where we were on the agenda. This is how this council operates. Just look at what they did to Bruce Ehlers. They gave him 2 minutes to defend himself. All of the speakers defended Bruce Ehlers and council didn’t care, they fired him.
We figured if you don’t want us then what’s the point of fighting?
The San Diego Union-Tribune last month reported that the combined salaries paid by the Surfing Madonna Oceans Project to Nichols and his wife have climbed year after year to just under $220,000 in 2018, the most recent year for which information was available.

Left out of your story are significant expenses incurred when “the couple” started to financially support the surfing Madonna artist out of pocket. As he became increasingly ill they moved him in with them to care for him as long as they could manage. After that they moved him in and footed the bill for assisted care.

First let me start by clarifying my salary. It’s not uncommon for 501c3 to pay their employees. As a matter of fact all successful 501c3 pay their employees. L101, E101, C101, Leightag, YMCA, you name it and they have employees who are being paid. Surfing Madonna was no different.
Second, our board always determined my salary, I never had the opportunity to vote on my salary as that would have been a conflict of interest. The board would often review my work, the revenue I was bringing in and determine whether or not my salary was just.
Third, our Bylaws stated that Officer’s could be Directors and vice versa, this is common for smaller organizations. Furthermore we had several employees, I wasn’t the only one.
Fourth, the IRS determined that our salaries were fair and just by comparing them to other 501c3 who’s President had a similar job role. As matter of fact I was entitled to a higher salary many times.
Lastly, I poured a lot of money into this organization from 2011-2014 to get us off the ground.
I’m going to list my salary from 2011 - 2020. I will back this up with a link to our 990’s tax returns via Guide Star, who gave us a Gold Rating. You may have to create a login with Guide Star if you want to verify these, but that will only take minute or two.

I'd also like to comment on a statement made by whom I think is Marco Gonzalez, because the statement he made 1-10, is 100% False. This will come in 2-3 parts as it's pretty long.

This is an untrue statement….SMOP was doing just fine financially, my wife and I created the largest beach in the world starting in 2013 and the 2nd largest half marathon in San Diego in 2016. In 2017 the Surfing Madonna Beach Run was recognized as the largest beach run in the world according to the Guinness Book of World Records. Both events brought in an approximate combined $680,000-$750,000 a year and roughly 15,000 people from across the country to Encinitas each year. Those participants spent well over 1 million dollars on hotel rooms, restaurants, novelty stores, etc according to an economic impact report by an independent party.
Revenue was not decreasing as you say, in 2019 we had our best year yet. Unfortunately COVID hit in 2020 and we could not hold our events, the Boston Marathon, the New York Marathon, every event across California and the country was cancelled. My salary at its peak in 2019 was roughly $120,000, my wife salary was roughly $100,000, it took a long time and a lot of years with no salary to get there. We did nothing illegal and our salaries were looked at by an independent 501c3 auditing group and determined to be “Very Reasonable”. Our salaries went for review in front of our Board of Directors periodically, nothing illegal and our Bylaws stated that we could receive salaries, like most 501c3 do. This was a full time job, and it wasn’t just the races that we put on. We did aquatics programming at the YMCA, free special needs surf camps every summer, and a whole list of programs, it was a full time job.
2. This statement is completely false. The City and SMOP always had a great relationship. SMOP received awards and accoladed from the City of Encinitas every year up through 2019. Mayor Catherine Blakespear and her family attended our events each year and spoke at them. In 2019 I was presented with award by Mayor Blakespear for all the good work we had done in the community. If I was having so many problems with city then why were they giving me awards up through 2019 and attending all of our events? So the statement you are making is completely false. If the moderator on this site allows, I will gladly provide a picture of the award Blakespear gave me in 2019 and appreciation from the Parks Dept.
3. SMOP had nearly 40 people lined up to speak at the council meeting. Including local businesses, hotels owners, restaurant owners, local schools board members, Ecke YMCA board members, local charities and residents all ready to present.
We didn’t show up for the meeting, because Blakespear and Kranz decided it would be wise to put us last up on a very busy agenda. We would have been speaking after midnight. I wasn’t about to ask local community members and representatives to wait until midnight to speak. The fix was in. We knew that council was going to vote against us no matter what when we saw where we were on the agenda. This is how this council operates. Just look at what they did to Bruce Ehlers. They gave him 2 minutes to defend himself. All of the speakers defended Bruce Ehlers and council didn’t care, they fired him.
We figured if you don’t want us then what’s the point of fighting?
Part 2 Below...
Part 24. My life was never “spiraling out of control”, what a ridiculous statement to make, completely false. My life’s been great and I wouldn’t change it for anything. I have a wonderful wife who I love dearly, a dog “Ocean” who we take swimming everyday, friends, live is good and I’m thankful for it.

We gave thousands in scholarships over the years to high school kids, who have kids, donated to local charities, purchased floating beach wheel chairs for local beaches, mobility mats for persons with disabilities, started an award winning national recognized special needs surf camp that was free for families working with over 1,400 families to date, donated about $15,000 a year to the Ecke YMCA special needs aquatic programming, donated $70,000 to Pacific View, donated $40,000 to the kids skate park in Solana Beach, donated tens of thousand in scholarship, purchased marine mammal rescue equipment for the Life Guards, etc etc. In all, we donated over $600,000 to ocean, beach and park related projects in Encinitas since 2013, not bad, and all from art on a wall. I’ll always be proud of the work we did and I have no regrets. My life is certainly not “spiraling out of control”.
5. This statement is blatantly false as well, I never broke any 501c3 rules, or used SMOP to influence an election, absolutely ridiculous. If that was the case, SMOP would have had its 501c3 status removed a long time ago. Two years later and SMOP is doing just fine. 501c3’s are allowed to post true statements regarding themselves even when it becomes political, simply because it involves the said 501c3. Statements of fact are and will always be perfectly legal. I like how the author, probably Marco, uses the phrase “word is that”.
6. Again this is a false statement is completely false. My wife and I never received any PPP payments of $70,000 in tax dollars, this is 100% false. Look at our organizations 990 tax returns, we resigned in January 2021. If the moderator will allow me to post a photo of our 990’s I’ll show you this statement is not true.
Mike Redman and Cathy Carey took over our positions for SMOP in 2021 and began applying for PPP grants. Not my wife and I.
Mike and Cathy received PPP payments of roughly $70,000 and were entitled to them, most organizations across the country did this, simply because organization had a hard time generating revenue during COVID, just like most businesses did. SMOP would have been fiscally irresponsible to not take advantage of what the government was offering.
7. Again, another very false statement. This one had me laughing out loud. I like how the author uses the phrase “word on the street” again, like they have some privy knowledge that no one else has.
If I had made an illegal deal with the candidates, such as this, do you think the candidates would have told everyone about it, thereby jeopardizing themselves. Ridiculous! Those events were exhausting to operate and run, the amount of work throughout the year was excruciating. Something I will never do again. Permitting, insurance, dealing with sponsors, residents, participants, timing company, medal and shirt manufactures, marketing, traffic planning, Sheriff and Fire Dept contracts, life guards, numerous city and planning meetings, medical, aid stations, etc etc. So to say that I colluded with the candidates to bring our events back is 100% ridiculous and false. I resigned from Surfing Madonna in January of 2021, so how would bringing the events back do anything for me? My wife and I now have a very successful business, where we make significantly more than what we did at Surfing Madonna with 10% of the word load.
Part 3.
Delete8. Another false statement. Both the City of Solana Beach, City of Oceanside asked if we wanted to bring our events to them, including our free surf camps. They reached out to us. I told them we would consider it. After determining that Solana Beach couldn’t handle a Half Marathon with their short 101 distance, and their beach being too short for a 10K, we turned them down. With regard to Oceanside, the traffic planning would have cost us nearly $50,000 on top of our already $370,000 race budget, there were too many what ifs and the risk was not worth the reward. Also the Surfing Madonna Beach Run in Oceanside wouldn’t have worked on the sand as the beach begins to get very narrow towards the south end a logistic nightmare and large gamble with participants. Logistically this would have been a nightmare and a potential liability. So, we turned Oceanside down as well. However I am very grateful for both cities support and their understanding of the way we were bring treated by Encinitas City Council, unfortunately it just wouldn’t have worked.
9. Another false statement… My wife and I bought a house in Oregon in August of 2018, well before our problems with Blakespear and Kranz began. Every years since 2012 we would drive up to Oregon and camp along the coastline. We’ve always loved Oregon’s rugged beauty.
We never fled to Oregon, why would we have to flee anywhere. Again the author of this post loses all credibility here. He makes it sound like we are Bonny and Clyde, fleeing from the authorities. In 2018 we were lucky enough to find our dream home. Yes we currently live in Oregon and we love it. But we also have a property in Encinitas, a city which I moved to in 1999. So, we still have an interest in Encinitas and we do care about who gets elected and who is representing us.
I will always love Encinitas more than any place in the world. We periodically visit our families property, one of which I have a 50% ownership in, every couple of months. So yes, I have a qualified interest in Encinitas and want to see that it’s well taken care of and not in the hands of Marco Gonzalez, attorney for the developers, Catherine Blakespear and Tony Kranz. These people are destroying this beautiful town with their concrete jungle, streetscape, deals with developers, etc.
10. Again Blatantly false. Really “voter fraud”? Give me a break. Notice the author uses words like “apparently”, obviously not sure of their statements. Residents filed voter fraud claims against me? Really? Give me a break, this is comical, what voter fraud have we committed that you are speaking of? Are we harvesting ballots, dumping ballots into trash bins, creating fake ballots? Hilarious.

DeleteWhen the City of Encinitas started misappropriation our donations, putting tens of thousands of our donor dollars into their general fund instead of projects where I directed our donations to go, such as parks trailhead signage, daycare for parents who couldn't afford it, floating beach wheelchairs, etc, I stopped donating to the Encinitas Parks Dept. Jennifer Campbell, now assistant City Manager to Pam Antil is responsible for the misappropriation of our donations. When I brought this to the attention of Council, it was all downhill for us from there. We also caught the City of Encinitas over billing us by tens of thousands of dollars on our events. The over billing was happening from 2014 up until 2019. Tony Kranz and Catherine Blakespear looked the other way when we brought this to our attention. Karen Brust was nice enough to call and apologize to me for this. I have several voicemails from Karen Brust apologizing for Jennifer Campbell's mistakes. I also have a voicemail message from Jennifer Campbell in 2016, telling us she was going to put our money towards Parks Trail heads like we agreed on, she never did, instead it went into the city's "General Fund". So when people say I was harassing, abusive, threatening to city staff, of course I was. Our money was being misappropriated, nothing was getting done about it and I was upset. I think anyone would be after 6 years of that happening to our organization.
Bob, there are many conversations online where you come across as bullying. I am giving you the benefit of the doubt and assuming that you are so passionate about your beliefs, that maybe you are unaware about how you are coming across. So, I'm coming from a place of helpfulness when I say that the repeated posts on Nextdoor in the last mayoral election, the way you have conducted yourself in conversations with Blakespear supporters, and the way I have seen you make comments towards people you disagree with in an arrogant and condescending way.

Tony Kranz tried to stop that from happening, say "it's going to create traffic" and "Lipstick on a pig". These are the kind of people we were dealing with. I'm just thankful that Mark's beautiful art is in a good place and that our free special needs surf camps can continue for many years to come, even if they are in Oceanside now.

One important contrast between Susan and Kellie Hinzie is that the Turney's have a registered Air B and B, and Kellie has one that is not registered. I find this corrupt--even more so since Kellie is a trust fund baby millionaire like our mayor who wants others to be taxed and charged with fees that they themselves avoid. They support Prop 19 that changes the tax basis for others yet were able to change ownership prior to the short deadline so that their own financial interests were protected. They are corrupt!

We worked really hard to raise money through the Encinitas Half Marathon and Surfing Madonna Beach Run for programming and projects and made sure we built up SMOP's account for a rainy day like we are seeing now from Blakespear/Kranz. SMOP is fortunate it can continue to perpetuate programming and projects for years to come.

I salute Mike Redman and Cathey Carey and the board of directors for taking the helm and guiding the SMOP ship through these stormy Encinitas political waters. The SMOP board and its volunteers are doing a fantastic job of navigating and focusing on the task at hand.
I am 100% confident that good will prevail and someday soon we will get a council who values what SMOP has done for the community since 2011, and will allow our special needs surf camps to continue at Moonlight Beach whereby families will have much easier egress and ingress for their children with special needs.
Marco, Blakespear, Kranz and the rest of them can attack me all they want, just words. But they will not physically take those special needs surf camps away from the families. That will never happen. Those surf camps will continue to make a difference in children, their family members and volunteers lives. There's too much good protecting those surf camps.

If you believe people are wrong about you and your dealings with SMOP, can you at least consider that maybe you have been wrong about some things you have said about people online? Blakespear is a public figure. But You've made some harsh allegations about some people who work for her and/or support her that could be wrong and you do it with so much vitriol that it seems you just have a hate filled agenda.
I always find it amusing when people here are so convinced they know who someone is. Any person that disagrees with them and you throw out the name of whoever you despise the most.

ReplyDeleteBlakespear should not have blocked anyone of facebook, but she is right that it is an evolving area of law and social media/constituents/electeds will probably continue to evolve. That being said, some of these people are acting like assholes. Steve Golden, Rachel Grave, Ruben Flores, Bob Nichols, all of them would repeatedly post in ways that may seem like activism to them, but come off as spam and trolling to a lot of people reading them. Blakespear had clearly posted rules of engagement in the about section of her page and at one time these rules were pinned. People that violated those rules were blocked.

There's rules at a city council meeting right? If a citizen starts cursing or yelling at a meeting that's a problem and no one would say that their first amendment right was violated if you had them removed from the podium.
There's a sense of entitlement with a lot of the Blakespear haters. Nothing but negativity and attacks.
You have a first amendment right to express your views without government interference, but that should not mean you have the right to troll without repercussions.
But I guess the repercussion is this: people see you. People see how you are acting and what you stand for and it is not on the side of right

Blakespear didn’t just block a couple of people, she blocked 28 people from her official “Public Figure” “Mayor Catherine Blakespear” social media page.
Her page according to the ACLU and the 3rd and 4th District courts is “Official” not only because of the title associated with it, and the label “Public Figure” but importantly she has conducted city business many times on the page over the years. She’s discussed upcoming city council meetings asking residents to speak in favor of certain topics, she’s discussed certain agenda topics before they hit city council meetings, SANDAG, proclamations given, EDCO, local energy issues, she even posted a Mayor Catherine Blakespear official letter addressing the residents when she fired Bruce Ehlers, all of this and so much more on her page makes it an official page according to the ACLU and District Courts across the nation.
Even Marco Gonzalez stated that regrettably she was using her page to conduct city business. Coast News- “Gonzalez did say that he felt as though the mayor had erred by utilizing her public Facebook page to engage in city-related business.”
Blakespear even signed a settlement agreement acknowledging that she blocked all of these people. She blocked
people from public comment such as a local firefighter asking safety related questions on Streetscape issue, a person with disabilities asking ADA accessibility questions, a former Encinitas Planning Commissioner, two former local school teachers, a couple of candidates running for elected positions, concerned parents about the moving the location of the “safe parking lot” next to a middle school full of children, a care taker and a former city employee, the list continues. These aren’t “right wing attackers” as Kevin Sabellico, Blakespear’s campaign manager states. These are people that have legitimate questions and concerns, but because Blakespear didn’t like the topic, she blocked the person from ever communicating with her on her Official “Mayor Catherine Blakespear” “Public Official” ever again.

2.She agreed to make public apology, instead she deeply offended all of the resident she blocked with her non-apology disparaging rant.
We’ve since given Blakespear several opportunities to do the right thing. Step up to the plate and say, “I’m sorry to all the Encinitas Resident and community members and anyone that I blocked on my “Mayor Catherine Blakespear” public page. I realize I violated my sworn oath of office as an elected representative to uphold and protect the First Amendment, Free Speech, and the right for citizens criticize government. I blocked you and I apologize, it will never happen again.” That would have been a sincere and honest apology.
Instead Blakespear starts her non-apology rant with – “As a woman serving in elected office, I have been the target of threatening and harassing comments on my social media and in my daily life — personal attacks, not simply ones disagreeing with my policy perspectives. My social media experience is part of my larger life experience as a female public official, including a direct rape threat texted to my personal cell phone number that addressed me by name, a large number of protesters outside my home where I live with my husband and children taunting me to come out, and being shouted at while going about my daily life, among other aggressions.” – Catherine Blakespear.
Does that sound like an apology?
Then she lies about blocking people in her apology.
“I always welcome expressions of political and policy differences, including criticisms for my job performance as your mayor, and I would never try to infringe on anyone’s right to freedom of speech. As a former journalist and attorney, I understand and deeply believe that the core of our democracy is every citizen’s right to express their opinion.” – Catherine Blakespear.
If she always welcomes expressions of political and policy differences, including criticisms for her job performance as mayor, then why did she block 28 people and delete all criticizing comments?
Then Blakespear says, “I would never infringe on anyone’s right to Freedom of Speech.” Another lie…Isn’t that exactly what she did when she blocked 28 people and deleted their comments. Her non-apology rant was fully of lies and deeply offensive.
Any representative such as Blakespear who continues to lie and pass the blame to other, all while paying for her mistakes with campaign donor funds, should not be in office.
The bottom line is Blakespear broke the law and she needs to held accountable. She’s been doing this for several years now, some of these people who were blocked have been blocked for years from being able to express themselves on her “Mayor Catherine Blakespear” page.
If you drive 100 mph in a 55 mph zone all the time, eventually you’re gonna get a ticket.

I'm pretty sure he'd rather surf than run for office but he's the only one talking about the corruption and producing evidence. He believe it's impossible for fair elections because the nonprofits are growing too powerful and control Encinitas politics. Our City Council stopped representing the residents back in 2019.

DeleteI keep hearing about how Morris has all of this evidence of corruption, can't get fair elections, non-profits are bringing us down. But I also hear that there is another deal being offered to certain candidates who cooperate with Kranz. This comes from another newbie in town, Garvin Walsh, who is also both Kranz's non appointed campaign manager. He has befriended Julie Thunder who is in the Cardiff district. Julie is friends with Kim Morris and they think if Tony gets the Mayorship then they can put Mali Woods-Drake (founder of E4E) in Kranz's place without an election. She does live in his district so unless a lot of residents want her on the Council, you had better pay attention. Morris thinks he can win, but that just shows his narcissism. So we could have yet another elected city council member when this is over, and most likely it will be Mali. Seems as if Julie doesn't have many worries over this, as Garvin is her new Mark Muir. And that's all I learned tonight while working a double.
