Blakespear's "apology" inflames her censorship victims

Mayor Catherine Blakespear and the City of Encinitas are now under threat of legal action after the 38th State Senate District candidate issued what some residents called a “disingenuous” public apology over the weekend as part of a settlement agreement for blocking her critics on social media, attorneys familiar with the matter informed The Coast News.

Michael Curran, attorney at Carlsbad-based law firm Curran & Curran Law who represents more than a dozen of residents who were reportedly barred from Blakespear’s social media pages, told The Coast News his clients will pursue a government tort claim against the city and Blakespear in both her official capacity as mayor and as a private citizen for violating her sworn oath to protect and uphold the constitution and infringing residents’ free speech rights.

If the city does not agree to settlement terms under this action, Curran said the plaintiffs will pursue a lawsuit in state court.

  1. Blakespear and Kranz have a lot of apologizing to do for shutting down public comment and public censorship. Where is our first amendment rights?

    schools, bars, restaurants, churches, parks, movie theaters, massages, hair salons, stores are all open with no mask requirement or open window requirements or anything.

    Everyones is vaccinated with numerous jabbs yet, the horrenous COVID still reigns and shuts down public meeting at City Hall. All while life everywhere else is apparently not effected. Hugh. Interesting?

    Our City Hall, closed to public meetings because one thing BIAspear and Kranz hate more than anything is public feedback.

    They hate it when people tell them they should not sell out to every developer over residents interests, They hate it went people tell them it makes no sense to allow thousands of new residents and new water meters in Encinitas when the whole southwest is over developed and water is a scarce resource, they hate it when people get pissed that Tony is focused on taking trips overseas with his developer "friends" and then provides free parking to his developer buddies along Vulcan Avenue for their apartments where there should be a nice trail like BIAspear recevied in Cardiff, they hate it when people say their family members are getting ill from all. the senseless noise and pollution from the empty polluting trains spraying spent diesel and dust clouds over our children and neighboring communities and breaking ear drums and causing dementia throughout the City, they hate it when people ask for money to be budgeted for repairing primary beach access over about 20 Karen water coloring club that wants a new $30 million dollar beach front new City Community Center that will sink the City iinto further debt due to the huge long term operational and maintenance costs. But most of all they hate:

    1. People requesting that they address the hazardous conditions they created by removing perfectly good bike lanes on high speed roadways and puttin in more sharrows guaranteeing more law suits. People are pleading for their lives and BIAspear and Kranz do not want to hear it.

    So there we have it. BIAspear and Kranz in an election year when primary votes are being cast, these two losers shut down public comments at City Hall.

    Criminal? maybe- pathetic clearly!

  2. 6:51 AM Well stated! Blakespear is one of the most divisive, incompetent, arrogant and conceited Mayors in City history. Blunders, scandals and cover-ups are her forte. She puts her loyalists into positions of authority, without voter approval or even periods for citizens input or questions. She goes quiet on controversies and hope they blow over. Now her developer handlers are funding her attempt at the State Senate, where she can serve their interests even more! Blakespear is damaged goods and will only get worse if allowed to move on.
    VOTE FOR JOE KERR - end the Blakespear nightmare of corruption, ineptitude and phony platitudes on June 4th....

  3. Hopefully the next poll will show Joe Kerr rising and again hopefully, overtaking the mayor, not my mayor.

    There is not a keeper in the whole bunch of them. A new majority is our only chance for real change. It would be nice to see tony and hinze in the minority. Just maybe, hopefully, they would read the tea leaves and resign.

  4. If any tort liability is assessed against the City because of Blakespear's refusal to comply with the settlement, the City should sue her for recovery.

    3. Just because Curran's an idiot of a lawyer, doesn't mean 1:02 was wrong. From what's been reported, a settlement agreement was entered, but the plaintiffs now allege the mayor didn't fulfill one of the contractual terms. This doesn't mean the original first amendment claims spring back to life (that would require rescission of the contract). It's now just a breach of contract case, and the questions are whether the mayor's apology was good enough and what the property remedy would be. The plaintiffs might be requesting rescission, but from statements they've made elsewhere, it seems they're claiming financial damages. I don't know how they're going to prove that one.

  11. The wonder of it to me is that Blakespear keeps going and going with no regard to how she might win an election. She has always been a cheater who bends rules for herself. People will not forget that she is only too happy to meet with people from other cities yet ignore the needs of Encinitas residents who she was elected to serve.

      What was their first step? To move in to Mommy's compound on the whitest street in Cardiff where they talk to all their white friends about how terrible it is that people did not mix and have multicultural family, friends, schoolmate, and working mates. All while their brown landscapers, maids, and other servants cared for all their compounds needs.

So another sleepless night in Encinitas due to the empty deadly pollution machines raging havoc pumping our deisel waste and dust clouds over our children, baslting horns to reduce everyones sleep so they lose their mind and feel like a zommie, and running down people left and right trying to get to the beach and not drive. Yes. All these things promoted by Kranz as his focus of increasing the distructive train service all while no one rides the slow disfunctional transit because it is super slow and not a good experience. What a collosal waste of tax dollars.

    So what is Kranz going to focus on today:

    1. Fencing off more of the Encinitas coastline, or
    2. Figuring out how to spend $30 million to build a new arts community center for 20 of his Karen water coloring friends to staff up and spend millions and millions of dollars operating and maintaining in perpetuity all while people can not access the beach or walk along Vulcan Avenue and La Costa Avenue.

  17. Blakespear still hasn't addressed her role in the SANDAG credit card scandal. She is neck deep in it, so all she can do is lay low and hope no one confronts her for an explanation. Notice that no criminal charges have been filed - it's a cover-up. I guess $2.5 million of taxpayers' money "misspent" isn't worth pursuing. Where's the District Attorney on this one?
