Blakespear raising funds for legal defense of her illegal censorship of constituents

Lost Coast Outpost:

A first-term state senator is raising money from interest groups to fight ongoing litigation related to complaints that she blocked critics on social media in her previous job as a mayor.

Sen. Catherine Blakespear, an Encinitas Democrat who was elected to the Senate in November, opened the legal defense fund at the end of January and has raised $17,500 so far, in addition to receiving legal assistance from the California Democratic Party, according to campaign finance records.

Blakespear appears to be the only legislator with an active legal defense fund. The contributions include $12,000 from the Southwest Regional Council of Carpenters and $5,500 from the Pechanga Band of Indians, both of which lobby at the state Capitol.

Blakespear declined to discuss the case in depth because it is still active, but she defended using her legislative position to fundraise for her legal bills.
Senator Blakespear appears to be the only member of the legislature who is collecting a legal defense fund.

    3. Marco, this is Bob responding. It's no surprise that once again you're making false statements. There was no "bait and switch". I wasn't the lead plaintiff and was the last plaintiff to sign on to the case, several weeks after everyone, so there was no "baiting".

The case brought against Blakespear was gonna take place with or without me as it wasn't about me. So I had no impact on the case.

Attorney DiMare urged me to join as a plaintiff. I let everyone know before signing on that we as plaintiffs needed to have written protection in an agreement from DiMare stating that we could freely withdraw at anytime. DiMare and the lead plaintiff agreed to that term for everyone, so I signed on.

Months later I expressed to everyone, and well ahead of time, that I was uncomfortable with the risk of moving forward and that I was going to withdraw. I urged the other plaintiffs to withdraw and well ahead of the anti-SLAPP being filed. So there was no "Bait and Switch".

It's unfortunate that DiMare didn't do a better job representing the plaintiffs and that the plaintiffs chose not to withdraw. It is what it is.

Regardless of the plaintiffs loss surrounding Blakespear's public apology, she has essentially already lost in the eyes of the public and court of public opinion.

Blakespear was forced to unblock people and refrain from deleting public comment on her official political page. She will never be allowed to silence those who disagree with her agenda ever again. That is a huge win for our First Amendment and democracy. This will be a stain on Blakespear's political career that will follow her forever.

She violated her sworn oath of office to uphold the First Amendment and her oath as an attorney. People now know that.

All those newspaper articles, podcasts and tv coverage surrounding Blakespear's violation of her sworn oath of office will continue to haunt and follow her throughout her political career. It will be used as ammo by her political opponents running against her and will always discredit Blakespear if she discusses the value of our First Amendment.

She will always be remembered as a politician who disregarded free speech. Whether it be her insistence on "Jazz Hands" during controversial agenda items. Cutting public comment times down from 3 minutes to 2 minutes on controversial agenda items or deleting and blocking all public comment on her official page.

So, I consider holding Blakespear accountable a win for our First Amendment and a win for democracy. Politicians will now think twice about deleting and blocking public participation with Blakespear being used as the example.

Marco, if I were you, I'd focus more on your corrupt sister Lorena Gonzalez and your sexual predator brother, Nathan Fletcher Gonzalez who now have mounting illegal issues against them.

The Ninth District Court already had some very choice words about your sister, "corrupt", "back room dealing", "favoritism", "spite" regarding her AB 5 bill. Can't wait to hear what the courts have to say about your brother who's accused of being sexual predator and sister who's being accused of extortion.

Your family's just full of winners.

    7. Marco, It’s Bob here. Speaking of political stunts…..Didn’t Blakespear file a counter-suit against the plaintiffs just prior to the election, only to drop it immediately after the election? Fooling the voters!

She knew all along her counter-suit was bogus, and Jordan Ingram and Steven Wyer had written declarations stating that the terms of the settlement agreement were never disclosed to the Coast News. So, she dropped her counter suit conveniently after the election. A political stunt on her part.

You’re always full of shit Marco!

From your years of bitching about homeowners trying to protect their property on the bluff from erosion and now full circle to defending developers who wanna place their hotels on the bluff and in other sensitive environmental areas.

You’re really no different than you sexual predator brother, Nathan Fletcher and your vile pig of a sister. One day soon I’m sure we’ll be seeing headlines regarding you!

    8. Marco this is Bob Nichols and I’ll say it again.

It's unfortunate that DiMare didn't do a better job representing the plaintiffs and that the plaintiffs chose not to withdraw. It is what it is. DiMare got greedy in my opinion and Blakespear had already lost. Unfortunately the plaintiffs didn’t withdraw and are now stuck with a large bill. It is what it is!

With that said, regardless of the plaintiffs loss surrounding Blakespear's public apology and how she stated it, she has essentially already lost in the eyes of the public and court of public opinion.

    9. Keep telling yourself that, Bob. She lost ... by winning the election. See, what you and the very small group of people like you didn't take into account are two very important facts: (1) Everyone who was paying attention saw the nasty shit you wrote on Blakespear's page and considered you guys to be a bunch of asshole trolls. No one reading your comments thought that's what the first amendment was designed to protect. Only the like minded jerks celebrated the takeover of Blakespear's pages; and (2) You all though that because the media was hungry for stories, that meant voters were buying into your bullshit. In this day and age everyone sees media as pushing someone's bias, so when you got "all those newspaper articles, podcasts and tv coverage," you didn't appreciate that none of it meant anything to anyone other than those of you who already weren't going to vote for her. You didn't win anything for democracy. You proved that in a hyper partisan world, the Republicans continue to be the assholes in the room.

And now your buddies get to write a bunch of big checks while you slink off to Oregon, abandoning them just like you did your non-profit. Good riddance, buddy!

    10. Marco, it was never about winning or losing the election. It was about holding Blakespear accountable for breaking the law and standing up for Democracy. I'm glad I did.

Blakespear had been blocking people and deleting public comment from her "official political page" as far back as 2017. She was caught deleting hundreds of comments over the years and blocked at least 4 dozen people on record.

Bottom line, she broke the law. - https://www.aclu.org/news/free-speech/court-rules-public-officials-cant-block-critics-facebook

Blakespear willingly and knowingly violated her sworn oath of office to uphold and protect the First Amendment as an elected official. She was warned multiple times over the years. She knew what she was doing was illegal! You knew it too. That's why she quickly signed a settlement agreement agreeing to make a public apology and pay me $5,000 when she was caught. Is that something an innocent person does?

The people she blocked weren't trolls and you know that!
She blocked firefighters, teachers, city employees, concerned parents, residents, politicians, even several persons with disabilities who were asking ADA related questions.

Blakespear has a history of disregarding the First Amendment. At City Council meetings during "public comment" Blakespear attempted to enforce "jazz hands" on controversial agenda items so viewers at home wouldn't be able to gauge the public's mood. She shortened speaker's comments from 3 minutes to 2 minutes during controversial agenda items, and eliminated time donations. She gave Bruce Ehlers just minutes to publicly defend himself after she illegal fired him, yet she took nearly an hour of the publics time to tell us why she was right! The entire room, including the planning commission disagreed with Blakespear. No Mayor in our city's history has turned as many "open session" council meetings into "closed session" as Catherine Blakespear. So, this wasn't about the election, this was about holding a corrupt politician, Blakespear, accountable for breaking the law. I'm glad I did.

I can see why you don't care about democracy and where you've developed your character.

Yes, "all the newspaper articles, podcasts, and tv coverage," will continue to follow Blakespear around like a smelly fart! If Blakespear mentions the value of our First Amendment, she'll immediately be discredited by her opposition. Blakespear's opponents, be it Democrat or Republican will always use these articles against her and with more organization and money it'll damage her.

Unfortunately the the attorney's decided to continue to pursue more damages out of Blakespear. Greed!

The plaintiffs were never going to see anything monetarily. I withdrew well ahead of time. I didn't believe in continuing the pursuit. Blakespear had already lost in the public's eye and the court of public opinion when she was forced to stop blocking people and deleting public comment. That will follow her forever. That was enough for me. I can only wish the plaintiffs well and hope they succeed in their appeal.

Regarding the Surfing Madonna, she's doing great, 12 years now. The organization is strong, with free special needs surf camps starting in June and ending in September 2000 families to date. I'm still very much a part of that organization, always will be. I continue to help and continue to donate to.

    12. Hey Marco, Bob here, and yet here’s another article about Blakespear.

FYI, 2 of the 4 plaintiffs weren’t Republican, and most the people Blakespear blocked were Democrats. So your go to MAGA theory is Bull Shit!

Anyways thought you’d enjoy this new article regarding Blakespear 😊

From the article, “Yes, you heard that right. Blakespear, the former mayor of Encinitas, has decided to take her Facebook fight to a whole new level. Instead of wasting her time on trivial matters like governance or public service, she has opened a legal fund to finance her relentless battle against a group of Facebook users. I mean, isn’t that just what we need? Donors eagerly lining up to pay for a politician’s lawsuits. It’s truly a remarkable innovation in the world of politics.” -
      https://www.sandiegonewsdesk.com/2023/05/the-marvelous-saga-of-senator-blakespear-fundraising-for-lawsuits-because-who-needs-real-issues/?fbclid=IwAR2uAinieb2oNqQOo6sbV2damzwyEUkmZ2T_RwWmpYEWQE8qAJvcgMUnoSM_aem_th_AfotiQz0O3GmUH5WEVLQYL6J9OKk8QyTxwSrBMb71QD99ZozpiH8VHDYNzGBF5k6c7g

Like I said, the articles regarding Blakespear’s censorship will continue to populate search engines. More to come.

Not a good look for Blakespear. A win for Democracy and our First Amendment.

Blakespear is now our poster child for what happens to the elected when they step on Free Speech and disregard their sworn oath of office.

    14. Hey Marco, What kind of nasty things did I write? I asked my lying, pompous, narcissistic mayor a host of questions on her pages. She wouldn't answer, since the answer would show her true colors...much like a debate would have done. I pointed out failures when appropriate and inconsistencies with her posts, so that her lies may not mislead the public reading them. She deleted hem all, gross interference with the election. I then asked her why she deleted my posts? No answer. There's one asshole in this legal battle, and it's the stooge in Sacramento who violated her oath and the constitution by violating the rights of her constituents in order to sway the election her way. Kudos to those standing up for democracy and calling out Blakespear for her BAD DOING!

She had almost twice the campaign money as her opponent and that always translates into more votes. When Blakespear refused to publicly debate her opponent that said everything to me.

Unfortunately we have a lot of voters who believe everything they see on a political mailer. That’s how Blakespear got elected!
