Settlement talks in bicycle death

 Coast News:
Teresa Worley, Jennings’ wife and the administrator of his estate, filed a wrongful death lawsuit in February 2021 against PODS Enterprises and the company’s driver, Epigmenio Serrato. In an amended complaint filed in August 2021, the plaintiffs’ named Shea Homes and the City of Encinitas as additional defendants, alleging negligence and strict liability.

The following month, PODS and Serrato filed a cross-complaint against the city, Shea Homes and Statewide Stripes. The city and Shea subsequently filed cross-claims against each other.

Despite three years of legal finger-pointing and numerous counterclaims, the Worley family filed a notice of conditional settlement on April 12, and the court generated a notice of dismissal in the case on April 19.

Ricardo Baca, an attorney representing the City of Encinitas, told The Coast News all the parties have started the process of “reaching a global settlement” in the lawsuit.

  3. The city basically stepped into the noose of culpability by removing bollards shortly after the accident.

    I drive that section daily and those bollards continue to remain a hazard for cyclists and emergency vehicles. They also add to the already growing traffic problems from development between the I5 and Quail Gardens Drive. They need to be reviewed for traffic safety and flow and hopefully, removed.

      Damn Marco, try and tell the truth for once.

      Reality. After this huge payouts for their bad road design from BIA it’s just a matter of time until 1) the JPA insurance kicks them out or 2) the premiums are super sky high because of their failure to implement Safe Road design.

      BIA continues to cost the city dearly for her stupidity. The only thing worse as we have Da Dunce as Mayor. Expect worse.

      We probably be better off having Nathan Fletcher as mayor. Right Marco?

Tell me you don't know how insurance works in litigation without telling me you don't know shit about how insurance works in litigation. And where are all those south Cardiff cycle track lawsuits you've all been screaming were imminent?

    2. Hey Marco, Wasn’t the reason why the city lost $11 million because they placed a Sharrow in a fast highway lane and Roberta got run over.

      Isn’t that the exact situation they have in South Cardiff they have a sharrow Lane because they screwed up the bike lanes and now they have sharrow Lane in a super fast setting?

      I don’t think that’s right, someone is going to die, and then probably going to get sued again.

      I bet next death will be 30 million.

Without access to the evidence driving the decision, my guess is the insurance company saw an issue with the street design (sharrows, signage, lane lines, ???) that might allow a jury to find for Roberta in an amount significantly greater than the settlement amount. And while the design of the bike land and bollards on Leucadia could have been better, that doesn't exculpate both the truck and the cyclist from reasonable behavioral safeguards. Again, there is a lot of evidence we don't have about that crash that will be relevant to the insurer.

    San Diego County, especially the northern part of the county, has a low population density that makes the train unattractive and uneconomical. Many people think of New York City when they think of rail and mass transit, but the NYC area is 30 times more dense than San Diego. NYC is the exception in America, not the rule. Most train lines in America suffer from poor utilization. Many were so poor that they were discontinued.

    Land use restrictions prevent large increases in density
    Land use restrictions make it highly unlikely that the density will ever change significantly in the north coastal part of the county. Even small changes in more dense housing projects would not have a meaningful impact on Coaster usage.

    Transportation-as-a-Service (TaaS)
    The rise of autonomous vehicles is likely to revolutionize transportation and mass transit. Ride-hailing companies such as Uber and Lyft have already impacted public transit. NCTD volumes are down 18% since 2009.
